Minutes of March 14, 1994 Meeting
The regular meeting of the Hastings Planning Commission was called to order by
Commissioner Retnardy at 7:00 p.m.
Commissioners Present: Reinardy, Schommer, Flom, Bateman, Williams and Onnen
Commissioners Absent: Bolesworth
Staff Present: City Planner Czech and Community Development Wozniak
MINUTES
Commissioner Retnardy called for additions or corrections to the
meeting minutes of March 14, 1994. There being no additions or
corrections the minutes were approved.
PUBLIC HEARING
-REZONE AND
PRELIMINARY/
FINAL PLAT-
SUNSSET WEST
Czech reviewed Staffs March 7, 1994, memorandum to the Planning
Commission concerning a request by Paul Lawrence of Lawrence
Construction and Realty for approval of a rezone from Agriculture
to R-1 and/or R-3 Planned Residential Development (PRD) and
preliminary/final plat for approximately 50 acres to be called
Sunset West. The subject property is located adjacent to and north
of West 15th Street at the West City Limits.
Commissioner Reinardy opened the public hearing at 7:03 p.m.
Rod Ritter of 1460 Pringle Court was present at the meeting and
inquired about the extent of the first phase and when street and
utility improvements would be completed. Czech answered Mr. Ritters
questions.
There being no other comments from the audience, the public hearing
was closed at 7:06 p.m.
The Planning Commission discussed with Staff and the applicants
surveyor John Dwyer issues relating to the rezone and
preliminary/final plat including, but not limited to, the area to be
rezoned and the proposed alternate phase I area.
Commissioner Onnen moved, Commissioner Schommer made a second, to
recommend approval of a rezoning from Agriculture to R-3 PRD for
phase one of Sunset West.
Upon vote taken, Ayes, 6; Nays, 0.
The Planning Commission further discussed issues relating to the
preliminary/final plat including, but not limited to, the naming of
West 14th Street and the location of through streets.
Commissioner Onnen moved, Commissioner Flom made a second, to
recommend approval of the preliminary/final plat for Sunset West
subject to the following conditions:

That the final plat hardshells conform with the preliminary
plat.
That the developer shall pay $265.00 per un£t for interceptor
sewer charges (ISC) prior to the city signing any final plat.
If the city Increases the ISC prior to receiving final plat
hardshells, the applicant will be responsible for the higher
ISC.
Prior to any building permits being issued the developer shall
provide a certified survey that the eptire slte as indicated
on the preliminary plat has been graded pursuant to the
grading plan.
The applicant/developer shall provide the city with street,
drainage and utility easements for that area to be platted as
General S£eben Drive and West 15th Street on or before April
15, 1994.
The developer shall comply with the requirements and/or
recommendations made by the Dakota County Soil & Water
Conservation District for complying with the Wetland
Conservation Act of 1991.
That all townhome structures fronting General Sieben Drive
shall be setback at least 35 feet and shall provide driveway
turnarounds which shall meet the requirements of the Public
Works Division.
The applicant shall be required to complete site grading by
June 15, 1994, for installation of public improvements during
1994.
That the phase I Alternate not be an option for public
improvements and that the developer be required to plat and
develop all necessary public improvements as part of 1994
phase I improvements.
That the sanitary sewer plan be revised to show sanitary sewer
running the full length of General Sieben Drive south to West
15th Street and west along West 15th Street to Seton Court and
O'Connell Drive.
That all mailboxes for Seton Court be located in one central
location at the intersection of West 15th Street.
That the developer shall prepare changes to the preliminary
plat consistent with these recommendations spelled out in
Public Works Director Tom Montgomery's March 9, 1994,
memorandum.
NRRC recommendation that:
A) That the City Staff recommendation for 1.03 acres of
land for a well site be accepted. This property will be
credited toward the developers park dedication. The
funds for this site will be paid to the NP, RC by Hastings
Utility Department.
B) That the City Staff recommendation for an 8 ft
bituminous blacktop trail and a 6 ft sidewalk on either
side of General Sieben Drive be accepted. If this
decision should change, keep it consistent with the
south side of the property.
C) Accept cash in lieu of land per ordinance for the park
property.

D) In accepting cash in lieu of land, that flexibility for
pa~ent of such be worked out between city and the
developer and be reviewed by the NRiRC.
13. The developer shall submit an application for site plan review
prior to any building permits being issued for the multi
family townhome units.
14. That the applicant submit an erosion and sedimentation control
plan which meets the requirements of the Public Works Division
prior to the City signing the final plat for Sunset West.
15. The developer shall enter into a subdivision development
agreement which recognizes those conditions outlined above and
any other requirements deemed necessary by the city.
Upon vote taken, Ayes, 6; Nays, 0.
Czech reviewed staffs March 9, 1994, memorandum to the Planning
Commission concerning a request by the Limited Partnership of
Duane R. Wallin and Winston R. Wallin for approval of a preliminary
plat for approximately 96 acres of property south of West 15th
Street, north of the Vermillion River, West of the Highland Hills
and Old Bridge Lane Additions, and East of the City Limits.
Commissioner Batmen moved, Commissioner Schommer made a second, to
remove from the table the preliminary plat for the 96 acre Wallin
Addition.
The Planning Commission discussed issues relating to the 96 acre
Wallin Addition preliminary plat including, but not limited to,
requirements for cul-de-sacs and frontage on park land.
Commissioner Schommer moved, Commissioner Bateman made a second, to
recommend approval of the 96 acre preliminary plat called Wallin
Addition subject to the following conditions:
Revise the Parkview Dr. alignment to flatten the two curves
immediately south of 21st St.
Revise the sanitary sewer utility plan to conform with the
City's Comprehensive Sanitary Sewer Plan.
Shift the park location northward and revise the 20th St.
alignment to facilitate the future extension of the 20th St.
sanitary sewer to serve land west of the Wallin property along
the unnamed east/west road alignment west of the park.
Revise the grading plan and storm sewer plan to show a
permanent sedimentation basin in the ponding basin previously
approved as part of the 24 acre Wallin Addition preliminary
plat.
Revise the grading plan to eliminate potential lot runoff
problems to the satisfaction of the Public Works Division and
as spelled out in Tom Montgomery's February 23, 1994
memorandum.
Relocation of a larger (eight acre) park to the north.
Eight foot wide bituminous trails along major collector
streets.

8. Trail access to Pleasant Park and any future park within the
Wallin development at the developers expense.
9. Street names which will not duplicate or closely duplicate
other streets.
10. The applicant shall submit the required preliminary plat
application fee of $2,110.00 on or before March 7, 1994.
Upon vote taken, Ayes, 5; Nays, 1 (Reinardy).
There being no further business, Commissioner Williams moved,
Commissioner Flom made a second, to adjourn the meeting at 8:00 p.m.
