Meeting of July 25~ 1994
The regular meeting of the Hastings Planning Commission was called to order by
Commissioner Reinardy at 7:00 p.m.
Commissioners Present: Bateman, Bolesworth, Onnen, Reinardy and Flom.
Commissioners Absent: Schommer
Staff Present: Community Development Director Wozniak and City Planner Czech
MINUTES
Commissioner Reinardy called for additions or corrections to
the meeting minutes of July 11, 1994. There being no additions
or corrections the minutes were approved.

OCCUPATION -
265 TIFFANY
DRIVE
Czech reviewed staffs July 20, 1994 memorandum to the Planning
Commission concerning a request by William & Carole Peterson
for approval of a home occupation permit which would allow
them a furniture reupholstering, refinishing and repair
business at 265 Tiffany Drive.
The Planning Commission discussed items relating to the home
occupation including, but not limited to, whether the home
occupation would occur in the home and if there would be
adequate ventilation.
Commissioner Bolesworth moved, Commissioner Bateman made a
second, to recommend approval of the home occupation permit
subject to Mr. & Mrs. Peterson complying with all home
occupation standards including, but not limited to, a basic
fire protection inspection by the Fire Marshall.
Upon vote taken, Ayes, 5; Nays, 0.

Wozniak reviewed staffs July 21, 1994 memorandum to the
Planning Commission concerning a request by Paul Keller in
party with the Hastings Housing & Redevelopment Authority for
approval of a comprehensive plan amendment from commercial to
Urban Residential - III, rezone from G-3 to R-7, site plan
approval for a 28 unit residential condominium project, and
setback variances.
Commissioner Reinardy opened the public hearing at 7:20 p.m.
There being no one to address the issue the public hearing was
closed.
The Planning Commission discussed with staff and the applicant
issues relating to the proposed request including, but not
limited to, plans for the existing home on the property, the
first street right of way and flood plain/shoreland
regulations.

Commissioner Bolesworth moved, Commissioner Flom made a
second, to reconnnend approval of the comprehensive plan
amendment from Commercial to Urban Residential III subject to
review and approval by the Metropolitan Council.
Upon vote taken, Ayes, 5; Nays, 0.
Commissioner Bateman moved, Commissioner Flom made a second,
to recommend approval of the rezone from C-3 to R-7.
Upon vote taken, Ayes, 5; Nays, 0.
Commissioner Onnen moved, Commissioner Bolesworth made a
second, to table action on the site plan until the August 22,
1994 regular Planning Commission meeting in order to allow the
applicant time to make revisions to the site plan so as to
comply with city code requirements and to allow time to
further negotiate public infrastructure design issues with
City Staff.
Upon vote taken, Ayes, 5; Nays, 0.
Commissioner Bolesworth moved, Commissioner Flom made a
second, to table action on the variance request until the
August 22, 1994 regular Planning Commission meeting to allow
the applicant to provide more information on the nature of the
variance(s) request.

Czech reviewed staffs July 18, 1994 memorandum to the Planning
Commission concerning a request by ECI Building Contractors
for approval of a site plan and special use permit to
construct and operate a gas/convenience store with carwash at
1402 Vermillion Street. The request also included variance
requests to allow two freestanding signs, two 40 and one 42
foot curb cuts.
Commissioner Reinardy opened the public hearing at 8:43 p.m.
Dan Dege of Finn Daniels Architects explained that he designed
the proposed project and explained reasons for requesting the
curb cut and sign variances.
Ed Steinke of 116 West 15th Street indicated that he agreed
with the applicants request for wider curb cuts but that he
was concerned that the West 15th and Vermillion Street
intersection was unsafe.
The Planning Commission discussed with staff, Dan Dege and Ed
Steinke issues relating to the proposal including, but not
limited to, traffic circulation for tanker trucks, curb cut
widths, and the design of the proposed trash enclosure
facility.
There being no further comments from the audience the public
hearing was closed at 8:10 p.m.
Commissioner Bolesworth moved, Commissioner Reinardy made a
second, to recommend approval of the site plan and special use
permit subject to the following conditions:
The proposed structure and accessory items including,
but not limited to, the parking lot and landscaping
shall be completed pursuant to the approved site plan.
Upon request for occupancy of the building, all
uncompleted items contained within the site plan shall
be addressed pursuant to the escrow requirements
contained within the site plan review provisions of the
city zoning ordinance (Section 10.24).
The applicant modify the site plan consistent with
recommendations 2 and 3 as spelled out in Public Works
Director Tom Montgomery's July 18, 1994 memorandum to
City Planner Paul Czech. The Planning Commission
reconnmended that 1 be modified to permit a 42 foot curb
cut on Vermillion Street subject to MnDot approval and
a 40 foot curb cut on West 15th Street. The Planning
Commission agreed with Tom Montgomery's recommendation
for a 32 foot curb cut on West 14th Street.
Upon vote taken, Ayes, 3; Nays, 2 (Bateman and Onnen).
Commissioner Bateman moved, Commissioner Bolesworth made a
second, to recommend denial of the applicants variance request
for two freestanding signs based on findings that the
applicant does not satisfy the following variance criteria:
That special conditions and circumstances exist which
are peculiar to the land, structure, or building
involved and which are not applicable to other lands,
structures, or buildings in the same district.
The literal interpretation of the City Code would
deprive the applicant of rights commonly enjoyed by
other properties in the same district under the terms of
Chapter 10.
That the special conditions and circumstances do not
result from the actions of the applicant.
That granting the variance requested will not confer on
the applicant any special privilege that is denied by
Chapter 10 to other lands, structures, or buildings in
the same district. No non-conforming use of neighboring
lands, structures, or buildings in the same district,
and no permitted or non-conforming use of lands,
structures, or buildings in other districts shall be
considered grounds for the issuance of a variance.
Upon vote taken, Ayes, 5; Nays, 0.
REVISED SITE
PLAN - 800 OAK
STREET
Commissioner Onnen moved, Commissioner Flom made a second, to
teton%mend approval of the variance request for a 40 and 42
foot curb cut on West 15th Street and Vermillion Street
respectively but to deny the 40 foot curb cut on West 14th
Street based on findings that the applicant has not satisfied
the following variance criteria:
That special conditions and circumstances exist which
are peculiar to the land, structure, or building
involved and which are not applicable to other lands,
structures, or buildings in the same district.

Czech reviewed staffs July 20, 1994 memorandum to the Planning
Commission concerning a request by Bob Wise for approval of a
site plan to construct an office building at the southwest
corner of Highway 55 and Oak Street (800 Oak Street).
The Planning Commission discussed issues relating to the
proposed site plan including, but not limited to, the design
of the building and driveway access.
Commissioner Bateman moved, Commissioner Onnen made a second,
to recommend approval of the revised site plan subject to the
following conditions:
That the proposed structure and accessory items
including, but not limited to, the parking lot and
utilities shall be completed pursuant to the approved
site plan. Upon request for occupancy of the building,
all completed items contained within the site plan shall
be addressed pursuant to the escrow requirements
contained within the site plan review provisions of the
city zoning ordinance (Section 10.24).
The applicant/owner shall provide additional landscaping
and/or a berm or decorative fence south of and adjacent
to the four most westerly parking stalls to the
satisfaction of the Community Development Division.

ADJOURNMENT
The parking lot and outside lighting shall be designed
so as not to be obtrusive to adjacent property nor to
passing motorists on public right of ways.

Czech reviewed City Council actions relating to planning
matters which occurred at the July 18, 1994 City Council
meeting.
Commissioner Bolesworth moved, Commissioner Flom made a
second, to adjourn the meeting at 8:38 p.m.
