HomeMy WebLinkAbout12/27/94HASTINGS PLANNING COMMISSION Meeting of December 27, 1994 The regular meet'mg of the Hastings Planning Commission was called to order by Commissioner Reinardy at 7:00 p.m. Commissioners Present: Bateman, Bolesworth, Omen, Reinardy, Schommer and Flom Commissioners Absent: None StaffPresent: City Planner Czech IVlINUTES Commissioner Reinardy called for additions or corrections to the meeting minutes of October 24, 1994. There being no additions or corrections the minutes were approved. HOME OCCUPATION 422 WEST 4TH STREET Czech reviewed staffs December 19, 1994 memorandum to the Planning Commission concerning a request by Thor Aasland for approval of a home occupation permit that would allow him a bookkeeping/tax return business at 422 West 4th Street. Commissioner Bolesworth moved, Commissioner Bateman made a second, to recommend approval of the home occupation permit subject to Mr. Aasland complying with all home occupation standards including, hut not limited to, a basic fire protection inspection by the Fire Marshall. Upon vote taken, Ayes, 6; Nays, 0. SITE PLAN- WALLIN ADDITION TOWNHOMES Czech reviewed staffs December 20, 1994 memorandum to the Planning Commission concerning a request by Greg Jablonske for approval of a site plan for townhome buildings within Wallin Addition. Commissioner Bateman moved, Commissioner Schommer made a second, to recommend approval of the site plan for Wallin Addition subject to the following conditions: That the construction of the townhomes and related site plan improvements shall be completed as per the approved site, landscaping and building elevation plans. Occupancy of the townhome units shall not take place until all site plan related improvements have been completed. In the alternative, occupancy of the units may be permitted if the developer provides the city, as per City Code requirements, a cash escrow in an amount equal to 125% of the cost of the site plan improvements remaining to be completed. 2. That the developer adhere to all provisions contained within the development agreement for Wallin Addition dated May 2, 1994. PUBLIC HEARING COMPREHENSIVE PLAN AMENDMENT AND REZONE- VERMILLION AND 36TH STREETS Upon vote taken, Ayes, 6; Nays, 0. Czech reviewed staffs December 14, 1994 memorandum to the Planning Commission concerning a request by Community National Bank for approval of a Comprehensive Plan amendment from Urban Residential II to Commercial for approximately 2.5 acres of property located at the southeast comer of Vermillion and 36th Streets and a rezone from Agriculture to C-2 for the same 2.5 acre site. Czech also reviewed the applicants request for approval of a rezone from Agriculture to R-3 for approximately 6.9 acres of property located south of36th Stree~ and immediately west of Cad Park Addition. Commissioner Reinardy opened the public heating at 7:10 p.m. Paul Greten an adjacent property owner west of the subject property was present at the meeting and indicated that he opposed the proposed commercial zoning but was in support of the staff recommendation for residential zoning. There being no further comments from the audience, the public heating was closed at 7:12 p.m. The Planning Commission discussed issues relating to the request including, but not limited to, the Hastings Comprehensive Land Use Plan and the policy that states "Hastings shall terminate the commercial strip development south of Vermillion Street by designating properties south of 36th Street extended east and west of either residential, quasi public, or, where appropriate, office". Commissioner Onnen moved, Commissioner Bateman made a second, to recommend approval of the rezone from Agriculture to R-3 for the entire 9.4 acres of property based on findings that the R-3 designation is consistent with the Comprehensive Plan. Upon vote taken, Ayes, 6; Nays, 0. Commissioner Bolesworth moved, Commissioner Flom made a second, to recommend denial of the Comprehensive Plan Amendment from Urban Residential II to Commercial based on findings that the Commercial designation is inconsistent with the Comprehensive Plan. Upon vote taken, Ayes, 6; Nays, 0. UPDATES/OTHER BUSINESS ADJOURNMENT Commissioner Onnen moved, Commissioner Bolesworth made a second, to recommend denial of the rezone from Agriculture to C-2 based on findings that the C-2 designation is inconsistent with the Comprehensive Plan. Upon vote taken, Ayes, 6; Nays, 0. Czech noted that work continues on updating the zoning ordinance and that the Planning Commission will begin review sometime in 1995. Commissioner Schommer moved, Commissioner Bateman made a second, the adjourn the meeting at 7:20 p.m.
