City Council Minutes
February 18,2020
The City Council of the City of Hastings, Minnesota met in a regular meeting on Monday, February 18,
2020 at 7:00 p.m. in the Council Chambers at the Hastings City Hall, 101 East 4`h Street, Hastings, Minnesota.
Members Present: Mayor Fasbender, Councilmembers Balsanek, Braucks, Folch, Leifeld, Lund and Vaughan

Mayor Fasbender recognized former Police Chief Daryl Plath with a moment of silence.
Presentation: Recognition of K-9 Ozzy
Schafer recognized Officer Schmitz and K9 Ozzy for their years of service to the community.
Approval of Minutes
Mayor Fasbender asked if there were any additions or corrections to the minutes of the Regular City
Council meeting on February 3,2020.
Minutes were approved as presented.

Councilmember Folch motioned to approve as presented, seconded by Councilmember Braucks. Ayes
7;Nays 0.
Public Hearing: Ordinance for Annexation -TC Land LLC -Rosalia Bauer
Hinzman explained the request to consider the annexation of approximately 40 acres from Nininger Township
to accommodate future plans for a residential subdivision consisting of single family and villa home sites.
Mayor Fasbender opened the public hearing at 7:12 p.m.
Mike Hamilton, lawyer for Nininger Township,and John Bremer, Planning Commission Chair for Nininger
Township, spoke in opposition to the annexation and raised questions about the adjacent quarry.
Kristy Barse, President of the Chamber of Commerce, spoke in favor of the annexation and the need for
additional housing.
Lisa Hedin and Jeff Pesta, ISD 200,spoke in favor of the annexation.
Bill Creck, representative from Solberg Aggregate,clarified that the quarry is active and mining operations
will continue well into the future.
Rob Halberg, St. Paul Association of Realtors, spoke in favor of the annexation.
Hearing no further comments, Mayor Fasbender closed the public hearing at 7:24 p.m.
Council discussed the City's legal right to annex land, clarified that the owner of the property approached the
City about annexation and that the City did not solicit the property owners, possible effects to homes from
quarry activities and the City's notification responsibility of the possible effects, overall needs of housing in
the City, depicted lot sizes in the concept plan,duty to disclose provision with regards to quarry, housing was a
Council's priority,the need for senior housing options, long-term residency projections,and understanding of
Nininger Township concerns.
Councilmember Vaughan motioned to approve as presented, seconded by Councilmember Balsanek. Ayes 7;
Nays 0.
Public Hearing and Resolution No. 02-13-20: Approval to Establish TIF District No.8-Real Estate
Equities-Schoolhouse Square Senior Housing
Hinzman explained the item and introduced Jessica Green,Northland Securities.
Green described the request to establish the Tax Increment Financing District No. 8, adoption of the Tax
Increment Financing Plan, modification of the Vermillion Street Redevelopment Area and adoption of
modified Redevelopment Plan.
Council discussed the duration of TIF District,the City's ability to control building quality, TIF District
criteria and types of TIF Districts,ability for a TIF district to be re-started or used elsewhere after de-
certification, use of CDA low-income housing tax credits and history of TIF districts in City.
Mayor Fasbender opened the public hearing at 8:10 p.m.
Hearing no comments, Mayor Fasbender closed the public hearing at 8:11 p.m.

Councilmember Lund motioned to approve as presented, seconded by Councilmember Braucks. Ayes 7;Nays
0.
Resolution No.02-14-20: Preliminary and Final Plat-Schoolhouse Square 4`h Addition -Real Estate
Equities.
Hinzman described the next three Council actions; the preliminary and final plat,the special use permit and the
site plan for a 90-unit independent living senior housing facility to be located northwest of 10"'and Ramsey
Streets proposed by Real Estate Equities. He indicated that staff recommends approval of all three actions.
Alex Bisanz,Real Estate Equities representative,gave a presentation on the proposed development.
Council discussed possibly including infrastructure for electric car charging stations, consideration of moving
the access into the building to the North,townhome association ability to re-negotiate previous reciprocal
agreement,wording changes to conditions of approval, future use of proposed green space, annual economic
impact to the community, water run-off management plan,traffic control modifications, pedestrian movement,
trail maintenance, sidewalk connections, ability to construct underground parking, water/sewer/stormwater
increased demand on system, City's ability to ensure property stays affordable housing after end of TIF
district.
Councilmember Folch motioned to approve with the amendments; that 3%of available parking spaces are
ready for electric vehicle charging stations and that condition#6 be changed to read"Execution of an easement
agreement to ensure ingress and egress between the proposed property, Ramsey Street, and 100' Street".
Motion was not seconded.
Councilmember Vaughan motioned to approve as presented, seconded by Councilmember Braucks.
Councilmember Folch motioned to amend staff s recommendation to change condition#6 wording to read:
Execution of an easement agreement to ensure ingress and egress between the proposed property, Ramsey
Street, and 10th Street. Seconded by Councilmember Lund.
Bisanz assured residents and City Council that Real Estate Equities would be responsible for all of the
maintenance of the shared space.
Sonia Metzger, president of the adjacent townhome homeowner's association, asked the City Council to table
the item until the homeowner's association obtains legal counsel and an agreement reached with the developer
regarding maintenance of the shared space.
Pat Regan, Camegaran, LLC, clarified about the grading of the site, previous maintenance agreements still in
place and reasons for Schoolhouse Square buildings being locked after normal business hours.
Councilmembers Folch and Lund agreed to remove amendment from motion.
Roll call vote on motion to approve as presented. Roll call:Ayes -Councilmembers Vaughan, Folch,
Balsanek, Braucks, Lund, Leifeld and Mayor Fasbender;Nays 0.
Resolution No. 02-15-20: Special Use Permit-Building Exceeding 40 Feet in Height-Real Estate

Councilmember Folch motioned to approve as presented, seconded by Councilmember Braucks. Ayes 7; Nays

Resolution No.02-16-20: Site Plan-90 Unit Senior Housing Building-Real Estate Equities -
Schoolhouse Square Senior Housing
Councilmember Leifeld motioned to approve as presented, seconded by Councilmember Folch. Ayes 7;Nays
0.
Authorize Signature: Amendment to Schoolhouse Square Development Agreement
Hinzman explained the amendment to allow an increase in building height and density.
Councilmember Vaughan motioned to approve as presented, seconded by Councilmember Braucks. Ayes 7;
Nays 0.
Resolution No.02-17-20: Special Use Permit-Retail Service in a 1-1 District-Smurawa Mini Storage-
Lightbourn Court
Hinzman indicated that there were two City owned lots in the Industrial Park of the I-1 Industrial Park Zoning
District for sale and discussed the request for a Special Use Permit to allow operation of a mini-storage
business on those sites.
Councilmember Vaughan motioned to approve as presented, seconded by Councilmember Leifeld. Ayes 7;
Nays 0.
Resolution No.02-18-20: Site Plan -Smurawa Mini Storage-Lightbourn Court
Councilmember Lund motioned to approve as presented,seconded by Councilmember Braucks. Ayes 7;Nays
0.
Rainbow Tree Care's review of 2019 Emerald Ash Borer treatment program
Jenkins introduced Jeff Hafner of Rainbow Tree Care who gave a recap of the 2019 Emerald Ash Borer
treatment program in Hastings.
Council discussed areas in the City with treated trees, re-treatment reminders sent to homeowners after initial
treatment,creation of economic impact model of City owned trees including die off data, legislative priorities,
complemented staff for work done, possible annual City tree sale and grant opportunities.
2020 Emerald Ash Borer Preferred Vendor for EAB Treatment Program
Jenkins introduced the item and requested Council to name Rainbow Tree Care as the City's 2020 Emerald
Ash Borer Treatment Preferred vendor. Rainbow Tree Care has been the City's preferred vendor since 2017.
Councilmember Vaughan motioned to approve as presented, seconded by Councilmember Leifeld. Ayes 7;
Nays 0.
Approval of Vermillion Falls Natural Resource Management Plan and 2020-2022 Work Plan
Jenkins introduced Karen Schik, Friends of the Mississippi,who gave a presentation asking for Council's
support of the Natural Resource Management Plan developed for Vermillion Falls Park. Friends of the
Mississippi developed the plan and intend to do ecological restoration projects from 2020-2022.
Council discussed the long-term maintenance of the restoration plan.

Stoffel introduced Jordan Shaffer from the City's Public Arts Task Force who explained the Art Call and
process used to select the winning artist. The winning artist's mural design will be placed on the north side of
the Hastings Family Service building.
Council discussed the durability and lastingness of the mural,appreciation for Task Force's and Stoffel's work,
possible needed modifications to building and final design details.
Councilmember Leifeld motioned to approve as presented,seconded by Councilmember Braucks. Ayes 7;
Nays 0.
Liquor License Violation: Jake's Discount Liquor
Fluegel explained alleged compliance check failure.
Councilmember Vaughan motioned to allow Fluegel to enter into a stipulation agreement with Jake's Discount
Liquor which would provide for a$500 fine and a stayed 3-day license suspension if Jake's Discount Liquor
enrolls in the City's Best Practices Program,seconded by Councilmember Balsanek. Ayes 7;Nays 0.
Councilmember Leifeld motioned to approve the stipulation agreement as presented, seconded by
Councilmember Braucks. Ayes 7;Nays 0.
Mayor Fasbender and Councilmembers made the following announcements:
• Planning Committee will meet on Monday, February 240'at 7:00 p.m.
• Public Safety Committee of the Council will meet on Thursday, February 20"at 7:30 am.
• Police Department staff will participate in the Polar Plunge on Saturday, February 22"a
• Councilmember Balsanek will meet with Jim Biermaier on Wednesday, February 19 to discuss WAC/SAC
fees.
• Councilmember Balsanek will attend the Dakota Communications Center Board of Directors meeting on
Thursday,February 201h
• Councilmember Vaughan asked that staff consider utilizing the AdHoc—Transportation/Transit
Committee of Council(*Vaughan, Balsanek, Leifeld)to meet to discuss transit and the loop bus.
• THRIVE Thursdays will meet on Thursday, February 20`h at 6:00 p.m. at the YMCA.
• Hastings Reads will be at the YMCA on Thursday, February 28'h beginning at 6:00 p.m.
• Councilmember Leifeld was wished a Happy Birthday!
Councilmember Leifeld motioned to adjourn, seconded by Councilmember Balsanek. Ayes 7;Nays 0. The
meeting was adjourned at 10:35 p.m.
