HomeMy WebLinkAbout10/23/95Hastings Planning Commission Meeting of'October 23, 1995 The regular meeting of the Hastings Planning Commission was called to order by Commissioner Reinardy at 7:00 p.m. Commissioners Present: Schommer, Flom, Bateman, Bolesworth, Onnen and Re'mardy Commissioners Absent: Harrington StaffPresent: City Planner Czech and Community Development Director Wozniak MINUTES Commissioner Reinardy called for additions or corrections to the meeting minutes of October 10, 1995. There being no additions or corrections the minutes were approved. HOME OCCUPATION- 517 WEST 4TH STREET Czech reviewed StalYs October 12, 1995 memorandum to the Planning Commission concerning a request by Delila S. Bergan for approval ora home occupation permit to allow two inter related businesses at 517 West 4th Street. The Planning Commission discussed with staff and the applicant issues relating to the proposed home occupation including, but not limited to, off street parking and health care management. Commissioner Bolesworth moved, Commissioner Onnen made a second, to recommend approval of the home occupation permit subject to the applicant complying with all home occupation standards including, but not limited to, a basic fire protection inspection by the Fire Marshall. Upon vote taken, Ayes, 6; Nays, 0. HOlVlE OCCUPATION - 1961 LOUIS LANE Czech reviewed Staff's October 12, 1995 memorandum to the Planning Commission concerning a request by Michelle and Kenneth Richmond for approval of a home occupation permit that would allow them a home health agency at 1961 Louis Lane. The Planning Commission discussed issues relafmg to the proposed home occupation including, but not limited to, operational requirements ora home health agency. Commissioner Bolesworth moved, Commissioner Bateman made a second, to recommend approval &the home occupation permit subject to the applicants complying with all home occupation standards including, but not limited to, a basic fire protection inspection by the Fire Marshall. PUBLIC HEARING- REZONE (R-3 TO R-l) ~ PRELIMINARY/ FINAL PLAT - BAUER' S HIGH POINT- WEST 25TH STREET Upon vote taken, Ayes, 6; Nays, 0. Czech reviewed Staff's October 12, 1995 memorandum to the Planning Commission concerning a request by Willard J. Bauer for approval of a rezone fi.om R-3 to R-1 for approximately 11.3 acres of property located east of Pleasant Drive. Staff also reviewed the applicants request for approval of a preliminary/final plat called B auer's High Point that would create 18 single family lots. Commissioner Reinardy opened the public heating at 7:13 p.m. There being no one to address the item the public heating was dosed. The Planning Commission discussed issues relating to the proposed rezone and preliminary/final plat including, but not limited to, current zoning and street names. Commissioner Onnen moved, Commissioner Bateman made a second, to recommend approval of a rezone from R-3 to R- 1. Upon vote taken, Ayes, 6; Nays, 0. Commissioner Bateman moved, Commissioner Schommer made a second, to recommend approval of the preliminary/final plat called Bauer's High Point subject to approval of the rezone fi.om R-3 to R-1 and the following conditions: 2. 3. 4. The final plat hardshells shall be consistent with the approved preliminary/final plat. Before the City signing the final plat hardshells, the applicant shall pay the required interceptor sewer charge of $4,860.00. Before the City signing the final plat hardshells, the applicant shall pay the required cash in lieu &park dedication fee of $15,300.00. The developer shall record a restrictive covenant or another instrument acceptable to the City that requires maintenance of the cul-de-sac and entrance islands. The developer shall adhere to Public Works Director Tom Montgomery's comments spelled out in his October 16, 1995 memorandum concerning Bauer's High Point Preliminary Plat. Upon vote taken, Ayes, 6; Nays, 0. PUBLIC HEARING - REZONE (A TO R-l) AND MINOR SUBDIVISION - TIERNEY DRIVE PUBLIC HEARING-AMEND CHAPTER 10 (C-4 DISTRICT) - ADULT USE ORDINANCE Czech reviewed Staff's October I 1, 1995 memorandum to the Planning Commission concerning a proposal by the City of Hastings to rezone approximately one acre of property next to Tierney Drive from Agriculture to R-1. Czech also reviewed the City's proposal for a minor subdivision of approximately 23 acres to create two parcels one of which would be approximately one acre and the other 22 acres. Commissioner Reinardy opened the public heating at 7:21 p.m. There being no one to address this item the public hearing was closed. Commissioner Bolesworth moved, Commissioner Schommer made a second, to recommend approval of a rezone from Agriculture to R-1 for that portion of the property shown as Parcel B on the boundary survey dated 12- 30-94 as prepared by Dwyer & Associates, Incorporated (Drawing No. 94- 097). Upon vote taken, Ayes, 6; Nays, 0. Commissioner Bateman moved, Commissioner Onnen made a second, to recommend approval of the minor subdivision to create two lots (Parcels A & B) as described on the boundary survey dated 12-30-94 as prepared by Dwyer & Associates, Incorporated (Drawing No. 94-097) subject to approval of the rezone from Agriculture to R-1. Upon vote taken, Ayes, 6; Nays, 0. Wozniak reviewed Staff's October 19, 1995 memorandum to the Planning Commission concerning a proposed amendment to the zoning ordinance to establish special use provisions for adult uses. Commissioner Reinardy opened the public heating at 7:30 p.m. There being no one to address this item the public heating was closed. The Planning Commission discussed issues relating to the proposed adult use ordinance including, but not limited to, principal versus accessory uses, definition of adult use, and existing businesses with adult uses. Commissioner Bolesworth moved, Commissioner Onnen made a second, to recommend approval of an ordinance for the City of Hastings amending Chapter 10 of the City Code by the addition of provisions allowing adult uses as principal and accessory uses by special use permit within the C-4 zone district. Upon vote taken, Ayes, 6; Nays, 0. UPDATES/OTHER Czech reviewed City Council actions concerning planning related matters. BUSINESS Commissioner Bateman moved, Commissioner Bolesworth made a second, to adjourn the meeting at 7:56 p.m.
