Minutes of June 24, 1996
Commissioner Onnen opened the meeting at 7:00 p.m.
Commissioners Present: Strauss, Bolesworth, Flom, I-hrrington, and Onnen.
Commissioners Absent: Schommer and Bateman.
Staff Present: Community Development Director Wozniak.
MINUTES:
Commissioner Onnen called for additions or corrections to the May 13 and
June 10, 1996, meeting minutes. There being no additions or corrections
the minutes were approved.
PLEASANT
VALLEY 10TH
ADDITION
Community Development Director Wozniak presented staff
recommendation regarding the Pleasant Valley 10th Addition final plat.
Commissioner Harrington moved and Commissioner Flom made a second
to recommend approval to the Hastings City Council of the Pleasant Valley
10th Addition final plat, subject to the following conditions:
The final plat hard shells must be consistent with the approved final
plat.
Before the City signs the final plat hard shells, the applicant shall
pay the required interceptor sewer charge of $3300.00.
The developer shall modify the Pleasant Valley 10th Addition plans
according to comments expressed in Public Works Director
Montgomery's June 13, 1996, letter to Thomas J. McMahan.
Upon vote taken, IAyes, 5; Nays, 0.
VARIANCE
REQUEST
Wozniak review background information pexxaining to a request from
Richard Fuchs (1131 Park Ct.) asking the City to grant a 2'6" variance to R-
I zone district side/comer yard setback requirements to allow an 8'10"
addition to an existing attached garage.
Commissioner Strauss moved and Commissioner Harrington made a
second to recommend denial of the request of Richard Fuchs (I 131 Park
Ct.) asking the City to grant a 2'6" variance to R-1 zone district side/comer
yard setback requirements to allow an 8'10" addition to an existing attached
garage based upon the finding that the applicant has not satisfied the
following criteria:

That special conditions and circumstances exist which are peculiar
to the land, structure, or building involved which are not applicable
to other lands, structures, or buildings in the same district.
The literal interpretation of the City Code would deprive the
applicant of rights commonly enjoyed by other properties in the
same district under the terms of Chapter 10.
That the special conditions and circumstances do not result from the
actions of the applicant.
That granting the variance requested will not confer on the applicant
any special privilege that is denied by Chapter 10 to other lands,
structures, or buildings in the same district. No non-conforming use
of neighboring lands, structures, or building in the same district and
no permitted or non-conforming use of lands, structures, or
buildings in other districts shall be considered grounds for issuance
of a variance.
Upon vote taken Ayes, 5; Nays, 0.
Wozniak presented background information related to Comp. Han
Amendment ~O6-13.
Commissioner Harrington moved and Commissioner Bolesworth made a
second to table consideration of this item until the next regularly schedule
Planning Commission meeting to allow the applicant to refine development
plans for the propeay in question.
Upon vote taken, Ayes, 5; Nays, 0.
Commissioner Bolesworth moved and Commissioner Flom made a second
to adjourn the meeting at 7:45 p.m.
