Minutes of August 12, 1996
Commissioner Onnen opened the meeting at 7:00 p.m.
Commissioners Present: Strauss, Bolesworth, Flom, Harrington, Schommer and Onnen.
Commissioners Absent: Bateman.
Staff Present: Community Development Director Wozniak and Planning Intern Matt Weiland
MINUTES:
Commissioner Onnen called for additions or corrections to the June 24,
1996, meeting minutes. There being no additions or corrections the
minutes were approved.
Commissioner Harrington stated that he could not participate in Planning Commission
consideration of the Dakota County Juvenile Facility due to his involvement with the project as an
employee of Dakota County.

Wozniak presented background information on the site plan for the
proposed Dakota County Juvenile Center.
Commissioner Strauss moved and Commissioner Bolesworth made a
second to Motion to recommend approval to the Hastings City Council of
the Dakota County Juvenile Center Site Plan subject to the following
conditions:
The proposed structure and accessory items including, but not
limited to, the parking lot and landscaping shall be completed
pursuant to the approved site plan. Upon request for occupancy of
the building, ail uncompleted items contained within the site plan
shall be addressed pursuant to city code escrow requirements.
Catch basins shall be installed at the north end of the driveway to
intercept storm water drainage before it shoots out onto 4th St.
RCP storm sewer pipe shall be utilized within the City right-of-way.
The existing 4 inch diameter sanitary sewer service that is to be
abandoned shall be bulkheaded at both the southwest end at the
connection with the new sanitary sewer service, and at the northeast
end where the existing service connects to an existing manhole in
4th St.
If the existing 2 inch diameter water service is to be abandoned, it
shall be disconnected and capped and the corporation stop at the
watermain connection in 4th St.

Commissioner Strauss moved and Commissioner Harrington made a PLAN
second to bring back for consideration a request for approval of
Comprehensive Plan Amendment 96-13, (tabled since June 10, 1996 -
Planning Commission meeting).
Wozniak review background information regarding this proposed plan
amendment involving a MUSA boundary adjustment on the Wallin
Property and a redesignation of approximately 14 acres of property.
Commissioner Schommer moved and Commissioner Flom made a second
to recommend approval to the Hastings City Council of City of Hastings
Comprehensive Plan Amendment 96-13 - Wallin Property MUSA
Boundary Adjustment.
Upon vote taken, Ayes, 6; Nays, 0.
Following a review of this item by Wozniak, Commissioner Onnen opened
the public hearing at 7:35 a.m. to consider comments related to this item.
Mr. Donald Fluegel of 2522 Old Bridge Lane expressed significant
concerns related to the proposed street, lot, and utility design for that
portion of the preliminary plat abutting his property. In particular he
expressed concerns regarding how access to a sanitary sewer manhole
situated on his property would be handled. Comments were also made by
Michael Harriage of 2504 Old Bridge Lane. Mr. Harfiage expressed
concerns regarding the proposed lot sizes abutting his property. He stated
that the proposed lots of 10,000 to 12,000 square feet in size would be
detrimental to abutting lots in the Old Bridge Lane Addition which are
30,000 sq. fi. or larger. Mr. Harriage objected to utilizing 25th St.
(Northridge Dr.) as a collector street due to safety concerns at the
intersection with Pleasant Dr. Lastly, Mr. Harriage suggested that the City
should require a perimeter off-street pedestrian trail around the Wallin
Property to provide more safe pedestrian walking and biking oppommities.
There being no further comments the public hearing was closed at 7:52
p.m.
Commissioner Schommer moved and Commissioner Strauss made a
second to recommend approval to the Hastings City Council the Wallin
Property preliminary plat (dated 7/15/96) subject to the following
conditions:
Approval of Comprehensive Plan Amendment 96-13 (Wallin
Property MUSA Boundary Adjustment).
Modification of the Preliminary plat and Development Plans to
comply with recommendations set for in Public Works Director
Montgomery's memorandum on the Wallin Property Preliminary
Plat dated July 26, 1996.
That the alignment and design of the sanitary sewer line which has
an east/west alignment and is situated just to noah of the Vermillion
River be evaluated by the Public Works Director to minimize
impact on the abutting property to east of Lot 6, Block 5 of the
preliminary plat.

Wozniak explained the request of the Wallin Partnership to rezone from the
Agriculture (AG) District to the Single Family Residence (R-l) District that
property which is being platted as Wallin 3rd Addition.
Commissioner Onnen opened a public heating to consider this item at 8:35
p.m. There being no comments the public hearing was closed.
Commissioner Harrington moved and Commissioner Schommer made a
second to recommend approval to the Hastings City Council of the request
to rezone from the Agriculture (AG) District to the Single Family
Residence (R-l) District that property which is being platted as Wallin 3rd
Addition.
Upon vote taken, Ayes, 6; Nays, 0.
Commissioner Hardngton moved and Commissioner Bolesworth made a
second to recommend approval to the Hastings City Council of the Wallin
3rd Addition final plat subject to the following conditions:
Approval of Comprehensive Plan Amendment 96-13.
City Council approval of the Wallin Property Preliminary Plat
(dated 7/15/96).
Rezoning of the subject property to R-1 (Single Family Residence).
Deeding of Outlot B to the City of Hastings to meet public land
dedication requirements for 130 acres of the Wallin Property
including Wallin 2nd, 3rd, 4th and subsequent additions.
Granting to the City of a pedestrian easement over Lot 1, Block 3
and over Outlot A for the bituminous trail that will be constructed
within this area.
Documentation that common open space and ponding basins
(Outlots A & C) shall be privately maintained by a development
association and not the City.
Modification of the final plat prior to submission of hardsheil copies
such that drainage and utility easements across the rear of Lots 7-9,
Blk. 1 are expanded to 20 ft. in width to accommodate the 10 ft.

easement in the northwest comer of Lot 9 and the southwest comer
of Lot 7 shall be expanded to accommodate a 30 ft. turning radius
for maintenance equipment.
Modification of the final plat such that drainage and utility
easements along the east side of Lot 18, Block 2 should be
increased to 30 ft. In width to accommodate both the sanitary sewer
and water mains that will be constructed within this area. In
addition a pedestrian easement shall be granted to the City over this
lot for the bituminous trail that will be constructed within this
easement area.
Submission of a low maintenance landscape plan for the Wyndham
Place Island to be approved by the Community Developmem
Director prior to release of the plat hardshells by the City.
Documentation that the landscape of Wyndham Place Island shall
be privately maintained under an association agreement.
Before the City signs the final plat hardshells, the applicant shall
pay the required interceptor sewer charge of $8800.00.
Prior to release of hardshell copies of the plat by the City the
developer shall execute a development agreement to be drafted by
the City which documents any conditions of plat approval or city
development requirements as deemed necessary by the City. Said
Development Agreement shall be recorded against the subject
property.

Commissioner Onnen opened a public hearing to consider this item at 8:40
p.m. Don Fluegel and Michael Haniage of 2522 and 2504 Old Bridge
Lane reiterated comments which they had earlier made during the public
hearing for the Wallin Property preliminary plat.
Commissioner Harrington moved and Commissioner Schommer made a
second to recommend approval to the Hastings City Council of the request
to rezone from the Agriculture (AG) District to the Single Family
Residence (R-1) District that property which is being platted as Wallin 4th
Addition.
Upon vote taken, Ayes, 6; Nays, 0.
Commissioner Schommer moved and Commissioner Ounen made a second
to recommend approval to the Hastings City Council of the Wallin 4th
final plat subject to the following conditions:
Approval of Comprehensive Plan Amendment 96-13.
Approval of the Wallin Property Preliminary Plat (dated 7/15/96).
Rezoning of the subject property to R-1 (Single Family Residence).
That a 20' gravel road shall be constructed from the end of River
Shore Dr., north to connect to Brooke Lane. This gravel emergency
access shall be constructed with grades not to exceed 8%, and with
ditches to handle storm water runoff. Construction of the
emergency access shall be completed with other public
improvements being constructed to serve the plat.
Documentation that common open space and ponding basins
(Outlots A) shall be privately maintained by a development
association and not the City.
Modification of the plat and development plans as follows: A
sanitary sewer main is proposed to constructed across the front
yards of Lots 6-11, Blk. 7, abutting River Shore Drive. This
proposed sewer main serves the entire sonthem half of the Wallin
Development. The Utility Department needs a paved access to the
manholes located on the property lines between Lots l0 & 11, Lots
8 & 9, Lots 6 & 7, and the manhole on the east property line of Lot
6 in order to maintain this critical sewer main. Obviously, a paved
trail across the front yards of these lots would hinder the sale and
development of these properties. As an alternative, an access
easement over the driveways with a turn mound area around the
manholes shall be provided. The driveways shall be constructed at
the same time as the street and utilities, and may no exceed an eight
percent grade. Maintenance of the driveways shall be the
homeowner's responsibility. The access easements for these
driveways shall be shown on the plat drawings for permanent
record. The driveway for Lot 6 shown on Sheet #7 of the Wallin
Property Preliminary Plat (7/15/96) does not provide access to the
sanitary sewer manhole on the east property line and should be
revised.
Modification of the final plat such that the drainage and utility
easement over the west 10 ft. of Lot 7, Block 1 shall be expanded to
20 ft. in width to accommodate the 10 ft. wide bituminous utility
maintenance trail that will be constructed across this lot. In
addition, the utility maintenance trail shall be temporarily extended
to intersect with the emergency access road, so that maintenance
vehicles using the trail have a way to get back out.
Before the City signs the final plat hardshells, the applicant shall
pay the required interceptor sewer charge of $4400.00.
Prior to release of hardshell copies of the plat by the City the
developer shall execute a development agreement to be drafted by
the City which documents any conditions of plat approval or city
development requirements as deemed necessary by the City. Said
Development Agreement shall be recorded against the subject
