HomeMy WebLinkAbout20190916 - CC Minutes Hastings, Minnesota City Council Minutes September 16,2019 The City Council of the City of Hastings, Minnesota met in a regular meeting on Monday, September 16, 2019,at 7:00 p.m. in the Council Chambers at the Hastings City Hall, 101 East 4`h Street, Hastings, Minnesota. Members Present: Mayor Fasbender, Councilmembers Balsanek, Braucks, Folch, Leifeld, Lund and Vaughan Staff Present: Interim City Administrator Julie Flaten City Attorney Dan Fluegel Community Development Director John Hinzman Finance Manager Melanie Lammers Senior Accountant Ashley Parker Approval of Minutes Mayor Fasbender asked if there were any additions or corrections to the minutes of the Regular City Council meeting on September 3,2019 and workshops on September 3 and 9, 2019. Minutes were approved as presented. Consent Agenda 1. Pay Bills as Audited 2. Approve Pay Estimate No. 3 for the 2019-1 Neighborhood Infrastructure Project in the amount of$1,110,317.06 3. Resolution No. 09-05-19: Approve a Massage Therapy License for Jeanne Lecher 4. Resolution No. 09-06-19:Accept Donation from Irish Football Boosters to Parks & Recreation Department in the amount of$1,586.63 5. Approve Special Event Request from Awaken the Dawn for October 17— 19, 2019 6. Approve Special Event Request for Candy Crawl on October 31, 2019 Councilmember Braucks motioned to approve as presented, seconded by Councilmember Leifeld. Ayes 7;Nays 0. Resolution No. 09-07-19: Type II Home Occupation Permit—Dean and Shirley Markuson(201 East 7 1 Street) Hinzman discussed the application request for a Type II Home Occupation Permit at 201 East 7`h Street. He summarized comments received from the public during the Planning Commission meeting and that the Planning Commission unanimously voted to deny the application request. Dean Markuson, applicant and CEO of Foss and Swanson Veterans and resides at 436 Tiffany Drive, provided details on the intended use of the property and that he would obey all of the specified conditions. Council expressed appreciation of Dean's commitment and passion to serve the community. They discussed the serving of alcohol, use of rental space, affiliation with other organizations and not duplicating those efforts,who will be served, neighborhood impact of the former funeral service operations, anticipated number of future events and daily operations, alternative sites, uses for the site in the R2 district, expiration of the non-conforming status,Type I1 Home Occupation permit stays with the applicant, the lack of details regarding the implementation of the proposed uses, Citywide zoning stability and the process for applicant to re-apply if denied. Additionally, a caveat was added to the sale agreement that the building could not be used as a funeral home for 30 years after the purchase date. Amy Martin, 220 7th Street East, was apprehensive with the vagueness and inconsistent details of the proposal and building uses and that boundaries and protocols were not recognized or followed. She also stated that Markuson approached her while in her yard on Saturday, September 14, 2019 and indicated he would be withdrawing his application. However, she confirmed with Hinzman that it was not removed from the City Council Meeting agenda. Jon Frey, a neighbor to 201 East 7th Street, was against the proposed uses of the building. Michelle Wolf, 600 Ramsey Street, was ambivalent with the amount of flexibility of the proposed use and the lack of definitive plans. Mark Dembroski, 121 Oh Street East, was concerned with the inconsistencies of the proposal details and provided examples. Councilmember Leifeld motioned to accept the Planning Commission's recommendation to deny the application request as presented, seconded by Councilmember Braucks. Ayes Balsanek, Braucks, Leifeld, Lund and Vaughan;Nays Folch and Fasbender. Motion carries. Approve Cost Sharing Agreement and Lease Agreement with Independent School District#200 Flaten detailed the Cost Sharing Agreement and Lease Agreement with Independent School District#200. Council discussed possible future maintenance needs at 213 Ramsey Street and that the agreement does not include cost sharing for major maintenance needs. Councilmember Folch motioned to approve as presented, seconded by Councilmember Braucks. Ayes Balsanek, Folch, Leifeld, Lund and Fasbender;Nays Braucks and Vaughan. Motion carries. Resolution No. 09-08-19: Approve Preliminary 2020 City Property Tax Levy,Preliminary Budget and Setting Truth in Taxation Hearing Flaten introduced Lammers who gave a presentation on the preliminary 2020 City Property Tax Levy and preliminary Budget. The proposed levy is a 3.9% increase over the 2019 levy. She requested Council to set the Truth in Taxation hearing date for Monday, December 2,2019. Councilmember Folch motioned to approve as presented, seconded by Councilmember Vaughan. Ayes 7;Nays 0. Resolution No. 09-09-19: Approve Proposed 2020 HEDRA—HRA Special Tax Levy Councilmember Vaughan motioned to approve as presented, seconded by Councilmember Folch. Ayes 7;Nays 0.
