DETERMINATION OF QUORUM V. APPROVAL OF MINUTES Approve Minutes of the Regular City Council meeting on September 3, 2019 and workshops on September 3 and 9, 2019. Minutes were approved as presented. VI. COMMENTS FROM THE AUDIENCE Comments from the audience may include remarks about items listed on the Consent Agenda. VII. COUNCIL ITEMS TO BE CONSIDERED VIII. CONSENT AGENDA The items on the Consent Agenda are items of routine nature or no perceived controversy to be acted upon by the City Council in a single motion. There will be no discussion on these items unless a Councilmember so requests, in which event the items will be removed from the Consent Agenda to the appropriate Department for discussion. Resolution : Approve a Massage Therapy License for Jeanne Lecher No. 09-06-19 4. Resolution : Accept Donation from Irish Football Boosters to Parks & Recreation Department in the amount of $1,586.63 5. Approve Special Event Request from Awaken the Dawn for October 17 – 19, 2019 6. Approve Special Event Request for Candy Crawl on October 31, 2019 IX. Once the public hearing is closed, no further testimony is typically allowed and the Council will deliberate amongst itself and with staff and/or applicant on potential action by the Council. X. It is up to the discretion of the Mayor as to what, if any, public comment will be heard on these agenda items. A. Public Works B. Community Development No. 09-07-19 1. Resolution : Type II Home Occupation Permit – Dean and Shirley th Markuson (201 East 7 Street) Hinzman discussed the application request for a Type II Home Occupation th Permit at 201 East 7 Street. He summarized comments received from the public during the Planning Commission meeting and that the Planning Commission unanimously voted to deny the application request. Markuson spoke providing details on the intended use of the property once he has ownership. Council discussion on clarification on alcohol to be served, use of space for rental, duplication of efforts of other organizations, appreciation of Dean’s commitment and passion to serve, affiliation with other organizations, who will be served, impact of former funeral service operations on neighborhood, number of events applicant plans to hold, alternative sites, options for site in R2 district, Type II Home Occupation permit stays with the applicant, more details needed on proposed uses, Citywide zoning stability, process for applicant to re-apply if denied. Jesse Starkson, property owner, provided clarification on previous uses of property, alcohol service, number of events held and hours of operation. th Amy Martin, 220 7 Street E, shared concerns with vagueness of proposal and uses of building. Jon Frey, who lives in neighborhood, shared concerns about uses of building. Michelle Wolf, who lives in neighborhood, shared concerns about flexibility in proposal. th Mark Dembroski, 121 6 Street E shared concerns about inconsistencies in proposal. Councilmember Leifeld to accept the Planning Commission’s recommendation to deny the application request as presented. Seconded by Councilmember Braucks. Roll call vote. 5-2 Folch, Fasbender voting against C. Administration 1. Approve Cost Sharing Agreement and Lease Agreement with Independent School District #200 Flaten detailed the Cost Sharing Agreement and Lease Agreement with Independent School District #200. Folch, Braucks to approve as presented. 5-2 Braucks, Vaughan voting against No. 09-08-19 2. Resolution : Approve Preliminary 2020 City Property Tax Levy, Preliminary Budget and Setting Truth in Taxation Hearing Flaten introduced Lammers who gave a presentation on the preliminary 2020 City Property Tax Levy and preliminary Budget. The proposed levy is a 3.9% increase over the 2019 levy. She requested Council to set the Truth in Taxation hearing date for Monday, December 2, 2019. Folch, Vaughan approve as presented. 7-0 No. 09-09-19 3. Resolution : Approve Proposed 2020 HEDRA – HRA Special Tax Levy Vaughan, Folch to approve as presented. 7-0 XI. UNFINISHED BUSINESS XII. NEW BUSINESS XIII. REPORTS FROM CITY COMMITTEES, OFFICERS, COUNCILMEMBERS th Heritage Preservation Commission meeting on Tuesday, September 17 at 7:00 p.m. at City Hall. th Public Safety Advisory Commission meeting, Thursday, September 19 at 6:30 p.m. at City Hall.  Fall Clean-Up day-Saturday, September 21th from 8:00 a.m. to noon at the Public Works building. rd Planning Commission meeting on Monday, September 23 at 7:00 p.m. at City Hall. th HEDRA Special meeting on Thursday, September 26 at 6:00 p.m. at City Hall.  Councilmember Braucks was wished a Happy Birthday.  There will be a reception for the new City Administrator, Dan Wietecha, on th Monday, October 7 prior to the council meeting. rd Public Safety Committee of the Council will meet on Thursday, October 3 at 7:30 a.m.  Councilmember Leifeld announced two events. The first is Women Inspiring Women to be held at Hastings Public House on Thursday, th September 26 and the second is a fundraiser for Draggin on River to be th held on Friday, September 27 at Levee Park from 7:00 – 9:00 p.m. XIV.
