HomeMy WebLinkAbout20190819 - CC Minutes r Hastings, Minnesota City Council Minutes August 19,2019 The City Council of the City of Hastings, Minnesota met in a regular meeting on Monday, August 19, 2019,at 7:00 p.m. in the Council Chambers at the Hastings City Hall, 101 East 4't'Street, Hastings, Minnesota. Members Present: Mayor Fasbender, Councilmembers Balsanek, Braucks, Folch, Leifeld, Lund and Vaughan Staff Present: Interim City Administrator Julie Flaten City Attorney Dan Fluegel Community Development Director John Hinzman Fire&EMS Director Mike Schutt Presentation—LeDuc Annual Update Matthew Carter and Mariah Ring updated the Council of the various activities at the LeDuc Historic Estate. Presentation—Zachery Bloomstrand, Eagle Scout Project Schutt introduced Zachery Bloomstrand and detailed his Eagle Scout project. Approval of Minutes Mayor Fasbender asked if there were any additions or corrections to the minutes of the Regular City Council meeting on August 5,2019 and workshop on August 5,2019. Minutes were approved as presented. Consent Agenda 1. Pay Bills as Audited 2. Approve Pay Estimate No. 2 for the 2019-1 Neighborhood Infrastructure Project in the amount of$849,319.70 3. Resolution No. 08-05-19:Acceptance and Appreciation of a Donation from the Henkel Foundation to the Parks and Recreation Department 10. Resolution No. 08-06-19: Acceptance and Appreciation of a Donation from the Hastings Area Chamber of Commerce to the Police Reserve Program 11. Resolutions No. 08-07-19 and No. 08-08-19:Acceptance and Appreciation of a Donation from the Shakopee Mdewakanton Sioux Community Business Council and Walmart to the Police Department 12. Resolution No.08-10-19: Approve Lawful Gambling Premise Permit for South Robert Street Business Association at Hastings Social, LLC d/b/a Hastings Tavern 14. Resolution No. 08-09-19:Acceptance and Appreciation of a Donation from Colleen Horsch to the Fire Department 15. Resolution No. 08-11-19:Acceptance and Appreciation of a Donation from Dorothy Clarke to the Parks and Recreation Department Councilmember Braucks motioned to approve as presented, seconded by Councilmember Leifeld. Ayes 7;Nays 0. Authorize Signature: 3rd Amendment to Purchase and Development Agreement—Confluence Development Hinzman detailed the complex history of the project, reasons for delays and highlights of the 3d Amendment to the Purchase and Development Agreement with Confluence Development. Council indicted their appreciation for staff's diligence of working on this project. They discussed the loss of TIF revenue and risks associated with TIF districts, clarification of City/HEDRA grant/expenses and partners, financing for the project, zoning of the property prior to sale, project impacts and expected communication throughout construction process. Councilmember Vaughan motioned to approve as presented, seconded by Councilmember Balsanek.Ayes 7;Nays 0. Resolution No.08-12-19: Consider Reversal of Decision by an Administrative Official—Allowance of Motorcoach Commerce Facility in the C-2 Zoning District Mayor Fasbender explained that the per City Code 30.02,City Council acts as the Board of Adjustment and Appeals and the required number of votes to allow the appeal or affirm of the decision. Hinzman described the application for a motorcoach commerce facility in the C-2 Zoning District and the reason for denial. He also detailed the correspondence between the applicant and staff and the reason for the applicant's appeal to the decision. Amanda Johnson,representative of Summit Management which owns the property, provided a history of land ownership, correspondence with staff regarding land use options,surrounding businesses and the proposed motorcoach commerce facility. Jacob Steen, Larkin Hoffman Attorneys, discussed the length of stay of a motorcoach and listed why a motorcoach commerce facility should be allowed on the C-2 Zoning District. Council discussed length of stay and types of permitted vehicles, whether the zoning changed since the property was purchased in 2004, the definition of motorcoach, how the area would be patrolled and staffed,zoning of the mobile home park and campground in the City and that this does not compliment the Vermillion Street corridor vision. Councilmember Braucks motioned to uphold staff's recommendation of denial, seconded by Councilmember Balsanek. Ayes - Balsanek, Braucks, Leifeld, Lund, Vaughan and Fasbender; Nays - Folch. Closed Door Session pursuant to Minnesota Statute Section 13D.05,subdivision 2(b) for Preliminary consideration by the City Council of Allegations or Charges Against an Individual Subject to its Authority. Councilmember Braucks motioned to adjourn the regular meeting at 8:52 p.m. to a closed-door session, seconded by Councilmember Folch. Ayes 7; Nays 0. Mayor Fasbender and Councilmembers made the following announcements • Planning Committee of the Council will meet on Tuesday,August 201h at 7:30 a.m. at City Hall. • Heritage Preservation Commission will meet on Tuesday, August 20d'at 7:00 p.m. at City Hall. • Closing day for the Hastings Aquatic Center is Sunday, August 25'h. • Planning Commission will meet on Monday, August 26`h at 7:00 p.m. at City Hall. • All City offices will be closed on September 2"d in observation of Labor Day. • City Council Workshop -Dakota County CDA on September 3rd at 6:00 p.m. at City Hall.
