HomeMy WebLinkAbout20190805 - CC MInutes Hastings, Minnesota City Council Minutes August 5,2019 The City Council of the City of Hastings, Minnesota met in a regular meeting on Monday, August 2, 2019, at 7:00 p.m. in the Council Chambers at the Hastings City Hall, 101 East 4`h Street, Hastings, Minnesota. Members Present: Mayor Fasbender, Councilmembers Balsanek, Braucks, Folch, Leifeld, Lund and Vaughan Staff Present: Interim City Administrator Julie Flaten City Attorney Dan Fluegel Community Development Director John Hinzman Presentation—Tennis Sanitation Stacy from Tennis Sanitation presented a check to representatives from the Hastings All Night Grad Party in the amount of$450.15 and provided a check to the City in the amount of$110.79. Approval of Minutes Mayor Fasbender asked if there were any additions or corrections to the minutes of the Regular City Council meeting on July 15, 2019 and workshops on July 15, 2019 and July 27, 2019. Minutes were approved as presented. Consent Agenda 1. Pay Bills as Audited 2. Resolution No. 08-01-19:Approve a Massage Therapy License for Elizabeth Olsen 3. Approve Special Event Request for TLC Hastings 4. Approve ISD 200 Ice Rental Agreement 2019-2020 5. Approve 2019-2020 IAFF Local 5113 Firefighters Contract Councilmember Folch motioned to approve as presented, seconded by Councilmember Braucks. Ayes 7;Nays 0. Resolution No. 08-02-19: Deny Special Use Permit—1St Floor Residential Use—Jupiter Peak Lodging(213 Sibley Street) Hinzman discussed the special use permit request to add an additional first floor apartment at 213 Sibley Street and why it should be denied. He indicated that the Planning Commission unanimously voted to deny the request. Council discussed the rationale for denial, the previous 2016 Special Use Permit approval for the apartment on the first floor, second floor building use,the lack of well-defined separation between commercial and residential uses, clarification on ordinance language,available windows in units, history of the ordinance not allowing first floor residential use, possible intended use of the unit and definition of "rear of building". Councilmember Vaughan motioned to approve the denial as presented, seconded by Councilmember Bracks. Ayes Balsanek, Braucks, Leifeld, Lund, Vaughan and Fasbender;Nays Folch. Motion passed. Councilmember Lund motioned to approve as presented, seconded by Councilmember Leifeld Ayes 7;Nays 0. Mayor Fasbender and Councilmembers made the following announcements • National Night Out is Tuesday,August 6h. Community Party to be held at Lions Park beginning at 5:30 p.m. • City Council Workshop to discuss the 2020 Budget on Monday, August 12"'at 5:30 p.m. at City Hall. • Planning Commission meeting on Monday, August 12`h at 7:00 p.m. at City Hall. • Parks&Recreation Commission meeting Tuesday, August 13`h at 7:00 p.m. at City Hall. • City Council Workshop to discuss the 2020 Budget on Monday, August 19'h at 5:00 p.m. at City Hall • Councilmember Balsanek will attend the DCC Executive Board Meeting on Thursday, August 15'h. Councilmember Vaughan motioned to adjourn the regular meeting to hold a closed-door session as authorized under the attorney-client privilege pursuant to Minn. Stat. §13D.05,subd. 3(b),to discuss the pending litigation of Robert S. Kleis v. City of Hastings, a Minnesota municipal corporation, venued in Dakota County District Court at 7:46 p.m., seconded by Councilmember Balsanek. Ayes 7;Nays 0. The closed-door session convened at 7:54 p.m. Mayor Fasbender re-opened the regular meeting at 8:47 p.m. Councilmember Vaughan motioned to approve the settlement agreement on the Kleis Special Assessment Appeal litigation that will allow for a reduction of the assessment for the Kleis parcel of $1,171.00 and to authorize the City attorney to carry out that settlement, seconded by Councilmember Folch.
