Call Meeting to Order Planning Commissioners Present: Alpaugh, Barse, Marin, Messina and Siebenaler Planning Commissioners Absent: Johnson and Best Staff Present: Community Development Director John Hinzman 2. Approval of Minutes Commissioner Barse moved to approve the minutes as amended, seconded by Commissioner Siebenaler. Ayes 5; Nays 0. Motion approved. PUBLIC HEARINGS 3. City of Hastings – Ordinance Amendment #2019-20 – Climate Controlled Storage in the C-4 Zoning District. Hinzman defined climate controlled storage and discussed the proposed ordinance amendment. Commissioner Alpaugh opened the public hearing. William “Skip” Melin, 6111 Olinger Blvd, Edina, works for Cushman & Wakefield, and represents the owner of County Crossroads Ed Rymer indicated his support for the amendment. Hearing no further comments, Commissioner Alpaugh closed the public hearing. Commissioner Siebenaler asked for clarification of the C-4 Zoning Districts in the City. Hinzman described the C-4 Zoning Districts. Commissioner Siebenaler and Hinzman discussed the reason for the ordinance amendment rather than issuance of a special use permit, public notification process, other areas within the City the ordinance amendment may affect and the proposed changes to the ordinance. Commissioner Barse reiterated that a special use permit may be issued. Hinzman responded yes, and explained why. They discussed site plan reviewal and the differences between special use permits and conditional use permits. Commissioner Siebenaler stated her concern for the current business in the C-4 Zoning Districts if the amendment were to pass. Commissioner Barse and Melin discussed restrictive use covenants of the property and how the building would be used. Commissioner Siebenaler, Melin and Hinzman discussed the various plans submitted for a climate controlled storage building. Commissioner Barse and Hinzman discussed other cities with climate controlled storage. Commissioner Barse detailed his opinion of the proposed amendment changes. Commissioner Barse and Melin discussed the operation of the proposed climate controlled storage building and the lack of this type of storage in Hastings. Commissioner Martin explained why he thought that the ordinance amendment may be too aggressive. Melin responded to his concerns. Commissioner Messina asked how the definition of a climate controlled facility would prevent businesses from using the proposed climate controlled storage facility. Melin indicated that the definition could be changed, that the market could dictate where businesses could rent storage facilities and there is a cold storage facility across the street from the proposed climate controlled facility which businesses may use. Commissioner Alpaugh inquired if staff supported the amendment change. Hinzman responded yes and detailed how he reached that conclusion. Commissioner Alpaugh expressed his concerns about potential future implications the ordinance amendment may have to the C-4 Zoning District. Commissioner Siebenaler detailed why she was not in favor of the ordinance amendment. Commissioner Barse asked about height restrictions and recommends allowing the use through a special use permit. Hinzman described how special use permits work. Commissioner Siebenaler moved to deny the proposed amendment to the Hastings City Code Chapter 155.32 Zoning allowing climate controlled storage uses within the C-4 Zoning District, seconded by Commissioner Barse. Commissioner Barse and Hinzman discussed the process of allowing climate controlled storage facilities through a special use permit. Commissioner Siebenaler and Hinzman discussed only allowing climate controlled storage facilities versus other types of storage facilities; that the definition was too specific rather than being broadly defined. Hinzman added that the amendment to the ordinance was prompted by the application proposing a climate controlled storage facility in a C-4 Zoning District. Regarding the specificity of defining a climate controlled storage facility, other storage facilities do not have utilities; therefore, those buildings would have to be destroyed for any future redevelopment whereas climate controlled storage facilities can be repurposed. Commissioner Alpaugh reiterated the differences between climate controlled storage facilities and other storage facilities. Commissioner Messina and Melin discussed potential future use of the various proposed buildings. Commissioner Messina asked about the other C-4 Zoning Districts in Hastings. Hinzman described the two other C-4 Zoning Districts and the lack of notification to the residents across from the discussed C-4 Zoning District. Commissioner Alpaugh commented that residents living across from commercial districts should assume that there will be future development. Commissioner Barse rescended his second to Commissioner Siebenaler’s motion. Commissioner Alpaugh asked if another Commissioner would second the motion, seeing none, the motion fails. Commissioner Martin moved to amend City ordinance Chapter 155.32 to allow climate controlled storage facilities as a special permitted use in C-4 Zoning Districts, seconded by Commissioner Barse. Ayes 5; Nays 0. Motion approved. The Commissioners and Hinzman discussed the process to amend the ordinance to allow climate controlled storage facilities as a special permitted use and the approval process of special use permit applications. The City Council will consider the 1st reading and order a public hearing at the August 19, 2019 meeting. OTHER ACTIONS 4. Other Business Hinzman updated the Commissioners of:  City Council denied the special use permit application for a first floor apartment at 213 Sibley Street;  The access agreements between Walgreens and the property to the south; and  The Confluence Development, the former Hudson Facility. 5. Adjourn Commissioner Barse motioned to adjourn at 8:15 p.m., seconded by Commissioner Siebenaler. Ayes 5; Nays 0. Motion approved.
