Call Meeting to Order Planning Commissioners Present: Alpaugh, Barse, Best, Johnson, Messina and Siebenaler Planning Commissioners Absent: Martin Staff Present: City Planner Fortney 2. Approval of Minutes Commissioner Messina moved to approve the minutes as amended, seconded by Commissioner Johnson. Motion approved 6-0. PUBLIC HEARINGS 3. Jupiter Peak Lodging – Special Use Permit #2019-17 – Residential Use of the 1st Floor – 213 Sibley Street. Fortney discussed the special use permit request for 213 Sibley Street. The public hearing was opened and closed with no comments. Commissioner Barse and Fortney discussed the location of the proposed residential area on the 1st floor, the occupancy rate of the office spaces and the notification process which did not include the commercial tenants of the building. Commissioner Siebenaler and Fortney speculated as to why that unit was proposed for residential use instead of other spaces. Commissioner Alpaugh asked about the percentage of residential units, including the proposed unit. Fortney was unsure of the percentage; stating that the drawings were not to scale. Commissioner Barse asked Fortney’s opinion. Fortney stated that the request does not meet all of the requirements specified in the zoning ordinance. Commissioner Johnson inquired about the number of residential units on the second floor. Fortney responded that he was unsure, but it appears to be around 12 according to the submitted floor plan drawing of the first floor. Commissioners Barse and Johnson stated their reasons for denial. Commissioner Johnson and Fortney discussed building requirements for mixed-use buildings. Commissioner Johnson moved to deny the application based on the following findings of fact, seconded by Commissioner Barse. Motion to deny 6-0. - The request does not meet most of the requirements of the ordinance, including: o having a separate outside entrance o No information provided showing how this residential use is accessory to a commercial use. o It is not located in the rear of the building, even though the proposed unit appears to be in the back half of the lot, o From the applicant’s sketch, it appears there is at least one commercial office between the proposed and existing residential units, which would create a peculiar situation and not in line with the intent of the ordinance. City Council will consider final action of this item at the August 5, 2019 City Council meeting. OTHER ACTIONS 4. Other Business Fortney updated the Commissioners of recent City Council and Planning Committee actions. 5.
