ADJOURNMENT Next Regular City Council Meeting: Monday, June 01, 1998 Hastings, Minnesota May 4, 1998 The City Council of the City of Hastings, Minnesota met in a regular meeting on Monday, May 4, 1998 at 7:00 p.m. in the City Hall Council Chambers, 101 Fourth Street East, Hastings, Minnesota. Consent Agenda Moved by Councilmember Yandrasits, seconded by Councilmember Riveness, to remove Consent Item No.5-Schedule Special Council Meeting for June 29, 1998 to discuss the Comprehensive Plan, place it as City Administrator Item No.3, and approve the consent agenda as amended. 1. Award Contract - Resolution No. 5-3-98, 1998 Improvement Program City Administrator Dave Osberg introduced this item noting the low bidder was Richard Knutson, Inc., with a bid approximately 10% below the estimated construction costs. Moved by Councilmember Moratzka, seconded by Councilmember Johnson, to approve Resolution No. 5-3-98, a resolution receiving bids and awarding contract for the 1998 Street & Utility Improvement Program. 7 Ayes; Nays, None. Copy of resolution on file. Sunset West Addition Final Plat Moved by Councilmember Yandrasits, seconded by Councilmember Riveness, to approve the final plat subject to the following conditions: 1. The final plat hard shells must be consistent with the approved final plat. 2. The developer shall pay $11,020 interceptor sewer charges prior to the City signing any final plat. 3. The developer shall pay $850 per unit at the time of build permit issuance, in order to meet park land dedication requirements. 4. The developer shall plant one "boulevard" tree and one front yard tree per lot. These trees shall be at least 2 inches in diameter at the base and the species of the tree should be on the list of approved trees created by the City Forester. This requirement is consistent with what the City has been requiring in other areas. An escrow is required for any unplanted trees before occupancy of any units without trees is allowed. 7 Ayes; Nays, None. Hastings City Council Minutes for Meetin: of May 4. 1998 Page 3 of4 Site Plan - Industrial Court - Tom Otto Moved by Councilmember Simacek, seconded by Councilmember Hicks, to approve a site plan from Otto Excavating for construction of a 3,250 square foot building and related site improvements at 2621 Industrial Court subject to the following conditions: 1. The proposed structure and accessory items including, but not limited to, the parking lot and landscaping shall be completed pursuant to the approved site plan. Upon request for occupancy of the building, all uncompleted items contained within the site plan shall be addressed pursuant to City Code escrow requirements. 2. Approval by Community Development Director of species and size of trees and shrubs proposed on the site landscape plan. 3. That the applicant be required to observe special caution and maintaining proper soil erosion and sediment control measures to avoid erosion to avoid erosion of the steep slopes on the northeast portion of the site. 7 Ayes; Nays, None. Amendment to Riverwood Planned Residential Development Plan Moved by Councilmember Johnson, seconded by Councilmember Yandrasits, to remove the item tabled at the March 30, 1998 Special City Council meeting for discussion of the Riverwood Planned Residential Development Plan. 7 Ayes; Nays, None. Councilmember Moratzka stated based on density changes from the original agreement in 1989, she supported further review on the park land dedication requirements with the Planning Commission or Natural Resources Commission. Councilmember Hicks and Yandrasits supported further land dedication requirements to be discussed at an appropriate committee. The applicant explained that the original 34% park dedication requirement was derived from in 1989. Moved by Councilmember Johnson, seconded by Councilmember Hicks, to table Items 3, 4 & 5 under the Community Development Director related to the Riverwood Planned Residential Development until City Attorney Shawn Moynihan could provide analysis on the 1989 Council action, noting what changes could still be made, and then direct Staff if appropriate, to refer the item to an appropriate committee, or for Council action at the May 18, 1998. 7 Ayes; Nays, None. Swimming Pool Financial Issues Mayor Werner described the request to propose a specific dollar amount of the State Grant to reduce bond indebtedness for the pool project. Councilmember Riveness, Moratzka and Hicks expressed support to reduce bonded indebtedness, but stated it was difficult to determine the specific dollar reduction until the City had received the swimming pool bids. Moved by Mayor Werner, seconded by Councilmember Simacek to buy down a minimum of $200,000 of the $500,000 Minnesota State Grant to reduce bonded indebtedness for the pool project. Councilmember Hicks offered a friendly amendment to change the wording of $200,000 to a "significant amount." Council vote on a motion to buy down a minimum of $200,000 of the $500,000 Minnesota State Grant to reduce bond indebtedness for the pool project. 3 Ayes; Nays, Councilmember Riveness, Yandrasits, Moratzka & Hicks. Motion fails due to lack of support. Hastings City Council Minutes for Meetin~ of May 4. 1998 Pa~e 4 of 4 Resolution No. 5-4-98 Mail Balloting for Washington County Registered Voters Administrative Assistant/City Clerk Joyce Hottinger explained the request noting a special mail balloting procedure would only be implemented if there is a minimum of 45 days prior to the Washington County Special Election in order to meet posting and state statute requirements. Moved by Councilmember Riveness, seconded by Councilmember Johnson, to approve Resolution No. 5-4-98, a resolution designating mail balloting for a Special Washington County Election to fill a Commissioner vacancy. 7 Ayes; Nays, None. Copy of resolution on file. Appeal ofHPC Action Denying Building Permit for Residing 314 2ad Street West HRA Director John Grossman introduced the item. Property owners of 314 2nd Street West, Angela Wilcox and Joe Melson, explained their request to reside the home with vinyl siding to limit potential contact with lead paint and to provide better insulation. Moved by Councilmember Simacek, seconded by Councilmember Yandrasits, to confirm the HPC action on the grounds that residing with vinyl is not consistent with the objectives of the preservation ordinance and designation of historic districts; that this case does not involve financial hardship nor deprive the owner of reasonable use; that residing is not the only acceptable control of lead paint and direct Staff to register historic homes along with the historic district rules, with property deeds. Moved by Mayor Werner, seconded by Councilmember Riveness, to table action on this item until May 18, 1998, to allow time for the applicants to test the home's paint for lead content, and if present, to provide bids for Council review on the cost of a contractor to remove the lead based paint compared to the cost of siding the home. 6 Ayes; Nays, None. BACKGROUND City Councilmembers will find attached a copy of a letter from Dakota County Housing and Redevelopment Authority Executive Director Mark Ulfers regarding the Community Development Block Grant Program. As you will note from the letter, the County HRA is beginning the process of continuing the qualification of the County as a participant in the Entitlement Community Development Block Grant Program for the next several years. Hastings participates in the Community Development Block Grant Program, and we will need to renew the Cooperative Agreement with Dakota County. As you will note, should the City not want to be included in the program, the City must provide written correspondence by June 5, 1998. BACKGROUND Based on direction previously provided by the City Council, Staff provided to the Union the enclosed letter dated April 30, 1998 regarding settlement of the agreement. On Monday, May 4, 1998 the Union voted to accept the agreement. I have enclosed in the packet a copy of the proposed agreement for review by the City Council. Please note that this will be reviewed further by City Staff for proper calculation of the wage amounts and confirmation of the appropriate language. However, I thought the City Council would find it advantageous to have this document in front them as they perhaps have not seen the Labor Agreement for quite some time. I draw your attention to the cover letter to Mr. Hansen which explains the City's proposal in which the Union agreed. Osberg City Administrator Attachment cl VI-7 MEMORANDUM DATE: May 14, 1998 TO: Honorable Mayor and City Councilmembers FROM: Dave Osberg, City Administrator SUBJECT: Authorize Execution of Satisfaction of Mortgage for Barker House RECOMMENDED CITY COUNCIL ACTION It is recommended the City Council take action authorizing the Mayor and City Clerk to execute the enclosed satisfaction of mortgage for the Barker House. BACKGROUND In April of 1997 the City took action approving the enclosed Agreement that allowed for the transfer of the Barker House to Mr. Dan Reuter. The proposal submitted by Mr. Reuter in 1997 suggested a purchase price in the amount of $4,500. With the agreement, the purchase price of $4,500 was secured by a mortgage, pending certain improvements to the Barker House, and if completed in a timely manner, the mortgage would be "eliminated." The basic elements of the agreement included the City transferring the property to Mr. Reuter for $4,500. The payment of $4,500 would not have to be paid at first, but instead the City held the mortgage for that amount. After completion of one year, improvements needed to be completed on the Barker House. The property has been inspected by the City, and the improvements, as outlined on the attached agreement have been completed to the satisfactory approval of the City. Attachment cl '" AGREEMENT THIS AGREEMENT, is made this day of April, 1997, between the City of Hastings, a Minnesota municipal corporation, ("City") and Daniel Reuter and Lorie Reuter, husband and wife, ("Reuters"). WHEREAS, the City has sold to Reuters, real estate legally described as Lot 3, Block 14, Barker's Addition to the town of Hastings, for $4,500, with the City receiving a mortgage for the entire purchase price; and WHEREAS, as a condition of this sale, Reuters have agreed to complete certain repairs to the structure on the real property; and WHEREAS, the City has agreed that if certain repairs are completed by Reuters within a specified period of time, the City would forgive the mortgage principal balance, plus accrued interest. NOW, THEREFORE, IT IS AGREED AS FOLLOWS: 1. If, by May 1, 1998, Reuters have completed all work on attached Exhibit A, to the City's satisfaction, the City will forgive all unpaid principal and accrued interest which has accrued to May 1, 1998. 2. If all repairs described on attached Exhibit A, have not been completed to the City's satisfaction prior to May 1, 1998, then the entire principal balance, plus accrued interest is due and payable by Reuters on May 1, 1998, all pursuant to the terms of the mortgage and promissory note dated , 1997. Repoint (tuckpoint) joints as necessary to bring mortar almost flush with the surface of the stone, in particular the southwesterly corner of the structure which needs immediate and complete repointing to prevent further mortar erosion and wall failure. The mortar is to be composed of local sand, type S hydrated lime and no more than 20% Portland cement, mixed in proportion: 4 parts lime, 1 part cement and 10 parts sand. Old mortar must be removed as necessary to provide clean and deep pockets for the new mortar, which should be slightly indented from the surface of the stone. 2. Repair or replace windows on north side of the building. Replacements are to look like the windows in the enclosed photographs. If possible, keep and repair the existing front door, or if not,-replace it with a door as close as possible to the appearance of the existing door. Additional material to strengthen the door can be applied on the inside surface. Replacement windows and doors are to be approved by the City before installation. Paint windows and doors. 3. Replace damaged and deteriorated portions of the roof structure, rafters and fascias. Reshingle, using shingles of similar type and appearance as existing. 4. Inspect and repair existing chimney, as necessary. The chimney now rests on the second floor. Previously the City provided applicants with a certified copy of Council Meeting Minutes for the meeting at which the plat was approved. The County Recorder has indicated that they now require a Resolution of the City Council. City Council approved the Wallin 6th Addition Final Plat at its March 3, 1997, meeting. Attached with this memo is a Resolution which documents that approval in order to satisfy recording requirements for the plat. Request Action: Approval ofa Resolution which recognizes that the City Council approved the VVallin 6th Addition Final Plat on march 3, 1997. HASTINGS CITY COUNCIL RESOLUTION NO. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HASTINGS APPROVING THE WALLIN 61H ADDITON FINAL PLAT WHEREAS, the Wallin Partnership requested approval of the Wallin 6th Addition Final Plat which proposed a subdivision of property to include thirty-six Twin-Home Residential Units and two Single Family Detached Residential Units. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL AS FOLLOWS: The Wallin 6th Addition Final Plat is hereby approved subject to the following conditions: 1. Plat approval shall be contingent upon approval of a Comprehensive Plan Amendment to include the subject property in the MUSA and to reclassity the property to U-l Urban Residential. 2. Plat approval shall be contingent upon rezoning of the property to R-3 PRD. 3. The final plat hard shells must be consistent with the approved plat. 4. The Developer shall pay an interceptor sewer fee of$II,115.00 ($285.00/unit). If the per unit fee is adjusted by the City prior to payment, the Developer shall be required to pay the rate being used at the time the fee is paid. 5. The hard shells of the final plat shall be modified as follows: o The twenty foot wide drainage and utility easement between Lots 16 & 17, Block 1, shall be expanded to thirty feet in width to accomodate both sanitary sewer and storm sewer mains. o The ten foot wide drainage and utility easement on the west property line of Lot 12, Block 2, must be expanded to 15 feet, and a 15 foot wide easement must be platted across the east boundary of Outlot B to accomodate required utility mains. o A drainage and utility easement over all of Outlot A must be identified on the plat. 6. Documentation shall be provided that the privately owned ponding area (Outlot A) shall be privately maintained by a development association and not the City. 7. Submission of a low maintenance landscape plan for the required Carleton Place Cul-de- sac Island to be approved by the Community Development Director prior to the release of the plat hard shells by the City. 8. Documentation shall be provided that the landscape of the Carleton Place Island shall be privately maintained under an association agreement. 9. The Developer shall plant one "boulevard" tree and one front yard tree per lot. BACKGROUND Included on the City Council agenda for the May 18, 1998 meeting is approval of the 4ger's Union Contract. As you will recall, Staff previously discussed with the City Council the possibility of exchanging Columbus Day as a paid holiday in the 4ger's Union Contract, in return for a second floating holiday. Since the 4ger's have approved the Labor Contract, and the City Council is asked to approve it under the consent agenda for this meeting, Staff is requesting that action be taken that allows for an exchange of Columbus Day as a paid holiday in return for an additional floating holiday. Floating holidays are used in the actual calendar year, with no provision for carrying over to another year. In addition, City employees are required to request use of a floating holiday in the same method that vacation or compensatory time off is requested. If approved, this will result in City Hall remaining open the Columbus Day holiday, which typically has been the second Monday in October. This change would be in effect in 1998, and employees would be allowed to use one additional floating holiday, but Columbus Day would no longer would be a holiday. .. David M. Second St. BACKGROUND: See attached Memo dated May 4. At the meeting of May 4, City Council tabled a motion to concur with the HPC and directed the owners, Angela Wilcox and Joe Melson, to return on May 18 with documentation oflead paint, and quotes for painting with appropriate precautions. The owners will provide a statement from Dakota County Environmental Management (attached) about lead paint and are trying to have quotes by the time of the meeting. The HPC visited the property on May 13, 1998 and considered the proposed residing a second time. HPC POSITION: The HPC observed the condition of the existing siding but did not find that the condition was so bad that residing was the only alternative. The HPC understands that a FHA mortgage inspector required funds be escrowed for scraping and painting. The HPC considers scraping and painting with health precautions, and replacement of some siding, the approach most consistent with the preservation ordinance. The choice of residing to avoid scraping, replacing decayed pieces, priming and painting conceals problems that do not go away and cannot be monitored. "This Old House" and National Park Service preservation technicians have warned that impermeable siding or insulation applied on the outside of houses seals moisture inside the wall, which may result in rot and mold. Property owners in a historic district may have an issue if the City does not enforce the provisions of the preservation ordinance. Several owners in the West Second District have gone to the trouble and expense of maintaining the original materials and design of their property by scraping and painting, and even removing asbestos siding to reveal the original clapboards. PRESERVATION ORDINANCE CRITERIA: The HPC finds that the proposed alteration will "adversely impair the significance or character of the Heritage Preservation Site" in that the historic character of a site is largely established by the building's style and materials which will be concealed by residing. The HPC used criteria established by the Secretary ofInterior's Standards: "The Historic character of a property shall be retained and preserved. The removal of historic materials or alteration of features and spaces that characterize a property shall be avoided. " The HPC used guidelines for historic districts: "Buildings originally clad in wooden siding should not be resurfaced with brick.. .or vinyl or aluminum siding. " CONCERNING LEAD-BASED PAINT This is not an isolated case. The paint on all wooden houses built before the late 1970s and certainly all historic buildings should be treated as if it contains lead. The assumed presence of lead-based paint does not automatically require remediation. The State Department of Health recommends procedures to safely scrape and paint in order to control lead-based paint. Residential owners are not required to test, but if blood tests show elevated lead levels in children, or tests prove lead-based paint, remediation is then required. Remediation rules apply equally to residing and repainting and raises the costs for both. Remediation means hiring licensed contractors and trained employees to remove all flaking paint and dispose of the flakes as hazardous material before siding or painting. From a preservation point of view the assumption or evidence of lead-based paint does not justify residing historic houses as long as safe procedures exist for repainting. CONCERNING NOTIFICATION: In March of this year the owners of property in all three historic districts were advised of the building permit review process and design guidelines were provided. The former owner forwarded this mailing on to the current owners. The HPC will start immediately to establish a method for recording designation on the title of all historic properties. RECOMMENDATION The HPC asks that City Council confirm the denial on the grounds that residing with vinyl is not consistent with the objectives of the preservation ordinance and designation of historic districts; that this case does not involve financial hardship nor deprive the owner of reasonable use; and that residing is not the sole control of lead paint acceptable to the Health Department. May 4, 1998 TO: The Honorable Mayor and Council FR: John Grossman for the HPC RE: Appeal ofHPC action denying building permit for residing 314 Second Street West SUMMARY: 314 Second st. W. is a Heritage Preservation Site under section 2.18 of the City Code, subject to building permit approval for work that would change its exterior appearance. The design of the work must be approved by the Heritage Preservation Commission (HPC) before a building permit can be issued. The owners, Angela Wilcox and Joe Melson, applied to the HPC for approval to reside the house with vinyl. The HPC denied the request on the grounds listed below. The HPC advised the owners that they could appeal the denial to the City Council and they wish to do so. The City Council may concur with the HPC decision or overrule the HPC by taking action to direct that a building permit can be issued for residing the house. BACKGROUND: 314 Second St. W. is located in the West Second Residential Historic District, placed on the National Register in 1977 and the list of Hastings Heritage Preservation sites in 1985. It contributes to the historic character of the district because it was built in 1880 and the existing siding, corner posts, frieze boards, fascia and soffit appear to date from that period. (See photographs) A picture window on the rear has been added. There may have been repair and remodeling over the years, but the house retains much of the original design, materials and appearance of its period. OWNER'S PROPOSAL: To cover the exterior walls with vinyl siding for the following reasons: (1) avoid future painting at regular intervals (2) limit potential contact with lead paint (3) add insulation under the siding to reduce energy use. The approximate cost of siding will be $9,000. The owners have chosen to use 3" lap siding which does not duplicate the existing 4.5" lap (width) of the siding and to cover up the frieze board (beneath the soffit) because its duplication would cost an additional $900. The owners were aware they were purchasing an historic property and asked for the guidelines after the purchase. HPC FINDINGS: The HPC was guided by the criteria (Subd 6.E.) in the ordinance and the guidelines (see attached) for residential districts in reviewing the proposed alterations to an existing building. (1) Covering the original siding does "adversely impair the character of the site" which the ordinance is meant to prevent. Residing would be extremely unfortunate because the building has survived to the present day with very little alteration, and residing is not the only option. (2) The guidelines specifY that "buildings originally clad in wooden siding should not be resurfaced with ... vinyl siding." This case does not qualify for the exceptions: built after 1940 or a garage. (3) There is no clear case of "economic hardship or deprivation of reasonable use of the owners property" because the owners are willing to spend more on residing than a high quality job of repainting would cost ($9,000 compared to $4,500 at the most); the type of siding does not change the use of the house. ADDITIONAL INFORMATION: Property owners wanted to preclude a possible contact with lead paint are not limited to residing. While residing is considered an effective control, the EP A recognizes that repainting is a reasonable alternative. The difference between siding and painting therefore remains the same: painted surfaces have to be maintained at intervals, the length of which depends on the quality of the job. The State Department of Health provides guidelines (attached) for owners wishing to scrape and repaint their homes built before 1978. Another owner ofa historic property (303 E. 5th Street) recently completed scraping and painting under Dakota County Environmental Services direction. The house was powerwashed, scraped as needed, primed and painted. If contractors are hired to do the work, they must be certified and dispose ofthe flakes as directed by the MPCA If the owners do the work they may dispose of the flakes as trash or household hazardous waste. Appropriate remediation is required only in cases of documented elevated levels of lead in the blood or when an owner has documented lead paint and wishes to remove it. RECOMMENDATION: Confirm the HPC action on the grounds that residing with vinyl is not consistent with the objectives of the preservation ordinance and designation of historic districts; that this case does not involve financial hardship nor deprive the owner of reasonable use; and that residing is not the only acceptable control of lead paint. Planning Committee met and recommended a compromise to rezone and re-guide the property to Office. This zoning will provide a buffer and transition between HWY 55 and the residential properties behind it. The memo pertaining to the original re-zoning request is enclosed with this memo. -- 1. Comprehensive Plan Amendment: The property is currently guided U-III Urban Residential. The request is to reguide the property to 0 Office. 2. Zoning: The subject property is currently zoned R-4 (Medium Density Residential). The applicant has requested rezoning of the property to 0-1 (General Office). Final approval of rezoning of the property will need to be withheld until the proposed Comprehensive Plan Amendment has been approved by the City and has cleared review by the Metropolitan Council. 3. This property would also act as a buffer between Hwy. 55 and the residential properties behind it. However, a consideration should be that this property and the property surrounding it are the last pieces of property zoned for high density housing in the City. The City of Hastings has three Comprehensive Plan Classifications used to plan undeveloped property for urban (sewered) housing. o Urban Residential I: This classification is intended primarily for single family and limited multifamily dwellings with an average density of tow to three units per acre. Planned residential and cluster developments may be required in order to promote sound environmental and economic development which minimize public investment now in the future. The City currently has @355 acres guided U-l. If developed at an average of 2.5 units/acre, 887 housing units could be constructed. o Urban Residential II: This classification is intended for a mix of residential uses at a density of three to eight units per acre. Planned residential and cluster developments may be required so as to promote more energy efficeient housing that will require fewer service lines and roadways, thus, reducing taxes for residentis and reducing cost tothe City to serve such areas. This classification recognizes manufactured housing as an acceptable use. The City currently has @285 acres of vacant property guided U-ll. If developed at an average density of 6 units/acre, 1710 housing units could be constructed. Much of the U-II property is currently in the process of being developed. The only project currently underway with a higher density componenet is Riverwood. The overall plan for this project call for a mix of single family detached, townhomes and apartments at @5.8 units/acre. 270 apartments are proposed as part of development of the remaining 90 acres of Riverwood. Planning Commission Page 3 February 19, 1998 o Urban Residential III: This classification will allow eight or more units per acre. This higher density designation shall be used in areas which are adjacent to or in close proxity to high traffic corridors, places of employment, shopping and/or community facilities. This designation may also serve as a transition district between low density residential and business areas. The City currently has only @15 acres guided V-III (property bounded by Bahls Drive, Lynn Way and the South Frontage Road). If developed at an average density of 10 units/acre, 150 housing units could be constructed on this property. At the meeting staff will present the current Comprehensive Plan Land Use Map and a vacant land inventory map to further illustrate the pattern of housing development occurring in Hastings. Also, relevant to this issue is the City's pledge to meet affordable and life-cycle housing goals related to the Metropolitan Livable Communities Act and the goal of the Metropolitan Regional Blueprint to increase housing densities within the existing urbanized areas in the region. Staffwill present background information regarding these issues at the meeting. V111-B-4 MEMORANDUM TO: Mayor and City Council FROM: Matt Weiland, Zoning Administrator DATE: 5/1398 SUBJECT: Special Use Permit- Renewal of Soil Processing Permit (Holst Excavating- 1998) Enclosed is an application from Holst Excavating requesting the City to renew their soil processing permit for 1998. Soil processing operations are required to renew their permits annually. A brief review of the Holst Excavating Company operation and recommendations are as follows: Holst Excavating's operation is located in east Hastings along Glendale Road south of the intersection of CSAH 54 and Glendale Road. The original permit for this site was issued to Donald Kluender in 1978. In 1983 the permit was transferred to Holst Excavating, INC. Holst's current permit allows them to operate from 7:00 am to 5:00 pm, Monday through Saturday. Normal truck routes moving to and from the operation are County State Aid 54 or County Road 91. The site was originally used to excavate sand. The site currently being used to wash crushed limestone to capture sand. A series of ponds of been constructed on the site for this purpose. It is a closed system. The applicant will be completing the restoration of the site this summer. They may excavate about 5000 more yards of sand as part of the restoration process. Cover has been established on the upper steep slopes of the site. Background Information: 1. Zoning: A Agriculture. Sand extraction is allowed as a Special Use in both the Agriculture District. 2. Existing: Conditions: The site is currently being used to wash crushed limestone to capture sand Planning Commission recommended approval of this special use permit at their 5/11/98 Planning Commission Meeting. Action Requested: A motion to approve the soil processing permit from May,1998 to December 31, 1998, subject to the following conditions: Holst Excavating is permitted to operate a soil processing operation on land described pursuant to the most recent information submitted and provided during the original application in 1983.. The conditions stipulated during the original special use permit issuance in 1987 are still in effect and the following: 1. The site is to be restored, upon completion of the mining operation, pursuant to the plans provided to the city during the original application in 1983. The site is being restored this summer. 2. Operating hours are not to be in excess of 7:00 am to 5:00 pm Monday through Saturday except holidays. In addition, Holst Excavating shall refrain from at all times from using CSAH 54 and HWY 91 for hauling purposes between the hours of 5 :00 pm and 7 :00 am. In cases of emergency Holst Excavating may operated during hours other than those noted upon approval by the City Administrator. 3. Holst excavating shall refrain from using West 10th St between Hwy 61 and Hwy 55 for the purpose of hauling. 4. Holst Excavating shall provide to the city within 10 days after the City Council approval of the permit, and before work begins an irrevocable bond or other form of security acceptable to the city in the amount of the estimated cost of restoring the site covered by the soil pursuant to City Code. This bond amount has been $75,000 in the past. 5. Holst Excavating shall provide to the City a Liability insurance policy or certificate of insurance from an insurance company authorized to write casualty insurance in the State of Minnesota as will protect the applicant, its agents and the city from claims for bodily injury, death or property damage which may arise from operations under the soil processing permit. The amounts of the insurance shall not be less than that which is required by the City Code. 7. Vegetative Cover as required by the City of Hastings Storm Water Management Ordinance shall be restored on the steeply sloped portions of the site, identified on the mining plans as tier 1,2,3, and 4. Appropriate erosion control measures as determined by the Public Works Director shall be undertaken to ensure establishment of vegetative over on steeply sloped portions of the site where mining is complete according to the approved plan. 8. Community Development Director Subject: Resolution to Establish License Fees for Rental Residential Properties Date: May 13, 1998 The City Council approved at its December 15. 1997 meeting. an amendment to City Code Chapter 17 (Structure Maintenance Code for Rental Residential Properties) which establishes a requirement that all rental units be licensed. Council did not adopt a resolution to establish license fees based on questions about an appropriate fee amount for multi-unit buildings. This issue was referred to the Planning Committee of City Council. The Planning discussed this issue and directed staff to present two or three options to Council. Attached with this memo are three pages of survey information compiled by staff which reflect current rental license fees for Columbia Heights, Brooklyn Park, Fridley, Crystal. Brooklyn Center. and Cottage Grove. Attached with this memo are two "draft" resolutions. The first "draft.. resolution is the same resolution that was presented to Council at the December 15, 1997 meeting. Amendment to Riverwood Planned Residential Development Plan . Riverwood Special Use Permit - Grading and Residential Development in the General Flood Plain District. . Riverwood 7th Addition Preliminary Plat. Council directed the City Attorney to prepare an interpretation as to whether the 1989 Council action establishing park dedication requirements for the balance of the Riverwood Property is binding based on the current development plans for the property. At the May 4, meeting, Council members questioned whether the park dedication requirements established by the Hastings City Council in 1989 (see attached copy of Council Minutes) was based on a development plan of comparable density to the current Riverwood PRD plan (5.7 units per acre). Staff research has indicated that the assumptions made regarding the amount ofland or cash in lieu ofland which should be required were based on a "Concept" Plan for 136.5 acres of the Riverwood Property which was prepared in 1988. This concept plan proposed construction of754 units on 136.5 acres at a development density of 5.52 units per acre. The current Riverwood PRD Plan proposes construction of 514 units on the remaining 90 acres of vacant property at a development density of 5.71 units per acre. However 103 units have been constructed within the other 46.5 acres addressed in the 1998 "Concept" Plan. This would yield an overall development density of 4.52 units per acre if the balance of vacant acreage is development according to the proposed Riverwood PRD Plan. This is one unit/acre less than the development density of5.52 units per acres which was used to determine park dedication requirements in 1989. Werner and City Council Members Hastings City Hall 101 East Fourth Street Hastings, MN 55033 RE: Riverwood Plats - Park Dedication Dear Mayor and City Council Members: As requested by the city council, I have been researching the history of the park dedication for the various Riverwood plats. I have not completed my research but I did want to inform the council of what I have learned so far. I will explain later in this letter what further work needs to be done. Backqround: The first Riverwood plat was approved in 1982. Prior to approving the plat, an environmental assessment worksheet was completed. As part of that worksheet, it was stated that the entire Riverwood project consisted of 140 acres. Within that 140 acres, it was expected there would be 507 manufactured housing units and 20 townhome units for a total of 527 total units. The Development Agreement prepared for the first Riverwood plat did not specifically callout the amount of pa=k dedication that would be given by the developer. Paragraph six of that Development Agreement merely states that the developer will give cash in lieu of land or land as required by the city ordinance. The plat of Riverwood shows two parks being dedicated. This park space totals L 07 acres. These two "parks" make up the drainage swale in that area. The next time a park dedication issue is raised is with respect to the Riverwood 4th Addition plat. This plat was approved by the city council in November, 1988. Under the park dedication requirements in effect at that time, the plat of Riverwood 4th Addition would generate a park dedication requirement of .75 acres. Concerns had been raised by citizens, as well as council members, that a large number of people were beginning to live in the . Also admitted to practice in Wisconsin .. Werner and City Council Members Page 2 May 8, 1998 Riverwood area but yet there was no park for the children. At the rate the area was being developed, enough land for a park would not be dedicated for many years. It appears the council wanted to have enough land dedicated at one time so that a park could be built then and not at some point in the future when enough land would be dedicated. The park dedication requirement was discussed in some detail at the April 17, 1989 city council meeting. At that time, approximately 110 acres remained to be platted in the Riverwood area. If all 110 acres were platted at one tillie, the l'ark dedication requirements in 1989 would require the dedication of an 11 acre parcel. The Riverwood 4th Addition plat would require only a .75 acre parcel to be dedicated. An agreement was made between the city and the developer whereby the developer would dedicate a sufficient size parcel of land to accommodate the construction of a park at that time and receive a credit to be applied against future park dedication requirements. Ci ty Planner Tom Harmening, calculated that based on the projected density for the remaining 110 acres, the 8 acre park dedication would satisfy 66% of the developers entire park dedication requirement for the remaining unplatted 110 acres. Since the developer was "advancing" to the city 7.25 acres in park dedication, the city agreed that for subsequent plats in the Riverwood area, the developer would pay only 34% of the park dedication requirement. This formula recognized that the developer, through the 8 acre park dedication, had already satisfied 66% of the park dedication requirement for the entire Riverwood area. To summarize at this point, in 1989 the city council made a decision to accept ar. 8 acre park from the developer. 7.25 acreE of this park were given by the developer prior to it legally being required to do so. In return, the developer was given a credit for future park dedication requirements for plats in the Riverwood area. Property Density in 1989: As I stated above, in 1989, the 8 acres represented 66% of the park dedication requirement for the remaining 110 acres of Riverwood, based upon the densities being proposed by the developer at that time. The question that remains is what density was being proposed in 1989 and how does that density compare to the present proposed density. If the present proposed density is greater than what was proposed in 1989, then the amount of park dedication , . Mayor Michael D. Werner and City Council Members Page 3 May 8, 1998 credit for those 8 acres should be lower than 66%. If the proposed density is the same now as it was in 1989, then the numbers should remain the same. Mike Wozniak and I are still in the process of trying to determine what was the proposed density in 1989 when Tom Harmening calculated that 8 acres satisfied 66% of the total park dedication requirement for the 110 acres. Opinion: Based on my review of the city files as well as watching the video tape of the April 17, 1989 council meeting and listening ~o the audio tape of the June 5, 1989 council meeting, I believe the city has made a binding agreement with the developer to give it credit for the "pre-payment" of park dedication fees in 1989 when it dedicated an 8 acre park. The city cannot now back out of that agreement. I believe, however, that the percentage of credit to be given to the developer for this "pre-payment" can be modified if the proposed density today is greater than the proposed density in 1989. The 66% credit was based on some assumed density. The developer can not increase the density and expect to receive the same percentage of credit for its pre-payment. If the developer has increased the density since 1989, then the amount of credit should be reduced. If the proposed density has remained the same, then the amount of credit should not be changed. I will continue to work with Mike Wozniak to try to determine what the proposed density was in 1989 that served as the basis for Tom Harmening's calculations. I was also asked to address what committee should address any prospective changes in the formula. I believe this should r=~~i~ with the Planning Committee of the council. The Planning Committee has been involved in the Riverwood project for some time. I believe it makes sense to have this group address this park dedication issue. Because of the increased amount of bike trails and bike traffic, as well as the need to address the random acts of vandalism occurring in some of our parks, we hope to focus attention to the parks and bike trails now going through our city. It is our goal and intention to hire two part-time seasonal employees similar to what other city departments do for the summer time season. Funds for this program would come from the funds in our budget for the CSO position. Andrew Pollard, our former CSO, resigned from his position as a CSO Officer to further his education. Rather than replace the one person daily CSO position we wish to use those funds to hire these two summertime seasonal positions to focus attention on the City parks and bike trail going through Hastings. The starting pay for this summertime seasonal job would be the same as other summertime seasonal jobs from other City departments, which is $6.95 per hour. These park trail patrol officers would also concentrate efforts in the downtown business area of Hastings to hopefully meet the needs of the Downtown Business Association. The downtown area has ongoing problems with ordinance violations of skateboards, roller blades or bikes being ridden on the sidewalks. The times the individuals would be scheduled to work would be the afternoon and evening hours. This program would also coexist with our regular bike patrol program in which our full-time regular officers are doing bike patrol in the parks and areas throughout Hastings as well as the park patrol program which the Police Auxiliary Unit is participating in. The goal of the park trail patrol program we wish to implement is that we'll be able to provide enough patrol in the parks, bike trails and downtown area to hopefully curtail the ongoing problem of vandalism and ordinance violations. We understand that these will probably never be eliminated completely, but with this new program hopefully a difference can be made. .. Thank you.
