ADJOURNMENT Next Regular City Council Meeting: Monday, May 4, 1998 Hastings, Minnesota April 6, 1998 The City Council of the City of Hastings, Minnesota met in a regular meeting on Monday, April 6, 1998 at 7:00 p.m. in the City Hall Council Chambers, 101 4th Street East, Hastings, Minnesota. Members Present: Councilmember Yandrasits, Riveness, Johnson, Simacek, Hicks, Moratzka and Mayor Werner Members Absent: None Staff Members Present: Dave Osberg, City Administrator; Tom Montgomery, Public Works Director; Lori Webster, Finance Director; Tracy Souder, Assistant Finance Director; Matt Weiland, Zoning Administrator; Joyce P. Hottinger, Administrative Assistant/City Clerk; and Shawn Moynihan, City Attorney Approval of Minutes Mayor Werner asked if there were any corrections or additions to the regular meeting of March 16, 1998 and the special meeting of March 30, 1998 and hearing none, approved the minutes as presented. Presentation-Certificate of Achievement for Excellence in Financial Reporting Ed Burrell, City of Roseville's Finance Director and Treasurer for the Minnesota Government Finance Offices Association, presented to the City Council a Certificate of Achievement for Excellence in Financial Reporting for the City's Comprehensive Annual Financial Report, for the year ended December 31, 1997. Public Hearing: Request to Vacate Part of Locust Street Right-of-Way Mayor Werner opened the Public Hearing on the request to vacate part of Locust Street right- of-way at 7:04 p.m. Zoning Administrator Matt Weiland introduced the item. Mayor Werner asked whether there were any public comments on the issue, and hearing none, closed the public hearing at 7:05 p.m. Resolution No. 4-5-98-Request to Vacate part of Locust Street Right-of-Way Moved by Councilmember Hicks, seconded by Councilmember Moratzka, to approve Resolution No. 4-5-98, a Resolution vacating the Locust Street right-of-way north of 3'd Street East between Lot 8, Block 5 and Lot 5, Block 6, Barker's Addition. 7 Ayes; Nays, None. Public Hearing-Request to Vacate Alley and Barker Street Right-of-Way Abutting Lot 2, Block 12, Barker's Addition Mayor Werner opened the Public Hearing on the request to vacate an alley and Barker Street right-of-way abutting Lot 2, Block 12, Barker's Addition at 7:06 p.m. Zoning Administrator Matt Weiland introduced the item and stated the applicant is requesting the vacation to create a buildable lot. Mike Nogle, on behalf of his sister Marlene, who resides at 1300 E. 3rd Street, stated he was opposed to the vacation, as the lot is buildable without the vacation. Clairece Frank, property owner adjacent to the proposed alley vacation, stated she was opposed to the vacation due to the proximity to her home. Jane Hoeschen, applicant, stated Lots 3, 4 & 5 owners are in favor of the vacation. Mayor Werner asked whether there was any additional public comment on the issue, and hearing none, closed the public hearing at 7:12 p.m. Public Works Director Tom Montgomery explained the location and necessity of a proposed 20 ft. drainage and utility easement on the right-of-way of the Barker Street vacation. Councilmember Yandrasits clarified the 20 ft. drainage and utility easement would only be located on the vacated land, and not on existing property owners lots. Moved by Councilmember Moratzka, seconded by Councilmember Simacek, to approve Resolution No. 4-6-98, a resolution vacating the unimproved Barker Street right-of-way located south of 3'd Street East between Lot 2, Block 12 and Lot 5, Block 11 Barker's Addition, and the unimproved alley located between Lot I, Block 12 and Lot 2, Block 12 of Barker's Addition; with the City retaining a 20 ft. drainage and utility easement down the middle of the center line of the alley. 6 Ayes; Nays, 1 (Johnson) Hastings City Council Minutes for Rel:ular Meeting of April 6. 1998 Page 3 of 5 Public Hearing-Proposed Ordinance Establi~hing a Permanent OddlEven Sprinkling Ban Mayor Werner opened the Public Hearing on the proposed Ordinance establishing a permanent odd/even sprinkling ban at 7:40 p.m. Public Works Director Tom Montgomery introduced the item. Mayor Werner asked if there were any public comments on the issue, and hearing none, closed the public hearing at 7:44 p.m. Ordinance No. 428 SecondfFinal Reading, an Ordinance Establishing a Permanent OddJEven Sprinkling Ban Moved by Councilmember Simacek, seconded by Councilmember Hicks, to approve Ordinance No. 428, an Ordinance establishing a permanent odd/even lawn sprinkling ban. 7 Ayes; Nays, None. Resolution No. 4-4-98-Approve Plans and Authorize Advertisement for Bid, 1998 Street & Utility Improvement Program Director of Public Works Tom Montgomery introduced the item noting the revised plans includes decorative street lights for one block, funded by the HRA, from the railroad crossing to Lea Street. Moved by Councilmember Yandrasits, seconded by Councilmember Johnson, to approve Resolution No. 4-4-98 a resolution approving plans and specifications for 1998 Street & Utility Improvement Program and ordering advertisement for bids. 7 Ayes; Nays, None. Water Tower Lettering and Ground Storage Tank Paint Colors Industrial Park Tank Moved by Councilmember Hicks, seconded by Councilmember Yandrasits, to approve "Hastings Est. 1857" as wording options for the Industrial Park Tank. 6 Ayes; Nays, 1 (Johnson) Ground Storage Tank Moved by Councilmember Simacek, seconded by Councilmember Moratzka, to approve wind swept white as a base color and dover cliff blue as an accent color for the new ground storage tank on Highway 55. 7 Ayes; Nays, None. Variance-Lot 2, Block 12-Barker's Addition (Tabled at March 16, 1998 Regular Council Meeting) Moved by Councilmember Hicks, seconded by Councilmember Yandrasits, to grant a 10ft. yard variance, based on the alley being vacated, to the required Chapter 10 (Section 10.26 District Lot Regulations) 20 ft. front yard setback based on findings that the applicant has demonstrated compliance with the following variance criteria: 1.) That special conditions and circumstances exist which are peculiar circumstance exist which are peculiar to the land, structure, or building involved and which are not applicable to other lands, structures or buildings; 2.) At literal interpretation of the City Code would deprive the applicant of rights commonly enjoyed by other properties in the same district under the terms of Chapter 10; 3.) That granting the variance requested will not confer on the applicant any special privilege that is denied by Chapter 10 to other lands, structures or buildings in the same district. No non-conforming use of neighboring lands, structures or building in the same district, and no permitted or non-conforming use of lands, structures or building in other districts shall be grounds for the issuance of a variance. 7 Ayes; Nays, None. House Move Proposal-1514 East 3rd Street Moved by Councilmember Riveness, seconded by Councilmember Simacek, to authorize issuance of moving and building permits to allow the home included in a proposal from Jim Hoeschen to be moved to Lot 1, Block 9, Barker's Addition subject to the following conditions: 1.) Compliance with all applicable City Code requirements including, but not limited to; City Code Chapter 4 (Construction Regulations) and City Code Chapter 18 (Property Maintenance Ordinance) 2.) That all exterior site work on the structure and site be completed within six months from the date of permit issuance. 3.) That one deciduous shade tree minimum 2.5 inch diameter (be planted in the boulevard area of each street frontage prior to issuance of Certificate of Occupancy) 4.) The applicant enter into an agreement based upon City Attorney Shawn Moynihan's comments as listed in his 4-2-98 letter. 7 Ayes; Nays, None. Variance-Agricultural Lot Size Requirement-3000 East 4th Street Moved by Councilmember Yandrasits, seconded by Councilmember Hicks, to allow a .2 acres lot size variance from the required Chapter 10 (Section 10.26 District Lot Regulations) 10 acre lot size requirement based on findings that the applicant has demonstrated compliance with the following variance criteria. I.) That special conditions and circumstances exist which are peculiar to the land, structure, or building involved which are not applicable to other lands, structures or buildings; 2.) Walgreens Site Plan-l017 Vermillion Street Zoning Administrator Matt Weiland introduced the item. Bob Cunningham, on behalf of Walgreens, explained the proposed truck usage, noting one truck per week would be anticipated for Walgreens deliveries. Hastings City Council Minutes for Regular Meetin2 of April 6. 1998 Page 5 of 5 Moved by Councilmember Hicks, seconded by Councilmember Yandrasits, to approve the site plan for redevelopment of 1017 Vermillion Street as aWalgreens by Told Development Company subject to the following conditions: 1.) Right in right out only access to 10th Street 2.) That the applicant be required to grant any necessary easements required to allow future construction of a right turn lane along the property's Highway 61 Frontage and to modifY the radius of the Highway 61/10th Street intersection according to recommendations of MN/DOT prior to issuance of any building permits for the project; 3.) That the applicant obtain any required permits from MN/DOT for work associated with developing the site as proposed and that the applicant comply with all MN/DOT design requirements affecting Highway 61 and the proposed site access/egress from that roadway. 4.) That costs associated with the closing of II th Street intersection be included as part of the project cost to be paid by the developer. 5.) That costs associated with reconfiguring the Highway 55/61 intersection including changes to signal locations and hardware shall be paid by the developer. 6.) That the proposed site grading, utilities, and storm water plan be modified subject to the approval of Public Works Director Tom Montgomery. 7 Ayes; Nays, None. BACKGROUND The one change order from Becker Arena Products is a substantial credit that was used for the athletic flooring at the Arena foyer and other areas, as Civic Arena Manager Jim McGree will be buying the product elsewhere at substantial savings. The Swanson proposal deals with an electrical error that will be covered by the engineers used by Birkeland Architects, but needs to be handled through a change order, and ultimately charged back to the Architect and Engineers. The presence of these signs would leave space available for police, social workers, probation officers and parents to conveniently park when they admit, release or visit clients. Since our program is short-term, we have clients corning and going daily as well as parents and professional staff who frequently meet with our residents. Our need for parking space would adequately be met if we had the use of the space on the south and east side of our property. Currently the Catholic grade school across the street from us has two-hour parking on the East side of their property and no parking on the North side (6th street) side. This plat involves the development of 29 Single family homes. The plat;l1so includes two outlots. Attached to this memo is a land use application, the final plat, and a site location map. Background Information: 1. Zoning: A - Agricultural 2. Proposed Zoning: R-l Low Density Residence. Final Plat approval should be contingent on this rezoning. 3. Comprehensive Plan Designation: U-I Urban Residential. Single Family homes are a consistent use with this Comprehensive Plan designation. 4. Existing Conditions: The subject property is currently undeveloped. 5. Prol)osed Conditions: The submitted plans shows 29 lots. 6. Preliminary Plat: The property located within Wallin 5th addition is part of the Wallin Property Preliminary plat approved by the City Council on August 19th,1996. The applicant is requesting this vacation because of a slight building encroachment into the alley. This alley is mostly under water and serves no public purpose. If the City Council vacates this alley, the applicants should be responsible for all recording fees required by Dakota County. Included with this memo is a Resolution referencing this action and a site location map. His property is currently zoned A Agriculture. This zoning district requires 10 acres of lot size per lot. His total land area currently totals 29.8 acres. He is proposing to split his land into two 10 acre lots and one 9.8 acre lot as shown on the enclosed property survey. He has obtained a lot size variance allowing the 9.8 acre lot. Attached with this memo are copies of a site map,and the land use application. Copies of the Survey will be available at the meeting. It is the same survey you received as part of the Variance proceedings for this property. Background Information: Minor Subdivision Criteria: A minor subdivision is a waiver of the platting requirement in the City. It is allowed for property which will not be subdivided into no more than three lots and these shall not necessitate any additional public investment. The property in question currently is served by an existing road and the lots are not serviced be City Sewer or Water. Property Location: the subject property is located near the eastern City limits in a rura1 area on East 4th St. Comprehensive Plan Classification: This property is guided R Rural. The proposed use is consistent with this plan classification. Site Zoning: The subject property is A Agriculture. The use of single family homes is permitted in this area provided they meet zoning standards. The proposed lots meet all of the zoning standards except the one lot that the lot size variance was granted for. Proposed Public Improvements: Their is currently a road which serves the existing homes out there. No further roads or public utilities would be required to serve these homes. Planning Commission Page 2 February 19. 1998 Park Dedication fees: The applicant shall be required to pay park dedication fees for each new lot created. The current fee rate is $850.00 per new lot. Trees: The developer shall plant one "boulevard" tree and one front yard tree per lot. These trees shall be at least two inches in diameter at the base and the species of the tree should be on the list of approved trees Created by the city Forester. This requirement is consistent with what the city has been requiring in other areas. Plan nine: Consideration: This minor subdivision would meet the intent of the zoning standards in the agricultural area. The home sites will be clustered on the high ground near the road. The rest of the property on the site will remain in open space and will never be developed. Planning Commission recommended approval of this minor subdivision based on the conditions listed at their April 13th, 1998 Planning Commission Meeting. Action Reouested: A motion to recommend approval of the minor subdivision subject to the following conditions 1. Approval of a resolution waving platting requirements.. 2. The resolution waving platting requirements and a certificate of survey shall be recorded with the County. A copy of the certificate of survey shall also be filed with the City. 3. Attached with this memo are copies of information regarding this request which has been submitted by Mr. Hoeschen. This item was referred to the Planning Commission to consider aesthetic and functional compatibility of the house for the site. The Commission is being asked to review this proposal as the "Board of Design Control". Site Location Issues: Th location the home is proposed to be moved to is in East Hastings. It is located on north western corner of the intersection of Lake St and E 3rd St. I encourage Planning Commissioners to drive by this property to get a feeling for the character of the neighborhood and appearance of abutting properties. Included with the proposal from Jim Hoeschen are photographs of the subject home which is currently in Golden Valley. The property is situated in one of the City's older neighborhood's and is surrounded by homes of mixed architectural style. A principal concern in siting a home in an existing neighborhood, whether new or one to be moved in, is whether the size and mass of the structure( s) are consistent with other structures in the area. It is my opinion that the size and mass of the house and accessory garage proposed to be moved is consistent with other structures in the immediate vicinity of the site. Further, the manner in which the home and garage would be configured on the property appears to be appropriate given the configuration of the corner lot. As part of the Building Permit application a Certificate of Survey providing more detailed measurements and elevations will be required if the applicant continues to pursue the project. There does not appear to be any grading and drainage problems which would arise from siting the proposed house on the premises. Flood Fringe: Part of the proposed home would be sited in the flood fringe. The lowest floor of the home must be above the 694 ft regulatory flood protection elevation. This must be demonstrated on the Certificate of survey. Planning Commission Page 2 February 20, 1998 Appearance & Condition of House & Garage to be moved: Included with the proposal are photographs of the exterior of the house and garage and a sketch of the floor plan of the interior of the house. The applicant's representation of the condition of the structures is included with the proposal. Role of the Board of Design Control: The Planning Commission acting as the "Board of Design Control" has the following responsibilities: 1. Call of Hearing: The Board is required to hold a hearing to consider the application papers. Notification of the hearing date and time must be given to the applicant and other persons deemed appropriate by the Board Secretary. 2. Hearing & Findings: Before or during the hearing, each member may view the premises upon which the hearing, each member may view the premises upon which the structure is located or to be located, and at the hearing the Board shall examine the application papers and hear the applicant. It may also hear any members of a citizen's committee and any other persons who request to be heard. The Board may adjourn from time to time, but within forty-eight (48) hours of the close of the hearing the Board shall, pursuant to a majority vote of all the members of the Board, file written findings of the fact that the exterior design, appearance and functional plan of such structure is or is not at variance or so dissimilar with the exterior design, appearance and functional plans of structures constructed or in the course of construction in the neighborhood of said proposed structures, which are in the same zoning district as the proposed structure, as to cause material depreciation generally to property in said neighborhood. The Board shall further make a recommendation that the application be accordingly granted or denied. The action of the Board will then be presented to the City Council at its next regular meeting. Further action with respect to the granting or refusing of a permit with respect to such application shall be held in abeyance pending order and direction of the Council. Comprehensive Plan Designation: The property is currently guided C Commercial. A dentist office is an appropriate use for this land use. 2. Setbacks: Structure setbacks for structures in the C-1 District are determined through the site plan review process.It is the opinion of staff that the proposed setbacks represent a rational approach to for orderly development of the site. The redevelopment would also create a new paved access to the site. Included with this memo is a package of site plan drawings, a site location map, and a land use application. Background Information: 1. Comprehensive Plan Designation: The property is currently guided I Industrial.The Cement plant is a permitted use. 2. Zoning: The site is currently zoned 1-1 Industrial Park. The cement plant is a permitted use in this district. 3. Existing Conditions: Part of the property is currently developed with the existing cement plant and part of the property remains undeveloped. This redevelopment would be developing more of the undeveloped portion of the property. 4. Proposed Conditions: The applicant is proposing to build a new Batch Plant on the site with associated parking and an access road. 5. Site Plan Issues: This is a large existing industrial site. The site plan is not that detailed, but the applicant does have a lot of property to work with. Setbacks: Moving the Batch plant back on the site more will help to buffer it more from surrounding property. Setbacks represent a rational approach to for orderly development of the site. I am not requesting action to approve the minor subdivision, but only action to proceed. This lot line adjustment could be done administratively. Background Information: Christy and Denny Thurmes are requesting a minor subdivision/lot line adjustment to property they own a part of at 320 w 4th St. The property was split into three parcels at one time. They own two of the parcels and a Y2 interest in the other parcel. There is a duplex on the property. They use Y2 of the duplex and another person uses the other half. The duplex is located on the parcel they own a Y2 interest of. They can not sell their Y2 of the home without a minor subdivision. This was originally platted as a standard 66 x 140 lot. City Ordinances The lot the duplex is located on was platted as a standard 66 x 140 lot. It is 9240 sq feet and is located in the R-2 Zoning district. Duplexes are allowed in the R-2 district on lots which are at least 9700 sq ft. This duplex exists as a nonconforming use of the property. If the property were to be split, it would create a 2918 sq ft lot and a 6355 sq ft lot. Both of these lots would be non- conforming lots. If anything happened to the existing home, it would be hard to build another home over the same property line because of how narrow parcel B would be. A parking pad would also have to be provided on parcel B to provide off street parking. The best solution for this lot would be to have someone buy _the.entireJot.and rent part of the home .as.aduplex. I have enclosed a copy of a letter from Christy and Denny Thurmes asking the City to consider this minor subdivision. BACKGROUND Throughout the last several weeks City Staff has been working with School District Staff regarding the possible sale of School District property near Hwy 55 and McAuliffe Elementary School. As City Councilmembers will recall, the City of Hastings owns approximately 6 acres in the area adjacent to the 14th Street Ponding Basin. This property was once considered for location of the outdoor swimming pool. The property was acquired from the School District for construction of the ponding basin, however, it became excess after the final construction of the ponding basin. In order to consider the sale of this property, in conjunction with the pending sale of School District property, the City Charter requires the conducting of a public hearing to consider the sale of real property. Section 7.04 of the City Charter, "Sales of Real Property", states in part as follows: "No real property of the City shall be disposed of unless the Council shall first pass a resolution containing specific findings that the public interest requires that the property be disposed, and only after public notice and hearing of such proposed disposition. Sales of rental property owned by the City shall be conducted in commercially reasonable manners." The Hastings School Board recently took action at its meeting on March 18, 1998 to begin the process of selling their property near Hwy 55 and McAuliffe School. It is anticipated that the City will soon receive requests for approval of development, site plans and rezoning for this property, for commercial purposes. Currently the property is zoned residential, with the comprehensive plan designating it as commercial property. Please see the attached City Council minutes from February 21, 1995, in which the Council approved the change in the Comprehensive Plan Designation_ In addition to the sale of the school property, the City will have an opportunity to reach an agreement with the School District and the Developer, to sell approximately six acres of City property near the ponding basin. City Councilmembers will recall there is a provision that the property must be used for public purposes, or else the School District has the right to reacquire it. Proceeds of the sale of the property would be split equally between the City and School. Fourth Street Hastings, MN 55033-1955 Re: Thomas Smith v. City of Hastings Our File No. 871 Dear Mr. Montgomery: We held a mediation in this matter on Friday, April 3, 1998. On that date we tentatively agreed to settle the matter for a total of $48,000. The settlement was tentative because we were not sure at that time whether Blattner would be contributing $3,000 or $5,000. Eventually, on Monday morning, it was confirmed that Blattner's contribution would be $3,000. Accordingly, the remainder was split evenly between the City and People's Electric. The City, by and through its insurance carrier, LMCIT, has agreed to pay $22,500 and People's Electric has agreed to pay $22,500. At mediation we were able to show Plaintiff, the mediator and People's Electric that Poeple's had substantial exposure because of their initial installation of the pole and ballast in question. People's Electric tried to argue that their initial installation must have been okay because the pole had been up for nearly ten years without any problems. Thankfully, George Vogel, our mediator, was able to convince Poeples that they had at least as much liability exposure as the City. As you know, this case was originally Smith v. Hastings. It was only after we third-partied in Blattner and People's Electric that we were able to get them to contribute toward settlement. Plaintiff did sustain significant damages in this case. When the ballast fell from the light pole and onto his neck, it fractured a vertebrae in his neck. Plaintiff's HMO, HealthPartners, had more than $20,000 in accumulated medical expenses. As part of this settlement, we resolved that subrogation interest by paying them $6,000 out of the total $48,000 settlement. I also want to thank you, Cal Ruedy and Doug Weber for all your help. In large part, we were able to convince People's Electric that they had substantial liability exposure for which they should make a significant settlement contribution. Our ability to convince them was based on infonnation that was provided to us by you and your employees. I have always maintained that good facts make good attorneys. In this case we were able to present "good facts" because those facts were provided to us by you. Because this matter has settled, the trial scheduled to start on May 4, 1998 has been cancelled.
