The City Council of the City of Hastings, Minnesota met in a regular meeting on Monday, May
3, 1999 at 7:00 p.m. in the City Hall Council Chambers, 101 4th St., East, Hastings, Minnesota
Members Present: Councilmember Yandrasits, Riveness, Simacek, Johnson & Hicks
Members Absent: Councilmember Moratzka & Mayor Werner
Staff Members Present:
Dave Osberg, City Administrator;
Matt Weiland, Acting Community Development Director;
Tom Montgomery, Public Works Director;

Approval of Minutes
Acting Mayor Hicks asked if there were any corrections or additions to the minutes of the regular
meeting of April19, 1999 and hearing none approved the minutes as presented.
Council Items to Be Considered
City Administrator Osberg recommended that the following changes and additions be made to
the City Council Agenda:
Item NO.6-Barton Sand & Gravel Soil Processing/Bituminous Permit and Item No.7-Holst Soil
Processing Permit be removed from the agenda since those are special use permits requiring six of seven
City Councilmember to approve.
Item No.1 Under Public Hearing-Changed to reflect a rezoning of the High School site, rather than a
vacation of an easement.
Item No.3 Under Community Development Director, Site Plan Review-Erickson Oil 18th & Vermillion
St. should reflect action as site plan and special use permit.
Item No.5 Under Community Development Director is added to reflect the 2nd reading of the rezoning
for the Hastings High School site.
Moved by Councilmember Simacek, seconded by Councilmember Johnson, to change the agenda
and add the items as presented by City Administrator Osberg.

Public Hearing-2nd Reading of Rezoning Ordinance for Hastings High School
Acting Community Development Director Matt Weiland presented to the City Council
information regarding the proposed rezoning of the Hastings High School site from Agriculture to R-3
PRD Medium Density Residence.
Acting Mayor Paul Hicks opened the Public Hearing at 7:04 p.m. for persons to comment on the
proposed rezoning. Acting Mayor Hicks asked for any comments from the audience and hearing none
closed the public hearing at 7:05 p.m.
Ordinance No. 443-2ndlFinal Reading-Rezoning Ordinance-Hastings High School
Moved by Councilmember Johnson, seconded by Councilmember Yandrasits, to approve
Ordinance No. 443 an Ordinance amending Section 10.01, Subdivision 1 of the City Code rezoning from
Agriculfure to R-3 PRD Medium.Density Residential.

Public Hearing-Easement Vacation-Sunny Acres 4
Acting Community Development Director Matt Weiland presented information on the proposed
easement vacation in the Sunny Acres 4 Addition.
Acting Mayor Paul Hicks opened the Public Hearing at 7:06 p.m. and asked for comments from
the audience, and hearing none closed the Public Hearing at 7:06 p.m.
Moved by Councilmember Riveness, seconded by Councilmember Simacek, to approve
Resolution No. 5-4-99.

Public Hearing-2nd Reading of Rezoning Ordinance-Wallin 9th Addition
Acting Community Development Director Matt Weiland presented information on the proposed
rezoning in the Wallin 9th Addition from Agricultural to R-1.
Acting Mayor Paul Hicks opened the Public Hearing at 7:07 p.m. and asked for any comments
from the audience, and hearing none closed the Public Hearing at 7:07 p.m.
Ordinance No. 442-2ndlFinal Reading-Rezoning Wallin 9th Addition
Moved by Councilmember Yandrasits, seconded by Councilmember Johnson, to approve
Ordinance No. 442 an Ordinance amending Section 10.01, Subdivision 1 of the City Code rezoning the
Wallin 9th Addition from Agricultural to R-l Low Density Residence.

Award Contract-1999 Public Improvement
Public Works Director Tom Montgomery presented the results of the bids received for the 1999
Street and Utility Improvement Program.
Moved by Councilmember Johnson, seconded by Councilmember Simacek, to approve
Resolution No. 5-5-99 receiving bids and awarding contract for the 1999 Street and Utility Improvement
Program.

Soldiers and Sailors Cemetery Fence
Public Works Director Tom Montgomery presented information on the Soldiers and Sailors
Cemetery Fence bid presented by Selby Ornamental Iron Company.
Moved by Councilmember Yandrasits, seconded by Councilmember Riveness, to approve the
compromise bid submitted by Selby Ornamental Iron Company and allow the City to enter into an
contract with Selby Ornamental Iron Company for furnishing and installing the ornamental fence around
the Soldiers and Sailors Cemetery at a bid price of $27,944. The fence construction will not include a
mow strip, and City forces will then be used to remove the existing fence.

Site Plan and Special Use Permit Erickson Oil
Acting Community Development Director Matt Weiland presented information on the proposed
site plan submitted by Erickson Oil at 18th & Vermillion St.
Moved by Councilmember Yandrasits, seconded by Councilmember Riveness, to approve the site
plan for the Freedom Gas/Convenience Store and Car Wash, subject to the following conditions:
1.) Site plan approval shall be contingent upon the site receiving special use permit approval for the
use of the gas station.
2.) The proposed structure and accessory items including, but not limited to, the parking lot
landscaping shall be completed pursuant to the approved site plan. Upon request for occupancy
of the building, all uncompleted items contained within the site plan shall be addressed pursuant
to City Code Escrow Agreements.
3.) The light pole in the northwest comer of the site shall be rotated clock wise to minimize the
amount of spill over light onto the adjacent western property.
4.) As a condition of special use permit issuance, the applicant shall be required to manage the
operation of the car wash, such that the use of blowers to dry the cars is mandated from
November to April.
5.) The trees and bushes along the west side of the property shall be kept to allow for more buffering
and screening.
6.) The applicants shall submit a revised site plan and incorporate Public Works Director Tom
Montgomery's comments listed in his memo dated April 27, 1999 concerning the Freedom
Station site plan before the City issues a building permit.
Councilmember Yandrasits offered a friendly amendment requiring that no lighting shall be
located on the west side of the canopy facing the existing residential area. Councilmember Riveness
agreed to allow this as a friendly amendment.
Acting Mayor Paul Hicks called for a vote on the action requested as amended, with the six
conditions as outlined.

Hastings High School Environmental Assessment Worksheet Decision
Moved by Councilmember Simacek, seconded by Councilmember Johnson, to approve
Resolution No. 5-6-99 a Resolution of the City Council of the City of Hastings adopting Findings of Fact
and conclusions pertaining to the environmental assessment worksheet for the proposed Hastings High
School and determining that an environmental impact statement is not required to be completed for said
project.

Interim Adjustments Due to Administrative Assistant/City Clerk Vacancy
Moved by Councilmember Riveness, seconded by Councilmember Yandrasits,
approve the following interim adjustments due to the current vacancy in the position of Administrative
Assistant/City Clerk:
I.) Adjust the monthly compensation of Carol Latham, Jane Toenjes and Tracy Souder by $200.00
per month for a period of time from March 24, 1999 through May 14, 1999.
2.) Grant Finance Director Lori Webster until July 1, 1999 to exceed the compensatory time
maximum of 80 hours, with the understanding that her compensatory time shall not exceed 80
hours, after July 1, 1999.

Appointment of City Planner
Moved by Councilmember Simacek, seconded by Councilmember Johnson, to approve the
recommendation of the Administrative Committee authorizing the appointment of Matt Weiland to the
position of City Planner at a starting salary for the position of $3,700 per month.

Establishment and Appointment of Full-Time City Hall Secretary/Receptionist
Moved by Councilmember Simacek, seconded by Councilmember Riveness, to authorize the
establishment of a full-time City Hall Secretary/Receptionist position, and authorize the appointment of
Adeline Schroeder to this position, effective May 4, 1999 at a starting wage of$12.10 per hour.

Unfinished Business
City Administrator Dave Osberg reminded the public and the City Council of the open house
scheduled for May 6,1999 from 4:00 to 8:00 p.m. in the Community Room at the Hastings City Hall for
further information on the City's Comprehensive Plan.
New Business
Acting Mayor Paul Hicks commented on the open house that was conducted at the new Senior
Center on Sunday, May 2, 1999 and thanked all those involved with the Senior Center Project.

meeting at 7:40 p.m.

It is recommended tI1at the City Council take action approving the attachedjbb
description and authorize the advertising for the position of Code Enforcement
Inspector.
BACKGROUND
The City Council previously approved the job description and authorized the
advertisement for the position of Housing/Building Inspector. After January 1,
1999, applications were received and interviews with four candidates were
conducted. For various reasons, including lack of qualified candidates and
withdrawal of one candidate, no person was hired for the position.
Since that time, Inspections and Code Enforcement Supervisor Bill Mesaros has
completed the attached job description that changes slightly some of the duties,
and changes the title from Housing/Building Inspector, to Code Enforcement
Inspector. Primary tasks for this position will continue to be the enforcement of
the housing, rental and property maintenance codes of the City. Less emphasis
is placed on the tasks commonly associated with building code inspections and
enforcement.
This change in the job description will more accurately reflect the responsibilities
of the position, and lend itself to more consistent and effective enforcement and
administra 'on of the hou ing, rental and property maintenance codes.

SUMMARY:
The position is intended to enforce and administer the various City ordinances related to housing,
property maintenance and code enforcement. The position will conduct field inspections of rental

bring deficient structures and properties into compliance with City requirements. The position will

Grading Permit and Inspection Policy

Under the existing inspection policy, Developers are required to post a cash escrow to be
used to fund the City's hiring of a grading inspector. However, under the building code adopted
by the City, the developer is also required to take out a grading permit. The Building Department
does not review the grading plans and does not inspect the grading operations and yet are
required, by adoption of the State Uniform Building Code, to issue the permit and the permit
amount is set by the code.
The Target developer, AMCON, was required to post a cash escrow in the amount of
$4,000 to cover the City's consultant grading inspection costs. AMCON was also charged over
$900 for a grading permit. The developer questioned why it was paying twice for inspection
services.
A review of the current policy by the Code Enforcement and Inspection Department, the
Planning Department, and Public Works Department, resulted in staff concluding that double
billing was occurring and recommending revision of the existing Private Improvements
Inspection Policy. Given that a grading permit is required by the State Uniform Building Code
and the permit fee is also set by the code, and given that the consulting inspection costs will also
exceed the grading permit fee, staff is recommending transferring the permit fee to the inspection
escrow account and crediting the developer for the grading permit fee paid. Staff is also
recommending revising the grading policy to cover developments five acres in size or larger, as
the five acre size is also used by the State in requiring an MPCA erosion control and drainage
permit.
COUNCIL ACTION REQUESTED
Council is requested to adopt the enclosed Site Grading and Private Improvements
Inspection Policy that has been revised to credit the developer for grading permit fees paid and to
increase the size of the applicable developments requiring site grading inspection from one acre
to five acres in size.

POLICY FOR INSPECTION OF SITE GRADING AND PRIV A TEL Y CONSTRUCTED
PUBLIC STREET AND UTILITY IMPROVEMENTS

Developers wishing to contract and construct the public street and utility improvements
for their development must first have their plans and specifications approved by the Public
Works Director. When submitting plans and specifications for approval, the Developer shall be
required to pay a $250 plan review fee.
The City of Hastings will hire a consultant to conduct construction inspection of site
grading for developments larger than one five acres in size, and for all privately constructed street
and utility improvements in the public right of way. The Developer contracting these
improvements will be required to post a cash escrow with the City of Hastings in the amount of
135% ofthe estimated cost of the inspection services prior to receiving approval to commence
construction. The City will pay all inspection costs incurred from these funds, and furnish the
Developer with copies of all invoices received. The City will also charge 10% of the consultant
fees to cover City overhead and administrative costs connected to the consultant inspection
services. Excess funds will be returned to the Developer upon completion of the improvement
project. If the funds deposited with the City are insufficient to cover the inspection costs, the
Developer will be required to deposit additional funds with the City to cover the estimated
overage.
As applicable by the State Uniform Building Code adopted by the City of Hastings,
grading permits will be required for site grading work. The grading permit will be issued by .
the City's Department of Code Enforcement and Inspection. The grading permit fee charged
will be credited toward the grading inspection costs and will reduce the escrow required for
grading inspection by the full amount of the grading permitfee.
No construction in the public right of way will be permitted without the City's consultant
inspector present. The City's consultant inspector will prepare the street and utility improvement
plan asbuilts in addition to inspecting the improvement construction. Prior to accepting or
approving the completed grading and/or street and utility improvements, the Developer must
submit a maintenance bond from his contractor in the amount of20% of the improvement costs,
covering a period of one year after City acceptance of the improvements.

A motion to recommend approval of the soil processing permit from May 1999 to December 31,

Barton Sand and Gravel Company is permitted to operate a soil processing operation on land
described in exhibit A and pursuant to the most recent information submitted and provided
during the original application in 1984 and in 1987 by Davies Excavating, Incorporated. The
conditions stipulated during thedriginalcspecial use pennitissuance in 1987 are still in effect
and the following:
1. The site is to be restored, upon completion of the mining operation, pursuant to the plans
provided to the city during the original application in 1984 and pit expansion proposal in
1987.
2. Operating hours are not to be in excess of7:00 am to 5:00 pm Monday through Saturday
except holidays. In cases of emergency Barton Sand and Gravel may operated during
hours other than those noted upon approval by the City Administrator.
3. Barton sand and Gravel Company shall refrain from using West 10th Street between
Trunk Highway 61 and Trunk Highway 55 for hauling purposes.
4. The City of Hastings shall be informed ofthe results of the most recent inspection ofthe
Barton Sand & Gravel pit as made by the Bureau of Mines.
5. Barton Sand & Gravel Company shall provide to the city within 10 days after the City
Council approval ofthe permit,' and before work begins an irrevocable bond or other form
of security acceptable to the city in the amount of $25,000 for the estimated cost of
restoring the site covered by the soil pursuant to City Code.
6. After the Special Use Permit is approved, Barton Sand & Gravel Company shall provide
to the City a Liability insurance policy or certificate of insurance from an insurance
company authorized to write casualty insurance in the State of Minnesota as will protect
the applicant, its agents and the city from claims for bodily injury, death or property
damage which may arise from operations under the soil processing permit. The amounts
of the insurance shall not be less than that which is required by the City Code.

The following information is hereby submitted in connection with an application for the renewal
of our Soil Processing Permit dated June 21, 1988 and renewed each year thereafter, to operate a
sand and gravel mine in the City of Hastings. The Applicant and Operator, Barton Sand &
Gravel Co. is a division of Tiller Corporation. The property is owned by C & D Enterprises, a
general partnership owned by Donald (Butch) Davies and Donald Cysiewski.
Location
The mine is located in part in the City of Hastings and in part in Ravenna Township. Barton has
obtained the required mining permit from Ravenna Township for the portion of the mine that lies
in Ravenna Township. The site is north of East 10th Street (CSAH 54) near the intersection with
County Road 91. The legal description for the mine is attached hereto as Exhibit A.
Operating Hours
The current Permit allows operations from 7:00 AM to 5:00 PM. However, situations arise such
as public emergencies or accelerated work schedules which may require an extension of our
normal operating hours.
Traffic Patterns
Traffic patterns to and from the site primarily involve the west entrance to the pit, and use East
10th Street (CSAH 54) and County Road 91. Traffic moves east and west on East 10th Street or
north and south on County Road 91. In addition to East 10th Street, traffic to and from an area
west ofthe site also uses U. S. Highway 61 for north and south travel through Hastings.
Phasing/Reclamation Information
Phasing and Reclamation Plans are attached hereto as Exhibit B. These plans, which are based
on current market demand, represent the best estimate as to the future mining of this site.
Site Inspection
A copy of the most recent inspection conducted by the Mine Safety and Health Administration
remains on file with the City of Hastings.

1998)
Enclosed is an application from Holst Excavating requesting the City to renew their soil
processing permit for 1999. Soil processing operations are required to renew their permits
annually. A brief review of the Holst Excavating Company operation and recommendations are
as follows:
Holst Excavating's operation is located in east Hastings along Glendale Road
south ofthe intersection of CSAH 54 and Glendale Road. The original permit for
this site was issued to Donald Kluender in 1978. In 1983 the permit was
transferred to Holst Excavating, INe. Holst's current permit allows them to
operate from 7:00 am to 5:00 pm, Monday through Saturday. Normal truck routes
moving to and from the operation are County State Aid 54 or County Road 91.
The site was originally used to excavate sand. The site currently being used to wash
crushed limestone to capture sand. A series of ponds of been constructed on the site for
this purpose. It is a closed system. This site will continue to operate for about another
year and a half while the applicant sets up s new washing area on a new proposed sand pit
at the comer of County Rd 54 and 91. The applicant will be completing the
restoration of the site this summer. They may excavate about 5000 more yards of sand as
part of the restoration process. Cover has been established on the upper steep slopes of
the site. The rest of the site should be restored this year.
Background Information:
1. Zoning: A Agriculture. Sand extraction is allowed as a Special Use in both the Agriculture

sand.

noted upon approval by the City Administrator.
3. Holst excavating shall refrain from using West 10th St between Hwy 61 and Hwy 55 for
the purpose of hauling.
4. Holst Excavating shall provide to the city within 10 days after the City Council approval
of the permit, and before work begins an irrevocable bond or other form of security
acceptable to the city in the amount of the estimated cost of restoring the site covered by
the soil pursuant to City Code. This bond amount has been $75,000 in the past.
5. Holst Excavating shall provide to the City a Liability insurance policy or certificate of
insurance from an insurance company authorized to write casualty insurance in the
State of Minnesota as will protect the applicant, its agents and the city from claims for
bodily injury, death or property damage which may arise from operations under the soil
processing permit. The amounts of the insurance shall not be less than that which is

7. Vegetative Cover as required by the City of Hastings Storm Water Management
Ordinance, shall be restored on the steeply sloped portions ofthe site, identified on the
mining plans as tier 1,2,3, and 4. Appropriate erosion control measures as determined by
the Public Works Director shall be undertaken to ensure establishment of vegetative over
on steeply sloped portions of the site where mining is complete according to the approved
plan.
8. Any other conditions which the Council may deem as appropriate to address
aforementioned concerns.

SUBJECT: Special Use Permit Renewal- Hot Asphalt Plant (Commercial Asphalt)
Enclosed is an application from Commercial Asphalt and background information that requests
the City to renew a special use permit for the operation of a temporary asphalt plant. The
applicant is required to reapply each year for their special use permit. There are no changes
requested for their approved conditions of operating. The asphalt plant is operated as part of the
Barton Sand and Gravel pit located along east 10th Street (CSAH 54).
The City approved the original special use permit on June 19, 1989, subject to several conditions.
The current application is similar to applications made in the past that have all been approved
with similar conditions. The plant has operated since May 1990. The City Council will be
reviewing this special use permit concurrently with the Barton Sand & Gravel Company's
application for the renewal of a soil processing permit.
Background Information
1. Location - The asphalt plant is proposed to be located in the west/northwest portion of the
Davies pit located along County Road 54 near the intersection of County Road 54 &
Glendale Road.
2. Performance Bond - City Code requires the submission of a performance bond by the
applicant. Staff is again recommending a performance bond in the amount equal to
$25,000.
3. Operating Hours - The applicant indicates that the plants operating hours will generally
be from 7:00 am to 5:00 pm. Last year the City allowed operating hours from 6:00 am to
5:00pm, however, no hauling before 7:00 am was allowed.
4. Vehicle Trios- The applicant indicates that the peak number of vehicle trips associated
with the plant would be 21 per hour. Assuming two-way traffic, this would result in 42
trips on a peak hour basis.
5. Soill containment svstem - Previous conditions by the city require a spill containment
system. The applicant has provided a spill containment system.
6. Flood Plain - The site ofthe asphalt plant is located near a flood hazard area. The
applicant has indicated that the plant is at an elevation of 694.2 that is above the 1 00 Year
Flood Boundary.
7. Screening - The site plan seems to illustrate that the plant will be screened in part be a
stockpile of material. The City should require this type of situation to make the plant as
unobtrusive as possible. It is strongly encouraged that the stockpile is
wrapped around the front ofthe asphalt plant site as much as possible.
Action Requested:
A motion to recommend approval of the special use permit that allows Commercial Asphalt to
operate a hot asphalt plant subject to the following conditions:
a. Expiration of the permit shall be December 31, 1999.
b. All PCA requirements shall be met and all permits received before the operation of the
plant.
c. The site must be watered as necessary to control dust.
d. Before commencing operation of the plant, the applicant shall provide the city with the
necessary insurance certificates and a performance bond for $25,000.
e. The site ofthe temporary asphalt plant shall be at an elevation of not less than 694 feet.
This requirement includes that the bottom of the spill basin shall also be at an elevation of
not less than 694 feet.
f: The aggregate stockpile shall be maintained as shown on the site plan for screening;.
purposes. Also, it is strongly encouraged that the stockpile be wrapped around the front
of the site as much as possible to provide effective screening.
g. That all requirements of the city code concerning temporary asphalt plants be attached as
conditions for permit approval and be adhered to by the applicant.
h. The applicant shall file with the local fire authority a material safety data sheet for a
flammable combustible liquid storage permit.
1. That conditions for approval be strictly enforced.
J. Hours of operation shall be from 6:00 am to 5:00 pm, however no hauling may begin
before 7:00 am.

The following information is hereby submitted in connection with an application for the renewal
of our Special Use Permit dated June 19, 1989 and renewed each year thereafter to operate a
portable hot mix asphalt plant in a sand and gravel mine in the City of Hastings. The Applicant
and Operator, Commercial Asphalt Co. is a division of Tiller Corporation. The property is
owned by C & D Enterprises, a general partnership owned by Donald (Butch) Davies and Donald
Cysiewski.
Location
The plant site is in a sand and gravel mine located in part in the City of Hastings and in part in
Ravenna Township. The site is north of East 10th Street (CSAH 54) near the intersection with
County Road 91. The legal description is attached hereto as Exhibit A.
The mine is operated under a current Soil Processing Permit issued by the City of Hastings to
Barton Sand & Gravel Co., also a division of Tiller Corporation and thereby related to
Commercial Asphalt Co.
The plant site is in the City of Hastings, near the western entrance to the mine, and south of the
Chicago, Milwaukee, St. Paul and Pacific Railroad tracks. A small part of the western portion of
the property south of the railroad tracks is within the 100- Y ear Flood Boundary (flood plain) as
set forth on the Flood Insurance Rate Map for the City of Hastings dated December 19, 1981.
The plant is at an elevation of 694.2 feet, and therefore not in the flood plain.
Operating Hours
The current Permit allows operations from 6:00 AM to 5:00 PM, with no hauling before 7:00
AM. However, situations arise such as public emergencies or accelerated work schedules which
may require an extension of our normal operating hours.
Estimated Volume
The amount of hot mix asphalt produced is dependent on market conditions and demand. We
estimate production in 1999 will be approximately 125,000 tons.
Traffic Patterns
Traffic patterns to and from the plant primarily involve the west entrance to the mine, East lOth
Street (CSAH 54) and County Highway 91. Traffic moves east and west on East 10th Street or
north and south on County Road 91. In addition to East 10th Street, traffic to and from an area
west ofthe site also uses U. S. Highway 61 for north and south travel through Hastings.
Traffic Control Program
The safety with which traffic moves to and from our plant and its impact on the health, safety
and welfare of the people of the community is a major consideration to us. Safe trucking
operations are dependent on the policies and procedures followed, including the condition of the
equipment and the attitudes and driving practices of the individual drivers. Our goal IS safe and
courteous trucking activities to and from our plant to minimize impact on the people around us.
We have employed a traffic control program in the interest of safe trucking operations which
includes the following:

1. Access to the site is limited to the two entrances that presently exist.
2. Stop signs are maintained at both exits from the site.
3. Signs have been placed by the plant to encourage safe and courteous driving practices in
accordance with all traffic rules and regulations.
4. We follow-up directly with drivers or customers who are not driving safely.
Traffic Volumes
The quantity of material a truck can haul is dependent on the legal load limit for each specific
truck and the weight restrictions on the streets and roads of the intended travel routes. The
estimated average load size for trucks hauling material from this plant is 19 tons.
Based on the production capacity of the plant, which is approximately 400 tons per hour, and the
estimated average load size, the peak number of loads from the plant in any hour during the
season will be 21.
Air Pollution Control Eauipment
The plant is equipped with a fabric filter baghouse to control particulate matter emissions (dust).
Plant operations require a permit from the Minnesota Pollution Control Agency (MPCA) which
specifies periodic performance testing to demonstrate continued compliance with the standards
established. This permit also addresses requirements regarding allowable fuels and the control of
fugitive emissions through application of water.
Petroleum Storage Facilities and Back-up Containment Svstem
The operations of the plant require storage facilities on site for burner fuel, diesel fuel and asphalt
cement. This requires a Liquid Storage General Permit for aboveground tanks from the MPCA.
This permit requires a containment system that will contain the tank contents in case of a spill.
In accordance with Condition H of our current Permit, attached hereto as Exhibit B is a copy of
the most recent inspection conducted by the Hastings Fire Department.
Security
Site access is restricted to authorized persons. Each site entrance has a gate that is locked during
non-operating hours. There is also a series of natural barriers, fences and earthen berms that
limit access. Trespassing or infringement by unauthorized persons has not historically been a
problem at this site.

Exclusive Beverage Rights - Hastings Family Aquatic Center
The Park and Recreation Committee of the City Council will meet on Monday, May 171h at 7:30
a.m. to make a recommendation on the exclusive beverage rights for the Hastings Family Aquatic
Center. The Park and Recreation Committee Chair, Lynn Moratzka, City Attorney Shawn
Moynihan, Aquatic Manager Darbie Johnson and myself met with representatives of Coca Cola
and Pepsi Cola to study their proposals. The recommendation that will be brought forward to the
full Park and Recreation Committee at their meeting on Monday morning May 171h will be to
enter into a contract with the Coca Cola Bottling Company to provide this service. Shawn
Moynihan, the City Attorney, is currently working on this contract and it will be reviewed by the
full Park & Recreation Committee meeting and forwarded to the City Council.

pricing for the fountain syrup is competitive. We have worked with
both of the these companiRs for many years. A soft drink vending
machine ln an employee area if thought to be necessary would probably
be acceptable to us. We could discuss the details of this. Also, we
feel that outside food or beverage should not be allowed into the
Aquatic Center. This could adversely affect our sales as well as
present problems with ( Glass containers, trash, etc. ). We would be
in operation all hours the Center would be open for public swiwming.

We feel we would need to establish a typical season with an amount
of days of operation. If the Center does not open on time due to
construction delays, etc., we would want to prorate the rents based
on the amount of days open. We would be willing to explore other
lengths of this agreement. One reason for five years would be
the ability to invest in additional equipment needed to meet customer
requests as we go along knowing that we would have adequate time to
recapture the value of the investment.
F. A DESCRIPTION OF ANY OTHER PRODlJCTS, SERVICES OR FACILITY
IMPROVEMENTS THAT WILL BE PROVIDED TO THE CITY DURING THE
LIFE OF THIS AGREEME~~.
We would have the ability to work with the marketing of the pool
by possibly offering a program regarding ticket purchases which may
entitle the holder to a discount at the Dairy Queen. This could be
done be offering a discount coupon on the back of a ticket stub or by
some other means. This is just an example of one of the promotions
that may be done. We feel we are already in the concession business
on a full time basis at the Dairy Queen and this would be a plus to
the marketing of th~ Aquatic Center.
We have decided to develop a proposal strictly related to the
Aqautic Center at this time rather that on the Civic Arena also for

Summit Point Drainage Easement
May 12,1999
The Summit Point development includes a ponding basin on the north end that outlets on
the north side of Featherstone Road into the ravine adjacent to the Oakwood Cemetery. The
north side of Featherstone Road and the ravine are in Nininger Township. In order to construct
the storm sewer pipe that outlets the Summit Point ponding basin, an easement from the
cemetery association was required. As part of the approvals for the Summit Point development,
Council mandated that the townhome associations in the Summit Point development are to be
responsible for maintaining this easement.
Enclosed is a letter from the developer, Todd Siewert, requesting that the City be
responsible for maintaining this easement. The new high school site plan includes a drainage
pond that will drain through the Summit Point ponding basin and outlet. The Featherstone Road
improvements to be constructed in conjunction with the high school will also drain through this
outlet.
Council Action Requested
Council is request to rescind the Summit Point development easement maintenance
requirement and authorize City forces to maintain the easement.

RE: Summit Point Cemetery Easement
Dear Tom,
The cemetery easement located to the north of Summit Point is currently proposed to be
maintained by the association governing the Summit Point Plat. Upon reviewing this
with Shawn Moniyhan this arrangement would be detrimental to the city and which could
open up a possible lawsuit. The reason is that this easement will not only serve the
Summit Point area but the School land as well will benefit from this easement. This
reason alone could become an open invitation for a legal issue when forcing a private
organization, who will be paying taxes, to financially obligate them to maintain this
easement that obviously will have more than one benefactor. Whether this easement is in
or out of the city limits does not have any significance. An easement is a tool used to
grant permission to use and upkeep as long as the easement is in place.
Siewert Construction requests to be put on the agenda to review and have the council
make a motion to have the City of Hastings maintain this easement at the Monday, May
17, 1999 city council meeting.

SUBJECT: Special Use Permit & Site Plan - - Freedom Gas Station/Convenience Store
and Car Wash (1726 Vermillion St)
Erickson Oil Products is requesting approval of a special use permit and site plan for the
construction of a new Convenience/ Gas Station and Car wash. The applicant is proposing to
raze and replace its existing gas station with a larger one. The applicant originally applied for
this permit approval back in October of 1996. This item went to the Planning Commission, but
was stopped before it went to the City council. The item was stopped in order to get more
information about their lighting plan. The city has finally received this information and the
project is ready to move forward. This project also involved the adjacent lot north ofthe existing
gas station where and office building once stood. This office building was razed a few years ago
in order for this future store to be built. There are site plans, a land use application, and a site
location map included with this memo.
Background Information:
1. Comprehensive Plan Designation: Commercial. The proposed use of the property is
consistent with the plan designation.
2. Zoning: C-3 Community Regional Commerce. Auto Service stations and Car washes are
allowed by special use permit. The City may attach conditions to the operation of the
Service station and Car wash it deems necessary to regulate the activity of this special
use.
3. Existing Conditions: The applicant currently has a gas station located at the comer of
18th and Vermillion, which faces East towards Vermillion Street. The applicant has also
purchased the property directly north of the gas station and has razed the office building
which was once on the property, in order to pursue an expansion of its current gas
station.
4. Proposed Conditions: The Submitted plans show a new enlarged store, new pumps, and a
new canopy. The construction of the new gas station will involve the demolition of the
old gas station. The proposed gas station will occupy both properties and will face South
towards 18th St (see site plans)
5. Lighting: Concerns have been expressed to staff about the lighting of the new gas station.
People are especially concerned about the new gas station being open 24 hours. The city
has recommended in the past that it needs to protect motorists and adjacent residential
property owners from excessive glare and trespass or spillover of light. The City
required the applicants to submit a revised lighting plan that will minimize the spillover
light to the neighbors. The lighting plan does minimize the light spillover for most of the
property very well, except for an area in the northwest corner. The applicants have
indicated that the light located in this area can be rotated counter clockwise to cut down
the spillover light even more. This will be a requirement of site plan approval.
6. Landscaping: The landscaping plan shows a variety of elements that should enhance the
appearance of the site. A 6 ft redwood fence is proposed to be built along the West side
of the property. This fence should be built in a manner which provides adequate
screening to the property owners and is aesthetically pleasing. There are also many large
trees and bushes which run along the West side of the property. These trees and bushes
should be kept.
7. Traffic Circulation. Drainage and Utilities: City Staff and the Public Works Division have
reviewed the submitted plans. Enclosed is a memo from Public Works Director Tom
Montgomery, dated 4/27/99 concerning the Erickson site plan. A condition is proposed
that incorporates Mr. Montgomery's comments.
8. Concerns of Abutting Propertv Owners: Following receipt of the public notice regarding
the special use permit request for this project, property owners situated to the west and
north of the subject property contacted staff to express concerns and ask questions related
to the impact of the proposed development on their respective properties.
The west lot line of the proposed convenience store site abuts two residential properties
located at 122 18th St and 115 17th St. Currently, numerous large trees as well as a large
hedge row are existing along this lot line. This vegetation provides an existing green
buffer. The City requested that the applicants move their site plan 5 ft to the east in
order to save these trees and hedges, which they were able to do.
Action Requested:
A motion to recommend approval of the Special Use Permit for the Freedom Gas/Convenience
Store and Car Wash, subject to the following conditions:
1. Site Plan approval shall be contingent upon the site receiving special use permit approval
for the use of the gas station.
2. The proposed structure and accessory items including, but not limited to, the parking lot
landscaping shall be completed pursuant to the approved site plan. Upon request for
occupancy of the building, all uncompleted items contained within the site plan shall be
addressed pursuant to city code escrow requirements.
3. The light pole in the northwest comer of the site shall be rotated clockwise to minimize
the amount of spillover light onto the adjacent western property..
4. As a condition of special permit issuance, the applicant shall be required to manage the
operation of the car wash, such that the use of blowers to dry the cars is mandated from
November to April. The blowers should also be required to be set for 75 second cycles.
5. The trees and bushes along the West side ofthe property should be kept to allow for more
buffering and screening.
6. The applicant shall submit a revised site plan and incorporate Public Works Director Tom
Montgomery's comments listed in his memo dated 4/27/99 concerning the Freedom
Station site plan before the city issues a building permit.
7. That all delivery and gas trucks shall travel to and from the site by way of Vermillion St
and not 18th St.
8. That there shall be no lit advertisement on the western side of the canopy or building.

I have reviewed the proposed Erickson Oil Freedom Station site plan and have the following
comments;
1. The proposed car wash location poses a problem during winter months. As evidenced by
the existing Conoco Station at 15th and Vermillion, vehicles exiting the car wash will drip
water for some distance. The exit to Vermillion St. and Vermillion St. itself could become
very slippery, creating a safety hazard. The car wash should either be relocated to the west
side of the new building to provide more distance away from Vennillion St. for the
vehicles to drip water, or the facility should be mandated to use blowers to dry the cars
from November to ApriL
2. The water service line for the existing gas station will have to be abandoned at the
watermain beneath 18th St. and the corporation stop capped. The sanitary sewer service
for the existing gas station should be capped at the property line. It also appears that the
water service line for the old KDW A building is proposed to be abandoned. Traffic
volumes on Vermillion St. prevent the developer from properly abandoning this water
service at the main beneath the highway. Instead, the developer should cap the water
service line at the curb stop, and tie out the curb stop location on the site plan for future
reference. In addition, a condition should be added to any approval of this project and
attached to the property such that if the abandoned Vennillion St. water service line should
fail, the developer would be responsible for the repair/abandonment costs.
3. As proposed, storm runoff and the car wash driveway drain will direct water across the
existing Vermillion St. sidewalk and boulevard to drain out to Vennillion Street. Drainage
should not be channeled across the sidewalk, but rather directed to drain out through the
driveway. The roof drains on the east side of the proposed building should also be revised
to direct runoff out to the Vermillion St. driveways and away from the Vennillion St. walk.
4. The 2 inch diameter water service line may not be able to provide adequate flow given the
40 - 45 psi water pressure available on the low water system.
5. Concrete curb and gutter should be constructed along the entire length of the 18th St.
frontage, constructed 18 ft. north of the centerline of the existing street. Concrete curb and
gutter should also be constructed west of the site to transition back to the existing
bituminous curb and gutter at a 30 degree angle.

Warning Siren Installation
At the City Council meeting on April 5, 1999 action was taken approving the installation
of a severe weather warning siren at the intersection of Tuttle Drive and Red Wing
Boulevard. Since that time, the City Staff have been working with the installers to secure
its location to the nearest power source. While once thought to be an NSP power source,
that proved to be too expensive. Instead, we are now looking at a Sprint power source for
the warning siren. It appears that this will be the most likely power source, but there is a
need for proper documentation and liability coverage/waivers for Sprint. I anticipate
having the necessary paperwork prepared soon, to allow for installation of the warning
siren, shortly thereafter. Should City Councilmembers have any questions, please do not
hesitate to contact me.
