Adoption requires a simple majority of the City Council. Background Information: The Fair Housing Policy attempts to ensure all people feel welcomed, treated fairly, and provided resources for fair housing when looking to reside in Hastings. Metropolitan Council has required adoption of a Fair Housing Policy to be eligible for future Livable Communities Development Agency Grants. The proposed policy is modeled after information provided by Metropolitan Council and other similar cities that have recently adopted Fair Housing Policies. Fair Housing Policy Statement: It is the policy and commitment of the City of Hastings to ensure that fair and equal housing opportunities are granted to all persons in all housing opportunities and development activities funded by the City regardless of race, color, religion, gender, sexual orientation, marital status, status with regard to public assistance, familial status, national origin, or disability. This shall be done through strong external policies that provide meaningful access to all constituents and fair housing informational and referral services; and internal practices and procedures do not discriminate and that affirmatively further fair housing. Policy Details The policy includes the following:  Recognition that the City of Hastings has limited resources available to solve diverse fair housing issues, but provides contacts for organizations that can assist.  Creation of Fair Housing information to be posted on the City website along with a Concern Report Form any fair housing issues. Meaningful Access i. Online Information. The City of Hastings will have information about fair housing displayed on its website under the category “Housing”. Information on the website will also include the City Staff contact for fair housing concerns. In addition, the City will post the following policies: 1. Hastings Fair Housing Policy 2. Link to the State of Minnesota’s Olmstead Plan ii. In-Person Information. Upon inquiries about fair housing policies, that individual will be directed to the Community Development Director who will provide information about reference organizations and inform them of City practices to ensure fair housing. c. Languages. The City of Hastings is committed to providing information in diverse languages for its residents. Therefore, if requested, the City of Hastings will connect the individual to an organization that can assist with translation of fair housing policies. d. Rental License Program. The City administers a rental licensing program which requires the property owners of rental dwelling units to obtain a license from the City. The City will provide information on this fair housing policy to licensees. The City will also consider hosting a training session for landlords that provides information on fair housing and other relevant landlord/tenant issues. 4. Internal Practices The City of Hastings commits to the following steps to promote awareness and sensitivity to fair housing issues in all its government functions. a. Reporting – If an individual calls or comes to City Hall to voice a fair housing concern, a Concern Report Form that includes the name, contact information, description of the concern and desired outcome will need to be completed. Once the report is completed City staff will connect the individual to organizations that can assist the individual. The Concern Report Form would then be on file at City Hall. Staff will follow-up as needed to ensure the individual has received assistance. b. Home Loan Program – The City of Hastings offers Home Loan Programs available to both owner occupied and rental units. These programs are intended to assist in providing resources for necessary improvements. These loans will be administered in accordance with the City’s Fair Housing Policy. VIII-02 c. Financial Assistance – Developers who seek financial assistance through the City for housing projects must adhere to the City’s Fair Housing Policy. Information on this policy will be provided to Developers at the onset of conversations regarding financial assistance. Developers will be required to execute a financial development agreement that includes language regarding fair housing and this commitment to uphold fair housing practices. d. Housing Analysis – The City will review its housing inventory to examine the affordability of both rental and owner-occupied housing and whether all reasonable actions have been taken to remove barriers to ensure adequate housing choice for all city residents. e. Code Analysis – The City will review its municipal code, with specific focus on ordinances related to zoning building and occupancy standards, to identify any potential for disparate impact or disparate treatments. Background Information: Small cell equipment is the next step in the evolution of this communications technology. A large push was made by industry in 2016-2017 nationwide to begin to deploy small cell installations. In Minnesota, this largely took place in the core cities of the metro area in advance of the Super Bowl. To stay ahead of the industry and set in place processes for regulating these deployments, cities were urged by the League of MN Cities and others to adopt changes to their codes. Hastings’ code revisions were made in 2017. Since that time the FCC has recently mandated that all cities having regulations on small cell technology also adopt policies setting expectations for the aesthetics and locations of equipment and poles. The FCC’s ruling requires these policies to be published by April 15th. City Attorney Dan Fluegel and I have worked to develop the attached policy, relying on guidance and templates from the League of MN Cities, as well as several example policies already in existence in other communities. The proposed policy is commensurate with expectations and standards set in these reference documents. Although it appears that the rate of installations in the metro area may have slowed somewhat since the initial push, and although we have not received any applications to date, we do expect over the next several years to encounter interest from carriers to deploy small cell technology in the City of Hastings, and with the adoption of this policy we will be prepared to regulate it for the best interests of all in the community. Financial Impact: The City is entitled to charge lease rates to small cell operators for each location where they make an installation of equipment on a city-owned utility or light pole, or a new standalone site location, and this has already been codified in Chapter 90.07 with the aforementioned updates made in 2017. There is no financial impact to the City for adoption of the aesthetic policy. Attachments: • Proposed Aesthetics Policy VIII-05 City of Hastings Small Wireless Aesthetic Standards Policy Findings The City desires the most advanced and highest quality wireless services available. The City also wishes to minimize the negative impacts associated with wireless facility deployments including small wireless facilities. Such negative impacts may include interference with right-of-way sight lines, aesthetic impacts that are inconsistent with the surrounding area, fall zone and clear zone risks, navigation obstacles, interference with future right-of-way improvement or transportation improvement plans, interference with the installation or maintenance of other utilities, and increased visual or noise pollution. To address such impacts, any person desiring to collocate small wireless facilities or place new wireless support structures in the right-of-way must first obtain a small wireless facility permit pursuant to the City’s right-of-way ordinance, Code Section 90.07. Moreover, any person seeking to collocate small wireless facilities on an existing wireless support structure owned or controlled by the City must first enter a standard collocation agreement. The following aesthetic standards and requirements are intended to maintain the City’s aesthetic environment while also allowing for the availability wireless services, including broadband and “5G” services, using small wireless facilities. These standards are intended to establish clear and consistent aesthetic standards for small wireless facility placements in the City and establish a streamlined review and approval process. The City will make these standards publicly available. These standards apply to all small wireless facility permit applications for placement of small wireless facilities on City-owned and non-City-owned support structures (poles), and the placement or replacement of small wireless support structures in the public right-of-way. Compliance with these standards is a requirement for, and condition of, issuance of a small wireless facility permit. Any installation that does not conform to these standards will be in violation of the associated permit and the City’s right-of-way ordinance. In addition to the following standards, the placement of new support structures for small wireless facilities shall be subject to any conditions specified in the small wireless facility permit. Applications to install small wireless facilities or place new support structures in districts zoned for residential uses or within a historic district established by federal or state law or city ordinance, shall further be subject to any conditions contained in the required conditional use permit authorizing such installation. With respect to City-owned support structures, these standards additionally seek to: 1. establish reasonable and practical design requirements for providers to implement when applying for new small wireless facility permits associated with City support structures. 2. minimize unnecessary placement of new poles by encouraging co-location of small wireless facilities. VIII-05 3. in situations where City support structures will be replaced, require that the structures be of a stealth design such that the maximum amount of facilities, including any wiring, are concealed inside the structure. 4. in situations where attachments will be made to existing poles, require that facilities, equipment, cabling, and conduit be concealed through the use of approved shrouding or camouflaging. Section 1. Site Plans Applicants must submit site plans, elevation drawings and structural calculations prepared and signed by a Professional Engineer licensed by the State of Minnesota as detailed below. Site plans must depict any adjoining or nearby existing wireless facilities, with all existing transmission equipment identified; neighboring public improvements; the proposed small wireless facility, with all proposed transmission equipment and other improvements, and; the boundaries of the area surrounding the proposed facility and any associated access or utility easements and setbacks. Site plans must further include: 1. Photo Simulations: For all applications, photo simulations must be included. Such photo simulations must be from at least three line-of-site locations near the proposed project site depicting the viewpoints of the greatest pedestrian or vehicular traffic. 2. Equipment Specifications: For all equipment depicted on the plans, the applicant must include: a. the manufacturer’s name and model number; b. physical dimensions including, without limitation, height, width, depth, volume and weight with mounts and other necessary hardware; c. technical rendering of all external components, including enclosures and all attachment hardware. Section 2. Design Standards The City desires to promote aesthetically acceptable and area conforming wireless facilities using the smallest and least intrusive means available to provide small wireless services to the community. All facilities in the public right-of-way must comply with all applicable provisions in this section. Antennas: Antennas must be top-mounted and concealed within a radome (a structural, weatherproof enclosure that protects an antenna and is constructed of material that minimally attenuates the signal transmitted/received by such antenna) or otherwise concealed to the extent feasible. Cable connections, antenna mounts and other hardware must also be concealed. The 2 VIII-05 radome or other concealment must be non-reflective and painted or otherwise colored to match the existing support structure. The diameter of the antenna or antenna enclosure should not exceed the diameter of the top of the wireless support structure pole, and to the maximum extent practical, should appear as a seamless vertical extension of the pole. Collocation: Collocations between wireless service providers on the same support structure is required wherever feasible. If an applicant chooses to not collocate in areas where options are or appear to be available, the applicant must document the reasons that collocation is infeasible. Concealment: Concealment elements must be incorporated into the proposed design of the small wireless facility installation, and must include approved camouflaging or shrouding techniques. All equipment, including cables and wires, must be fully concealed on the support structure and shall match the color of the support structure. All equipment enclosures including electric meters shall be as small as feasible, and in no case shall the total volume of enclosures mounted on a small wireless support structure exceed six cubic feet in volume. Pole-Mounted Equipment Cages/Shrouds: When facilities are permitted to be pole- mounted, facilities other than the antenna(s), electric meter and disconnect switch must be concealed within an equipment shroud. The facilities must be installed at a height that presents the least aesthetic impact, but in no event lower than 15 feet above ground level. The equipment shroud must be non-reflective and painted, wrapped or otherwise colored to match the support structure. Shrouds must be mounted flush to the support where feasible. Standoff mounts must provide the minimum separation distance from the support structure necessary for feasibility. Tree Impacts: Tree “topping” or improper pruning of trees for gaining of clearance between a wireless support structure and/or antenna equipment is prohibited without explicit approval by the City. New Poles: New support structures must be the same color as neighboring, similar support structures and of the same design characteristics. Ground-Mounted Equipment: Ground-mounted equipment must be installed below grade or, if technically necessary, concealed in a ground-mounted cabinet. In addition to any applicable requirements in the City’s right-of-way ordinance, Code Section 90.07, ground mounted cabinets must: 1. be installed flush to the ground; 2. be the same color as neighboring, similar support cabinets or other ground-mounted structures; 3. on or adjoining sidewalks, trails, or other similar passageways, not interfere in any way with the flow of pedestrian, bicycle or vehicular traffic or violate any applicable local, state or federal safety or design standards; 3 VIII-05 4. conform to the American’s with Disabilities Act (ADA) including with respect to appropriate sidewalk spacing; and 5. not create a safety hazard; 6. Signage, Logos, Decals, & Cooling Fans: a. Signage: The small wireless facility operator/permittee shall post its name, location identification information, and emergency telephone number in an area on the cabinet to the small cell facility that is visible to the public. Signage shall not exceed 4 inches x 6 inches. b. Logos: The small wireless facility operator/permittee shall remove or paint over unnecessary equipment manufacturer decals in a color that matches the wireless support structure as approved by the City. Small wireless facilities and wireless support structures shall not include advertisements and may only display information required by federal, state, or local agencies. c. Cooling Fans: All equipment must use a passive cooling system unless otherwise substantiated by the operator/permittee and approved by the City. Any active cooling system considered for approval by the City shall have a low noise profile, and the operator/permittee shall submit equipment specifications for review. Lights: Unless otherwise required for compliance with FAA or FCC regulations, small wireless facilities shall not include any lights or lighting. This subsection does not prohibit installations on streetlights or the installation of luminaires or additional street lighting on new support structures if and where required by the City. Section 3. Location Criteria Obstructions: Any new support structure or other facilities associated with a new or existing support structure must not obstruct access to: 1. any existing above-ground or underground right-of-way user facilities, or public facilities; 2. any public infrastructure for traffic control, streetlight or public transportation purposes, including without limitation any curb control sign, parking meter, vehicular traffic sign or signal, pedestrian traffic sign or signal, barricade reflectors; 3. any public transportation vehicles, shelters, street furniture or other improvements at any public transportation stop (including, without limitation, bus stops, streetcar stops, and bike share stations); 4. fire hydrants; 5. any doors, gates, sidewalk doors, passage doors, stoops or other ingress and egress points to any building appurtenant to the right-of-way; and/or; 6. any fire escapes; and/or 7. Other public infrastructure owned and maintained by the City. Section 4. New and Replacement Support Structures 4 VIII-05 New Support Structures: Any new support structures shall be placed: 1. a minimum of 250 feet from any existing support structure or pole, and 2. at a distance which is the same as the prevailing separation distance among existing structures and poles in the surrounding vicinity as agreed upon by the applicant and City, or determined by the City where agreement cannot be reached. 3. as functional streetlights as the City may require, in its reasonable discretion. 4. in alignment with existing trees, utility poles, and streetlights. 5. an equal distance between trees when possible, with a minimum of 15 feet separation such that no proposed disturbance shall occur within the critical root zone of any tree. 6. with appropriate clearance from existing utilities. 7. outside of a 20-foot equipment clear zone (for base cabinets less than 18-inches in diameter) or 30-foot clear sight triangle (for base cabinets equal to or greater than 18-inches in diameter) at intersection corners. 8. so as not to be located along the frontage of a Historic building, deemed historic on a federal, state, or local level. 9. so as not to significantly create a new obstruction to property sight lines. 10. at shared property lines if feasible. 11. not within 15 feet of the apron of a fire station or other emergency service responder facility. Replacement of City-Owned Support Structures: Any replaced support structures shall remain in their existing location unless otherwise permitted by the City. Replacement pole height shall not exceed 50 feet, or the height of the existing pole, whichever is greater. New and Replacement Structures. All support structures must: • be constructed of aluminum or stainless steel. • where constructed as a light pole, luminaire(s) and luminaire arm(s) must match adjacent city lighting standard and must contain a light fixture in accordance with City specifications 5 VIII-05 City Council Memorandum To: Mayor Fasbender & City Council Members From: Ryan Stempski – City Engineer Date: April 9, 2019 Item: Authorize Project Work – 2020 Neighborhood Infrastructure Improvements Council Action Requested: The Council is requested to authorize the Engineering Department to take up the required field data collection (surveying, pipe condition evaluation, and geotechnical investigation), design work, the preparation of a feasibility report, and an appraised benefits analysis for the 2020 Neighborhood Improvement Area. Background Information: The City’s Capital Street Improvement Plan calls for 15th Street from Tyler Street to Pine Street; 21st Street E and Commerce Drive; Cannon Street, 22nd Street W, 23rd Street W, 24th Street W and 25th Street W to be improved in 2020 as the City budget will allow. 15th Street and a portion of Cannon Street are on the State Aid System and subject to certain design standards to receive State Aid funding. The remainder of the streets are local and would receive a street improvement based on results of geotechnical evaluation and the need determined for the underground utility improvements. Funding through the Vermillion River Watershed has been secured in the amount of $184,600 to assist in water quality improvements along 21st Street E. A survey will need to be completed to begin design for these street segments. Water and sanitary sewer mains will need to be evaluated for their current pipe condition. A geotechnical investigation will have to be conducted to identify subsurface conditions in order to verify design assumptions and anticipate construction costs. An appraised benefits analysis will also need to be completed to prepare a preliminary assessment roll for the project. In order to initiate these improvements, the Council must direct the preparation of a feasibility report as required by the statutory process for public improvements that are specially assessed. Financial Impact: The costs for surveying, pipe condition assessment, appraised benefits analysis, and geotechnical investigation will be covered through reimbursement from bonded debt funds when bonds are issued for construction of the project in 2020. These services will need to be outsourced to consultants, therefore fee estimates will be obtained and managed within the overall project budget. BACKGROUND INFORMATION The City received three bids for this project on March 20th. A summary of the bids is listed below. Bidder Total Bid A-1 Excavating – Bloomer, WI $3,375,829.75 Danner – South St. Paul, MN $3,490,452.25 Northdale Construction – Albertville, MN $3,775,152.18 All three bids were competitive, and the overall cost arrived within City budgetary constraints. The engineer’s construction cost estimate for this work was $3,493,500. POST-BID CONTRACTOR QUALIFICATION REVIEW Contractors who furnished a bid were required to include a completed questionnaire and to submit a variety of company background and experience data to substantiate their ability to perform the work on this project. Contractors’ proposals were also scored using objective criteria for the information being submitted. A score of 10 points being the minimum necessary to be considered qualified to perform the project work. The qualification review for A-1 Excavating determined that their proposal score was 11 points, which meets the minimum score necessary to be considered qualified to perform this project. We also had a discussion with A-1 Excavating on dedicating an experienced and qualified project superintendent and committing to an early season start date to avoid delays associated with late fall construction. STAFF RECOMMENDATION Staff is recommending that the City Council move forward in adopting the attached resolution awarding the contract to A-1 Excavating, in the amount of $3,375,829.75. RESOLUTION RECEIVING BIDS AND AWARDING CONTRACT FOR PROJECT 2019-1 2019 NEIGHBORHOOD INFRASTRUCTURE IMPROVEMENTS WHEREAS, pursuant to an advertisement for bids for Project 2019-1, the 2019 Neighborhood Infrastructure Improvements project, and bids were opened on March 20, 2019 and tabulated according to law, and the following bids were received: Bidder Total Bid A-1 Excavating – Bloomer, WI $3,375,829.75 Danner – South St. Paul, MN $3,490,452.25 Northdale Construction – Albertville, MN $3,775,152.18 and WHEREAS, each bidder was required to submit detailed information regarding their company’s ability to perform said project, and said information was reviewed and scored through the use of objective criteria for the purposes of determining bidder’s ability to perform the project work, and WHEREAS, the lowest bidder, A-1 Excavating, met the minimum number of points in the bidder’s qualification review to meet the requirements, and WHEREAS, it appears that A-1 Excavating is the lowest responsible bidder. BACKGROUND Existing Condition The site is nearly five acres, including a few platted city blocks, undeveloped city rights-of-way, and property owned by the Minnesota Department of Transportation. The site contains an athletic stadium, storage building, concession building, bleachers, and a gravel parking lot. Proposed Condition Proposed improvements generally include the installation of a synthetic turf, handicap bleacher lift, parking lot paving, trash enclosure, ticket buildings, and reconstruction of the concessions building. Encouraging facility users and visitors to arrive by bike and on foot will be an important strategy for reducing motor vehicle traffic congestion on MN 55 and MN 61, as well as mitigating parking concerns in the adjacent residential neighborhood. Therefore, MnDOT strongly recommends that bicycle racks be included at the facility. Background Information: Muath Ahmed submitted an application for an Exclusive Tobacco Store license on February 6, 2019. Upon completion of a standard background investigation, it was revealed that Mr. Ahmed was convicted of selling tobacco to a minor in 2017, a conviction Mr. Ahmed did not disclose on his application. Both the conviction and the failure to disclose the conviction on the application are reasons the Council may consider for denying the application. Attached is a letter from Mr. Ahmed’s attorney we received after asking Mr. Ahmed to provide any explanation he wanted the City Council to consider on this issue. Per City Ordinance §112.05, an application can be denied on the basis of: (1) the applicant have been convicted within the past 5 years of any violation of a federal, state, or other law, ordinance provision, or other regulation relating to tobacco or tobacco products, or tobacco-related devices and (2) the applicant fails to provide information required in the application, or provides false or misleading information. NOW, THEREFORE, based upon the evidence and testimony the City Council of the City of Hastings makes the following: FINDINGS 1. The Application is deemed complete and the Applicant signed the Application attesting that all the statements in the Application are true and complete and that any misstatements or omissions of material facts may result in disqualification or denial of the license. 2. The Applicant seeks an Exclusive Tobacco Store License so that he may acquire and continue the operation of the existing tobacco store business currently operating at 1769 Market Boulevard in Hastings. The Application indicates the Applicant is a current employee of the existing tobacco store business. 3. Following receipt of the Application, the City completed a background check of the Applicant which revealed that the Applicant had been convicted of Misdemeanor Sale of Tobacco to a Minor in violation of Minn. Stat. § 609.685, subdivision 1(a) on January 11, 2017 (the “Conviction”) for an incident occurring on or about November 23, 2016 at 1769 Market Boulevard in Hastings. 4. The Application does not disclose the existence of the Conviction. 5. Upon receipt of the background check the City notified the Applicant of the apparent failure to disclose the Conviction on the Application and provided the Applicant an opportunity to submit supplemental information or an explanation regarding the apparent failure to disclose the Conviction on the Application. The attorney for the Applicant X-C-01 submitted a letter dated March 29, 2019 which acknowledged the failure to disclose the Conviction in the Application but explaining the omission was due to a misunderstanding by the Applicant and was not intentional. That letter has been considered by the City Council and is part of the record. 6. Hastings City Code Section 112.05 provides: § 112.05 BASIS FOR DENIAL OF A LICENSE. (A) Generally. The following shall be grounds for denying issuance or a renewal of a license under this chapter. Except as may otherwise be provided by law, the existence of any particular ground for denial does not mean that the city must deny the issuance or renewal of the license. If a license is mistakenly issued or renewed to a person, it shall be revoked upon discovery the person was ineligible for the license under this section. (B) Specifically. (1) The applicant is under the age of 18 years. (2) The applicant has been convicted within the past 5 years of any violation of a federal, state, or other law, ordinance provision, or other regulation relating to tobacco or tobacco products, or tobacco-related devices. (3) The applicant had a license to sell tobacco, tobacco products, or tobacco related devices revoked within the preceding 12 months of the date of application. (4) The applicant fails to provide information required in the application, or provides false or misleading information. (5) The applicant is prohibited by federal, state, or other local law, ordinance, or other regulation, from holding such a license. (6) The applicant or license holder has outstanding fines, penalties, or property taxes owed to the city. CONCLUSION Muath Ahmed was convicted within 5 years of the date of the Application of violating a state law relating to tobacco and the Conviction was not disclosed on the Application. For these reasons and based on the provisions of City Code § 112.05, the Application should be denied. ORDER The application of Muath Ahmed for an Exclusive Tobacco Store License for the premises at 1769 Market Boulevard in Hastings is hereby denied for the reasons set forth above. The City Clerk shall mail a copy of this Resolution to the Applicant as notice of the denial. As provided in City Code § 112.13, the Applicant may request a hearing on the denial before the City Council. Any request for a hearing must be made by the Applicant in writing and filed with the City Clerk within 10 days of the mailing of the notice of denial to the Applicant. Failure to file a request for a hearing within the required time shall be deemed a waiver of any further right to a hearing on the denial.
