Members Present: Mayor Fasbender, Councilmembers Balsanek, Braucks, Folch, Leifeld, Lund and Vaughan. Staff Present: Interim City Administrator Julie Flaten City Attorney Dan Fluegel Police Chief Bryan Schafer Fire & EMS Director Mike Schutt Public Works Director Nick Egger City Engineer Ryan Stempski Presentation: New Employee Introductions Flaten introduced the new Deputy City Clerk Erica Henderson and Chief Schutt introduced the new Fire and EMS responder Joe Cysiewski. Swearing-in of New Officers New officers, David Bauer, Jacob Willers, Nicholas Cross, Daniel Vomastek and Michelle Caballero were introduced by Chief Schafer; Flaten administered the Oath; and badges were pinned by family member. Approval of Minutes Mayor Fasbender asked if there were any additions or corrections to the minutes of the City Council Workshop or to the Regular City Council Meeting on March 4, 2019. He also detailed how the proposed assessments were determined and how residents may pay the assessment fee. Mayor Fasbender opened the public hearing at 7:31 p.m. Shelly Rohr, 2420 Southview Court, objected to the special assessment calculation method for the double cul-de-sac and claimed the ordinance and their constitutional rights were violated and explained why. She also cited the names of residents who provided written appeals to assessment amounts and gave them to Interim City Administrator Julie Flaten. Teal Girgen, 2430 Southview Court, discussed why he opposed the assessment calculation. Bob Kleis, 2470 Southview Court, stated that the assessment calculations were incorrect. Chris Hornisch, 1928 Manor Lane, disagreed with the assessment amount and that the public hearing process was difficult. Frank Siben, 2925 Highview Knoll, disagreed with the cul-de-sac amount of assessment. He inquired about the appeal process. City Attorney Fluegel described the appeal process. Dan Lavalla, 1948 Manor Lane, objected to the amount, fairness and timing of the assessment. Gary McNamara, 355 Hackberry Circle, recommended tabling the vote for this item and claimed the original road construction was faulty. Fred Rueman, 335 Hackberry Circle, discussed current road conditions and was objected to the assessment calculations. Todd Herbst, 3275 Lester Avenue, disagreed with the assessment calculation and the $50 Dakota County fee. He agreed that this topic should be tabled. Bruce Ganrud, 1895 Louis Lane, opposed how corner lots were assessed and provided Interim City Administrator Julie Flaten with a written objection. Dave Greengo, 705 Bohlken Drive, disagreed with which streets were included in the project scope. Rohr and Greengo both favored to table this discussion. Jewel Pickert, 570 Whispering Lane, spoke of the previous assessment to her condo. Mayor Fasbender closed the public hearing closed at 8:15 p.m. Per Council’s instruction, City Engineer Stempski responded to the various questions and concerns posed by the residents. He also described the method of determining assessment amounts. Council discussed the assessment calculations of irregular lots and cul-de-sacs, using franchise fees to fund road projects, process and appeal process for special assessments, property value appraisals and the issues of tabling the item. City Attorney Fluegel explained whether the item could be tabled or not. Councilmember Balsanek motioned to approve as presented, seconded by Councilmember Vaughan. Ayes, 7; Nays, 0. Update on Spring Flood Forecast & Request to Authorize Flood Preparation Actions Public Works Director Egger explained the flooding forecast and the City’s anticipated response to potential flooding. Council discussed the possibility of a train stopped on 2nd Street and blocking safety responders access to residents on the east side of the City, the City would provide sandbags to residents, the City’s cleanup efforts after the flood and the level of the Vermillion River. Councilmember Balsanek motioned to approve as presented, seconded by Councilmember Leifeld. Ayes, 7; Nays, 0. The event would start Saturday, June 15, 2019 and continue every other Saturday through September 7, 2019 from 4:00 p.m. to 9:00 p.m. Council discussed public parking areas and appreciation towards Kevin Hoeschen for coordinating the event. Councilmember Vaughan motioned to approve as presented, seconded by Councilmember Leifeld. Ayes, 7; Nays, 0. Resolution No. 03-06-19: Support of Comprehensive Transportation Funding Councilmember Balsanek stated that the League of Minnesota Cities requested cities to pass this resolution and to forward it to the State Legislature. He stressed that this resolution was not related to a gas tax or any tax increase. Council discussed Local Road Improvement Grants, City Councils’ ability to tax for road improvements at local level and that support of this resolution does not provide support for tax increase. Mayor Fasbender and Councilmembers made the following announcements:  Parks & Recreation Commission Workshop on Tuesday, March 19 at 6:30 p.m. at Joint Maintenance Facility.  Heritage Preservation Commission meeting on Tuesday, March 19 at 7:00 p.m. at City Hall.  Public Safety Advisory Commission meeting on Thursday, March 21 at 6:30 p.m. at City Hall.  Planning Committee of the Council will meet on Monday, March 25th at 6:00 p.m. at City Hall to discuss the keeping of chickens.  Planning Commission meeting on Monday, March 25 at 7:00 p.m. at City Hall.  Councilmember Vaughan will attend the Red Rock Corridor meeting on Thursday, March 28th at Newport City Hall.  Councilmember Folch expressed gratitude for Congresswoman Craig’s meeting with local leaders on Friday, March 15th to discuss local issues. The 2019 Crack Seal Program consists of routing and filling pavement cracks with a hot rubber crack sealer up to 10.5 miles of streets or $15,000 maximum, whichever comes first. Financial Impact: The crack sealing budget is $15,000 and will be paid out of Upkeep to Grounds. Background Information: A mill and overlay is a street maintenance technique that extends the life of a pavement by removing the top layer of pavement by milling off the surface. After the top layer is removed, a new layer of bituminous pavement is put back in its place. The ideal street to mill and overlay contains the following characteristics: • Age: 20-25 years old • Pavement Condition Index (PCI) Rating: 55-70 on a scale of 0-100, 100 being a brand new road in perfect condition. • Cross Section: 4” minimum pavement thickness • Surface: Cracks becoming wider and more abundant. Potholes becoming more prevalent. Surface may appear better than the actual road condition dictates. Annual maintenance costs begin to spike. • Base: Generally in good condition. The project proposes to mill the top 2” of pavement for 1.46 miles on Ramsey St from 10th St to 18th St, Tyler St from 10th St to 18th St, River St from 4th St to Hwy 55, and pedestrian ramp safety improvements located on General Sieben Dr at Market Blvd and South Frontage Rd. Please note: This scope varies from the one proposed in the 2019 Budget requests, which included Northridge Drive instead of River Street. Late in the budgeting process funding for the program was reduced and staff made adjustments to maximize utilization of the approved funding in the 2019 Budget. Ramsey St, Tyler St, and River St were last constructed in 1991, 1992 and 1987 respectively. PCI ratings fall narrowly below the targeted range for a mill and overlay however they remain a good candidate for a mill and overlay since most of the dilapidation can be attributed to surface stripping and potholing. The base remains in decent condition. The project also includes replacing the adjacent sidewalk pedestrian ramps to include truncated domes to meet ADA standards, spot replacement of curb and gutter, spot replacement of rings and castings on catch basins and manholes, and spot replacement of problematic top box sections on gate valves. Centerline striping will remain the same as the existing layout. The timeline for this project is to begin construction as early as June 10th and be wrapped up by no later than July 18th to accommodate Kennedy Elementary School and Rivertown Days festivities. The entire process should take approximately 3-4 weeks. VIII-04 Financial Impact: Ramsey St and Tyler St from 10th St to 15th St are State Aid streets. The City’s Municipal State Aid for Local Transportation account via MnDOT and not the general fund will account for a targeted cost of $200,000. The state aid portion has an estimated construction and inspection cost of $207,000. Ramsey St and Tyler St from 15th St to 18th St and River St from 4th St to Hwy 55 are local residential non-State Aid streets and is allotted a $200,000 budget. The non-State Aid portion has an estimated construction and inspection cost of $200,000. General Sieben Dr pedestrian ramp safety improvements has a $65,000 budget and the construction cost estimate is $54,000. Background Information: The original development agreement was executed in 2000 for the redevelopment of the former Guardian Angels Church and School located at 208 East 4th street by Sherman Associates. The project included the establishment of a TIF district and the issuance of a loan by the former Hastings Housing and Redevelopment Authority (HRA). Met Council also gave several grants to the project through Livable communities, one which was structured as a loan. The Met Council loan was for $328,500 to enable Sherman Associates to acquire and rehabilitate an existing building. It was interest free and repayment was due at the end of 30 years or in 2031. The grant was structured in this manner for tax reasons that benefitted the developer. The City had to authorize the loan but was not entitled to any repayment, as Met Council would receive any funds repaid. Common Bond is now purchasing the property from Sherman Associates. They plan to add three units to the area once designated as a daycare, and rehabilitate the property. Common Bond has requested the $328,500 Metropolitan Council loan be forgiven. Met Council has reviewed the request and related documents and does not see a conflict in the City forgiving the Met Council loan. Met Council is granting additional monies to Common Bond for the remodel and renovation costs. Financial Impact: The attached resolution reassigns the loan to Common Bond. It then terminates the Loan agreement and note, and authorizes the release of the mortgage. There is no financial impact to the City as we were a pass through for the loan from Met Council. In 2018, the Engineering Department hired an intern to collect data on what infrastructure we have and in what condition it is in. Sidewalks, trails, pedestrian ramps, and parking lots were identified and rated. Costs for upgrading the deficiencies were calculated. By December 2018, a draft ADA Transition Plan was drafted that described a 30 year plan to bring its infrastructure in to full ADA compliance. After meeting with the Operations Committee on January 23, 2019, City staff held an informational public meeting on February 27, 2019 to discuss the draft plan and to gain feedback from the public. For reference, these comments are attached. Applicable comments have been updated within the plan. City Council is requested to approve the ADA Transition Plan. Approving of the plan allows the City to continue its practice of applying, when applicable, for Federal Funding for projects within the public right of way. The proposed ADA Transition Plan can be found on the City’s website: www.hastingsmn.gov/ADA Financial Impact: The City of Hastings is mandated (unfunded) to bring the system in to ADA compliance. The cost estimate to bring all infrastructure within City of Hastings public right of way in to ADA compliance is 4.7 million dollars. The property is wooded with moderate slope and contains a 40 foot deep ravine traversing the north central area of the property. Access to the existing home is provided from a private joint driveway shared with the easterly adjacent property located within Nininger Township. The property was annexed to the City of Hastings in 2002. Financial Impact: Subdivision will create an additional lot for construction of a single family home. Hold a public hearing and review the following actions requeste d by Johnson & Schofield Land  Surveying on behalf of property owned by Shelly Kranz located at 1548 Featherstone Road:    1) Minor Subdivision – Split a 13,299 s.f. lot from a 2.52 acre lot.     2) Variance to Hastings City Code Chapter 155.50 – Residential Lot Regulations.  Request  to vary 45 feet from the 75 foot minimum lot width at front setback requirement.   Proposed lot would be 30 feet in width for the front 143 feet of lot depth.  Beyond  143 feet the lot would meet minimum width requirements.    BACKGROUND  Existing Condition  The 2.52 acre property contains a single family home constructed in 1976.  The property is  wooded with moderate slope and contains a 40 foot deep ravine traversing the north  central area of the property.  Access to the existing home is provided from a private joint  driveway shared with the easterly adjacent property located within Nininger Township.  The  property was annexed to the City of Hastings in 2002.    Proposed Condition  Subdivide a 13,299 s.f. lot (93’ x 143’) from the existing 2.52 acre lot for future construction  of a new home by the current property owner.  The new lot is located at the southwest  corner of the existing lot with frontage on Featherstone Road.    Comprehensive Plan Classification  The site is designated as “Low Density Residential” in both the 2030 and 2040 Hastings  Comprehensive Plan.  Site development is consistent with the Plan.    Planning Commission Memorandum X-B-01 Zoning Classification City Code Chapter 154 – Subdivision Regulations outlines rules and procedures for division  of property.  Smaller subdivisions resulting in the creation of no more than three lots and  not requiring new roads are considered “Minor Subdivisions” and can be completed without  the need for Preliminary and Final Plat.  Minor Subdivision regulations are outlined in  Chapter 154.10. Zoning Regulations  Parcel 2 would not meet the minimum 75 foot width requirement or the R‐1 District and  would require approval of the variance submitted in conjunction with the subdivision  application.  The two parcels would meet all other minimum size and setback requirements  of the Zoning Ordinance.     Permanent Street and Utility Easement  The current property is unplatted and extends to the centerline of Featherstone Road.   Since the City has maintained the right‐of‐way area for at least six years we have acquired  right‐of‐way interest through Minnesota State Statutes.  To make ownership of the right‐of‐ way more definitive, the City will require recording of a Permanent Street and Utility  Easement as a condition of subdivision approval.  The Easement would be recorded against  the property to more clearly delimit the extents of the right‐of‐way.    Public Utility Access  Water and sanitary sewer services were stubbed near the shared driveway abutting the  property to the east.  Since the service stubs are not located on the newly created property  the owner would need secure rights from the abutting property owners to construct and  maintain service lines.    Public Land Dedication  City Code Chapter 154.07 outlines public land (park) dedication requirements for  subdivision of property.  Cash in lieu of land dedication will be required in the amount of  $2,200 prior to recording of the subdivision with Dakota County.    Sewer Interceptor Fee  The developer shall pay $485 in sewer interceptor fees for the unit added through the minor  subdivision.  The payment is due prior to recording of the minor subdivision.     Landscape and Streetscaping  Existing vegetation located within the building addition area would be removed with new  vegetation being installed along a new outdoor patio area.    X-B-01 Landscaping  Requirements to plant a boulevard and front yard tree for the new home have been waived  due to the presence of existing trees on the property.    Tree Preservation Policy  Construction of the new home may require removal of trees.  Any tree removal shall adhere  to the City’s Tree Preservation Policy for replanting of significant trees removed.    Public Notification  Notice of the request was published in the Hastings Star Gazette and paper copies were  sent to all property owners within 350 feet of the property.  No comments have been  received to date.    RECOMMENDATION  Approval of the Minor Subdivision is recommended subject to the following conditions:    1) Approval of a Variance to the minimum lot width requirements of the R‐1 Zoning  District for the larger 2.2 acre lot.  2) Conformance with the plans submitted with the Planning Commission Staff Report  dated March 25, 2019.  3) VARIANCE REVIEW    Variance Definition  Variances are deviations from strict compliance of City Code provisions.  The Board of  Adjustment and Appeals may recommend issuance of a Variance upon determination of  findings of fact and conclusions supporting the variance as established in Chapter 30.02,  Subd. F of the City Code.    X-B-01 Board of Zoning Adjustment and Appeals  Hastings City Code Chapter 30.02 establishes the Board of Zoning Adjustment and Appeals  and appoints the Planning Commission to facilitate the Board’s roles and duties.   Applications for Variances require Board of Zoning Adjustment and Appeals review.     Requested Variance – Minimum Lot Width in the R‐1 Zoning District  Hastings City Code 155.50 – Residential Lot Regulations establishes minimum area and  setback requirements for various residential zoning districts.  The subject property is zoned  R‐1 and subject to the 75 foot minimum lot width requirement.  The lot width requirement  is established at the front setback line (20 feet).   The larger 2.22 acre parcel (Parcel 2)  would have a minimum lot width of 30 feet, requiring a variance of 45 feet from the 75 foot  minimum requirement.    Variance Review  The Planning Commission may consider variances to the Zoning Code that are not contrary  to the public interest where owing to special conditions, and where a literal enforcement of  the provision of the City Code would result in practical difficulties.  Variances may be granted  providing the following has been satisfied:      (1)  Because of the particular physical surroundings, shape or topographic conditions of the  land involved, a practical difficulty to the owner would result, as distinguished from a mere  inconvenience, if the strict letter of the regulations were to be carried out;  The shape of the land provides a practical difficulty.  The minimum lot width cannot be  achieved at the 20 foot setback line; however the property would be 113 feet wide where  the existing house is set.    (2) The conditions upon which the petition for a variance is based are unique to the tract of  land for which the variance is sought and one not applicable, generally, to other property  with the same zoning classification;  Additional public utility stubs were placed to facilitate future subdivision of the property.     (3) The purpose of the variance is not based exclusively upon a desire to increase the value  or income potential of the parcel of land;  The current owner of the parcel seeks to construct a new home for their use on the newly  created parcel.     (4)  The granting of the variance will not be detrimental to the public welfare or injurious to  other land or improvements in the vicinity in which the tract of land is located;  Granting of the variance will not be detrimental to the public welfare or injurious to other  land improvements in the vicinity.    (5)  The proposed variance will not impair an adequate supply of light and air to property,  or substantially increase the congestion of the public streets, or increase the danger of fire,  X-B-01 The property will not impair light, air, congestion, fire danger, public safety, or property  values within the vicinity.     (6)  (7) The variance is consistent with the comprehensive plan;  The property is guided for low density residential development.  The proposed use is  consistent with the Comprehensive Plan.
