Swearing-In of New Officers Police Sergeant – David Bauer New Police Officer – Jacob Willers New Police Officer – Nicholas Cross New Police Officer – Daniel Vomastek New Police Reservist – Michelle Caballero Chief Schafer introduced the Officers, Flaten administered the Oath and badges were pinned by family members. V. APPROVAL OF MINUTES Approve Minutes of the Regular City Council meeting and Workshop on March 4, 2019 Minutes were approved as presented. VI. COMMENTS FROM THE AUDIENCE VII. COUNCIL ITEMS TO BE CONSIDERED VIII. CONSENT AGENDA The items on the Consent Agenda are items of routine nature or no perceived controversy to be acted upon by the City Council in a single motion. There will be no discussion on these items unless a Councilmember so requests, in which event the items will be removed from the Consent Agenda to the appropriate Department for discussion. Councilmember Balsanek asked for #7 to be removed. This will be placed as #2 under Administration. Folch, Braucks to approve as amended. 7-0 1. Pay Bills as Audited 2. Resolution No. 03-04-19: Approve Fireworks License for TNT tent at Wal-Mart parking lot 6. Resolution No. 03-05-19: Approve Lawful Gambling Premise Permit for Irish Football Boosters 7. Resolution No. 03-06-19: Support of Comprehensive Transportation Funding IX. AWARDING OF CONTRACTS AND PUBLIC HEARING These are formal proceedings that give the public the opportunity to express their concern, ask questions, provide additional information, or support on a particular matter. Once the public hearing is closed, no further testimony is typically allowed and the Council will deliberate amongst itself and with staff and/or applicant on potential action by the Council. 1. Public Hearing – Proposed Special Assessments for 2019 Neighborhood Infrastructure Improvements Program Stempski introduced the item requesting Council to conduct a public hearing and to consider the resolution to adopt the proposed assessments for City Project 2019-1, the 2019 Neighborhood Infrastructure Improvements. With all roadways within the project area being neighborhood-level streets, abutting properties are proposed to be assessed in accordance with the City’s ordinance policy for non-collector roads. This policy dictates that the assessment rates are based on the estimated special benefit to the assessed properties accruing from the constructed improvements. Public Hearing opened at 7:31 p.m. Several residents provided written appeals to assessment amounts to the City Clerk. Shelly Rohr, 2420 Southview Court, objected to special assessment method of calculation for double cul-de-sac and claims ordinance and constitutional rights were violated. Teal Girgen, 2430 Southview Court, disagreed with assessment calculation. Chris Hornisch, 1928 Manor Lane, disagreed with assessment amount and process. Frank Siben, 2925 Highview Knoll, disagreed with cul-de-sac amount of assessment. Dan Lavalla, 1948 Manor Lane, objected to assessment amount, fairness, timing, and challenged appraisal. Gary McNamara, 355 Hackberry Circle, proposed tabling item and claims original road construction was faulty. Resident at 355 Hackberry Circle, discussed current road condition and assessment calculation. Todd Herbst, 3275 Lester Avenue, disagreed with assessment calculation and $50 Dakota County fee. Bruce Gandrud, 1895 Louis Lane, disagreed with corner lot assessment amount. Dave Greengo, 705 Bohlken Drive, disagreed with streets included in project scope. Jewel Pickert, 570 whispering Lane, lives in condo and shared previous years assessment amount. Public Hearing closed at 8:15 p.m. City Engineer Stempski provided clarification on thorough communication process with neighborhood, several opportunities for resident input throughout process, irregular lot size calculation methodology, reclaim area designs standards, $50 Dakota County fee is a pass-through, funding mechanisms, and how assessment determinations are made. Councilmembers discussed calculation of irregular lot and cul-de-sac assessment amounts, option to move to franchise fee to pay for road construction projects, process and appeal process for special assessments, appraisals, and assessments vs. property values and pitfalls with tabling item to a later date. X. REPORTS FROM CITY STAFF These items are intended primarily for Council discussion and action. It is up to the discretion of the Mayor as to what, if any, public comment will be heard on these agenda items. A. Public Works 1. Resolution No. 03-07-19: Approve Special Assessments for 2019 Neighborhood Infrastructure Improvements Program Balsanek, Vaughan to approve as presented. 7-0 2. Update on Spring Flood Forecast & Request to Authorize Flood Preparation Actions Egger presented introduced the item requesting Council to approve a similar flood fighting policy as adopted in 2011. City forces would provide sand, sandbags, logistical support, and hauling of filled sandbags to curbside locations, but City forces will not be used to fill sandbags or to build barriers on private property. After the flood, City forces will haul away all sandbags that are brought back out to the curb. Council discussion on CP Railroad blocking crossing at 2nd Street for access needed by East Side residents, City collection of sandbags and sand after flood event, no cost to residents for sandbags and sand provided by City, Vermillion River levels and flows. Balsanek, Vaughan to approve as presented. 7-0 B. Community Development C. Administration 1. Approve 2019 Historic Downtown Hastings Cruise-In Chief Schafer introduced the item requesting Council to designate the Historic Hastings Downtown Cruise-In as a Special Event with conditions. The Downtown Business Association is planning for the 2019 Annual Cruise-In events. The requested dates begin on Saturday, June 15, 2019 and every other Saturday through September 7, 2019 from 4:00 p.m. to 9:00 p.m. The details of this event are similar to previous years with recommended new conditions regulating parking from City Staff. Council discussion on public parking, new parking ramp completion date and appreciation for work Kevin Hoeschen has done with event over several years. Vaughan, Leifeld to approve as presented 7-0. 2. Resolution No. 03-06-19: Support of Comprehensive Transportation Funding Councilmember Balsanek provided clarification on origin of resolution (League of Minnesota Cities) and cities were asked to pass resolution to be sent onto State Legislature. Balsanek clarified this resolution was not related to a gas tax or any tax increase. Council discussion on Local Road Improvement Grants, City Councils’ ability to tax for road improvements at local level, support of resolution does not provide support for tax increase. REPORTS FROM CITY COMMITTEES, OFFICERS, COUNCILMEMBERS  Parks & Recreation Commission Workshop on Tuesday, March 19 at 6:30 p.m. at Joint Maintenance Facility.  Heritage Preservation Commission meeting on Tuesday, March 19 at 7:00 p.m. at City Hall.  Public Safety Advisory Commission meeting on Thursday, March 21 at 6:30 p.m. at City Hall.  Planning Committee of the Council will meet on Monday, March 25th at 6:00 p.m. at City Hall to discuss the keeping of chickens.  Planning Commission meeting on Monday, March 25 at 7:00 p.m. at City Hall.  Councilmember Vaughan will attend the Red Rock Corridor meeting on Thursday, March 28th at Newport City Hall.  Councilmember Folch expressed gratitude for Congresswoman Craig’s meeting with local leaders on Friday, March 15th to discuss local issues.
