ADJOURNMENT: Next Regular City Council Meeting on Monday, December 18, 2000 Hastings,Minnesota November 20, 2000 The City Council of the City of Hastings, Minnesota met in a regular meeting on Monday, November 20, 2000 at 7:00 p.m. in the City Hall Council Chambers, 1010 Street East,Hastings, Minnesota. Members Present: Councilmember Riveness, Simacek, Hicks, Moratzka, Yandrasits &Mayor Werner Members Absent: Councilmember Johnson Staff Members Present: David Osberg, City Administrator, Shawn Moynihan, City Attorney; John Grossman, HRA Director Matt Weiland, City Planner; Tom Montgomery, Public Works Director Melanie Mesko, Administrative Assistant/City Clerk Approval of Minutes Mayor Werner asked if there were any corrections or additions to the minutes of the regular meeting of November 6, 2000 or the Special Meeting of November 9, 2000. Councilmember Hicks requested that the"Hayes" on the vote for a Minor Subdivision at 1803 Westview Drive be recorded on the November 6, 2000 minutes. With that correction, the minutes were approved as amended. Hastings City Council Minutes for Retular Meeting on November 20 2000 Pate 2 of 3 Public Hearing- Proposed Modification to Downtown Redevelopment Area Plan and TIF Plan and Proposed Tax Increment District No. 3 for the Guardian Angels Redevelopment Public Hearing was opened at 7:02 P.M. Mark Ruff of Ehlers and Associates, the public financial advisors of the Hastings HRA, was present to discuss how the TIF district is to be set up, used, and administered in this development. Hearing no other public comment, the public hearing was closed at 7:14 P.M. Resolution Approving Modification of the Downtown Redevelopment Area and TIF Plan and Establishment of Tax Increment District No. 3 for Qualified Housing District. Moved by Councilmember Yandrasits, seconded by Councilmember Riveness to amend the Redevelopment Area to exclude the additional lots located across the street from City Hall and Guardian Angels from the plan with staff to formally notify residents of any modifications in the future. 6 Ayes;Nays, None Moved by Councilmember Simacek, seconded by Councilmember Yandrasits to approve the amended Resolution for Modification for Downtown Redevelopment Area and TIF Plan and the establishment of Tax Increment Financing District No. 3. 5 Ayes; 1 Nay, Councilmember Riveness voting against First Reading and Order Public Hearing for Rezoning Bailey Ridge from R-1 to R-3 PRD City Planner Weiland stated that this rezoning request is consistent with the City's Comprehensive Plan. BACKGROUND The Utility Committee members, along with the City Staff are continuing to meet to discuss renewal of the cable television franchise with ATT Broadband. On November20, 2000 the Utility Committee conducted a meeting to discuss aspects of the franchise renewal that will be discussed in further detail with representatives from ATT Broadband. Until such time that the renewal discussions are complete, the City Council needs to take action granting a temporary extension for the operation of the cable system. Brian Grogan, an attorney from Moss and Barnett, who the City is utilizing to assist with renewal of the franchise renewal, has prepared the attached Resolution for the City Council to approve, which would grant the temporary extension through March 31, 2001. AUTHORIZING ATT BROADBAND TO TEMPORARILY OPERATE THE CABLE COMMUNICATIONS SYSTEM WHEREAS,the City of Hastings,Minnesota("City") passes and adopted an Ordinance(hereinafter referred to as the"Franchise")granting a non-exclusive franchise; and WHEREAS, the Franchise is currently head by ATT Broadband; and WHEREAS, pursuanf to Section 47 U.S.C. & 546 (a)ATT Broadband provided notification to the City of ATT Broadband's intent to seek renewal of the Franchise under 47 U.S.C. & 546(a-g); and WHEREAS, pursuant to Section 47 U.S.C. & 546 (a)the City properly commenced franchise renewal proceedings; and WHEREAS,the City and ATT Broadband have agreed, pursuant to 47 U.S.C. & 547(h),to conduct franchise renewal negotiations informally in an attempt to reach a mutually acceptable franchise agreement; and WHEREAS, the City and ATT Broadband are interested in continuing informal discussions and negotiations regarding franchise renewal; and WHEREAS, both the City and ATT Broadband desire to expressly reserve all of their respective rights under state and federal law. NOW, THEREFORE, be it resolved by the City Council of the City of Hastings, Minnesota that: I. The City hereby authorizes ATT Broadband to operate the cable television System in the City of Hastings, in full compliance with all of the terms and conditions of the Franchise, for a period commencing on January 1, 2001 and continuing through either the date on which ATT Broadband Franchise is either renewed or until March 31, 2001 whichever shall first occur. 2. A small square was left out of the street vacation (see map). This street vacation request will solve this problem. Background information: Dave Carroll has submitted an application and a petition to the City Of Hastings requesting the vacation of a portion of 4'h St. E (Site Location Map enclosed). The vacated property is legally described as follows: The east 33 ft of the platted Locust St Right Of Way located adjacent to Lot 4, Block 14, Barker's Addition, and southerly of the north line of the south 33 feet of 4`i' St extended westerly He is requesting this vacation for many reasons. The main reason is that the road has always been an unimproved city street and he would like to add this property to his property for future site development. He has been maintainin4 this property for many years. This request for a street vacation first came before the City Council back in April, 1999. There were concerns raised at that time about this street being used as a future public access for Lake Isabel. The item was tabled at that time to allow for a study being done on Lake Isabel to be completed. That study has now been completed. I would recommend the City Council order a new public hearing to discuss this street vacation to be held on February 22"a, 2000. If the City Council vacates this str applicant should be responsible for all recording fees required by Dakota County. Hastings on the Mississippi Planning Comments: Every property owner in the city has a right to petition the city to vacate street r.o.w. property. However, the City is not obligated to vacate street property. This property has always been unimproved. It is a slope that runs down to the flood plain. The applicant would like to maintain this property and possibly put a home on the property. The property owner is aware of the shoreland and flood plain rules in this area and will have to meet these rules in order to put a home in here. Currently, all collection of MSW and recycling is collected Monday — Thursday. The enclosed map outlines the current collection days. Because this work is performed in four days,we have four trucks (2 trash & 2 — recycle) trucks perform this work. Essentially, we are collecting an average of 1,086 homes each day. With the rate reduction that will take place on January 1, 2001, Waste Management is requesting to add a fifth collection day. The new collection day would be Friday; the enclosed map titled "proposed" outlines the new collection areas, and the enclosed flyer talks about the new collection areas. By adding a fifth day, we would be able to collect an average of 869 homes per day, and do this work efficiently with only one truck for MSW and one for recycling. The reduction in trucks will not result in a reduction of staffing at Waste Management — Hastings, as those employees would be shifted to collection areas in Washington and Goodhue County. Waste Management will employ Graphic Designs to create a similar map as the enclosed, that outlines the new collection days. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HASTINGS ESTABLISHING GUIDELINES FOR CIVIL PENALTIES FOR ILLEGAL LIQUOR SALES IN THE CITY OF HASTINGS DECEMBER 49 2000 Council member introduced the following Resolution and moved its adoption: WHEREAS, Minnesota Statutes Section 340A.503 and Hastings City Code Chapter 3.01 provide that it is a gross misdemeanor to sell,barter,furnish or give alcoholic beverages to a person under twenty-one years of age; WHEREAS,the City conducts regular compliance checks to insure that those establishments holding municipal liquor licenses in the City of Hastings are in compliance with this State Statute and City Code. In the event that a liquor license establishment is proved to have made an illegal sale, Minnesota Statutes Section 340A.415 authorizes the City Council to revoke the license or permit, suspend the license or permit for up to 60 days, impose a civil penalty of up to $2,000 for each violation or impose any combination of these sanctions; and WHEREAS, the Hastings City Council believes it to be in the public interest to establish guidelines for civil penalties to be imposed for illegal liquor sales in the City of Hastings; and WHEREAS, the City Council also believes these guidelines could be deviated from if the City Council deems it to be appropriate in a given case. NOW, THEREFORE,BE IT RESOLVED by the Hastings City Council as follows: A. The Hastings City Council establishes the following guidelines for civil penalties to be imposed for illegal liquor sales in the City of Hastings. The Hastings City Council reserves the right to deviate from these guidelines based upon the circumstances of each case. The following designated civil penalties are in addition to any criminal penalties that may be imposed by State law. 1. First Offense: Three hundred dollar civil penalty and a letter outlining the civil penalties that could be imposed if further violations occur. 2. Second Offense Within Any 24 Month Period: Seven hundred and fifty dollar civil penalty and a two day license suspension which will occur on a Thursday and Friday selected by the Council. 3. Third Offense Within Any 24 Month Period: One thousand dollar civil penalty and a five day license suspension which will include one consecutive Friday and Saturday selected by the Council. 4. Fourth Offense Within Any 24 Month Period: Two thousand dollar civil penalty and revocation of the liquor license. B. The City Council retains the right to impose a penalty different from those contained in this Resolution if the Council deems the circumstances warrant it. C. In the event of a new owner,the prior owner's violations, if any,will not roll-over to the new owner. The new owner will start out as having no first violations. If the new owner is related to the previous owner by blood,marriage or partnership of any type, the previous offenses will carry over to the new owner. D. When a first illegal sale is alleged to have occurred,documentation of the illegal sale shall be sent to the City Council by either the Chief of Police or the City Administrator, together with the proposed penalty called for by these guidelines. If no Councilmember objects to the proposed penalty within 7 days after the information is after the information is mailed to the City Council, then City staff will proceed to inform the liquor license holder of the penalties to be imposed pursuant to these guidelines. If a Councilmember objects to the proposed penalties, the Councilmember shall notify the City Administrator and the illegal liquor sale matter shall be placed on the next available City Council agenda for Council discussion. E. Upon proof that a first illegal liquor sale has occurred,the Chief of Police or the City Clerk shall issue a notice to the holder of the liquor license. That notice shall be given in person or by mail to the holder of the liquor license. The notice must contain the date,time and nature of the offense, the amount of the scheduled civil penalty. This notice must also provide that the liquor license holder can appeal the imposition of this penalty to the Hastings City Council by delivering to the City Clerk a written notice of appeal within 10 days of the date of the notice. Failure to timely pay the penalty shall be grounds for additional monetary penalties or license suspension or revocation. F. If the violation is a second or subsequent violation within a 24 month period, a hearing shall be held before the City C6dncil before any license suspension or revocation shall be imposed. The license holder shall be given notice of the hearing at least 10 days before the date of the hearing. The notice shall state the time,place and the nature of the charges. Proposed Liquor Ordinance Violation Guidelines and Illegal Liquor Sales Dear Mayor and City Council Members: Enclosed for council consideration are two separate matters related to illegal liquor sales in Hastings: 1. Proposed city council guidelines for imposing civil penalties for illegal sales. 2. Information on seven recent illegal liquor sales in Hastings. Proposed City Council Guidelines for Civil Penalties for Illegal Liquor Sales Several months ago, the city council had to address the issue of imposing penalties on a liquor license holder for an illegal liquor sale. At that time, the council expressed its desire to develop some form of guidelines that the city council could use for future illegal liquor sales. The administrative committee met and recommended the guidelines outlined in the attached proposed Resolution. These are only guidelines and can be deviated from when the council deems it appropriate in any given case. In general, the way these guidelines work for first violations is that the council will be notified of the illegal liquor sale and of the proposed monetary civil penalty to be imposed pursuant to these guidelines. If any council membU disagrees with the proposed action,that council member can notify the city administrator and the matter will be then put on the next council agenda for discussion. If no council member objects to the proposed action,the city staff will then proceed to impose the monetary penalty called for by the guidelines. *Also admitted to practice in Wisconsin Mayor Michael D. In that event,the matter would come before the city council for a decision. If there is no appeal, then the liquor license holder would be required to pay the monetary civil penalty. If the violation is a second or subsequent violation within 24 months,the guidelines call for a license suspension and possibly revocation. Under Minnesota law,a license cannot be suspended or revoked without the license holder being given an opportunity for a hearing before the city council. Therefore,before the license can be revoked or suspended it will be necessary for the city council to hold a hearing,just as it did last summer. Recent Illegal Liquor Sales. The Hastings Police Department has conducted compliance checks on July 27, 2000 and October 25, 2000. As the council has been informed, on July 27, 2000, employees at Super America on Pleasant Drive and The Bottle Shop made an illegal liquor sale. On October 25,2000, employees at the following establishments made illegal liquor sales: Rivers Grill and Bar,House of Wines, Sun Moon Buffet,The Bar and Short Stop Liquors. With respect to Super America,The Bottle Shop,House of Wines,The Bar and Sun Moon Buffet,these illegal sales are their first illegal sales within the past 24 months. With respect to Short Stop Liquor, their last illegal sale was 23 months earlier,in November 1998. With respect to Rivers Grill and Bar,this is their second illegal sale within the past seven months. If the council approves the attached Resolution, it may want to consider imposing the monetary civil penalty against the five establishments that had their first illegal liquor sale. With respect to Rivers Grill and Bar,this is their second violation in seven months. If the council is considering a license suspension, a hearing must be held and notice must be sent to the license holder for Rivers Grill and Bar prior to the hearing. Under current city ordinance,the notice must be published in the paper. The hearing could be held at the next city council meeting, December 18, 2000 or at any other time the council deemed appropriate. The council needs to decide if it is considering suspending the license and, if so, when it will conduct the required hearing. Mayor Michael D.
