ADJOURNMENT: Next Regular City Council Meeting on Monday, September 18, 2000 Hastings,Minnesota September 5,2000 The City Council of the City of Hastings, Minnesota met in a regular meeting on Tuesday, September 5, 2000 in the City Hall Council Chambers, 1014' St. East, Hastings, Minnesota Members Present: Councilmember Yandrasits, Riveness, Simacek, Johnson, Hicks, Moratzka& Mayor Werner Members Absent: None Staff Members Present: Dave Osberg, City Administrator; Shawn Moynihan, City Attorney; Matt Weiland, City Planner; John Grossman, HRA Director; Tom Montgomery, Public Works Director; and Melanie Mesko,Administrative Assistant/City Clerk Approval of Minutes Mayor Werner asked if there were any corrections or additions to the minutes of the regular meeting of August 21, 2000 and hearing none approved the minutes as presented. 7 Ayes;Nays,None. City Council Items to Be Considered City Administrator Osberg requested the Item VIII-B-9-Zoning Text Amendment-Section 10.07, Special Provisions-Temporary Car Sales be removed from the agenda. Moved by Councilmember Simacek,seconded by Councilmember Hicks,to remove Item VIII- B-9 from the agenda. 7 Ayes;Nays,None. Presentation Hastings Lions Club Mike Norgaard,on behalf of the Hastings Lions Club, presented checks to the City for a hockey park and a wild flower park. Bill Berg, also a member of the Lions Club stated that their Lions' involvement with the park is to attract more people by adding more items for people to enjoy at the park. On behalf of the City, Mayor Werner accepted the checks from the Hastings Lions Club and thanked them for their continued support in the community. United Way Portable Sign Permit Fee Waiver Tennis West-Construct Hockey Rink Behind Civic Arena-$75,629.00 Moved by Councilmember Johnson, seconded by Councilmember Riveness, to award the contract as presented. 7 Ayes;Nays,None Public Hearing-Hastings Marketplace Rezoning(C-4 to R-4) Mayor Werner opened the Public Hearing at 7:09 p.m.Matt said that this property it is currently zoned C-4 and the Rezoning request is for R-4 PRD,mixed use development,which is consistent with the comprehensive plan. Weiland also stated that the Planning Commission has recommended approval of the Rezoning. With no public comments to be heard,the public hearing was closed at 7:12 p.m. Ordinance-Rezoning of Hastings Marketplace from C-4 to R-4 Moved by Councilmember Hicks, seconded by Councilmember Simacek, to approve the ordinance for the Rezoning of the Hastings Marketplace. 7 Ayes;Nays,None Resolution No. 9-4-00-Preliminary/Final Plat-Hastings Marketplace Family Housing 1'and 2nd Addition Moved by Councilmember Moratzka, seconded by Councilmember Hicks, to approve the Preliminary & Final Plat for Hastings Marketplace Family Housing I I Addition. 7 Ayes;Nays,None Moved by Councilmember Simacek, seconded by Councilmember Moratzka, to approve the Preliminary& Final Plat for Hastings Marketplace Family Housing 2"d Addition. 7 Ayes;Nays,None Site Plan Hastings Marketplace Senior/Family Housing Project Councilmember Moratzka stated that Staff has worked with the public, based on their comments,to make changes to this project. She also stated that the Dakota County CDA builds quality facilities. Moved by Councilmember Hicks, seconded by Councilmember Moratzka,to approve the site plan for Hastings Marketplace Senior Housing Project. 7 Ayes;Nays,None Public Hearing-Industrial Park Rezoning I-2 to I-1 Mayor Werner opened the Public Hearing at 7:26 p.m. and, hearing no public comment, the public hearing was closed at 7:27 p.m. Ordinance-Rezoning of Industrial Park from I-2 to I-1 Moved by Councilmember Hicks, seconded by Councilmember Yandrasits, to approve the Rezoning from I-2 to I-1. 7 Ayes;Nays,None Minutes of the Regular City Council Meeting of September 5 2000 Page 3 of 4 Resolution No. 9-3-00-Minor Subdivision & Variance- 1516 Ramsey Street Moved by Councilmember Johnson, seconded by Councilmember Yandrasits, to approve a variance for 1516 Ramsey Street. 7 Ayes; Nays, None Moved by Councilmember Yandrasits, seconded by Councilmember Johnson, to approve the Minor Subdivision for 1516 Ramsey Street. 7 Ayes;Nays,None Special Use Permit-Tiller Corporation (Barton Sand and Gravel) County Rd 54 Mining Operation Matt Weiland stated that the Council is being requested to renew the soil processing special use permit for Barton Sand& Gravel subject to the conditions listed in the Planners Report of August 30, 2000. Weiland stated that additional conditions have been added as a result of the comments heard through the City-ordered Environmental Assessment Worksheet process. Weiland also stated that this permit would be in effect through December 2000 and Barton Sand& Gravel would need to apply for a new permit for the 2001 year. Councilmember Moratzka inquired as to who would monitor the condition as outlined and approved by the Council. Weiland stated that this is an annual permit and compliance with the conditions will be evaluated on an annual basis. Moratzka also inquired as to whether the $75,000 bond required by the City is adequate for clean-up should that be needed. Weiland stated that the amount required by the City is enough to reclaim each phase of the project as needed. Moved by Councilmember Riveness, seconded by Councilmember Yandrasits,to approve the special use permit for Tiller Corporation (Barton Sand& Gravel) County Road 54 mining operation with the conditions as presented in the August 30, 2000 City Planners report. 7 Ayes; Nays,None Site Plan-Park Place Storage Moved by Councilmember Johnson,seconded by Councilmember Riveness,to approve the site plan for Park Place Storage. 7 Ayes;Nays,None Site Plan-Hastings Civic Arena Locker Room Addition Councilmember Moratzka stated that she wanted clarification that all costs will be born by others, not the City, and the City will be held harmless for construction and other items. Councilmember Moratzka also added a friendly amendment that the agreement for payment be signed before a Certificate of Occupancy is issued. Moved by Councilmember Hicks, seconded by Councilmember Riveness, to approve the site plan for Hastings Civic Arena Locker Room Addition with the friendly amendment. 7 Ayes;Nays, None Exempt Employee Compensatory Time Policy City Administrator Osberg recommended approval of a Compensatory Time/Overtime Policy for all exempt employees. He stated that each position has been analyzed for exempt/non-exempt status and he is recommending a uniform policy for all positions as outlined in his August 31, 2000 memo. This item was referred to the Utility Committee of the Council for further information. Webster,Finance Director Subject: Utility bill fee waiver Date: September 13, 2000 A request is presented to waive a$50.00 fee that is applied to a customers account when the water is shut off(usually for non-payment) I received a phone call from the property owner regarding their bill. They had °just°received the shut off noticed so I instructed them to come in and pay the amount of the bill outstanding. The problems arises due to the fact that an employee at the front counter neglected to inform me that the water was already shutoff(thereby indicating they should pay the$50.00 to turn it back on,in addition to the outstanding balance)On top of this,that same employee then dispatched the utility department to turn the water back on when the owner paid(without the$50.00)This is not standard practice-the fees must be collected up front before the utility department is notified to turn the water back on. The personnel involved have been notified of this error. In addition to this,the homeowner also notified the City as to the incorrect mailing address on the bill. This also has since been corrected. For the reasons stated above, I am recommending that the council authorize the waiver of this fee. If you should have any questions,please feel free to contact me. 4-5-00 Hastings City Council We are requesting a refund on a disconnect charge on our previous water bill. Our water service was apparently disconnected in June at some time. We were on vacation when the disconnect notice was taken to our house. We returned the weekend of June 24th. We called the billing department and explained we never received the bill. W(;immediately did pay what we owed,and we were told we wouldn't be charged the disconnect fee, since we didn't receive the bill. In August,we received our next bill 2 days prior to the due date. It also included a$50 disconnect fee. The bill that was sent out July 30th,went to the wrong address,which I'm sure is what caused the delay,and we are assuming this is what happened to the previous bill. For this reason,we do not feel it is our fault that our payment was late and would like to be refunded the$50 fee. If you look at our history of payments from 313 East 4th Street,you will see that we were very prompt with all of our payments. The Council, at the meeting of September 5, authorized the HRA to start the process to establish a TIF housing district for Block 30, the Guardian Angels property and to modify the downtown redevelopment district boundary to include Block 30. The HRA has started the process by asking Council to ordering the public hearing. The attached HRA resolution is to be adopted September 14, 2000. The downtown tax increment financing plan will also have to be modified. The last plan was approved in 1996 and has become outdated. The HRA asks the Council to consider the modified plan at the same time because it requires the same process. That has also been included in the public hearing resolution. Modification does not expand the Downtown TIF District (the parcels where TIF is collected) or change its duration beyond 2006. Downtown is TIF District No. 1. The Industrial Park TIF District No. 2 ended in 1995. The HRA proposes that these processes can be undertaken simultaneously with the assistance of Ehlers&Associates,the HRH's financial consultants. See the attached schedule. Sherman Associates will provide a Letter of Credit to reimburse the HRA for its costs in the event that the district is not approved or the development is not completed. As information and numbers are developed on the housing district and on the modifications, over the next four weeks,they be provided to Council. The proposed development is being built at the density allowed with this land use designation. 2. Zoning: The site is currently zoned R-3 Planned Residential Development. Duplexes are a permitted use in this district. The project is meeting the minimum setbacks and lot area requirements for this district. 3. Adjacent Land Uses:There are a'mix of single familyhomes and multi-family units along 35' Street and Leroy Avenue. 4.
