ADJOURNMENT: Next Regular City Council Meeting on Monday, July 10, 2000 Hastings,Minnesota June 5,2000 The City Council of the City of Hastings, Minnesota met in a regular meeting on Monday, June 5, 2000 at 7:00 p.m. in the City Hall Council Chambers, 101 4"' Street East, Hastings, Minnesota Members Present: Councilmember Yandrasits, Riveness, Simacek, Johnson, Hicks, Moratzka& Mayor Werner Members Absent: None Staff Members Present: Dave Osberg, City Administrator; Shawn Moynihan, City Attorney; Tom Montgomery, Public Works Director; Matt Weiland, City Planner; Mike McMenomy, Police Chief, Bill Mesaros, Code Enforcement Supervisor; and Melanie Mesko, Administrative Assistant/City Clerk Approval of Minutes Mayor Werner asked if there were any corrections or additions to the minutes of the regular meeting of May 15, 2000 and hearing none approved the minutes as presented. 7 Ayes;Nays,None. Consent Agenda Councilmember Moratzka requested that Item No. 10-Tierney Drive Drainage Repair be removed and put under Public Works for discussion. Approve 2000 Tobacco License Holders Minutes of the Regular City Council Meeting of June 5 2000 Page 2 of 5 Award Contract, Roadside Playground Equipment Moved by Councilmember Moratzka, seconded by Councilmember Yandrasits, to approve the Contract to Auto Landscaping for Roadside Park playground equipment including installation in the amount of$75,375.50. 7 Ayes;Nays,None. Award Contract, 4`h Street Water Tower Painting Public Works Director Tom Montgomery stated that Staff is recommending awarding the repainting of the 4`h Street water storage tank to Champion Coatings in the amount of$159,000.00. The City's Consultant TKDA is also recommending award of contract to Champion Coatings. A representative from TMI Coating, the second lowest bidder for the project, was present to dispute the qualifications of Champion Coatings. Public Works Director Montgomery stated that while the business of Champion Coatings is new, the individual experience behind the business is adequate to provide the services requested by the City and that Champion will be required to fulfill financial obligations prior to beginning the project. Moved by Councilmember Yandrasits to table this contract award to the June 29`h Council meeting to allow Champion Coatings to respond to the dispute. Motion died for a lack of a second. Moved by Councilmember Riveness, seconded by Councilmember Hicks, to award the Contract to Champion Coatings for the repainting of the 4`h Street water storage tank. 6 Ayes;Nays, Yandrasits Public Hearing-Dangerous Dog Ordinance Amendment Mayor Wemer opened the Public Hearing at 7:17 p.m. City Attorney Moynihan stated that per Council direction at the May 15`h meeting, Staff had changed the proposed ordinance to allow for an exemption to dangerous dog classifications under certain circumstances. Hearing no public comment, the public hearing was closed at 7:19 p.m. 2"d Reading-Dangerous Dog Ordinance Amendment Moved by Councilmember Moratzka, seconded by Councilmember Hicks, to approve the 2nd Reading and adoption of Dangerous Dog Ordinance amendment with a friendly amendment offered by Councilmember Riveness to provide a six-foot limit on the leash length. 7 Ayes;Nays,None. Resolution No. 6-2-2000-No Parking on East Side of Pleasant Drive between 18th & 19th Streets Rod Smith of 1348 W. 18d' Street stated that he had made this request due to safety issue concerns regarding visibility to Pleasant Dr. when cars are parked on Pleasant Drive north of the 19d' Street intersection. Council discussed issues of precedent in the approval of this request; Pleasant Drive was constructed to allow for on street parking. Minutes of the Regular City Council Meeting of June 5,2000 Page 3 of 5 Moved by Councilmember Johnson, seconded by Councilmember Yandrasits, to approve the motion for no parking on the east side of Pleasant Drive between 18`h& 191, Streets with Staff to install signs. 4 Ayes;Nays, Councilmembers Hicks,Riveness& Mayor Werner Vermillion River Watershed Management Organization Joint Powers Agreement Public Works Director Montgomery stated that Council is requested to approve the Joint Powers Agreement for the Vermillion River Watershed Management Organization; the current agreement expires July 31, 2000. The new agreement must be approved by all 21 members of the VRMO to continue. Montgomery also stated that the Joint Powers Agreement sets an annual appropriation cap of$200,000 to be raised from all 21 WMO Members, of which approximately $15,000 would be Hastings' annual allocation. Montgomery also stated that the VRWMO board can initiate construction projects, but any additional funding would take a 2/3 vote of member cities for approval. Currently, there are no construction plans at this time. Moved by Councilmember Yandrasits, seconded by Councilmember Riveness, to approve the VRWMO Joint Powers Agreement as presented. 4 Ayes; Nays, Councilmember Johnson & Mayor Werner; Councilmember Moratzka abstaining from the vote. General Sieben Drive Extension Alternatives Public Works Director Montgomery stated that revised cost estimates for the General Sieben Drive extension shows that there is a little cost difference between the two alignment alternatives proposed. Alternative One, routing General Sieben Drive around Vermillion River, is estimated to cost $1,315,850. Alternative Two bridging the Vermillion River is estimated to cost$1,374,390. Montgomery stated that Staff is recommending that this issue be forwarded to the Planning Committee of the Council for further study and recommendation. The recommendation from the Planning Committee could then be forwarded to the full Council for consideration. Moved by Councilmember Hicks, seconded by Councilmember Johnson, to send the issue of the General Sieben Drive extension alternatives to the Planning Committee of the City Council. 7 Ayes;Nays,None. Tierney Drive Drainage Repair Moved by Councilmember Moratzka, seconded by Councilmember Riveness, to authorize the correction of the swale at 1608 & 1620 Tierney Drive with the City Attorney to recover the cost of this project from the builder. 7 Ayes;Nays,None. Setback Variance-219 5th Street West Moved by Councilmember Simacek, seconded by Councilmember Yandrasits, to approve the setback variance request of 219 5`h Street West. 7 Ayes;Nays,None. Minutes of the Regular City Council Meeting of June 5 2000 Page 4 of 5 Draft Development Agreement-Arbor Oaks Mayor Werner stated that he wanted the City to reserve the opportunity to move the service road to the west as much as possible and requested that be added as an amendment to the draft development agreement. Moved by Councilmember Riveness, seconded by Councilmember Yandrasits, to approve the draft development agreement for Arbor Oaks with a friendly amendment as presented by Mayor Werner. 7 Ayes;Nays,None. EAW Distribution-Barton Sand & Gravel Moved by Councilmember Johnson, seconded by Councilmember Hicks, to approve the publication and distribution of the EAW for Barton Sand& Gravel. 7 Ayes;Nays,None. Resolution No. 6-3-00-Authorizing Application for Livable Communities Demonstration Program Moved by Councilmember Simacek;.seconded by Councilmember Johnson, to approve Resolution No. 6-3-00 authorizing application for Livable Communities Demonstration Program. 7 Ayes;Nays,None. Industrial Park Preliminary Approval-Miller Electric (Bud Miller) Moved by Councilmember Riveness, seconded by Councilmember Moratzka, to approve the preliminary approval for Miller Electric. 7 Ayes;Nays,None. Aquatic Center Concession Area Parks & Recreation Director Marty McNamara stated that Staff is recommending that the City pay the cost of air conditioning plus electrical hook-up for the Aquatic Center and the concession operators pay the cost of the enclosure with no extension of their contract. Moved by Councilmember Hicks, seconded by Councilmember Yandrasits, to approve the air conditioning addition to the Aquatic Center concession area with the understanding that the concession operator would also pay any costs of the south wall construction and air conditioning if that wall was ever opened. 7 Ayes;Nays,None. State Building Code Administration of Public Buildings & State Licensed Facilities City Administrator Osberg stated that no Council action is needed at this time as the State did not receive the information that they requested. Therefore, the State will no longer be offering public buildings and state licensed facilities to the City for plan review or inspections. Minutes of the Regular City Council Meeting of June 5,2000 Page 5 of 5 Mayor Werner stated he was concerned with the health and safety of the City as it relates to the Code Enforcement Department and requested Council support for an independent inspection and an investigation by the State with the results to be reported to the Administrative Committee of the Council. Moved by Councilmember Johnson, seconded by Councilmember Yandrasits, to approve an independent assessment investigation request of the City's Code Enforcement Department Building Inspection operations by the State of Minnesota. 7 Ayes;Nays,None. ISTS Qualified Employee Appointment Moved by Councilmember Simacek, seconded by Councilmember Moratzka, to appoint Code Enforcement Supervisor Bill Mesaros as an ISTS Qualified Employee Appointment for the City of Hastings. 7 Ayes;Nays,None. Golf Course Utilization Report City Administrator Osberg requested Council action to accept the report from the Minnesota Golf Course Owners Association and forward the report to Springsted for their financial consideration. Mr. Curt Walker and Mr. Al McMurchie of the Minnesota Golf Course Owners Association presented a report to the Council commenting on the report prepared by THK Associates. Moved by Councilmember Hicks, seconded by Councilmember Moratzka, to accept the report prepared by the Minnesota Golf Course Owners Association and forward it to Springsted for consideration. 7 Ayes;Nays,None. Closed Door Session Moved by Councilmember Riveness, seconded by Councilmember Johnson, to adjourn to open door session at 8:50 p.m. for a closed-door session to discuss labor relations. This closed-door session was opened at 8:51 p.m. All Councilmember were present. Moved by Councilmember Simacek, seconded by Councilmember Hicks, to adjourn the closed-door session and reconvene the open door meeting. This year the ambulance service applied for, and received, $1,648.00 in reimbursements. This amount was not anticipated and, therefore, not included as revenue for the purpose of off-setting the fire department budget. The fire department is licensed by the State of Minnesota to provide emergency medical technician training. We train both fire and police in-house. This results in significant cost savings for emergency medical technician training. The City of Hastings recognizes that such drug dependency may be an illness. Consistent with this understanding, the City of Hastings has an obligation to insure that its employees perform their jobs safely, efficiently and in a professional manner. This policy is also intended to comply with all applicable Federal regulations governing drug and alcohol testing programs in the transit industry. The Federal Transit Administration (FTA) of the U.S. Department of Transportation has published Title 49 Code of Federal Regulations(CFR)Parts 653 and 654, as amended, that mandate urine drug testing and breath alcohol testing for safety-sensitive positions and prohibits performance of safety-sensitive functions when there is a positive test result. The U.S. Department of Transportation(DOT) has also published Title 49 CFR Part 40, as amended, that sets standards for the collection and testing of urine and breath specimens. 2_0 APPLICABILITY of POLICY This policy applies to all safety-sensitive transit system employees, paid part-time employees, contract employees, and contractors when performing any transit-related safety-sensitive business. 3.0 SAFETY-SENSITIVE FUNCTION- DEFINITION A safety-sensitive function is any duty related to the.safe operation of mass transit service including the operation of a revenue service vehicle (whether or not the vehicle is in revenue service), dispatch, maintenance-of a revenue service vehicle.or equipment used in revenue service, security personnel who carry firearms, and any other employee who holds a Commercial Driver's License. See Appendix B.for a list of safety-sensitive positions that perform one or more of the above- mentioned functions for Recipient 4_0 SUBSTANCES SUBJECT to TESTING 4_1 ILLEGAL DRUGS Safety sensitive employees will be tested for marijuana, cocaine, amphetamines, opiates, and phencyclidine. The appropriate use of legally prescribed drugs and non-prescription medications is not prohibited. However,the use of any substance which carries a warning label that indicates that mental functioning, motor skills,or judgement may be adversely affected must be reported to a transit system supervisor. In addition,the employee must obtain a written release from the attending physician releasing the person to perform their job duties any time they obtain a performance-altering prescription. A legally prescribed drug means that individual has a prescription or other written approval from a L physician for the use of a drug in the course of medical treatment. It must include the patient's name,the name of the substance, quantity/amount to be taken,and the period of authorization. The misuse or abuse of legal drugs while performing transit business is prohibited. 4.2 ALCOHOL The use of beverages containing alcohol or substances,including any medication, mouthwash, food, candy,or any other substance, such that alcohol is present in the body while performing transit business, is prohibited. The concentration of alcohol is-expressed in terms of alcohol per 210 liters of breath as measured by an evidential breath testing device. 5.0 PROHIBITED CONDUCT 5.1 INTOXICATION/UNDER the INFLUENCE Any safety-sensitive or non-safety-sensitive employee who is reasonably suspected of being intoxicated, impaired,under the influence of a prohibited substances, or not fit for duty shall be suspended from job duties pending an investigation and verification of condition. Employees found to be under the influence of a prohibited substance or who fail to pass a drug or alcohol test shall be removed from duty and may be subject to disciplinary action. A drug or alcohol test is considered positive if the individual is found to have a quantifiable presence of a prohibited substance in the body above the minimum thresholds defined in Title 49 CFR Part 40, as amended. 5.2 ALCOHOL No safety-sensitive employee should report for duty or remain on duty when his/her ability to perform assigned safety-sensitive functions is adversely affected by alcohol or when his/her breath alcohol concentration is 0.04 or greater_ A safety-sensitive employee who has a confirmed alcohol concentration of greater than 0.02 but less than 0.04 will be removed from his/her position for eight hours unless a retest results in a concentration measure of less than 0.02. No safety- sensitive employee shall use alcohol while performing safety-sensitive functions, or just before or just after performing a safety-sensitive function. No safety-sensitive shall use alcohol within four hours of reporting for duty, or during the hours that they are on call. All safety sensitive employees are prohibited.from reporting for duty or remaining on duty any time there is a quantifiable presence of a prohibited substance in the body above the minimum thresholds defined in Title 49 CFR Part 40, as amended. 2 6_0 TESTING REQUIREMENTS All safety-sensitive employees will be subject to urine drug testing and breath alcohol testing as a condition of employment. Any safety-sensitive employee who refuses to comply with a request for testing shall be removed from duty. Any safety-sensitive employee who is suspected of providing false information in connection with a.test, or who is suspected of falsifying test results through tampering, contamination, adulteration, or substitution will be required to undergo an observed collection. Verification of falsifying test results will result in the employee's removal from duty. Behavior that constitutes a refusal can.include an inability to provide a sufficient urine specimen or breath sample without a valid medical explanation, as well as a verbal declaration, failure to arrive in a timely manner, obstructive behavior, failure to sign DOT required testing forms for urine collection, or physical absence resulting in the inability to conduct the test. Refusal to take a drug or alcohol test constitutes a verified positive drug test result. Drug tests can be performed any time a safety sensitive employee is on duty. An alcohol test can be performed when the safety sensitive employee is actually performing a safety sensitive duty,just before, or just after the performance of a safety sensitive duty. 7_0 TESTING PROCEDURES 7_1 CONDUCT OF TESTS Testing shall be conducted in a manner to assure a high degree of accuracy and reliability and using techniques, equipment, and laboratory facilities which have been approved by the U.S. Department of Health and Human Service(DHHS). All testing will be conducted consistent with the procedures put forth in Title 49 CFR Part 40, as amended. The procedures will be performed in a private, confidential manner and every effort will be made to protect the employee, the integrity of the drug testing procedure, and the validity of the test result. 7_2 DRUG TESTING PROCEDURES: URINE TESTS The drugs that will be tested for include marijuana, cocaine,opiates, amphetamines, and phencyclidine. Urine specimens will be collected using,the split specimen collection method described in Title 49 CFR Part 40. Each specimen will be accompanied by a DOT Chain of Custody and Control Form and identified using a unique identification number that attributes the specimen to the correct individual. An initial drug screen will be conducted on the primary urine specimen. For those specimens that are not negative, a confirmatory Gas Chromatography/Mass Spectrometry (GC/MS)test will be performed. The test will be considered positive if the amounts present are above the minimum thresholds established in Title 49 CFR Part 40, as amended. Appendix D lists 3 the minimum thresholds established for each drug and/or its metabolites. The test results from the laboratory will be reported to a Medical Review Officer. A Medical Review Officer (MRO) is a licensed physician with detailed knowledge of substance abuse disorders and drug testing. The MRO has appropriate medical training to interpret and evaluate an individual's confirmed positive test result. The MRO will review the test results to ensure the scientific validity of the test and to determine whether there is a legitimate medical explanation for a confirmed positive test result. The MRO will contact the employee, notify the employee of the positive laboratory result, and provide the employee with an opportunity to explain the confirmed test result. The MRO will subsequently review the employee's medical history/medical records to determine whether there is a legitimate medical explanation for a positive laboratory result. If no legitimate medical explanation is found, the test will be verified positive and reported to the company program manager. If a legitimate explanation is found,the MRO will report the test result as negative. The split specimen will be stored at the initial laboratory until the analysis of the primary specimen is completed. If the primary specimen is negative, the split will be discarded. If the primary is positive, the split will be retained for testing if so requested by the employee through the Medical Review Officer. The laboratory shall retain the split specimen in frozen storage for 60 days from the date on which the laboratory acquires it. Following the end of the 60-day period, if not informed by the MRO that the employee has requested a test of the split specimen, the laboratory may discard the specimen. The primary specimen if positive, it will be retained in frozen storage for one year. A drug test that has been declared invalid by a MRO is a canceled test. A canceled test is neither a positive or negative test. If the analysis of the split specimen fails to reconfirm the presence of the drug(s) or drug metabolite(s) found in the primary specimen, or if the split specimen is unavailable, inadequate for testing or untestable, the MRO shall cancel the test and report cancellation and reason for it to the DOT, the employer,and the employee. 7.3 ALCOHOL TESTING PROCEDURES: BREATH TEST Tests for breath alcohol concentration will be conducted utilizing a National Highway Traffic Safety Administration(NHTSA)-approved testing device operated by a trained technician. If the initial test indicates an alcohol concentration of 0.02 or greater, a second test will be performed to confirm the results of the initial test. The confirmatory test will be performed using an NHTSA- approved evidential breath-testing device (EBT) operated by a trained breath alcohol technician (BAT). The BAT shall be trained to proficiency in the operation of the EBT he or she is using and in the alcohol testing procedures of Title 49 CFR Part 40. The BAT must successfully complete an NHTSA-approved course of instruction that provides training in the principals of EBT methodology, operation, and calibration checks. In Addition the BAT must complete training on the fundamentals of breath analysis for alcohol content,the procedures required for obtaining a breath specimen, and interpreting and recording EBT results. The BAT will identify each test by a unique sequential identification number. This number,time, and unit identifier will be provided on each EBT printout. The EBT printout along with an approved Federal alcohol testing form will be used to document the test, the subsequent results, and to attribute the test to the correct employee. The test will be performed in a private, confidential manner as required by Title 49 CFR Part 40 as amended. The procedure will be followed as prescribed to protect the 4 employee and to maintain the integrity of the alcohol testing procedures and validity of the test result. A safety-sensitive employee who has a confirmed alcohol concentration of greater than 0.02 but less than 0.04 will be removed from his/her position for eight hours unless a retest results in a concentration measure of less than 0.02. An alcohol concentration of 0.04 or greater will be considered a positive alcohol test and in violation of this policy and a violation of the requirements set forth in Title 49 CFR Part 654 for safety-sensitive employees. In alcohol testing, a canceled test is a test that is deemed invalid under Title 49 CFR Section 40.79. It is neither a positive or negative test. Any safety-sensitive employee that has a confirmed positive drug or alcohol test will be removed from his/her position, informed of educational and rehabilitation programs available, and referred to a Substance Abuse Professional (SAP)for assessment. 7.4 EMPLOYEE REQUESTED TESTING Any safety-sensitive employee who questions the results of a required drug test under paragraphs 8.2 through 8.7 of this policy may request that the split sample be tested. This test must be conducted at a different DHHS-certified laboratory. The test must be conducted on the split sample that was provided by the employee at the same time as the original sample. The method of collecting, storing, and testing the split sample will be consistent with the procedures set forth in Title 49 CFR Part 40, as amended. The employee's request for a split sample test must be made to the Medical Review Officer within 72 hours of notice of the original sample verified test result. Requests after 72 hours will only be accepted if the delay was due to documentable facts that were beyond the control of the employee. 8.0 KINDS OF TESTS REQUIRED 8.1 PRE-EMPLOYMENT TESTING All safety-sensitive position applicants shall undergo urine drug testing prior to hire or transfer into a safety-sensitive position. Receipt by the transit system of a negative drug test result is required prior to employment. If an applicant drug test is canceled, the applicant must retake and pass the test before being hired. Evidence of the absence of drug dependency from a Substance Abuse Professional that meets with the approval of the company and a negative pre-employment drug test will be required prior to further consideration for employment. A pre-employment/pre- transfer test will also be performed anytime an employee's status changes from an inactive-status in a safety-sensitive position to an active status in a safety-sensitive position(i.e., return from Worker's Comp., return from leave of absence). 8.2 REASONABLE SUSPICION TESTING 5 All safety-sensitive employees may be subject to urine and/or breath testing when there are reasons to believe that drug or alcohol use is adversely affecting job performance. A reasonable suspicion referral for testing will be made on the basis of documented objective facts and circumstances which are consistent with the short-term effects of substance abuse or alcohol misuse. Examples of reasonable suspicion include,but are not limited to, the following: A. Physical signs and symptoms consistent with prohibited substance use or alcohol misuse. B. Evidence of the manufacture, distribution, dispensing, possession, or use of controlled substances, drugs, alcohol, or other prohibited substance. - C. Occurrence of a serious or potentially serious accident that may have been caused by prohibited substance abuse or alcohol misuse. D. Fights(to mean physical contact), assaults, and flagrant disregard or violations of established safety, security, or other operating procedures. Reasonable suspicion referrals must be made by one supervisor who is trained to detect the signs and symptoms of drug and alcohol use and who reasonably concludes that an employee may be adversely affected or impaired in his/her work performance due to possible prohibited substance abuse or alcohol misuse. 8.3 POST-ACCIDENT TESTING All safety-sensitive employees will be required to undergo urine and breath testing if they are involved in an accident with a transit system vehicle (regardless of whether or not the vehicle is in revenue service)that results in a fatality. This includes all surviving safety-sensitive employees that are operating the vehicle and any other whose performance could have contributed to the accident. In addition, a post-accident test will be conducted if an accident results in injuries requiring immediate transportation to a medical treatment facility; or one or more vehicles incurs disabling damage;unless the employee can be completely discounted as a contributing factor to the accident. The accident definition may include some incidents where an individual is injured even though there is no vehicle collision. Following an accident, the safety-sensitive employees will be tested as soon as possible,but not to exceed eight hours for alcohol testing and 32 hours for drug testing. Any safety-sensitive employee involved in an accident must refrain from alcohol use for eight hours following the accident or until he/she undergoes a post-accident alcohol test. Alcohol testing must be attempted to be completed within two hours of the accident. If the alcohol test is not completed within two hours a report must be filed explaining why the test was unsuccessful and continued attempts to obtain specimen in eight hours documented. If unable to obtain specimen in eight hours, attempts to obtain specimen must cease and the two-hour written report updated. Any safety-sensitive employee who leaves the scene of the accident without justifiable explanation prior to submission to drug and alcohol testing or who fails to remain readily available for such 6 testing will be considered to have refused the test and their employment terminated. Employees tested under this provision will include not only the operations personnel,but also any other covered employee whose performance could have contributed to the accident. If the Transit system is unable to perform a FTA drug and alcohol test(i.e., employee is unconscious, employee is detained by law enforcement agency),the transit system may use drug and alcohol post-accident test results.administered-by State and local law enforcement officials. The State and local law enforcement officials must have independent authority for the test and the employer must obtain the results in conformance with.state and local law. 8_4 RANDOM TESTING Employees in safety-sensitive positions will be subjected to random, unannounced testing. The selection of safety-sensitive employees for random testing will be made using a scientifically valid method that ensures each covered employee that they will have an equal chance of being selected each time selections are made. The random tests will be unannounced and spread throughout the . year. Tests can be conducted at any time during an employee's shift(i.e. beginning, middle, end). Employees are required to proceed immediately to the collection site upon notification of their random selection. The current random testing rates are 50% for drug testing and 10% for alcohol testing(as published in the Federal Register on November 24, 1999). 8.5 RETURN-to-DUTY TESTING All safety-sensitive employees who previously tested positive on a drug or alcohol test must test negative(below 0.02 for alcohol) on a return-to-duty test and be evaluated and released to by a Substance Abuse Professional before returning to work A Substance Abuse Professional (SAP) is a licensed physician or certified psychologist, social worker, employee assistance professional, or addiction counselor certified by the National Association of Alcoholism and Drug Abuse Counselors Certification Commission or by the International Certification Reciprocity Consortium/Alcohol and Other Drug Abuse. The SAP must also have clinical experience in the diagnosis and treatment of drug and alcohol related diseases. Before scheduling the return to duty test, the SAP must assess the employee and determine if the required treatment has been completed. - 8.6 FOLLOW-UP TESTING Safety-sensitive employees will be required to undergo frequent,unannounced urine and/or breath testing following their return to duty. The follow-up testing will be performed for a period of one to five years with a minimum of six tests to be performed the first year. The frequency and duration of the follow-up tests beyond the minimum will be determined by a qualified Substance Abuse Professional. 7 9_0 EMPLOYMENT ASSESSMENT Any safety-sensitive employee who tests positive for the presence of illegal drugs or alcohol above the minimum thresholds set forth in Title 49 CFR Part 40, as amended, will be referred for evaluation by a Substance Abuse Professional (SAP). A SAP is a licensed or certified physician, psychologist, social worker, employee assistance professional, or addiction counselor with knowledge of and clinical experience in the diagnosis and treatment of alcohol and drug-related disorders. The SAP will evaluate each employee to determine what assistance, if any, the employee needs in resolving problems associated with prohibited drug use or alcohol misuse. If a safety-sensitive employee is allowed to return-to-duty, he/she must properly follow the rehabilitation program prescribed by the SAP, the employee must have negative return-to-duty drug and alcohol tests, and be subject to unannounced follow-up testing for a period of one to five years. 10.0 INFORMATION DISCLOSURE All drug and alcohol testing records will be maintained in a secure manner so that disclosure of information to unauthorized persons does not occur. The training must also include manifestations and behavioral cues that may indicate prohibited drug use. Supervisors will also receive 60 minutes of reasonable suspicion training on the physical, behavioral, and performance indicators of probable drug use and 60 minutes of additional reasonable suspicion training on the physical,behavioral, speech; and performance indicators of probable alcohol misuse. Comprehensive Plan Designation: The subject property is guided Industrial in the Comprehensive Plan. The communication tower s a consistent and permitted use for this land use designation. 2. Zonin : The property is currently zoned I-1 Industrial. This zoning classification is consistent with the City's Comprehensive Plan. The proposed communication tower would be allowed in this district by special use permit. 3. Existing Conditions: The property currently contains the National Guard Armory which consists of two buildings and a gated storage area for vehicles.. 4. Proposed Conditions: The applicant is proposing to construct a 75ft monopole communication tower on the site (See Site Plan). 5. Adjacent Land Uses: The proposed project is located within the Hastings Industrial Park. Site Plan Page 2 Tower Ordinance The City of Hastings adopted a Tower Ordinance that provides a reasonable opportunity for the establishment of wireless communications within the City, while protecting the safety, health and general welfare of citizens. The City can not prohibit towers in the City,but it can enforce reasonable rules which protect its citizens. The tower ordinance provides rules and regulations for the establishment of new towers and antennas within the City. These rules include height restrictions,minimum setbacks and co-location requirements. Most of the wireless providers in the City have gone on top of existing water towers in town, due to co-location requirements. This will be the first monopole communication tower approved in town. Tower Requirements The proposed tower is allowed as a special use in the Industrial park. Because the tower is under 80 ft tall, it is exempt from the co-location requirement of having to be located on the City's water tower. This tower is however required to allow future providers to locate on it, if reasonable terms are met. The Tower is meeting all required setbacks. This type of monopole tower is designed to bend, and not break. The tower technically has a"no fall zone"area. There will be a small equipment building at the base at the tower. The entire base of the tower will be enclosed with a fence and will be screened by landscaping. MNDOT (Minnesota Department of Transportation) This project also requires MNDOT review because it is adjacent to a state highway(HWY 61). The City is currently waiting for comments from MNDOT on the proposed site plan. MNDOT has review authority over property adjacent to their right of way. It is anticipated that MNDOT will not have any comments since the project is located so faraway from HWY 316. A condition of site plan approval will be to incorporate any of MNDOT's comments into the site plan. Summary: The proposed tower meets the requirements of the City's Tower ordinance. The intent of the ordinance is to try to locate communication providers on water towers first and the Industrial Park second,before any other areas of the City. Communication towers are used by and benefit a majority of the people in the City. They serve the same functions as telephone lines or electric wires. This is a good location for a tower in the City versus other locations. The Tower is shorter than most other towers and has adequate setbacks from street right-of-ways (ROW) and residential areas. The tower is also designed to accommodate an additional user in the future, which may eliminate the need for another tower in the City for a while. Planning Commission Action. The Planning Commission held a public hearing at their 6/12/00 Planning Commission meeting. There were no comments received. The Planning Commission recommended Page 3 approval of the special use permit and site plan for the 75 ft tower,based on the conditions listed below. Recommended Action: There are two separate actions which must be voted on as follows: Special Use Permit Motion to Recommend the approval of the US West 75 ft monopole tower special use permit subject to following: 1. The tower must be substantially completed within one year, including any structures accompanying the tower, following the date of permit, unless a time extension is approved by the City Council. In the event that a tower is not substantially completed within one year of the permit issuance,the tower and associated facilities may be removed by the city and the costs of removal assessed to the tower owner or against the property. 2. All abandoned or unused towers and associate facilities shall be removed within 12 months of the cessation of operations at the site, unless a time extension is approved by the City Council. The Tower owner is responsible for these costs. In the event that a tower is not removed within 12 months of the cessation of operations at a site, the tower and associated facilities may be removed by the city and the costs of removal assessed against the property. 3. Unused portions of towers above a manufactured connection shall be removed within two years six months of the time of antenna relocation, if the unused portion exceeds 25% of the height of the tower or 30 feet, whichever is greater. The replacement of portions of a tower previously removed requires the issuance of a new special use permit. 4. The tower owner and successor owners shall allow the shared use of the tower, if an additional user agrees in writing to meet reasonable terms and conditions for shared use and so long as there is no negative structural impact upon the tower, and there is no disruption to the service provided. 5. The property owner shall enter into an agreement with the City which holds itself and its successor's responsible for the tower on their property. The property owner shall further agree to be assessed for any expenses related to the removal of the tower and associated facilities. Given the size and magnitude of use of the US West Wireless system,there must be several antenna facilities located in and around the Twin Cities area in order for US West Wireless to provide service throughout the community. As each additional facility is constructed, its location and height become relatively fixed. This makes it essential to ensure that any newly proposed facilities are at the proper heights and locations to allow them to"connect"and provide seamless coverage between the existing sites. Because of this,the amount of flexibility in the acceptable heights and locations of the remaining proposed facilities is reduced. With these parameters in mind,we have identified the property located at 3050 Hyw 316 as a location that best meets the engineering requirements for the proposed site. City staff are currently working with the Metropolitan Council to get the plan approved. City staff needs to make some changes to plan in order for the plan to get officially approved. In the meantime,two housing projects have come forward that are consistent with the goals,policies, and land use plan of the 2020 Comprehensive Plan. These properties are within the municipal urban service area(MUSA) and can be adequately served by existing City services. City staff is recommending that the City Council approve a Comprehensive Plan amendment that would approve the land use changes to these properties faster than the overall approval of the City's Comprehensive Plan. The purpose of this amendment is to reaffirm the City's Comprehensive Plan decisions made back in February, and to allow these properties to be developed in a reasonable and timely matter. This Comprehensive Plan Amendment does not change the 2020 Comprehensive Plan in any way, it just speeds up the approval process for these two properties. This land use amendment is consistent with the 2020 Comprehensive Plan the City adopted. Comprehensive Plan Amendment The two properties involved in the comprehensive plan amendment are the Bailey Ridge property (4 acres) and part of the Hastings Market place Property(9.6acres) (site location map attached). The Bailey Ridge property is guided U-II Medium Density Urban Residential and the Hastings Marketplace property is guided U-III High Density Urban Residential in the Hastings 2020 Comprehensive Plan. Both of these properties would have to be rezoned after the Comprehensive Plan amendments were approved. The Metropolitan Council has set up a Comprehensive Revision/Amendment form that must be submitted for the Metropolitan Council to review and approve the City's Comprehensive Plan.
