Hastings, Minnesota City Council Minutes August 6, 2018 The City Council of the City of Hastings, Minnesota met in a regular meeting on Monday August 6, 2018 at 7:00 p.m. in the Council Chambers at the Hastings City Hall, 101 East 4th Street, Hastings, Minnesota. Members Present: Mayor Hicks, Councilmembers Braucks, Folch, Leifeld, Lund and Vaughan Members Absent: Councilmembers Balsanek and Braucks. Staff Present: City Administrator Melanie Mesko Lee Administrative Services Director Julie Flaten City Attorney Dan Fluegel Community Development Director John Hinzman Approval of Minutes Mayor Hicks asked if there were any additions or corrections to the minutes of the Regular City Council meeting or the Council Workshop meeting on July 23, 2018. Minutes were approved as presented. Consent Agenda Councilmember Vaughan, seconded by Councilmember Folch to approve as presented. Ayes, 5; Nays, 0. 1. Pay Bills as Audited 2. Resolution No. 08-01-18 – Approve One-Day Liquor License for Hastings Rotary Club on September 7, 2018. 3. Resolution No. 08-02-18 – Approve One-Day Liquor License for Dakota County Historical Society on August 15, 2018. 4. Authorized Signature – License to Encroach – 3584 Village Way. 5. Special Event Request – TLC of Hastings – 5K Run & 1 Mile Walk. 6. Approve Change Order No. 1 for the 2018-1 Neighborhood Infrastructure Improvements Project - $9,390.00 (BCM Construction). 7. Resolution No. 08-03-18 – Accept donation from the Miesville Lions Club to the Fire Department. Resolution No. 08-04-18 – Original Hastings Design Standards Review – Verner (614 5th Street West) Hinzman introduced the item asking Council to grant Original Hastings Design Guildelines approval for a new rear living space and garage addition to the property at 614 5th Street West. Councilmember Leifeld, seconded by Councilmember Folch to approve as presented. Ayes, 5; Nays, 0. Preliminary and Final Plat – Wallin 18th Addition (General Sieben Drive) Hinzman introduced the item asking Council to table the item at the request of the applicants. Applicants would like to make changes to their plat plan. This item will be reviewed by the Planning Commission before any additional action by Council will be requested. Council discussed about notifying the area residents on this item. There were several concerns that many residents were not notified of this and that affects a large portion of the City of Hastings August 6, 2018 City Council Minutes Page 2 of 3 neighborhood. Councilmembers Lund, Leifeld, and Vaughan agreed that notification of changes should be expanded. Councilmember Vaughan motioned to approve as presented, seconded by Councilmember Folch. Ayes, 5; Nays, 0. Order Public Hearing: Vacation of Easement – Wallin 17th Addition Hinzman introduced the item asking Council to order a public hearing to consider the Vacation of Easement #2018-39 – Wallin 17th Addition. This is requested by Roberta Sjodin on land owned by Duane Wallin and Winston Wallin Partnership. The public hearing will be held on August 20th, 2018. No Council action will be taken until the Planning Commission has reviewed. This item in linked to the Preliminary and Final Plat for Wallin 18th Addition. Councilmember Vaughan motioned to approved as presented, seconded by Councilmember Folch. Ayes, 5; Nays, 0. Resolution No. 08-05-18: Site Plan – Parking Ramp – Former 1st National Bank (119 2nd Street W) Hinzman introduced the item to Council to adopt the resolution approving the Site Plan request of Confluence Development to construct a 123 stall parking ramp on the former 1st National Bank Site located at 119 2nd Street W. Council discussed if MNDOT and Dakota County approved. Hinzman stated that he has heard back from MNDOT, but it has not been approved yet by either MNDOT or Dakota County. Council also discussed electric car charging station, overnight parking. Greg Stotko stated that there will be two electric car charging stations inside of the parking structure. City Attorney Fluegel stated that he did not see anything in the developer’s papers that would not allow for overnight parking. Mayor Hicks and Councilmember Leifeld commented on the looks of the ramp, they both agree that it is a good looking ramp and that it will fit into downtown. Councilmember Folch asked about the timeline for the demolition of the Hudson building and the implementation of the plan. Mike Mattingly stated the 1st National Bank demolition would be scheduled for September/October with the completion of the ramp at the end of this year. Councilmember Lund motions to approve as presented, seconded by Councilmember Folch. Ayes, 5; Nays, 0. Mayor Hicks and Councilmembers made the following announcements: National Night Out is Tuesday, August 7th. Community Party at Lions Park from 5:30 – 7:30 p.m. Welcome Week Planning Committee will meet on Wednesday, August 8th at 6:00 p.m. at City Hall. HEDRA will meet on Thursday, August 9th at 6:30 p.m. at City Hall. Planning Commission will meet on Monday, August 13th at 7:00 p.m. at City Hall. Tuesday, August 14th is Primary Election Day. All polling places will be open from 7:00 a.m. to 8:00 p.m. Parks and Recreation Commission meeting will be held on Wednesday, August 15th at 7:00 p.m. at City Hall. Special City Council meeting on Thursday, August 16th at 7:30 p.m. to canvass the Primary Election results. Public Safety Advisory Commission meeting on Thursday August 16th at 6:30 p.m. at City Hall. City Council workshop on Monday, August 20th to discuss Indoor Recreation Facility. Councilmember Folch noted MNDOT has not swept roadway near County Road 47 and Highway 61. Councilmember Lund was wished a Happy Birthday on August 16th. Councilmember Balsanek was wished a Happy Birthday on August 18th. Motion to adjourn the meeting was made by Councilmember Vaughan, seconded by Councilmember Leifeld. The Riverwood PRD was created in the 1980’s and identified the northwest portion of 31st Street West to allow for higher densities for apartments. Planning Commission Memorandum VII-B-01 SUP REVIEW A portion of this property is within the Shoreland Overlay district due to its proximity to the Vermillion River. The overlay district requires that multi family structures receive Special Use Permit approval. SUP review allows for determining if any special conditions should be required to assure that the use does not adversely affect the surrounding area. The subject property is much larger than necessary for even this large 60 unit building. Some of the site is not even proposed for grading, due to it falling out of the extent of development. The site does not directly abut the Vermillion River due to a city trail corridor. Impervious surfacing has been reduce by including half of the required parking within the structure. Staff has not identified any additional conditions that should be included with approval of a SUP. SITE PLAN REVIEW Access and parking There are two driveways. One is located across from the phase I driveway and the other has been held back from the Highway 46/ 31st St W Intersection. There is an existing multi-use path on the other side of 31st Street W and a concrete sidewalk adjacent to the subject property. There are 120 parking spaces required with two being required for each unit. 126 are proposed with half being located on the ground level of the building. Lighting The photometric plan shows acceptable residential light limits at the front property line along the parking lot and zero foot-candles at all the other boundaries. Setbacks The setbacks for the building appear adequate. The front corner of the angled building is about 90-feet closer to the road than the phase I building across the street. The closest proposed comer is about 53-feet from the front property line. All other setbacks are greater on the proposed building than the existing. The southern front elevation is over 200-feet from the front property line. Landscaping Plan The site was graded about 15 years ago. Since that time there have been a variety of volunteer trees that have sprung up. There are some Black locust trees that have gotten fairly large in that time due to their fast growing nature, but most are malformed because they have been crowded and not pruned. The landscaping plan shows a 10-foot wide landscape strip between the driveway and property line along 31st St W. 42 trees are required based on the grading limits perimeter, VII-B-01 impervious coverage, and removal of some borderline significant trees. Fifty shrubs are required based on project perimeter and 400 are proposed. Design Standards The building exterior utilizes several different materials, including vinyl lap siding, vinyl shake siding, architectural precast panels, glass, rock faced block, and brick. Multifamily dwellings requires 25% of both one and two materials for principal elevations. They are a little short at about 23% for the front elevation including the trash enclosure and 8% & 18% on the north two elevations from the class I requirement of. However, they do propose to include 19% class I and 30% Class II on the rear which does not require it, which is visible from a multi-use path. Staff is supportive of this substitution. VARIANCE REVIEW The Shoreland Overlay District requires a maximum height of 35-feet for structures within the overlay. Structures in the downtown are allowed to be taller due to their preexistence. The height of the proposed structure is 59.5-feet tall from average adjacent grade to roof peak. The 36 unit apartment across the street is the same height. Below is a list of variance requirements that must be satisfied prior to approval of a variance with the findings summarized below each item: • Evidence that practical difficulties in complying with the regulations exist o The city and developer made the agreement to allow this scale of development on this property prior to the City adopting the Shoreland Overlay District. o Cutting the building height in half would more than double the lot coverage, thereby cause other Shoreland Overlay impacts and drainage implications. • Circumstances relating to these difficulties may not have been created by the landowner. o The property owner did not cause the creation of the Shoreland Overly District. • The variance may not alter the essential character of the locality o The character of the area will remain unchanged, the building will be in line with the existing scale of approved development in this section of 31st Street W. Notification Immediate neighbors were notified of the request and no comments have been received. The DNR was notified of the SUP and height variance and responded that they had no comments relating to those requests. Recommended Action: Approval of the site plan, subject to the following conditions: 1) Conformance with the Planning Commission Staff Report and plans dated August 13, 2018. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HASTINGS AS FOLLOWS: That the City Council hereby approves the Preliminary and Final Plat as presented to the City Council subject to the conditions: 1) Conformance with the plans submitted with the City Council Staff Report dated August 20, 2018. 2) All disturbed areas on the property shall be stabilized with rooting vegetative cover to eliminate erosion control problems. 3) Final approval of civil engineering plans including grading, drainage, erosion control, and utility plans by the Public Works Director. 4) Payment sewer interceptor fees in the amount of $12,125 ($485 x 25 units) prior to release of the Final Plat for recording. 5) The developer shall enter into a Development Agreement with the City for the construction of all public streets and utilities. 6) Establishment of a home owners association or similar entity to ensure private maintenance of all commonly held amenities within the subdivision. 7) Approval is subject to a one year Sunset Clause; the plat must be recorded with Dakota County within one year of City Council approval or approval is null and void. 8) Submittal of a landscape and boulevard tree planting plan prior to release of the Final Plat for recording.
