CITY COUNCIL WORKSHOP
AGENDA

City Council workshops are tentatively held prior to the second Council meeting of the month. Items presented at a workshop are for discussion only and no formal action is intended until
forwarded to the full Council as determined by Council recommendation. Generally, it is expected that workshop items referred to the full Council would be done so at the subsequent first
meeting held the next month.
Topic: Mobile Food Unit Policy
Background Information:
City Code Chapter 115 outlines the adopted process which applies to peddlers and solicitors. Mobile Food Units (“food trucks”) fall into this licensing category as a “transient merchant”.
Generally, a transient merchant may be administratively issued a license to operate on private property, provided that the appropriate application and background check has been completed.
These licenses are not valid during any Council-designated special event, as separate license is required during those events.
Several years ago, the City Council adopted policy language regarding Special Events
SPECIAL EVENT. A festival, city-wide celebration or other happening which is designated as a special event by resolution of the City Council, which resolution shall define the dates
and locations of the special event.
For sales on public property, the event must be designated as a Special Event by the City Council or as part of a recreational tournament sanctioned by and occurring on City property.
In late 2017, the Council requested additional discussion on the process for licensing Mobile Food Units (MFU’s) operating on City property. City staff have reached out to a number of
other cities, consulted with our attorney, and have prepared the attached for discussion by the Council. There are a number of policy implications the Council is encouraged to discuss,
including but not necessarily limited to:
Authority to grant approval administratively or by Council action
Ability to locate within proximity of existing restaurants
See attached map with illustration on possible “buffers”
Limitations on number of days licensed to sell
Whether background checks will be conducted
Impacts on sales within public rights-of-ways
Please see the attached background sheet for more information. At this time, staff have not yet reached out to our local business community to gauge perspective on this issue. We would
expect to do so with information gained from Council feedback at the workshop.
