Regular Meeting
Commissioner Schultz called the meeting to order at 7:00 p.m.
Commissioners Present: Anderson, Greil, Harrington, Schultz, and Strauss
Commissioners Absent: Stotko
Staff Present: City Planner Matthew Weiland, Associate Planner Kris Jenson
2. Approve May 22nd, 2000 Planning Commission Meeting Minutes.
3. Public Hearing - Special Use Permit for Personal Communications Services (PCS) 75 ft tower (3050
Hwy 316).
4. Site Plan - Personal Communication Service (PCS) 75 ft Tower (3050 Hwy 316).
City Planner Matthew Weiland presented background information on the project.
Chairman Schultz opened the Public Hearing at 7:04 pm. With no public comment made, the Public Heating was
closed at 7:05 pm.
Commissioner Strauss inquired as to what an ice bridge was, as indicated on the site plan.
Mr. Kelly Sleeter of US West, explained that it was a protective covering for the cable which ran from the tower
to the equipment building.
Commissioner Schultz asked Staff is they had received any comments from the neighbors.
Planner Weiland stated that a notice was mailed to all residents within 350' of the site and that no comments were
received.
Planning Commission Action:
Commissioner Harrington moved and Commissioner Strauss seconded to recommend to City Council the
approval of the US West 75 ft monopole tower special use permit subject to the following:
The tower must be substantially completed within one year, including any structures
accompanying the tower, following the date of permit, unless a time extension is approved by
the City Council. In the event that a tower is not substantially completed within one year of the
permit issuance, the tower and associated facilities may be removed by the City and the costs of
removal assessed to the tower owner or against the property.
All abandoned or unused towers and associate facilities shall be removed within 12 months of
the cessation of operations at the site, unless a time extension is approved by the City Council.
The tower owner is responsible for these costs. In the event that a tower is not removed within
12 months of the cessation of operations at a site, the tower and associated facilities may be
removed by the city and the costs of removal assessed against the property.
Unused portions of the towers above a manufactured connection shall be removed within two
years six months time of the antenna relocation, if the unused portion exceeds 25 % of the
height of the tower or 30 feet, whichever is greater. The replacement of portions of a tower
previously removed requires the issuance of a new special use permit.
The tower owner and successor owners shall allow the shared use of the tower, if an additional
user agrees in writing to meet reasonable terms and conditions for shared use and so long as
there is no negative structural impact upon the tower, and there is no disruption to the service
provided.
The property owner shall enter into an agreement with the City which holds itself and its
successors responsible for the tower on their property. The property owner shall further agree to
be assessed for any expenses related to the removal of the tower and associated facilities.
Upon vote taken, Ayes, 5; Nays, 0. Motion carried.
Planning Commission Action:
Commissioner Strauss moved and Commissioner Anderson seconded to recommend to the City Council
the approval of the US West 75 ft monopole tower site plan subject to the following:
1. That the proposed structure ans accessory items, including the landscaping, shall be completed
pursuant to the approved site plan. Upon request for occupancy of the building, all uncompleted items
contained within the site plan shall be addressed pursuant to city code escrow requirements.
2. The applicant shall incorporate any comments from MNDOT into their site plan application.
Upon vote taken, Ayes, 5; Nays, 0. Motion carried.
5. Updates and Other Business
Planner Weiland briefed the Planning Commission about the neighborhood open house held for the Guardian
Angels Redevelopment project.
Commissioner Greil asked about the issues brought up, as well as who was all notified of the meeting.
Planner Weiland stated that neighbors within 500' were notified by mailing. The newspaper was notified that a
meeting was scheduled, but no official notices were published by the City. The major concerns raised at the
meeting were in regards to the appearance of the new townhomes, and how they will blend with the neighborhood.

There being no further business the meeting was adjourned at 7:11 pm.
