Regular Meeting
Commissioner Schultz called the meeting to order at 7:05 p.m.
Commissioners Present: Anderson, Greil, Harrington, Schultz, Stotko, and Strauss
Commissioners Absent: None
Staff Present: City Planner Matthew Weiland, Associate Planner Kris Jenson
2. Approve April l0th, 2000 Planning Commission Meeting Minutes.
3. Variance - Setback Variance 1303 3rd Street East
Planner Jenson presented background information on the project.
Commissioner Harrington inquired as to when the garage was originally constructed.
Kenneth Macheska, applicant, stated that the garage was originally constructed in approximately 1940. Planner
Weiland reminded the Commission that that was prior to the adoption of the Zoning Code.
Commissioner Strauss asked the applicant why the structure simply wasn=t being replaced, being that the original
structure would be re-sided and re-roofed as a part of this project.
Mr. Macheska indicated that the garage was still a sound structure.
Planning Commission Action:
Commissioner Harrington moved and Commissioner Anderson seconded to recommend to City Council
the approval of a 15' corner side yard setback variance and a variance from Section 10.06 Subd. 4 (a) for
an addition to a non-conforming structure based on the findings that the applicant has satisfied the
variance criteria as follows:
That special conditions and circumstances exist which are peculiar to the land, structure, or
building involved and which are not applicable to other lands, structures, or buildings in the
same district.
The literal interpretation of the City Code would deprive the applicants of rights commonly
enjoyed by other properties in the same district under the terms of Chapter 10.
That the special conditions and circumstances do not result from actions of the applicant.
That granting the variance requested will not confer on the applicant any special privilege that is
denied by Chapter 10 to other lands, structures, or buildings in the same district. No non-
conforming use of neighboring lands, structures, or buildings in the same district, and no
permitted or nonconforming use of lands, or buildings in other districts shall be considered
grounds for the issuance of a variance.
Upon vote taken, Ayes, 5; Nays, 1. Motion carried.
4. Site Plan - Garage Move - 720 3rd Street West
Planner Jenson presented background information on the proposal. The Planning Commission is reviewing this
item as the Board of Design Control.
Commissioner Harrington inquired about the distances from the existing house to the west and the proposed
driveway. Planner Weiland responded that the existing house to the west is very close to the property line, within
4' and the proposed driveway is proposed to be located at the property line. Planner Weiland also reminded the
Commission that they were only reviewing the garages to be moved onto the site, not the homes which are
proposed to be constructed on the site.
Commissioner Anderson stated that he was in favor of re-using structures, and felt that these would be in the
spirit of the neighborhood. He inquired about the colors of the garage and whether they would match the homes
being built.
James Schoffman, applicant, stated that the garages would be repainted to match the new homes, and the new
homes would have shingles that match the existing shingles on the garages. The garages will also have new
garage doors installed.
Chairman Schultz asked if there was anyone in the audience who was interested in speaking about this issue.
Cathy Maynard, 738 W 3rd Street, stated that she is fully in support of this project and thinks it will be an asset to
the neighborhood. However, she stated that due to the fact that her home is located so close to the property line,
she would rather see the proposed layout flipped and the proposed home next to hers with the driveway to the
east. Ms. Maynard stated that the bedrooms in their home are located on the east side of the home, and the
proposed driveway would be running right along those bedrooms. Ms. Maynard would prefer to see the proposed
home on the west (the one adjacent to hers) Aflipped@ so that the home would be closer to hers and the driveway
would be on the east side of the lot, adjacent to the driveway for the other lot.
Commissioner Anderson stated that he felt Ms. Maynard=s request was a reasonable one. Commissioner Stotko
asked if it would be possible to Aflip @ both site plans and have the driveways on the east of both lots.
Mr. Schoffman stated that the property owner to the east has a driveway at the west property line, and therefore
the driveways would then be adjacent. The proposed arrangement was decided upon to maintain the uniformity
along the street.
Commissioner Harrington inquired about whether Ms. Maynard=s property was surveyed at the time of purchase.
Ms. Maynard stated that the property was not surveyed at the time of purchase, but that they were aware of the
property line being very near the house.
Commissioner Anderson noted that he drove by the site prior to the meeting. He asked Planner Weiland if the
Planning Commission, as the Board of Design Control, would be reviewing this matter if the garages were being
constructed on site rather than moved in. Planner Weiland stated that no, the matter would not be brought before
the Board.
Ms. Maynard stated that she has spoken with the applicant regarding installing a fence along the property line to
provide privacy, however due to the location of a number of trees and stumps, it would make the installation of a
fence nearly impossible.

Mr. Schoffman stated that perhaps when the backhoe is on site to dig the foundations for the homes, he could
have the backhoe pull out some or all the stumps. This would clear the way for a fence to be installed.
Planning Commission Action:
Commissioner Harrington moved and Commissioner Strauss seconded a motion to recommend to the City
Council to authorize issuance of moving and building permits to allow the garages to be moved to Lots 15
and 16, Block 12, Addition #13 to the City of Hastings subject to the following conditions:
Compliance with all applicable City Code requirements including, but not limited to: City Code
Chapter 4 (Construction Regulations) and City Code Chapter 18 (Property Maintenance
Ordinance).
The applicant shall paint the garages to match the new home constructed on the lot, as well as
install new garage doors.
That all exterior site work on the structure and site be completed within 6 months from the date
of permit issuance. This shall include paving the entire driveway, from the curb to the garage
doors.
That the garages be sited in order to save as many trees as possible.
Upon vote taken, Ayes, 5; Nays, 1. Motion carried.
5. Site Plan - Jablonske Office Building - 314 Vermillion Street
Planner Weiland provided background information on the project.
Commissioner Strauss asked for clarification on the Phase II portion of the property, what was being done with
that part of the lot and what it would be used for in the meantime. Planner Weiland responded that the Phase II
portion would be sealcoated and used for overflow parking until the applicant determined how to proceed with the
area. The boulevards which were located in the Phase II area on the site plan would actually be completed as a
part of Phase I.
Commissioner Anderson asked the applicant if the building was to be sprinkled. Mr. Greg Jablonske, applicant,
stated that he was not intending to sprinkle the building.
Planning Commission Action:
Commissioner Stotko moved and Commissioner Strauss seconded a motion to recommend to the City
Council approval of the site plan for 314 Vermillion Street subject to the following conditions:
That the proposed structure and accessory items including, but not limited to, the parking lot
and landscaping shall be completed pursuant to the approved site plan. Upon request for
occupancy of the building, all uncompleted items contained within the site plan shall be
addressed pursuant to city code escrow requirements.
That the developer shall be required to obtain site plan approval for phase II of the project prior
to obtaining a building permit.
That the developer modify the site plan to include the following elements subject to approval of
the City Planner:
1. There shall be two 10 fl landscaped and curbed boulevard areas installed at the south
end of the parking lot fronting 4th St as required by City Code.
2. The sidewalk on the south side of the building shall be increased to 5 fl.
3. The sidewalks on the east and west side of the parking lots shall be increased to 7 fl to
allow for car bumper overhang.
That the developer modify the site plan to include the following elements subject to approval of
Public Works Director:
1. The grading plan needs to be revised to show existing contours.
2. The parking lot also needs to be redesigned to properly drain to the street. There
should be at least a 1% grade to drain across bituminous.
That the developer modify the landscape plan to include the following elements subject to
approval of the City Planner:
1. One tree shall be added to each landscaped boulevard on the north and south end of the
parking lot as identified on the site plan. This would total 4 additional trees.
2. Foundation plantings shall be required between the building and the sidewalk on the
south side of the building.
3. One additional 6" diameter maple shall be place along 4th St. as identified on the site
plan.
That the Developer shall incorporate any MNDOTs comments into the site plan.
That the phase II area of the site plan shall have the landscaped boulevards established and that
the parking lot shall be seal coated. There shall be no vehicle storage in this parking area.
That the Developer shall provide evidence that the land swap has been finalized with the
adjoining property owner or the building shall be changed to meet building code requirements
prior to the issuance of a building permit.
If there is a land swap deal arranged, it shall incorporate and access easement over the parking
lot entrance to be recorded with the property.
Upon vote taken, Ayes 6, Nays 0, Motion Carried
6. Updates and Other Business
Planner Weiland stated that he has not received any applications for the open Planning Commissioner position.
Chairman Schultz stated that there would be a meeting on May 3rd for the proposed Red Rock Corridor relating to
station locations, impacts on land uses, parking, etc. at the St. Paul Park City Hall.
