HomeMy WebLinkAbout11/08/99Hastings Planning Commission November 8th, 1999, 1999 Regular Meeting Commissioner Schultz called the meeting to order at 7:00 p.m. Commissioners Present: Flom, Schultz, Anderson, Donndelinger, Stotko and Strauss Commissioners Absent: Harrington Staff Present: City Planner, Matthew Weiland and Associate City Planner Kris Jenson 2. Approve Meeting Minutes of October llth, 1999 Planning Commission Meeting. 3. Setback Variance - 316 4th St E Associate City Planner Kris Jenson presented background information on this subject. Planning Commission Action: Commissioner Donndelinger made a motion and Commissioner Flom made a second to recommend approval to City Council of a 5.5' side yard setback variance and approval to City Council of a 1' to 2' extension of the non-conforming structure to the rear of the lot based on the findings that the applicant has satisfied the variance criteria as follows: A. That special conditions and circumstances exist which are peculiar to the land, structure, or building involved and which are not applicable to other lands, structures, or buildings in the same district. B. The literal interpretation of the City Code would deprive the applicants of rights commonly enjoyed by other properties in the same district under the terms of Chapter 10. C. That the special conditions and circumstances do not result from actions of the applicant. D. That granting the variance requested will not confer on the applicant any special privilege that is denied by Chapter 10 to other lands, structures, or buildings in the same district. No non-conforming use of neighboring lands, structures, or buildings in the same district, and no permitted or nonconforming use of lands, or buildings in other districts shall be considered grounds for the issuance of a variance. Findings of Fact 1. Special conditions exist which are peculiar to the structure in that it is an 1870's home. 2. The literal interpretation of the City Code would deprive the applicants of rights commonly enjoyed by other properties in the same district, such as an inside stairway to the lower level of the home, under the terms of Chapter 10. 3. This home is consistent with other homes in the area. 7. Updates and Other Business: City Planner Matthew Weiland informed the Planning Commission about the status of the Comprehensive plan and set up a planning commission comprehensive plan workshop for November 17th, 1999 Adjournment: There being no further business the meeting was adjourned at 7:10 pm 2
