HomeMy WebLinkAbout06/28/99Hastings Planning Commission Minutes of June 28th, 1999 Regular Meeting Commissioner Schultz called the meeting to order at 7:03 p.m. Commissioners Present: Flom, Harrington, Schultz, Anderson, and Strauss Commissioners Absent: Donndelinger Staff Present: City Planner, Matt Weiland. 2. Approve Meeting Minutes of June 9th Special Planning Commission Meeting. 3. Public Hearing- M+H Special Use - Canceled 4. Public Hearing -Featherstone Ridge Prelim/Final Plat City Planner, Matt Weiland presented background information on this subject. Public Hearing Opened at 7:15 pm for the Rezoning. Public Comments: Bill Shommer, 1347 Jackson Dr presented comments form the Condo Association that he represents. The association was concerned about impacts to the hill and public safety because of the long road ending in a cul de sac. The Public Hearing was closed at 7:20 pm Planning Commission discussion: The Planning Commission was concerned with the environmental impacts of this project as well as the public safety. Planning Commission Action: Commissioner Strauss made a motion and Commissioner Anderson made a second to recommend denial of the Featherstone Ridge Preliminary plat based on findings of fact that the impacts to the hillside were to great, that all property should not be developed, and due to public safety concerns. Upon vote taken, Ayes, 5; Nays, 0. Motion did not Carry. 5. Public Hearing - Rivertown commons Prelim/Final plat City Planner, Matt Weiland presented background information on this subject.. Public Hearing Opened at 8:22 pm for the Preliminary Plat Public Comments: Dennis Crowe (applicant)- Wanted to point out the 300 ft buffer to existing homes and the amount of green space. Murray Kornberg-Supported project but was concerned with outdoor storage area and requested more screening of that area. Lisa - Concerned with traffic going through Cari Park The Public Hearing was closed at 8:30pm Planning Commission discussion: The Planning Commission was concerned with the outdoor storage area and recommended increasing the opaque screening to the north. The Planning commission also talked about traffic issues. Planning Commission Action: Commissioner Harrington made a motion and Commissioner Flom made a second to recommend to City Council the approval of the Hastings Retail Preliminary Plat subject to the following conditions: That the storm water plan is approved by Barr Engineering and the Public Works Director. The Developer shall be required to incorporate into the development plans any comments from BARR Engineering or the Public Works Director. That the Developer shall incorporate MNDOT's comments into the preliminary plat or site plan. That the applicant shall pay a $300/lot - Interceptor Sewer Fee - which would total $300 for the proposed lot prior to City release of final plat hardshells. That the Developer shall obtain Site Plan approval from the City prior to issuance of any building permits for any future proposed developments on property. That the Developer shall be required to replat outlots before they may be developed That the Developer shall enter into a Development Agreement with the City to memorialize conditions of preliminary plat approval and that the executed Agreement shall be recorded against the subject property prior to issuance of a grading permits. Upon vote taken, Ayes, 5; Nays, 0. Motion Carries. 6. Public Hearing - Rivertown commons Special Use Permit (Gas Station) City Planner, Matt Weiland presented background information on this subject.. Public Hearing Opened at 8:45 pm for the Special Use Public Comments:No Comments The Public Hearing was closed at 8:46pm Planning Commission discussion: No discussion Planning Commission Action: Commissioner Flom made a motion and Commissioner Anderson made a second to recommend to City Council approval of the special use permit and site plan for the Rivertown Commons self service gas pump area, subject to the following conditions: The proposed structure and accessory items including, but not limited to, the parking lot landscaping shall be completed pursuant to the approved site plan. Upon request for occupancy of the building, all uncompleted items contained within the site plan shall be addressed pursuant to city code escrow requirements. That the Rivertown Commons Landscaping Plan is modified to add more screening of the gas pump area, subject to approval of the City Planner. 3. That the canopy lights are recessed and designed to shine down with limited spillover light. Upon vote taken, Ayes,5; Nays, 0. Motion Carries. 7. Master Plan - Rivertown Commons City Planner, Matt Weiland presented background information on this subject.. Planning Commission Action: Commissioner Strauss made a motion and Commissioner Harrington made a second to recommend to City Council the approval of the Rivertown Commons Master Plan amendment subject to following: That the Master Plan is modified to show the pedestrian trail connection with the housing development to the south Future uses proposed on the site shall be consistent with the Master Plan layout and size of uses. Detailed site plans must be submitted for each phase of the project. That the applicant shall modify the site plan to eliminate the 35 parking spaces along the northern property line. Upon vote taken, Ayes, 5; Nays, 0. Motion Carries. 7. Site Plan - Rivertown Commons City Planner, Matt Weiland presented background information on this subject. Planning Commission Action: Commissioner Flom made a motion and Commissioner Harrington made a second to recommend to City Council the approval of the Rivertown Commons Site Plan subject to following: 2. 3. 4. 5. That the storm water/utility plan is approved by Barr Engineering and the Public Works Director and that any comments from them is incorporated into the storm water and utility plan. That the Developer shall incorporate MNDOT's comments into the preliminary plat or site plan. That the developer extend the accent banding around the back of the building using the same materials and design. That the applicant shall modify the site plan to eliminate the 35 parking spaces along the northern property line. That the developer modify the landscape plan to include the following elements subject to approval of the City Planner: A. A mixture of trees should be planted along the southern edge of the proposed ponding basin. B. More trees and shrubs should be added along the western property line to screen the self service gas area. More trees and shrubs should be added to the new green space added to the noah of the site with the elimination of the 35 parking spaces. That the applicant modify the site plan to include a pedestrian trail connection to the southern housing development subject to approval of the City Planner. The cost and design of this trial shall be agreed to in a development agreement. The cost share and design of the traffic signals for this project shall be agreed to in a development agreement. That the proposed structure and accessory items including, but not limited to, the parking lot and landscaping shall be completed pursuant to the approved site plan. Upon request for occupancy of the building, all uncompleted items contained within the site plan shall be addressed pursuant to city code escrow requirements. Upon vote taken, Ayes, 5; Nays, 0. Motion Carried 9. House Move - 1104 4th ST W City Planner, Matt Weiland presented background information on this subject. Planning Commission discussion: The Planning commission was concerned about the tree on the site. Planning Commission Action: Commissioner Harrington made a motion and Commissioner Anderson made a second to recommend to City Council to authorize issuance of moving & building permits to allow the home included in a proposal from Cindy Towe to be moved to Lot 16, Block 21, Addition 19 to the City of Hastings (1120 W 4th St) subject to the following conditions: Compliance with all applicable City Code requirements including, but not limited to: City Code Chapter 4 (Construction Regulations) and City Code Chapter 18 (Property Maintenance Ordinance). That the yard area is seeded or sodded to establish a lawn. That 2 deciduous shade tree (minimum 2.5 inch diameter) be planted in the front yard prior to issuance of a Certificate of Occupancy. That a paved driveways is installed. That the home is placed on a full perimeter foundation. That all exterior site work on the structure and site be completed within 6 months from the date of permit issuance. Upon vote taken, Ayes, 4; Nays, 1. Motion Carried 10. House Move - 13th + Pine St City Planner, Matt Weiland presented background information on this subject. Public Comment: Neighbors in the area were very concerned with the duplex being brought into the area. They were especially concerned with the duplex being rental property. The applicant indicated his desire to split the duplex into two homes. Planning Commission discussion: The Planning commission was concerned with other properties in the area. The Planning Commission also felt the whole home should be painted. Planning Commission Action: Commissioner Harrington made a motion and Commissioner Anderson made a second to recommend that the City Council authorize issuance of moving & building permits to allow the home included in a proposal from Mark Cemensky to be moved to Lot 6, Block 7, Hancock Thomas and Company Addition (1304 W 13tn St) subject to the following conditions: Compliance with all applicable City Code requirements including, but not limited to: City Code Chapter 4 (Construction Regulations) and City Code Chapter 18 (Property Maintenance Ordinance). That the yard area is seeded or sodded to establish a lawn. That 4 deciduous shade tree (minimum 2.5 inch diameter) be planted in the front yard prior to issuance of a Certificate of Occupancy. That two paved driveways to the house are installed with a landscaping strip down the middle that must be landscaped according to a submitted plan approved by the City Planner. The applicant shall paint the entire house. The applicant shall install a new deck will to replace the red deck. That all exterior site work on the structure and site be completed within 6 months from the date of permit issuance. Upon vote taken, Ayes, 5; Nays, 1. Motion Carried 6. Updates and Other Business: City Planer, Matt Weiland informed the Planning Commission about the Comprehensive Plan workshop held with City Council on June 22nd, 1999 at 7:00pm Adjournment: There being no further business the meeting was adjourned at 9:45 pm
