Minutes of November 23rd, 1998
Regular Meeting
Commissioner Schommer called the meeting to order at 7:02 p.m.
Commissioners Present: Anderson,, Schommer, Harrington, Flom, Donndelinger, and Strauss
Commissioners Absent: Schultz
Staff Present: Zoning Administrator, Matt Weiland.
2. Minutes:
There being no additions or corrections the minutes of the November 9th26th, 1998, Regular Planning
Commission Meeting were approved.
3. Public Hearing - Rezone (Pleasant Hills)
Zoning Administrator Matt Weiland presented background information related to this item.
Commissioner Schommer opened the public hearing at 7:07 p.m.
Public Hearing Discussion:
Robert Schommer stated he represented the Pleasant Valley Townhome Association and that they had a lot of
concerns about the proposed project on Featherstone hill. The main concerns were with the impact on the hill, the
loss of habitat, the traffic and the density of the project.
Pat Schmitz stated she was concerned about the height of the buildings on the proposed pleasant hills
development.
The hearing was closed at 7:24 p.m.
Planning Commissioner Discussion
The Planning Commission was concerned about the density on the project. The concerns were about the amount
of impervious service, the impact to the habitat on the hill, and the amount of traffic. The Commissioners also
indicated they would like to see a zoning with less density for the site, such as R-2 zoning.
Planning Commission Action:
Commissioner Anderson made a motion and Commissioner Harrington made a second to make a
Recommendation to the City Council to approve the rezoning of the property to R-3 Planned Residential
Development
Upon vote taken, Ayes, 3; Nays, 3. Motion results in a non recommendation
Commissioner Strauss then made a motion and Commissioner Anderson made a second to make
Recommendation to the City Council to approve the rezoning of the property to R-2 Medium Density
Residence.
Upon vote taken, Ayes, 6; Nays, 0 Motion Carried.
4. Final Plat - Summit Point
Zoning Administrator Matt Weiland presented background information related to this item
Discussion:
The Planning Commission was concerned about the road widths in the Summit Point Final Plat. The applicant
informed the Planning Commission the narrower street widths were being proposed in this development which
satisfied the Planning Commission
Planning Commission Action:
Commissioner Donndelinger made a motion and Commissioner Flom made a second to make a Motion to
recommend approval to the City Council of the Summit Point Final Plat subject to the following
conditions:
1. Rezoning of the subject property from Agriculture to R-3 PRD.
2. The applicant be required to identify drainage and utility easements or provide documentation that the
common open spaces will be used as drainage and utility easements subject to the Public Works Director=s
approval.
3. That the Developer shall pay cash in lieu of land to meet park dedication requirements at the rate which has
been established by the City Council at the time of final plat approval. The per residential umt cash in lieu of
land requirement may be paid at the time of building permit issuance for each residential unit at the
established rate set at that time by City Council (currently $850.00).
4. That proposed street names be changed. Summit Point Drive must continue through to the northeast.
5. That the applicant shall pay $20,590 for the proposed 71 units in Interceptor Sewer Fees prior to City release
of final plat hardshells.
6. That the Developer shall obtain Site Plan approval from the City prior to issuance of any building permits.
7. That the developer shall construct a temporary 20 ft. wide gravel drive as part of Phase One, connecting to
Featherstone Road.
8. The applicant shall provide evidence of an easement for storm water outfall in the Oakwood Cemetery
Ravine.
9. That reference shall be made in the Development Agreement to the two phases of development and the
requirements required for both phases.
10. That reference shall be made in the Development Agreement that the Developer must provide evidence to the
City that common areas including the proposed cul-de-sac island and ponding areas will be maintained by a
homeowner=s association prior to issuance of any building permits for residential construction.
11. That the Developer shall enter into a Development Agreement with the City to memorialize conditions of
preliminary/final plat approval and that the executed Agreement shall be recorded against the subject
property prior to issuance of any grading and/or building permits.
Upon vote taken, Ayes, 6; Nays, 0. Motion carried.
5. Updates and Other Business:
City Planner Matthew Weiland informed the Planning Commission that they would talk about the Comprehensive
Plan Revisions at the upcoming meetings and would also discuss the 1999 Planning Commission members and
the Officers for that Commission.
