HomeMy WebLinkAbout10/26/98Hastings Planning Commission Minutes of October 26th, 1998 Regular Meeting Commissioner Schommer called the meeting to order at 7:00 p.m. Commissioners Present: Anderson, Donndelinger, Schommer, Harrington, Flom, and Strauss Staff Present: Zoning Administrator, Matt Weiland. 2. Minutes: There being no additions or corrections the minutes of the October 12th, 1998, Regular Planning Commission Meeting were approved. 3. Shoreland Variance - (Lot Size Variance lots 1-4, Block 9, Barker=s Addition) Zoning Administrator Matt Weiland presented background information related to this item. The Commission agreed that the lot size variance request met the variance criteria to be approved but debated about whether or not the lot width variance should be granted. The issue was that there was that there was enough lot area to make the proposed lots conforming to the 75 ft width requirement. The applicant indicated that the survey was drawn up to create 11,000 sq ft lots that he felt would meet the City=s and the DNR=s requirements. In the end, the commission decided to also recommend approval of the lot width requirement. The Commission also indicated they would like a shoreland setback requirements worksheet created. Planning Commission Action: Commissioner Harrington made a motion and Commissioner Anderson made a second to make a Recommendation to the Board of Appeals and Adjustment (City Council) to grant a variance to the City of Hastings Shoreland Management Ordinance lot size requirements to allow Lot 1-4, Block 9, Barker=s Addition to be split into 3 lots (2- 11,000 sq ft 1- 14,960 sq ft), based on findings that the applicant has demonstrated compliance with the following variance criteria: That special conditions and circumstances exist which are peculiar to the land, structure, or building involved and which are not applicable to other lands, structures, or buildings; That literal interpretation of the City Code would deprive the applicant of rights commonly enjoyed by other properties in the same district under the terms of Chapter 10; That the special conditions and circumstances do not result from the actions of the applicant; That granting the variance requested will not confer on the applicant any special privilege that is denied by Chapter 10 to other lands, structures, or buildings in the same district. No non-conforming use of neighboring lands, structures, or building in the same district, and no permitted or non-conforming use of lands, structures, or building in other districts shall be considered grounds for the issuance of a va_fiance. If the variance is approved, The following conditions of subdivision must be met: 1. The minimum lot size shall not be less than 11,000 sq ft 2. Development of the lot shall meet setback requirements 3. The impervious service coverage shall not exceed 25% 4. Three lots will be created from four non-conforming lots, all of which meet the aforementioned provisions. Upon vote taken, Ayes, 6; Nays, 0. Motion carried. 4. Updates and Other Business: Commissioner Strauss indicated that she would give the Planning Commission a presentation on shoreland requirements at a future meeting. It was agreed that this should be done and the other City elected and appointed officials should be invited to attend the presentation. Adjournment: There being no further business the meeting was adjourned at 7:40m.
