Minutes of July 13, 1998
Regular Meeting
Commissioner Schommer called the meeting to order at 7:18.
Commissioners Present: Schommer, Schultz, Strauss and Anderson.
Commissioners Absent: Harrington, Donndelinger, and Flom.
Staff Present: Community Development Director Wozniak and Zoning Administrator Weiland.
Minutes:
There being no corrections or additions the Meeting Minutes of the June 22, 1998 - Regular Planning
Commission Meeting were approved.
Public Hearing: Zoning Text Amendment to District Use Regulations for the Agriculture District:
Community Development Director Wozniak presented background information related to this item.
Commissioner Schommer opened the hearing at 7:20 p.m. Sean McMurray of 1514 3rd Street E, commented in
favor of the amendment.
Commissioner Strauss made a motion and Commissioner Schultz made a second to recommend approval
of a Zoning Ordinance Text Amendment to Section 10.11 of the Hastings City Code to add as a use
permitted by Special Permit - Motor Vehicle lmpound Lots, subject to the following conditions:

Motor vehicles cannot be kept in an impound lot for more than 14 days unless a police hold has been
placed on the motor vehicle.
No sales of motor vehicles, salvaging, repairing, dismantling, or stripping of motor vehicles shall be
allowed in the impound lot.
100% opaque fencing or landscaping at least six feet high must be placed around the entire lot and must
be adequately maintained.
All motor vehicles impounded shall be kept within the opaque fenced or landscaped area.
All buildings on the lot must be permanent structures with permanent foundations.
The entire impound lot shall be surfaced with a bituminous covering, class 5 gravel, or other surface
covering as approved by the City.
A sufficiently sized bituminous area shall be provided for the parking of vehicles which may be leaking
fluids or other pollutants.
Any lighting in the impound lot shall not be obtrusive to neighboring property.
Employees of the city or its duly appointed representatives, shall be allowed on the property at any time
to inspect the impound lot to verify compliance with the City Code.
Any special use permit issued hereunder shall be reviewed annually and at other times deemed
appropriate by the City, to verify compliance with the City Code and any special conditions of the
permit. As part of the review procedure, the city may hold a public hearing, preceded by the appropriate
mailed and published notice. As part of any review procedure, the City may amend the permit by adding
or deleting any conditions it deems necessary to protect the public health, safety, and welfare.
All conditions imposed by City Code Section 2.04, Subd. 5, Subsection (B) (5) must be met.
Additionally, the City may impose any other conditions it feels are necessary to protect the public, health,

safety and welfare.
Any violation of this subdivision or any conditions imposed upon the special use permit shall be cause
for termination of the permit by the City.
Upon vote taken, Ayes, 4; Nays, 0. Motion carried.
The Commissioner further directed staff to research the 14 day limit for storage of vehicles to determine if it
conflicts with state requirements for impounding vehicles for evidence in criminal investigations.
Public Hearing: Special Use Permit - 520 Vermillion Street - Veterinary Clinic:
Zoning Administrator Weiland presented background information related to this item. Commissioner Schommer
opened hearing at 7:30 p.m. There being no comments the hearing was closed.
Commissioner Schultz moved and Commissioner Anderson made a second to recommend to City Council
of the Special Use Permit request of Jon Woodman, DVM, to operate a small animal clinic at 520
Vermillion Street, subject to the following condition:
1. There shall be no outside storage of animals.
Upon vote taken, Ayes, 4; Nays, 0. Motion carried.
Public Hearing: Minor Subdivision - 727 W. 5th St. - Mark Raway:
Zoning Administrator Weiland presented background information related to this item. Commissioner Schommer
opened hearing at 7:33 p.m. There being no comments the hearing was closed.
Commissioner Anderson moved and Commissioner Strauss made a second to recommend approval to the
City Council of the minor subdivision request of Mark Raway to subdivide property situated at 727 W. 5th
Street subject to the following conditions:
Approval of a resolution waving platting requirements.
The resolution waving platting requirements and a certificate of survey shall be recorded with the
County. A copy of the certificate of survey shall also be filed with the City.
The applicant shall pay $850.00 in park dedication fees.
The developer shall plant one Aboulevard@ tree and one front yard tree per lot. These trees shall be at
least two inches in diameter at the base and the species of the tree should be on the list of approved trees
created by the City Forester. This requirement is consistent with what the city has been requiting in other
areas.
Upon vote taken, Ayes, 4; Nays, 0. Motion carried.
Site Plan Assisted Living - Regina Medical Center:
Zoning Administrator Weiland presented background information related to this item.
Commissioner Strauss moved and Commissioner Schultz made a second to recommend to the City
Council approval of the Regina Medical Assisted Living Complex Site Plan subject to the following
conditions:
Submission of a revised utility plan showing the installation of a storm water catch basin at the western
end of the parking lot meeting the Public Works Director=s approval
The proposed structure and accessory items including, but not limited to, the pa]king lot and landscaping
shall be completed pursuant to the approved site plan. Upon request for occupancy of the building, all
uncompleted items contained within the site plan shall be addressed pursuant to city code escrow
requirements.
Upon vote taken, Ayes, 4; Nays, 0. Motion carried.
