Minutes of November 10, 1997
Commissioner Schommer opened the meeting at 7:00 p.m.
Commissioners Present:
Schommer, Flom, Bolesworth, Strauss, Donndelinger and Schultz
Commissioners Absent:
Harrington.
Staff Present:
Community Development Director Wozniak and Zoning
Administrator Weiland.
Minutes:
Commissioner Schommer called for corrections or changes to the November 10, 1997 meeting
minutes. There being no changes or correction the meeting minutes were approved.
Public Hearing: Tech Automotive - 2127 Vermillion Street (Magic Touch Carwash) -
Special Use Permit:
Zoning Administrator, Matt Weiland, present background information related to a special use
permit request from Richard King to allow motor vehicle repair and motor vehicle detailing at
2127 Vermillion St.
Commissioner Bolesworth moved and Commissioner Flom made a second to recommend
approval to the Hastings City Council of a special use permit to allow motor vehicle repair and
motor vehicle detailing at 2127 Vermillion Street subject to the following conditions:
The applicant must get the necessary building permits to convert the carwash into a repair
shop; and
The applicant shall make sure the building and site comply with the requirements of the
Property Maintenance Code.
Upon vote taken, Ayes, 6; Nays, 0.
Variance - 509 6th St
Zoning Administrator, Matt Weiland, present background information related to a setback
variance request from Larry Sanders of 509 W 6th St.
Commissioner Flom moved and Commissioner Donndelinger made a second to approve a 2.8 foot
front yard setback variance and a variance to Chapter 10, Section 10.06, Subd. 4 (non-
conforming structures); based on the finding that the applicant has satisfied the variance criteria as
follows:
That special conditions and circumstances exist which are peculiar to the land, structure or
building involved which are not applicable to other lands, structures or building in the
same district.
The literal interpretation of the City code would deprive the applicants of rights commonly
enjoyed by other properties in the same district under the terms of Chapter 10.
That the special conditions and circumstances do not result from actions of the applicant.
That granting the variance requested will not confer on the applicant any special privilege
that is denied by Chapter 10 to lands, structures, or building in the same district. No non-
conforming use of neighboring lands, structures or buildings in the same district, and no
permitted or non-conforming use of land, or building in other districts shall be considered
grounds for the issuance of a variance.
Upon vote taken, Ayes, 6; Nays, 0.
