Minutes of July 28, 1997
Commissioner Schommer opened the meeting at 7:00 p.m.
Commissioners Present:
Schommer, Harrington, Flom, Bolesworth, Strauss, Donndelinger
and Schultz.
Staff Present:
Community Development Director Wozniak.
Minutes:
Commissioner Schommer called for corrections or changes to the July 14, 1997 meeting minutes.
There being no changes or corrections the meeting minutes were approved.
Public Hearing: Old Mill Addition - Preliminary/Final Plat & PRD Plan:
Wozniak presented background information regarding this item to the Commission.
Commissioner Schommer opened the public hearing at 7:20 p.m. The following comments were
made:
Ken Klein of 1500 Bailey Street asked a question related to a portion of 15th St. Right-of-
Way which was unrelated to the project.
Vern Timmer of 1517 Tyler Street - asked if an EAW would be required for the project
and stated that the City should acquire the property to expand its park holdings.
Herman Fasbender (applicant) explained his role and interest in developing the property.
Jim Lewanski of 1575 King Midas Lane asked questions about the design of public
improvements proposed for King Midas Lane and described the unique plant materials
present on the subject property.
Kevin Pomerenke of 1601 King Midas Lane also asked question about the design of public
improvement proposed for King Midas Lane and expressed concerns about vandalism in
Old Mill Park moving onto the Old Mill Addition property if a public trail or boardwalk is
built along the river.
Following considerable discussion regarding the proposed subdivision Commissioner Strauss
moved and Commissioner Schultz made a second to recommend approval to the Hastings City
Council of the Old Mill Addition Preliminary/Final Plat & PRD Plan subject to the following
conditions:
Dedication of public land to be platted as an Outlot for purposes of developing a
pedestrian trail and/or boardwalk along the Vermillion River. The configuration of said
outlot shall be determined based upon recommendations of Public Works Director
Montgomery and Park & Recreation Director McNamara and shall be reflected on hard
shell copies of the plat submitted to the City for signatures.
That homes to be constructed on Lots 5, 6 and 7 be setback a minimum of 150' from the
Ordinary High Water Line (OHWL) of the Vermillion River or 30' from the top of the
bluff as identified on the enclosed preliminary plat utility plan; whichever is more
restrictive.
That all proposed structures adhere to yard setback requirements established for the R-2
Zone District except where greater setbacks are required to meet Shoreland Management
Ordinance requirements.
Execution and recording against the subject property of an agreement between the
developer and the City that the maintenance of the Old Mill Court cul-de-sac island shall
be the responsiblity of the owners of the lots which front on the cul-de-sac.
That City Council shall be provided with the detailed design of public improvements to
address concerns expressed by other King Midas Lane property owners.
Upon vote taken, Ayes, 7; Nayes, 0.

Commissioner Bolesworth moved and Commissioner Flom made a second to adjourn the meeting
at 9:00 p.m.
