The City Council of the City of Hastings, Minnesota met in a regular meeting on
Monday, December 1, 1986, at 7:30 p.m. at St. Phil ip's Lutheran Church, 15th and Pleasant
Streets, Hastings, Minnesota.
Members Present: Councllmember Werner7 Kulzer, Bond, Trautmann
Nesbitt, Plan, Wendler and Mayor Stoffel
Members Absent: Councllmember Berg.

The Mayor cal led for additions or corrections to the minutes of the meeting of
November 17, 1986 and hearing none declared the minutes approved as presented.
The Mayor asked if there were any additional items to be
placed upon the agenda. There were none.
Moved by Councilmember Trautmann, seconded by Councllmember
Wendler to accept the highest bid from Cushing Rural Fire
Corporation In the amount of $6,100 for the 1959 International
Fire Truck. 8 Ayes; Nayes, None.
Moved by Councilmember Wendler, seconded by Councilmember
Werner to approve a minor subdivision for Lots 2 and 3, Block 17
Allison's Addition, 809 West 10th Street, Louis Hoffman per
Planning Commission's recommendation. 8 Ayes; Nayes, None.
Moved by Councilmember Werner, seconded by Councilmember
Bond, to approve a 10 foot rear yard setback variance request
for Michael Kef Iy at 2470 Southview Court, Lot 10, Block 2,
Tannenbaum Estates. Approval is subject to a survey being
completed to ensure lot I ine locations and proper setback
distances. 8 Ayes, Nayes, None.

Moved by Councilmember Werner, seconded by Counci I member
Plan that the five Individuals, Parks Department, Marty McNamara
and Lee Erickson, Street Department, Keith Rosch and LaVere Fox,
and Building Department, Merl In Wilbur, using City vehicles have
their salaries increased by $200 for 1987 to compensate them for
the amount of deduction withheld by the Internal Revenue Service.
City Staff Is directed to look into this matter further to
determine if the new tax laws have any further effect on this.

Moved by Councilmember Bond, seconded by Councilmember
Wendler to approve the Mayor's appointment of Edward Rlveness
to the Library Board. 8 Ayes; Nayes, None.
Moved by Councllmember Plan and seconded by Councilmember
Wendler to accept the Industrial Park Commission's
recommendation appointing Arvid Evensvold as the Interim
Industrial Park Director for a term not to exceed 90 days or
March 15, 1987. 8 Ayes, Nayes, None.
Moved by Councilmember Wendler, seconded by Councllmember
Trautmann to accept the resignation effective November 18, 1986 of
the Councilmember from the First Ward, Tom Berg. 8 Ayes, Nayes,
None.

Wendler to authorize the advertisement for a two week period
accepting appl ications to fil I this position.

Moved by Councilmember Werner, seconded by Council member
Trautmann to amend the main motion al lowing a period of one
month's time for advertising. 4 Ayes; Nayes, Bond, Nesbitt,
Wendler, and Stoffel. This motion did not carry as it was a
tie vote.
The Mayor then cal led for the vote on the main motion.
4 Ayes; Nayes, Kulzer, Trautmann, Plan, and Werner. This
motion did not carry as it was a tie vote.
Moved by Councllmember Werner, seconded by Council member
Nesbitt to authorize the advertisement for a three week period
for appl icants to be considered to fil I the vacancy in the
third ward council seat. 7 Ayes; Nayes, Trautmann. Motion carries

Bond to refer the matter of Section 3.11, Subdivision 11 of the
City Charter regarding department head contracts to the Charter
Commission to meet and make a recommendation to the City
Council. 8 Ayes; Nayes, None.
Moved by Councllmember Nesbitt, seconded by Councllmember
Trautmann to pass the first reading amending the Cable Franchise
Ordinance making reference to Coaxial Communications versus
Telephone and Data Systems and setting a publ ic hearing for the
~~:~ber 15. 1986 regular City Council meeting. 8 Ayes; Nayes. ~
Moved by Councllmember Trautmann, seconded by Councllmember'~~
Werner to approve the cancel I atlon of a del I nquent water b III at
1881 Brittany Road In the amount of $86.14 due to a bankruptcy.

Moved by Councllmember Werner, seconded by Councllmember
Trautmann to approve the Issuance of a 3.2 malt I iquor license
for on and off sale for Shiner's Tavern, 223 Sibley Street. The
Council further terminated the license held by Heinen's Tavern by
Carol Maninnen. 8 Ayes; Nayes, None.
Moved by Councilmember Werner, seconded by Council member
Kulzer to have City staff prepare a resol ution for the next
meeting which would address the previous resolution No. 54-86
regarding the no wake on the Mississippi and setting forth pol Icy
on how the City would like to have the no wake addressed.
The Council further suggested the possible separation of tows
during high water. 8 Ayes; Nayes, None.
Moved by Councllmember Kulzer, seconded by Councilmember
Wendler to adopt resolution No. 96-86 accepting a parcel of land
Immediately west of 14th Street, ranging from 1.39 ft. to 1.69
ft. by 360.85 ft. long wh I ch was not descr I bed I n the property [. 'I! I
description of property currently owned by Walter Bauer. The
City further accepts this dedicated land by simply paying the
filing fee of approximately $10. 8 Ayes; Nayes, None. Copy
of resolution on file.

Werner to approve the final payment for Keller Construction for
the 1986 improvement proJects numbers 1, 3, 4, 5, 6, 7, 8, 9, 10,
11, 12 and 13, In the amount of $166,550.41. 8 Ayes, Nayes,
None.
