April 7, 1986
The City Council of the City of Hastings, Minnesota met in a regular
meeting on M:mday, April 7, 1986 at 7: 30 p.m. in the Council Chambers of the
City Hall.
Members Present: Councilrnember Berg, Werner, Kulzer, Bond, Trautmann,
Nesbitt, Plan, Mathiowetz and Mayor Stoffel.
Members Absent: None.

The Mayor called for additions or corrections to the minutes of the
meeting of March 17, 1986 and hearing none declared the minutes approved
as presented.
Moved by Councilrnember Trautmann, seconded by Councilmember Plan to
adopt" Resolution No. 36-86 accepting and awarding the bid for the fire
truck to Custom Fire, per the Safety Committee and the Rural Fire
Association recornnendation. 8 Ayes; Nayes, None. Copy of resolution
on file.
Moved by Councilmember Berg to reconsider the award of bid for
further review and discussion. This motion died for lack of a second.
The Mayor declared the Public Hearing open at 7:55 p.m. to consider
amending Section 10.23 footnote G of the City Code, by establishing
interior sideyard setback requirements for attached garages, attached
garages with adjoining living space, or detached garages in an R1 zone.
The Mayor asked if anyone wished to speak on the issue; No one wished to
do so. The Mayor declared the public hearing closed at 7:56 p.m.
The Mayor declared the Public Hearing open at 7:56 p.m. to consider
amending Section 10.24 Subdivision 4 of the City Code having to do with
the site and building plan review procedure. The Mayor asked if anyone
wished to speak on the issue; no one wished to do so. The Mayor closed
the public hearing at 7:57 p.m.

Moved by Councilmember Kulzer, seconded by Councilmember Berg to
pass the 2nd reading of an Ordinance amending Section 10.23 footnote G
of the City Code by establishing interior sideyard setback requirements
for attached garages, attached garages with adjoining living space, or
detached garages in an R 1 zone. 8 Ayes; Nayes, None.
Moved by Councilmember Werner, seconded by Councilmember Mathiowetz
to pass the 2nd reading of an Ordinance amending Section 10.24
Subdivision 4 of the City Code having to do with the site and building
plan review procedure. It was further noted that the Planning Committee
was to continue work on refining Section 10.24. 8 Ayes; Nayes, None.

pass the 2nd reading of an Ordinance amending Section 10.01 Subdivision REZONING FROO
1 of the City Code rezoning Sieben's 3rd Addition from Agricultural to AGRICULTURAL TO
R3 PRD and accepting the Planning Commissions recornnendation for approvalR3 PRD-SIEBEN'S
of the final plat subject to a developers agreement being entered into; 3RD ADDITION &
to take into consideration, but not limited to, those i terns of concern FINAL PLAT
which were brought forward during the rezoning and preliminary plat review
including matters pertaining to the planned residential development
proposal. Approval of the final plat is also subjec;t to the passing
of the third reading of the rezoning amendment. The applicant is
~ further requested to consider an alternate name for the proposed High
View Drive Street. 8 Ayes; Nayes, None.
Moved by Councilmember Werner, seconded by Councilmember Nesbitt
to deny the applicant for a Wood Restoration business at 715 Pine Street,
per the Planning Commissions recornnendation based on the following:
1. The applicant is proposing to use an accessory building for the
Home Occupation which is not permitted by the City's Code pertaining
to Home Occupation permits.
2. That a person other than a member of the family residing on the
premises would be involved with the Home Occupation which is not
permi tted in the City's Code pertaining to Home Occupation permits.

to adopt Resolution No. 37-86 amending the Hastings Comprehensive Plan
and Capital Improvements Plan. 8 Ayes; Nayes, None. Copy of resolution

Moved by Councilrnember Bond, seconded by Councilmember Berg, to
set a public hearing for the May 5, 1986 regular City Council meeting
to consider vacating a drainage and utility easement located on the
carmon line of Lot 7 & 8, Block 1 Olson's Addition - 111 West 25th
Street. 8 Ayes; Nayes, None.
Mr. Matt J. Begich requested that the City Council reconsider
Project 1986- 1 Oak Street from 11 th Street to 1 3th Street. The Council
took no action.
Moved by Councilmember Werner, seconded by Councilmember Trautmann
to have the City of Hastings continue the 40% cost share for removal 0
of diseased boulevard trees in the 1986 season, stump removal will .
be the responsibility of the home owner and the City will not
participate with diseased trees on private property and only mark
private trees on request from the residence. 8 Ayes; Nayes, None.
Moved by Councilmember Werner, seconded by Counci1.member Bond
to enter into an agreement between the City of Hastings and Daryl
Plath, Chief of the Police Department, regarding the accumulated
vacation days of Mr. Plath. 8 Ayes; Nayes, None. Copy of agreement
on file in the office of the City Administrator/Clerk.
Moved by Councilmember Trautmann, seconded by Councilmember Nesbitt
to approve an annual increase of $300.00 for the Hastings Fire Relief
Association pension fund. 7 Ayes; Werner abstained.
Moved by Counci1.member Werner, seconded by Counci1.member Bond to
appoint Cal Ruedy to fill the vacancy in the Street Department for the
Heavy Equipment operator effective May 1, 1986 and authorize the posting
of the then vacant Light Equipment operator position. 8 Ayes; Nayes, None.
Moved by Councilmember Trautmann, seconded by Councilmember Kulzer
to approve the 4 lane highway design that is adjacent to the park and
various changes including the curb, gutter and bike way for Highway
55 so that the necessary documents can be forwarded to the Federal
Highway Administration, and authorizing City Staff to forward the O'
statement of approval to the Minnesota Department of Transportation.

Moved by Councilmember Werner, seconded by Councilmember Kulzer
to have the Planning Committee of the City Council discuss various
aspects of the Highway 55 construction project. 7 Ayes; Nayes, None.

Moved by Counci1.member Werner, seconded by Councilmember Berg to
adopt Resolution No. 38-86 approving plans and specifications and ordering
advertisements for bids for the 1986 City Improvements. 7 Ayes; Nayes,
None. Counci1.member Bond was absent for this vote.
Moved by Councilmember Trautmann, seconded by Counci1.member
Werner to approve the East 3 feet of Lot 10, Block 1 Fasbender Addition
as non conservation land due to non payment of taxes for years 1979 to
1981. 8 Ayes; Nayes, None.
Moved by Councilmember Bond, seconded by Councilrnember Plan to
have the appropriate Corrrnittee of the City Council discuss needs
and consider additional staffing for the Police Department and the
Street Department. 8 Ayes; Nayes, None.
