The City Council of the City of Hastings, Minnesota met in a regular
meeting on Monday, October 7, 1985 at 7:30 p.m. in the Council Chambers
of the City Hall.

Members Present: Councilmember Berg, Werner, Kulzer, Bond, Trautmann,
Nesbitt, Plan, Mathiowetz and Mayor Stoffel.
Members Absent: None.

The Mayor called for additions or corrections to the minutes of the
meeting September 16th and the Special meeting on September 23, 1985 and
hearing none declared the minutes approved as presented.
The Mayor declared the Public Hearing open at 7: 32 p.m. to
consider vacating the Alley between Spring and Eddy Streets. The
Acting City Planner, Tom Loucks, explained the area to be vacated.
The Mayor asked if anyone wished to speak on the issue, no one
wished to do so. The Mayor declared the Public Hearing closed at
7:33 p.m.
The Mayor declared the Public Hearing open at 7:34 p.m. to
consider amending Section 10.24 of the City Code regarding Site
and Building Plan Review Procedure. The Acting City Planner,
Tom Loucks, explained the proposed Ordinance Amendment. The Mayor
asked if anyone wished to speak on the issue, Mr. Keith Law,
503 Whispering Lane, stated that he felt that the Ordinance Arrendment
would be a benefit to the community and a good step forward. No one
else wished to speak on the rratter. The Mayor declared the public
hearing closed at 7:38 p.m.

The Mayor declared the Public Hearing open at 7:39 p.m. to
consider amending Section 10.13, 10.14 and Section 10.145 and
Section 10.146 having to do with R3 moderate density residence,
R4 medium density residence and R5 high density residential. The
Acting City Planner, Tom Loucks, explained the Ordinance Amendment.
The Mayor asked if anyone wished to speak on the issue, no one
wished to do so. The Mayor declared the Public Hearing closed at
7:44 p.m.

family mortgage. revenue bonds, autilorizing submission of same to PROORAMo-'HAVEN
Minnesota Housing Flinance Agency and authorizitlLJthe issuance of bonds VILLA APARTMENTS
pursuant thereto by the Dakota County Housing and Redevelopment
Authority. Mr. Mark Dlfers of the Dakota County BRA, explained the
program. The Mayor asked if anyone wished to speak on the issue,
no one wished to do so. The Mayor declared the public hearing closed
at 7:47 p.m.
The Mayor declared the Public Hearing open at 7:48 p.m. to PUBLIC HEARING-
hear and pass on all objections, written or oral, if any, to ~
proposed assessments for the improvement for the Downtown REDEVELOPMENT
Redevelopment Project. Jim Kleinschmidt, the City Engineer, explained ASSESSMENTS
the assessments as to areas benefitted, total cost, city cost,
benefitted assessments, and individual projects. The Mayor asked if
anyone wished to speak on the issue, no one wished to do so. The
rrayor declared the Public Hearing closed at 7:56 p.m.

consider amending Section 5.42, Subdivision 2, of the City Code
having to do with Garbage Haulers Licensing. The Mayor asked if
anyone wished to speak on the issue, no one wished to do so. The
Mayor declared the Public Hearing closed at 7:59 p.m.
The Mayor declared the Public Hearing open at 7:59 p.m. to
consider assessing unpaid City Accounts to the County Auditor. The
Mayor asked if anyone wished to speak on the issue, no one wished
to do so. The Mayor declared the public hearing closed at 8:00 p.m.

Berg to adopt Resolution No. 90-85 vacating the alley between
Spring and Eddy Street. This alley is vacated subject to a
reservation of an easement for existing utility lines. 8 Ayes;

Moved by Councilmember Kulzer, seconded by Councilmember
Mathiowetz to pass the 2nd Reading of an Ordinance Amending
Sections 10.13, 10.14, 10.145 and 10.146 of the City Code having
to do with medium density and high density residential areas.

Bond to table the rratter of the 2nd Reading for the R3, R4 and

Moved by Councilmember Bond to approve the request to
develop one half ( ~) of phase two of the Three Rivers Partnership,
at 160th Street and Millard Avenue, to approve the surmountable
curbs, allow an office building to be built in front and to
disallow vinyl siding on the homes. 2 Ayes; Nayes, Nesbitt,
Plan, Mathiowetz, Berg, Werner and Kulzer.
Moved by Councilmember Berg, seconded by Councilmember Plan
to amend the development agreement with the Three Rivers
Partnership, at 160th Street and Millard Avenue, to allow for
sunrountable curbs, and the building of an office at the
Northwest entrance to the property. 8 Ayes; Nayes, None.
Moved by Councilmember Werner, seconded by Councilmember
Trautrrann to approve the Final Plat for Valley Manor Subdivision
at Bahls Drive and Lyn Way. 8 Ayes; Nayes, None.

Moved by Councilmember Trautmann to allow an extension to
a Home Occupation Permit for Joleen Ellis (Hoffrran House) 301 W.
8th Street for 6 months. This motion died for lack of a second.
Moved by Councilmember Werner, seconded by Councilmember
Trautrrann to allow the Home Occupation at 301 W. 8th Street
(Hoffrran House-Joleen Ellis) to continue her home occupation
until January 1, 1986. 7 Ayes; Nayes, Berg.
Moved by Councilmember Berg, seconded by Councilmember
Werner to authorize the On Sale and Sunday On Sale Liquor License
transfer of the Mississippi Belle from Thorras Olson to Linda K.
Hohenstein. This license transfer will be effective October 15,
1985. 8 Ayes; Nayes, None.
Mr. Donald Fluegel and Mr. Ron Langness explained to the
Council that there were a number of items that needed attention
at this Council meeting in order to close the Hydro-electric
Project on Tuesday, October 8. Mr. Ron Langness explained
that a Resolution was needed to provide for borrowing the
proceeds of $9,300,000 Energy Development Revenue variable
rate bonds of the Minnesota Energy and Economic Development
Authority and Mr. Don Fluegel explained a number of, what he
termed, General Housing Keeping Items.

Trautrrann to adopt Resolution No. 91-85 providing for borrowing
the proceeds of the $9,300,000 Energy Development Revenue variable

Moved by Councilmember Nesbitt, that the City of Hastings go on
record stating that any excess money from this project is not to be spent
until this project financing is completed. Excess money should buy back
the bonds. This motion died for lack of a second.
Moved by Councilmember Werner, seconded by Councilmember Trautrrann
to go on record stating, that it is this Council's intent, that the excess
money on this project be spent for 50% of the bond issue and 50% of a tax
reduction. 7 Ayes; Nayes, Bond.
Moved by Councilmember Nesbitt, seconded by Councilmember Berg to
approve and authorize execution of contracts with Lunda Construction Company
and Voith Hydro Incorporated for the Hydro-electric Project at Lock and Dam

Mr. Kevin Max of the AAA presented Chief of Police, Daryl Plath
with a plaque, denoting the Pedestrian Safety Award for Hastings.

That the City Administrator/Clerk is hereby directed to set the budget
for the year 1986 at the sum of $3,684,879 and that he directs the Dakota
County and Washington County Auditor that the sum of $2,187,579 be levied
upon the taxable property within the limits of the City of Hastings,
Minnesota.
Adopted by the City Council of the City of Hastings, Minnesota this
7th day of October, 1985.
Councilmember Trautmann seconded the motion to adopt said Resolution
