HomeMy WebLinkAbout06-17-85 Hastings, Minnesota June 17, 1985 053 The City Council of the City of Hastings, Minnesota met in a regular meeting on Monday, June 17, 1985 at 7:30 p.m. in the Council Chambers of the City Hall. Members Present: Councilmen Berg, Werner, Kulzer, Bond, Trautmann, Nesbitt, Plan and Mayor Stoffel. Members Absent: Councilman Mathiowetz. ~ The Mayor called for additions or corrections to the minutes of the meeting of June 3, 1985 and hearing none declared minutes approved as presented. Moved by Councilman Kulzer, seconded by Councilman Werner to adopt Resolution No. 55-85 awarding the bids for the 1985 $680,000 Improvement Bonds to Allison-Williams, the apparent low bidder. 7 Ayes; Nayes, None. Copy of resolution on file. The Mayor declared the Public Hearing open at 7:36 p.m. to consider the sale of approximately 33 feet of city land South of Lots 1 and 2 in Maurice Zweber Addition. All persons were given an opportunity to address this issue. No one wished to speak on the matter. The Mayor closed the Public Hearing at 7:38 p.m. The Mayor declared the Public Hearing open at 7:39 p.m. to consider the spending of approximately $8,500 to purchase word processors and up to $6,000 to conduct a feasibility study for a computer system for City Hall. All persons were given an opportunity to address the issue. No one wished to speak on the matter. The Mayor closed the Public Hearing at 7:40 p.m. r-- ! I I i The Mayor declared the Public Hearing open at 7:41 p.m. to consider establishing a slow no wake zone along portions of the Mississippi River. All persons were given an opportunity to address the issue. Mr. Gary Stevens, 1326 West 17th Street presented a petition with 202 names opposing the no wake. His oplnlon was that the fishermen and the Sunday pleasure craft caused no wake on the Mississippi. He felt that the no wake ordinance would cause congestion at the lock and dam, he felt the barges were the main problem, the Northern half of the Mississippi is not in the corporate limits, and other communities have a no wake because of congestion not erosion. Mr. Butch Carl, 801 East 1st Street, expressed his views on the no wake stating that the larger boats were the ones that caused the prohl-em bynbt slowing down. Mr. Harold Nicholls, 1215 Walnut, took opposition with the no wake. Mr. Steve Mollick, 623 East 1st Street, was in favor of the no wake stating that his home was along the Mississippi River and his home was over 100 years old, he also stated that the North side of the Mississippi is all wing dams and bouys. Mr. Dennis Larson, 740 West 4th Street was definitely against the no wake ordinance. If the Council adopted a no wake ordinance he felt that the metropolitan area should be involved as so many people use the Mississippi River. Ms. Sandy Mollick, 623 East 1st Street was in favor of the no wake ordinance stating that both Red Wing and Prescott have no wake and that small boats out on the Mississippi get swamped. Mr. Toni Reuter, 2025 Maple felt that the barges should be stopped. Mr. Kevin Hoeschen, felt that he was both for and against the no wake stating that possibly it would help if the Corp of Engineers limited the size of the barges. Mr. Butch Carl spoke again stating that barges and cruisers just don't stop and because of this he was in favor of the no wake. Mr. Maurice Crosby, of the Sheriff's Department felt that the no wake caused damage to private property this past year in particular because of the high water. Mr. Jerry Hoeschen stated that he felt the barges should be fined for creating wakes. No one else wished to speak on the issue. The Mayor closed the Public Hearing at 8:15 p.m. r-- The City Administrator/Clerk, Gary E. Brown, explained to the Council that a couple more days would be needed for city review of the bids for the hydro-electric project to determine the best possible bidder. The Council would call a special meeting fot the award. FAIR Moved by Councilman Werner, seconded by Councilman Bond to authorize the appraisal of approximately 3 to 5 acres of land located in the Northwestern pondingbasin for a,~:r:oposed elderly housing project. 7 Ayes; Nayes, None. APPEAL ADMINISTRATIVE Moved by Councilman Nesbitt, seconded by Councilman Kulzer DECISION-717 EDDY STREET to deny the continued use of the Beauty Shop (Let There Be Hair) ,LET THERE BE HAIR at 717 Eddy Street. The establishment is currently located in an R2 zone which does not allow Beauty Shops. 5 Ayes; Nayes, Bond and Trautmann. SECOND READING- ORDINANCE AMENDMENT- REZONING-160TH ST. & MILLARD AVENUE SITE PLAN APPROVAL 3175 VILLAGE TRAIL SECOND READING- ORDINANCE-NO WAKE ON MISSISSIPPI RIVER OLD LATTO HOSPITAL- 620 RAMSEY STREET MASTER INCORPORATED- BUILDING PERMIT SET SPECIAL COUNCIL MEETING SALE OF CITY LAND- 15TH STREET ALLOCATIONS-FEDERAL REVENUE SHARING FUNDS RESOLUTION NO. 56-85 1986 TRANSIT APPLICATION Moved by Councilman Werner, seconded by Councilman Kulzer 0 to allow Mr. James Bennis, Jr. 6 months to relocate his business " at 717 Eddy Street. The city will take no action against this establishment for th~t period_of time. 7 Ayes; Nayes, None. Mrs. Bennis presented the City Council with a petition with 69 signatures in favor of leaving Let There Be Hair at 717 Eddy Street. Moved by Councilman Trautmann, seconded hy Councilman Berg to pass the Second Reading of an Ordinance amending Section 10.01 Subdivision 1 of the City Code having to do with the official zoning map for Sunny Acres (160th Street and Millard Avenue). 7 Ayes; Nayes, None. Moved by Councilman Werner, seconded by Councilman Berg to approve the site plan for 48 residental units to be constructed on 4.29 acres at a density of approximately 7 units per acre. This is subject to the Planning Commission recommeridation that no building permits be issued for the project until such time as the outlot upon which it is located is platted and second that the complete detailed landscape plan be submitted to the staff for review and approval. 7 Ayes; Nayes, None. Moved by Councilman Plan to pass the Second Reading of an Ordinance establishing a slow no wake zone along portions of the Mississippi River. The motion died for lack of a second. o Moved by Councilman Kulzer, seconded by Councilman Berg to approve the Mayor's Committee appointment of Florence Peterson, Tom Olson and one other person of their choice to review the request for proposals that were submitted to the City of Hastings for the potential use of the facility at 620 Ramsey Street. This committee will report back to the City Council with their recommendations. 7 Ayes; Nayes, None. Moved by Councilman Werner, seconded by Councilman Kulzer to extend the time allotted to the Laubs for the building permit issuance on the Master Incorporated building located in the Industrial Park to June 26th or sooner, so that the SAC and WAC charges can be accurately determined. 7 Ayes; Nayes, None. Moved by Councilman Berg, seconded by Councilman Kulzer to set a special Council meeting for Wednesday, June 19, 1985 at 4:30 p.m. at the City Hall Council Chambers to award the bid for the Hydro-electric construction at Lock and Dam No. 2 and to review the 1984 audit. 7 Ayes; Nayes, None. Moved by Councilman Werner, seconded by Councilman Berg to declare 33 feet of lots 1 and 2 in Maurice Zweber Addition excess property and offer the property to Mr. & Mrs. William Helwig at 1.035 times the land sale price of the Tan Sel property sale. 7 Ayes; Nayes, None. o Moved by Councilman Trautmann, seconded by Councilman Kulzer to approve the allocation of $8,500 to purchase a word processor and up to $6,000 to conduct a feasibility study for a computer system for the City Hall out of the Federal Revenue Sharing Funds. 7 Ayes; Nayes, None. Moved by Councilman Berg, seconded by Councilman Plan to adopt Resolution No. 56-85 entering into a Contract with the State of Minnesota Department of Transportation to provide puhlic transportation in the City of Hastings. 7 Ayes; Nayes, None. I n Ii Moved by Councilman Trautmann, seconded by Councilman Nesbitt to approve the application requesti~g $2,000,000.00 commitment of mortgage funds through the Minnesota Housing and Finance Agency for the City of Hastings. 7 Ayes; Nayes, None. Moved by Councilman Werner, seconded by Councilman Trautmann to deny payment to Ron Bathrick for legal services that he incurred regarding the property he owned at 401 E. 3rd Street for the Northwest Ponding Basin. 7 Ayes; Nayes, None. Moved by Councilman Trautmann, seconded by Councilman Berg to set a Public Hearing for the July 1, 1985 regular City Council meeting to reallocate the balance of the 1983 Federal Revenue Sharing Budget. 7 Ayes; Nayes, None. The Mayor will select and appoint a Committee consisting of two Council Members, two HRA Members and two Citizens at large to discuss, review and make recommendations to the Council regarding the Riverfront Development. Moved by Councilman Trautmann, seconded by Councilman Werner to approve Resolution No. 57-85 annexating certain lands in Marshan Township owned by Al Siehen. Parcel No.1: Lot 6, Block 2, Sieben's First Addition, together with the portion of LeRoy Avenue and 162nd Street adjacent. Parcel No.2: Outlot A, Sieben's First Addition, together with that portion of 162nd Street adjacent thereto. Parcel No.3: Lot 3 powers place together with that portion of upper 160th Street and Levi Avenue adjacent thereto. Parcel No.4: All of the vacated First Street and the vacated North 140 feet of Williamson Street and Lot 1, except the South 48 feet thereof, and Lot 9, except the South 86 feet thereof, all in Power's Place, according to the recorded plat thereof on file and of record in the office of the County Recorder for Dakota County, Minnesota, and that portion of upper 160th Street adjacent thereto. The Council also authorized extending the water and sewer service to the Sieben house located 16190 LeRoy Avenue. 6 Ayes; Nayes, Kulzer.
