The City Council of the City of Hastings, Minnesota resummed meeting
as the Board of Equalization at 6:30 p.m. in the Council Chambers of the
City Hall.
Meeting called to order by Mayor Lu Ann Stoffel at 6:35 p.m. in
the City Council Chambers of the City Hall.
Members Present: Councilman Werner, Kulzer, Bond, Trautmann,
Nesbitt, Plan, Mathiowetz and Mayor Stoffel.
Members Absent:
Councilman Berg.
The following persons indicated their intent on appealing the decision
of the Dakota County Assessor; Mr. Jerry Wiles at 1121 Southview Drive,
(Parcel Members 19-83753-245-00 and parcel 19-32100-230-05), Thomas Nesbitt
at 221 West 8th Street, William F. Pechacek at 1241 Southview Drive and
Matt Begich at 800 West 13th Street and Janice Bour 50 Valley Lane, Hastings
who is represented by her son Tony Bour.
Moved by Councilman Werner, seconded by Councilman Plan to deny the
request of the above mentioned parties for adjustments in their assessed
valuation and to refer their request for adjustments to the Dakota County
Board. Mayor left meeting at 6:45 p.m.
Acting Mayor Kulzer then called for roll to be taken. 7 Ayes; Nayes,
None.
Moved by Councilman Werner, seconded by Councilman Nesbitt to adjourn
at 7:03 p.m. 7 Ayes; Nayes, None.
The City Council of the City of Hastings, Minnesota met in a regular
meeting on Monday, June 3, 1985 at 7:30 p.m. in the Council Chambers of
the City Hall.
Members Present: Councilman Werner, Kulzer, Bond, Trautmann,
Nesbitt, Plan, Mathiowetz and Mayor Stoffel.
Members Absent: Councilman Berg.
The Mayor called for additions or corrections to the minutes of the
meeting of May 20, 1985 and hearing none declared the minutes approved as
presented.
The Mayor declared the Public Hearing open at 7:31 p.m. to
consider the request for a Street Vacation for a portion of the
North Frontage Road. All persons were given an opportunity to
address the issue. No one wished to speak on the matter. Mayor
closed the Public Hearing at 7:32 p.m.

NORTH FRONTAGE ROAD
The Mayor declared the Public Hearing open at 7:32 p.m.
to outline the estimated cost in assessments for the Water Main
Construction to serve the new water tower. All persons were given
an opportunity to address the issue. No one wished to do so.
The Mayor closed the Public Hearing at 7:42 p.m.

CONSTRUCTION
The Mayor declared the Public Hearing open at 7:43 p.m.
to consider a preliminary plat. The First National Bank is
replatting for Outlot D Imperial Estates First Addition into four
lots and one outlot. This hearing wap held over from the May 28th
Planning Commission meeting due to the lack of quorum. All persons
were given an opportunity to address the issue. No one wished to
speak on the matter. The Mayor closed the Public Hearing at 7:44
p.m.

PRELIMINARY PLAT-
FIRST NATIONAL BANK
The Mayor declared the Public Hearing open at 7:45 p.m. PUBLIC HEARING-
to consider a preliminary plat subdivision for 25th Street OLSON'S ADDITION-
(Olson's Addition). The hearing had been held over from the regular PRELIMINARY PLAT-
May 28, 1985 Planning Commission meeting due to the lack of a quorum. SUBDIVISION
All persons were given an opportunity to address the issue. No one
wished to speak on the matter. The Mayor closed the Public Hearing
at 7:46 p.m.

The Mayor declared the Public Hearing open at 7:46 p.m.
to consider a rezoning from Agricultural to R3, 160th Street and
Cory Lane, and to consider site plan approval. This Public Hearing
was held over from the May 28, 1985 regular P1!annirig Commission
meeting due to lack of quorum. All persons were given an opportunity
to address the issue. Mr. Leon Werth of Marshan Township was opposed
to portions of the rezoning and site plan approval. He did not feel
that the Southern most Street exit on to Malcomb Avenue was necessary.
No one else wished to speak on the matter. The Mayor closed the
Public Hearing at 8:01 p.m.

Moved by Councilman Trautmann, seconded by Councilman Kulzer
to reject all bids for the Utilities work on the Master Incorporated
Project. 7 Ayes; Nayes, None.
Moved by Councilman Werner, seconded by Councilman Kulzer
to approve the preliminary plat - First National Bank - North Frontage
Road and Pleasant Drive. First National Bank is replatting Outlot D
Imperial Estates First Addition into four lots and one outlot.

Moved by Councilman Werner, seconded by Councilman Nesbitt
to approve the preliminary plat for Olson's Addition, 125 West 25th
Street, subject to lots 2 and 3 being defined as one unit. 7 Ayes;
Nayes, None.
Moved by Councilman Trautmann, seconded by Councilman Nesbitt
to approve the rezoning from an Agricultural to R3 zone for 77 units
to be located on plus or minus 23 acres. This also includes a site
plan approval. 7 Ayes; Nayes, None.
Moved by Councilman Plan, seconded by Councilman Werner to
approve a special use permit for the Hastings Health and Racquetball
Club at 515 East 3rd Street for commercial recreation; a volley ball
court, and 2 or 3 horse shoe pits. Approval is subject to the
following conditions:
1. That outdoor recreation stop at dark and that no lighting be
installed to allow activity after dark.
2. That the appearance be improved by some leveling, landscaping,
and lawn care.
This permit is subject to review in one year. 7 Ayes; Nayes, None.

Moved by Councilman Nesbitt, seconded by Councilman Kulzer
to adopt Resolution No. 54-85 vacating a portion of the North Frontage
Road. 7 Ayes; Nayes, None. Copy of resolution on file.
Moved by Councilman Nesbitt, seconded by Councilman Kulzer
to direct staff to negotiate with the 49'ers the current contract
be maintained as it currently exists with the exception of the
compensatory time, which has been made null and void due to the
Fair Labor Standards Act. The only exception to the existing
contract could be that the 49'ers could have two days of their
vacation available to take in two hour increments. 7 Ayes; Nayes,
None.
Moved by Councilman Plan, seconded by Councilman Kulzer
to approve the third and final reading of Ordinance No. 180 amending
Section 5.40 Subdivision 4 of the City Code regulating peddlers.

Moved by Councilman Werner, seconded by Councilman Trautmann
to pass the third and final reading of Ordinance No. 181 establishing
regulations related to cats. 6 Ayes; Nayes, Plan.
Moved by Councilman Werner, seconded by Councilman Plan to
set a public hearing for the June 17, 1985 regular City Council
meeting to discuss the sale of land to Mr. and Mrs. William Helwig.
The previously scheduled hearing had not met the legal notice
deadline. 7 Ayes; Nayes, None.

Moved by Councilman Trautmann, seconded by Councilman Werner
to set a Public Hearing for the June 17, 1985 regular City Council
meeting to consider the use of Federal Revenue Sharing Funds for
the purchase of word processors and conducting a feasibility study
for computer usage for the City. 7 Ayes; Nayes, None.
Moved by Councilman Nesbitt, seconded by Councilman Kulzer
to authorize the hiring of James Kleinschmidt as the City Engineer
at an annual salary of $35,000. Mr. Kleinschmidt is to be
contacted and to be on staff as soon as possible. 6 Ayes; Nayes,
Bond.
Moved by Councilman Trautmann, seconded by Councilman Plan
to pass the First Reading of an Ordinance establishing a slow no
wake zone along portions of the Mississippi River, and to set Public
Hearing for the June 17, 1985 regular City Council meeting. The
Ordinance would establish a distance greater than one quarter
mile for the slow no wake zone. 5 Ayes; Nayes, Mathiowetz and Bond.
Moved by Councilman Trautmant, seconded by Councilman Kulzer
to have the City of Hastings issue a stop work order on a permit
that has been issued to the Hastings School District for the
construction of a fence. No fence shall be erected until the
property owners can show the City the dispute between the School
District and the property owners has been settled. 7 Ayes; Nayes,
None.
Moved by Councilman Kulzer, seconded by Councilman Werner
to grant a seven (7) day extention to the downtown redevelopment
contract for D.H. Blattner and Son Incorporated. 7 Ayes; Nayes,
None.
Moved by Councilman Kulzer, seconded by Councilman Werner
to approve the payment of $1,205.00 from 1984 construction funds
for the repair of the broken sanitary sewer service line at the
corner of 11th and Spring Street. 7 Ayes; Nayes, None.
Moved by Councilman Werner, seconded by Councilman Trautmann
to refer the matter of stop signs at the intersections of 19th and
Oak and 15th and Westview to the Safety Committee of the City
Council. 7 Ayes; Nayes, None.
Moved by Councilman Trautmann to approve the request of the
Hastings Area Chamber of Commerce to use the gravel portion of the
Civic Arena parking area for helicopter rides during Rivertown days
on Saturday, July 27th from 10:00 a.m. till dusk and Sunday, July
28th from 10:00 a.m. till dusk. The motion died for lack of a
second.
Moved by Councilman Kulzer, seconded by Councilman Werner
to have the Chamber of Commerce present three of four alternate
sites to the city for helicopter rides for Rivertown days. 7 Ayes;
Nayes, None.
Moved by Councilman Trautmann, seconded by Councilman Plan
to renew the Employment Agreement Contract for the City
Administrator/Clerk, Gary E. Brown, for one year with his salary
being adjusted to $42,556 effective June 6, 1985. 6 Ayes;
Nayes, Nesbitt.
Moved by Councilman Trautmann, seconded by Councilman Bond to
1) Pay all bills audited.
2) Partial payment - Blattner Construction-$67,216.
7 Ayes; Nayes, None.
Moved by Councilman Trautmann, seconded by Councilman Werner
to adjourn the meeting at 9:55 p.m. 7 Ayes; Nayes, None.
