HomeMy WebLinkAbout09-05-78 341 Hastings, Minnesota September 5, 1978 The City Council of the City of Hastings, Minnesota met in a regular meeting on Tuesday, September 5, 1978 at 7:00 P.M. in the Council Chambers of the City Hall. Members present: Councilmen Shannon, Trautmann, Fischer, Erickson, Trutna, Novak, Karnick, Collins, and Mayor Petersen. ! Members absent: None. The Mayor called. for additions or corrections to the minutes of the meeting of August 21, 1978 and hearing none approved the minutes as read. I The Mayor opened the Public Hearing on the purchase of PUBLIC HEARING property in conjunction with the Vermillion River Flood Control VERMILLION RIVER FLOOD Project at 7:00 P.M. The legal notices of the Hearing were read CONTROL into the record. The City Engineer gave a brief presentation and outline, with slides, of the property purchased and the areas affected. The Engineer explained that the project's total cost was $1,221,900, of that the federal government is paying $904,000. The City's share is approximately $317,900, broken down as follows: assessments to property owners, $120,000; State grant, $95,250; LAWCON grant $50,000; EPA $51,500; Miscellaneous $1,070. The Mayor then opened the meeting to the public. Richard Bond questioned why the area to be assessed was smaller on the final map making the assessments higher for each land owner. Mr. Bond asked what happened to the additional funding from other sources that was going to be used to help fund the project. Mr. Olson explained that the prelim- inary report contained only a rough estimate of the area, and the final assessment reflected a refinement to the original area. Mr. Wally Erickson indicated the funding sources mentioned by Mr. Bond were given as potential areas of funding and all were not used toward this project. The City was not able to use funds or receive grants from some of the sources mentioned in the first reports. Mrs. McCoy asked if she was in the Flood Plain. Mr. Olson said her property was formerly in the Flood Plain but when the project is finished she will no longer be in it. Other citizens had various questions which were answered by Mr. Olson. Everyone was given the opportunity to be heard. The Mayor closed the Hearing at 7:35 P.M. Moved by Councilman Trautmann, seconded by Councilman Shannon to accept the report and assessments on the Vermillion River Flood Control Project as recommended by the Engineer, Len Olson. Ayes, 7; Nayes, Collins. ACCEPT REPORT AND ASSESSMENTS ON VERM. RIVER FLOOD PROJECT The Mayor opened the Public Hearing to consider the PUBLIC HEARING VACATE vacation of the alley between East 1st and East 2nd Streets and ALLEY-MASTER, INC. Tyler Street and the alley at 7:36 P.M. The legal notices of the hearing were read into the record. The Mayor clarified several points regarding the vacation request from Master, Inc. He stated that Master, Inc. has been in business in this location and will continue to do business there for some time to come and we would not ask them to relocate; it is located in an appropriately zoned area; if there is an odor problem, Master, Inc. will do its best to eliminate this when the warehouse is completed; the vacation will decrease the traffic congestion by the completed warehouse having a loading dock; it will not aggravate the parking problem to any degree, Master is presently negotiating for additional parking land. The Mayor continued by stating that the items listed in the City Administrator's memo would be conditions of the vacation of the alley. Comments were received from Murray Laub, Paul Birchen, Clarence Soleim, Jr., and Gayle Erickson. The City Planning Director, Paul Burns, submitted his report and commented on same. When all persons present had been given an opportunity to be heard, the Mayor declared the hearing closed at 7:55 P.M. INC. VACATION OF Mter a discussion by the Council on the vacation request of the alley by Master, Inc. Councilman Erickson moved, seconded by Councilman Karnick that it is the consensus of the Council that the alley be vacated in the future, but only after the City receives satisfactory assurances that the following items will be accomplished: Ayes, ,; Nayes, ~. T~"''''NA (a) That the owner of the properties to the North of the alley acquire the narrow strip of land to the South of the alley so as to allow proposed expansion of structure presently existing North of the alley. (b) That the petitioner will pay all costs involved in reloca- tion of any utility lines existing in the alley which the City requires to be relocated. (c) That existing well be capped off as required by applicable CoQ.es. (d) That by dedication or easements, as the City may determine, provision be made for an access road or driveway from 2nd St. Northerly along the Westerly edge of the existing railroad tracks to the Local Oil facility. (e) That the vacation not extend more Easterly than a Southerly extension of the East line of the building presently located North of the alley. That at such time as the City Staff has received assurances satisfactory to it that the foregoing will be accomplished, the matter shall again be placed on the Council Agenda for action on the petition to vacate. The Mayor opened the public hearing on the roadway vacation request for a portion of East 4th Street between Locust and Lake Street at 7:55 P.M. The legal notices of the hearing were read into the record. Mr. & Mrs. Breyer are requesting that the street, as presently being used, be vacated. They are not requesting that the street as platted be vacated. Two petitions were presented to the Council from citizens in the area. One petition for and one against the vacation. The Mayor gave every- one who wished to speak on the matter an opportunity to do so, after which the hearing was declared closed at 8:15 P.M. 342 MASTER , ALLEY PUBLI C HEARING VACATION PORTION 4m STRfiET-BREYER HOLD OVER ACTION ON VACATION 4TH STREET D. Ayes, 8; Nayes, none. The Council took no action on the two reques ts for 30 minute parking at 112 Vermillion Street and at 5th & Vermillion Street. MOved by Councilman Erickson, seconded by Councilman Fischer to approve the dates for the meetings with Citizens participation on the Comprehensive Plan update as set forth in the memo from the City Planner dated September 5, 1978. MOved by Councilman Trutna, seconded by Councilman Novak to adopt the resolution awarding the bid for 20,000 yards of crushed gravel for the Street Dept. to Davies Excavating, Inc. Moved by Councilman Fischer, seconded by Councilman Erickson to pass the second reading of the ordinance which adds an additional section to Chapter 8 of the City Code imposing a general time limit on the parking of vehicles upon streets and highways. Moved by Councilman Trutna, seconded by Councilman Shannon to pass the third and final reading of Ordinance #93 regulating hours of operation of liquor licensees and providing for inspections of licensed premises.
