The City COlUlCil of the City of Hastings, Minnesota met in a
regular meeting on Monday, March 6, 1978 at 7: 30 P.M. in the Council
Chambers of the City Hall.

Members present: Councilmen Shannon, Trautmann, Fischer, Erickson,
Trutna, Collins, and Mayor Petersen.
Members absent: Councilmen Novak and Karnick.

TIle ~~yor asked for corrections or additions to the minutes of
the meeting of February 21, 1978 and hearing none declared the minutes
approved as read.
Moved by Councilman Erickson, seconded by Councilman
Trutna to adopt Resolution #146-78 awarding the bid for one 1978
Chevrolet ~ Ton Pickup Truck for the Street Department. Complete
copy in Resolution File in City Hall. Ayes, 6; Nayes, none.
Councilman Novak arrived at the meeting at this time.
Moved by Councilman Erickson, seconded by Councilman
Collins to approve the Preliminary Plat of Welch 1st Addition
according to the Planning Commission recommendation.
Moved by Councilman Trutna, seconded by Councilman
Fischer to table the item, Preliminary Plat Welch 1st Addition,
further, that a committee comprised of Councilmen Shannon,
Trautmann, Erickson, and Mayor Petersen be fonned to study the
alternatives for Park dedication on this Plat. Ayes, 7;
Nayes, none.

Erickson to approve a variance on the setback for a garage at LANGENFELD CONST.
1800 Manor Lane for Frank Langenfeld Construction. (Lot 10, Blk 1,
Franz emeier, 1st Addition.) The ordinance requires a 15 ft.
setback, the garage now sits 14.1 ft. from the property line.

Shannon to approve the variance for Dennis Emrick, (north of DENNIS EMRICK
Hwy #55 and East of Westview Dr.) for total allowable building
coverage, with the following condition; That an access easement
be established through the site to the area on the West of the
proposed building site. The C-l zoning district restricts the
floor area of a structure to 6,000 square feet, Mr. Emrick's
proposal is 7,360 square feet. Ayes, 7; Nayes, none.
:Moved by Councilman Trutna, seconded by Councilman APPROVE VARIANCE
Shannon to grant a variance on the length of the loading dock FAIRWAY FOODS PERMIT
to Setterholm- Fairway Foods building. The zoning ordinance A CANOPY
requires a 50 ft. long loading dock, the Fairway building loading
dock is 44 ft. long. Further to approve special permission for
a canopy for the Fairway Foods building. Ayes, 7; Nayes, none.
Moved by Councilman Collins, seocnded by Councilman
Shannon to amend the motion of February 6, 1978 appointing
Joseph Novak and Merlin Anderson to the Industrial Park Advisory
Board for a tenn of one year, to read: to be appointed for a
tenn of three years each. Ayes, 7; Nayes, none.
:Moved by Councilman Novak, seconded by Councilman Trutna
to approve the reappointment of Kathleen Seibert, 1513 Lyn Way,
to the Charter Commission for a tenn of four years, tenn to
expire August, 1981. Ayes, 7; Nayes, none.

The next item on the agenda was a request by the
owners of property zoned R-2 (Medium Density Residence).
The owners requested an interpretation of Section 10.12,
Subdivision 2 (c). The owners stated that they felt that
a cOJIlIlercial racketballcourt would be a "similar use" as
the other permitted uses listed in the Subdivision of R-2
dealing with "uses permitted". .An extended discussion
occurred. Adjacent property owners were given an opportunity
to be heard. The COWlcil reviewed permitted uses under R-2,
and those permitted under R-l which are incorporated in the
R-2 classification as additional permitted uses. At the
conclusion of the discussion a motion was made by Councilman
Erickson, seconded by COWlcilman Trutna as follows: That
"uses permitted" under Section 10.12, Subdivision 2 )C) be
interpreted to include "conmercial racketba1l facilities"
as a permitted use. Upon being put to a vote, the following
vote was recorded: Ayes, 4; Nayes, Councilmen Shannon,
Trautmann, Fischer. The Mayor declared the motion passed
and based upon said motion, commercial racketball facilities
are to be considered a permitted use in R-2 zoning classifi-
cations.

Shannon to approve the sale of a parcel of land in the
Hastings Industrial Park No. I, legally described as follows:

Lot 3, a distance of 304.68 ft. tg the point of beg. of the

to the north line of said Lot 3; thence S 89 33' 00" E

Engineers discussed the Vermillion River Recreation Area funding

to cancel the public hearing scheduled for March 9, 1978 on the
