"The City Council of the City of Hastings, Minnesota met in a
regular meeting on Monday, December 5, 1977 at 7: 30 P.M. in the Council
Chambers of the City Hall.
Members present: Councilmen Shannon, Trautmann, Fischer, Erickson,
Novak, Karnick, Collins, and Mayor Petersen.

The Mayor asked if there were any corrections or additions to the
minutes of the meeting of November 21, 1977 and hearing none declared the
minutes approved as read.
Moved by Councilman Novak, seconded by Councilman
Fischer to pass the third and final reading of the amendment to
the Zoning Ordinance, Section 10.23 - District Lot Regulations
(Footnote C). Ayes, 7; Nayes, none.
Moved by Councilman Shannon, seconded by Councilman
Erickson to pass the third and final reading of the amendment
to the Zoning Ordinance to rezone property belonging to the
First Baptist Church of Hastings, legally described as: That
Part of the West ~ of the East ~ of the SE~ of Section 32,
Twp. ll5N, Range l7W, lying west of Pleasant Drive, North of
25th Street and East of the West 198' of the West~ of the East~

effective date of employment to be December 16, 1977, at a
salary of $1,166.30 per month with a probationary period of

Moved by Councilman Erickson, seconded by Councilman
Fischer to approve the Mayor's appointment of Sue Dredge, 216
W. 12th St., as the secretary to the Hastings Historical
Preservation Commission for a term of two years. Ayes, 7;

Shannon to refund to Arrow Engineering Sales Company the $1,000
earnest money as per the Agreement Terminating the Earnest

AGREEMENT TERMINATING EARNEST MONEY CONTRACT
WHEREAS, Arrow Engineering Sales Company, as Purchaser, entered
into a certain earnest money contract dated April 15, 1975 with
the Ci ty of Has tings pursuant to the terms of which Arrow
Engineering proposed to purchase lands in the Hastings Industrial
Park from the City of Hastings, and
WHEREAS, the parties have mutually agreed to the termination of
said earnest money contract and all rights and obligations there-
under and the parties wish to set forth said agreement termina-
ting in writing:
NOW, THEREFORE, it is hereby agreed as follows:
1. The parties hereto agree that the earnest money contract
between Arrow Engineering Sales Company, as Purchaser, and the
City of Hastings as Seller dated April 15, 1975 is hereby ter-
minated.
2. All rights and obligations under said earnest money contract
are hereby terminated, and hereafter the purchaser under said
earnest money contract shall have no right, title, estate or
lien in and to said real estate.
3. The earnest money paid pursuant to the execution of said
contract in the amount of $1,000.00 shall be, concurrent with
execution hereof,refunded to Arrow Engineering Sales Company.

and the Amendment to the Contract between the City of Hastings
and Tom Loucks & Associates. A copy of the Contract August 29,
1977 with Addenda and attachments is on file in the office of

The Mayor recognized the need of an Ad Hoc Committee
for the Ice Arena for the purpose of recommending any changes
in operation of the City Ice Arena, and appointed the following
to that Committee: Bob Niederkorn, Gus Heinold, John Steingart,
and John Lightbourn.

Collins that the City Council authorize the City Administrator
to prepare an application for funding for a Mini Bus Service,

in the amount of $2,999.22 for the following: removal of old
original street light bases, trenching, additional concrete
curbing, and additional concrete sidewalk removed and replaced.

ACCEPTING WORK & ORDERING FINAL PAYMENT
WHEREAS, pursuant to a written contract signed with the
City of Hastings on the 21st day of June, 1977 Electric Service
Company having satisfactorily completed the Construction of the
Downtown Street Lights; and
NOW, THERE BE IT RESOLVED by the City Council of the
City of Hastings, Minnesota:
Change Order #1 is approved and accepted and the work
completed under said contracts is hereby accepted and approved
subject to lein waivers and final check lists, and

i BE IT FURTHER RESOLVED, that the City Clerk and Mayor
are hereby directed to issue a proper order for final payment of
$14,386.02 the Construction of the Downtown Street Lights,
taking the nt ctor's receipt in full.
