HomeMy WebLinkAbout11-21-77 177 Hastings, Minnesota November 21, 1977 The City Council of the City of Hastings, Minnesota met in a regular meeting on Monday, November 21, 1977 at 7:30 P.M. in the Council Chambers of the City Hall. Members present: Councilmen Shannon, Trautmann, Fischer, Novak, Karnick, Collins, and Mayor Petersen. Members absent: Councilman Erickson. ,..--, I The Mayor asked if there were any corrections or additions to the minutes of the meeting of November, 7, 1977 and hearing none declared the minutes approved as read. Councilman Novak introduced the following resolution and moved its adoption: AWARD BID INDUSTRIAL PARK STREET LIGHfING RESOLUTION #136-77 WHEREAS, pursuant to an advertisement for bids for the construction and installation of a Lighting System within the Hastings Industrial Park, the following bids were received com- plying with the advertisement: Hilite Electric Company Peoples Electric Company Collins Electric Company Hoffman Electric Electric Service Mollerud Electric Total System $ 39,355.00 42,104.00 43,600.00 45,700.00 48,100.00 51,750.00 Alternate System $ 27,235.00 26,477.00 27,800.00 29,800.00 29,370.00 32,700.00 ,..-- ! WHEREAS, it appears that Peoples Electric Company of St. Paul, Minn. is the lowest responsible bidder for the Alternate Lighting System for the Hastings Industrial Park, NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Hastings, Minnesota: The Mayor and City Clerk are hereby authorized and directed to enter into a contract with Peoples Electric Company for the con- struction and installation of the Alternate Lighting System at the Hastings Industrial Park (22 poles lighting Spiral Blvd. down to Scully's) in the amount of $26,477.00 and according to the specifi- cations therefore approved by the City Council and on file in the office of the City Engineer. The Mayor opened the public hearing on the amendment PUBLIC HEARING REZONE to the Zoning Code to rezone the property belonging to the First BAPTIST CHURCH PROPERTY Baptist Church, legally described as Part of the W~ of the Eh of the SE~ of Section 32, Twp. 115, Range 17, at 7:35 P.M. The Administrator read into the record the legal notices of the Hearing. No one appeared in opposition to the rezoning. ISSUE OCCUPANCY PERMITS FOR LOTS 4 & 5 PUBLI C HEARING AMEND SEC. 10.23 DISTRICT LOT REGULATIONS 2ND READING TO AMEND SEC. 10.23 ZONING CODE DISTRICT LOT REGULATIONS VERMILLION RIVER RECREATIONAL DEVELOPMENT STATUS REPORT TABLE APPROVAL OF PLAT WHISPERING OAKS 3RD COMMITTEE TO SELECT CONSULTANT FOR HISTORIC PRESERVATION PLAN Moved by Councilman Shannon, seconded by Councilman Novak to pass the second reading of the Amendment to the Zoning Code to rezone the Baptist Church property from Agri- cuI ture to an R - I Zone. Ayes, 6; Nayes, none. Councilman Erickson came into the meeting at 7:40 P.M. The Mayor read a letter of resignation received from Councilman Latch who moved out of Second Ward and can no longer serve as its Councilman. The Mayor expressed the Council's regret and thanked Mr. Latch for his services to the City. Moved by Councilman Novak, seconded by Councilman Trautmann to accept the letter of resignation from Donald La tch as Councilman of the Second Ward. Ayes, 7; Nayes, none. n \ t Moved by Councilman Novak, seconded by Councilman Erickson that Letters of Intent from persons desiring to be considered to fill the vacancy resulting in Mr. Latch's resignation should be submitted to the City Administrator by 4:30 P.M. on December 2, 1977 for consideration at the Council meeting of December 5, 1977. Ayes, 7; Nayes, none. Moved by Councilman Trautmann, to table the approval of the Preliminary Plat for Mid-Continent Development Corp. until a further study of the drainage issue. Motion lost for want of a second. Moved by Councilman Trautmann, seconded by Councilman Shannon to authorize the issuance of the Occupancy Permits for the buildings on Lots 4 & 5 of the proposed Preliminary Plat of Westview Addition, but not approve the Preliminary Plat until the Northwest Ponding Basin report is completed. Ayes, 6; Nayes, Karnick. The Mayor opened the public hearing on the amendment to the Zoning Code, Section 10.23 - District Lot Regulations Footnote "C" at 8:05 P.M. The Administrator read into the record the notices of publication of the Hearing. The Mayor gave anyone who desired to speak on the issue an opportunity to do so, after which the Mayor closed the Hearing at 8:10 P.M. Moved by Councilman Fischer, seconded by Councilman Trautmann to pass the second reading of the amendment to the Zoning Ordinance, Section 10.23 - District Lot Regulations. Ayes, 7; Nayes, none. Ii \ I --.. j Ed McNally from the Corps of Engineers gave a status report to the Council regarding the Vermillion River Recreational Development. Mr. McNally suggested that the City of Hastings send a Letter of Intent to the Corps stating their interest to study the possibilities and to participate in an estimated share cost in the amount of $40,000. Moved by Councilman Shannon, seconded by Councilman Fischer to send a Letter of Intent to the Corps of Engineers stating that the City is interested in having the Corps of Engineers study the recreational development in the Vermillion River area, also the City's intent to participate in the cost to an amount not to exceed $40,000. Motion and second were withdrawn. The Corps of Engineers is to pro~ed with the study without a Letter of Intent. 1-' \ 'nJ Moved by Councilman Erickson, seconded by Councilman Collins to table the approval of the Preliminary Plat Whispering Oaks 3rd Addition for 30 days until such issues as the access to Whispering Lane, assessment agreements, and easements is established. Ayes, 7; Nayes, none. The next item on the agenda was the selection of a Consultant for the Historic Preservation Plan. The Mayor will Chair the Committee charged with this responsibility and report back to the Council with their recommendation. Moved by Councilman Shannon, seconded by Councilman Collins to approve the variance for the Archdiocese of St. Paul and Minneapolis on their elderly housing project at 1199 Bahls Drive. The variance approves 109 units to be constructed on 5.86 Acres. Ayes, 7; Nayes, none. 179 APPROVE VARIANCE FOR ARCHDIOCESE 1199 BAHLS DR. HOUSING PROJECT Moved by Councilman Fischer, seconded by Councilman APPROVE HOME OCCUPATION Erickson to approve the Home Occupation Permit for James Peters, PERMIT JAMES PETERS 910 W. 9th St. to operate a Day Care Center. Ayes, 7; Nayes, none. MOved by Councilman Fischer, seconded by Councilman Trautmann to pass the third and final reading of the ordinance establishing the Historic Preservation Commission. Ayes, 7; Nayes, none. Moved by Councilman Novak, seconded by Councilman Shannon to ratify the Mayor's appointment of the following to the Hastings Historic Preservation Commission. Ayes, 7; Nayes, none. a) Partial payment to Centennial Contractors Corp. in the amount of $22,052.44 (S/W Watermain) b) Partial payment to Geo Olsen Construction in the amount of $8,049.60 (W/S Bldg.) c) All Bills as audited. Moved by Councilman Trautmann, seconded by Councilman Novak as follows: That the October 17, 1977 authorizations by the Council for sale of 1.5 acres in the Hastings Industrial Park to River Road properties for the Stoffel building and the sale of 4.3 acres to Stoffel Beverage on Contract for Deed are amended as follows: That sale of 1.5 acres in Lot, Block 3, Hastings Industrial Park is approved for a cash consideration of $15,000, said sale to be to Richard Stoffel and Louella Stoffel. That the sale of 4.3 acres in said Lot 1, Block 3, Hastings Industrial Park No. 1 be authorized and approved, said sale to be to Richard L. Stoffel and Louella Stoffel on standard Minnesota form Contract for Deed with the following provisions: Price $43,000.00. Down payment of $4,300.00. Interest at eight percent (8%) per annum on declining balances commencing six months from date of contract. Annual payments of principal and interest $5,400.00. Ten year balloon payment. MOved by Councilman Novak, seconded by Councilman Shannon that the City of Hastings enter into a contract with Barr Engineering for a combined report (Northwest Ponding Basin and Storm Sewer) in the amount of $14,250.00 and also author- ization is given the City Engineer to proceed with necessary expenditures regarding contour maps needed for the report. $10,000 is to be taken from 1978 Federal Revenue Sharing Funds an e est of the money is to be taken from available Engin r' g Funds.
