HomeMy WebLinkAbout10-03-77 143 Hastings, Minnesota October 3, 1977 The City COW1cil of the City of Hastings, Minnesota met in a regular meeting on Monday, October 3, 1977 at 7:30 P.M. in the C0W1ci1 Chambers of the City Hall. Members present: COW1cilmen Erickson, Karnick, Novak, Latch, Trautmann, Collins, Fischer, and Mayor Petersen. ".-- Members absent: COW1cilman Shannon. TIle Mayor asked if there were any additions or corrections to the minutes of the meeting of September 19, 1977, hearing none declared the minutes approved as read. The Mayor asked if there were any additions or corrections to the minutes of the special meeting of September 28, 1977 and hearing none declared the minutes approved as read. The Mayor declared the Public Hearing on the adoption PUBLIC HEARING ON of the 1977 Assessments open at 7: 35 P.M. The Administrator read 1977 ASSESSMENTS into the record the notices of mailing and the affidavit of the Notice of Public Hearing, thereby declaring the Hearing had been called according to MiIU1esota law. The Mayor established the procedure of having one motion for each Proposal. Everyone in the audience was given the opportunity to be heard as each project listed under the Proposal was presented. Property owners on 15th Street voiced their objections to paying 100% assessments on a 44 foot wide street, stating that other 44 foot wide streets are State Aid and same assistance is provided. They felt the City should participate in the additional cost incurred in the 44 foot wide street rather than the usual 36 foot wide street, because it benefitted the whole community and not a direct benefit to them . Moved by Councilman Collins to assess 15th Street, Brittany to Todd Way, for the 36 foot wide street not the 44 foot wide. Motion failed for lack of a second. Moved by Councilman Erickson, seconded by Councilman Karnick to adopt the assessments listed W1der Proposal I. Ayes, 7; Nayes, none. ADOPT PROPOSAL I . Block 1 and Block 2 of Westview Shopping Center 1st Addition. NOW, 'ffiEREFORE BE IT RESOLVED by the City Council of the City of Hastings, Mirmesota: 1. Such proposed assessments, a copy of which is attached. hereto and made a part hereof is hereby accepted and shall constitute the special assessments against the lands therein, and each tract of land therein included is hereby found to be benefited by the proposed,.." improvement in the amount of the assessment levied againast. it. 2. Such assessment shall be payable in equal installments extending over a period of 10 years, the first of the installments to be payable on or before the first Monday of January, 1977. Any qeferred installments shall bear interest at the rate of eight percent (8%) per anmun. To the first installments shall be added interest on the entire assessment, from the date of this assessment resolution until December 31, 1977. To each subsequent installment when due shall be added interest for one year on all unpaid installments. (----., I \ U 3. The owner of any property so assessed may, for 30 days after notification from the City Treasurer, pay to the City Treasurer, the whole of the assessment without interest, and he may at any time, prior to certification of the assess- ment to the County Auditor, as herein provided, pay the whole of the assessment against any parcel with interest accrued to the date of payment to the City Treasurer, and he may at any time thereafter pay the County Treasurer the entire amount of the assessment remaining unpaid with interest accrued to December 31st of the year in which such payment is made. ,--- I 4. The City Clerk shall forthwith transmit a certified duplicate of this assessment to the County Auditor to be extended on the proper tax lists of the County and such assessment shall be collected and paid over in the same manner as other municipal taxes. Total amount to be assessed is $ 382,356.67. Councilman Latch seconded the motion to adopt said resolution and the same was passed by the following vote: Ayes, 7; Nayes, none.
