HomeMy WebLinkAbout08-15-77 Has tings, Minnesota August 15, 1977 123 The City Council of the City of Hastings, Minnesota met in a regular meeting on Monday, August 15, 1977 at 7: 30 P.M. in the Council Chambers of the City Hall. r-- I Members present: Councilmen Shan non, Trautmarm, Fischer, Latch, Erickson, Karnick, Collins, and Mayor Petersen. Members absent: Councilman Novak. The Mayor asked if there were any aditions or corrections to the Minutes of the meeting of August 1, 1977 and hearing none declared the Minutes approved as read. PUBLIC HEARING TAX LEVY LIMIT BASE INCREASE The Mayor opened the Public Hearing on the pro- posed pennanent levy limit base adjustment. The Administrator read into the record the legal notice of the Hearing. All persons desiring to comment on the prOposed adjustment were heard. A Petition, signed by the required number of taxpayers was noted, said Petition was against the proposed adjustment. There being no other comments the l<fayor closed the Hearing at 7: 35 P.M. No action was taken by the Council other than this item be held over to the meeting of September 6, 1977. The Mayor opened the Public Hearing on the appli- PUBLIC HEARING REZONE cation for rezoning of Judge Electric, Inc. property located JUDGE ELECTRIC PROP. on South 23rd Street, fram an R-2 district to a C-3 or C-5 zoning district. Lots 6 thru 12, B1k 3, and Lots 14 thru 17, Blk. 4, Vermillion Addition. The Administrator read the legal notices of the Hearing. No unfavorable comments regarding the request were presented. After everyone was given the opportunity to speak on the issue the Mayor closed the Hearing at 7:45 P.M. ,--. , I Moved by Cmmcilman Shannon, seconded by Councilman Trautmarm, to approve the First Reading of the amendment to the Ordinance to rezone the Judge Electric, Inc. property fram an R-2 District to a C-5 District. ~IDtion and second withdrawn. Moved by Councilman Latch, seconded by Cmmcilman Shannon to move the first reading of the amendment to the ordinance to rezone the Judge Electric, Inc. property located on South 23rd Street, legally described as: Lots 6 thru 12, Blk 3, and Lots 14 thru 17, Blk 4, Vermillion Add. from an R-2 district to a C-5 Zoning District. Also to move the first reading to rezone the McCoy property, legally described as Lot 13, Blk 3, Vermillion Add., fram an R-2 district to a C-3 Zoning District. Ayes, 6; Nayes, Erickson. Moved by Councilman Latch, seconded by Councilman ORDINANCE 167 SEC. SER. Erickson to pass the third and final reading of the Park Use PARK USE ORDINANCE Ordinance, subject to the changes recommended by the Staff being incorporated in the final draft. Ayes, 7; Nayes. none. Moved by Councilman Latch, seconded by Councilman Tra\1tmarm to pass the third and final reading amending Section 10.01 of the Zoning Ordinance to rezone property on Hwy #55" Westview Drive to Pleasant Drive to a C-5 Zoning District. Sa:i4' property legally described as follows: Outlot B and Outlot D, Imperial Estates Add. and the unplatted land within the SE~ of the ~ of Section 29, Twp. 115, Range 17W, locate north of T.H. #55. Motion failed for lack of a second. Moved by COW1cilman Trautmann, seconded by COW1cilman Collins that a Special Use Pennit be approved for James Sobers automobile repair shop, with the conditions requested by the City Planner be satisfied, Le. Clean up property and blacktop parking area within one year fran purchase of the property. Ayes,S; Nayes, Sharmon and Fischer. JOSEPH CHYLIK RESIGNS PARK DEPARTMENT APPOINT ROBERT NIEDERKORN-IND. PARK ADVISORY BOARD Moved by Councilman Karnick, seconded by Councilman EXTENSION DENIED TO Trautmann that Rosewood Corporation be notified that the Council ROSEWOOD CORP. will not grant an extension of time on the Purchase Agreement and Option and that the $1,000 earnest money be returned to Rosewood Corporation. Moved by Councilman Fischer, seconded by Councilman REPLACE WINOOWS INSTALL Trautmann that the Engineer proceed with the replacement of the FIRE ALERT CITY HALL windows in the office and the installation of a Fire Alarm System in City Hall, in an amount not to exceed $8,500.00 to be taken from Federal Revenue Sharing Funds. Councilman Fischer inuroduced the following resolution and moved its adoption: RESOLUTION ACCEPTING WORK & ORDERING FINAL PAYMENT RESOLUTION #118-77 FINAL PAYMENT ALLIED PAINTING CO. REPAIR CITY HALL WHEREAS, pursuant to a written contract signed with the City of Hastings on the 29th day of April, 1977, Allied Painting and Renovating Company, St. Paul, Minnesota, having completed the repair work on the City Hall building; ~ NOW, TIiEREFORE BE IT RESOLVED by the City Council of the City of Hastings, Minnesota: The repair work is approved and accepted and the work completed under said contracts is hereby accepted and approved subject to lein waivers and final check lists, and ATIEST: B IT 1HER RESOLVED that the City Clerk and Mayor are hereby di ect d to issue a proper order for final payment of $2,274.00 or he repair work done on the City Hall building on such con r t, taking the Contractor's receipt in full. by the City Council of the City of Hastings, 5th y of August, 1977.
