The City Council of the City of Hastings, Minnesota met in a regular
meeting on Monday, May 2, 1977 at 7:30 P.M. in the Council Chambers of the City
Hall.
Members present: Councilmen Shannon, Trautmann, Fischer, Erickson,
Latch, Novak, Karnick, Collins, and Mayor Petersen.

The Minutes of the meeting of April 18th were approved with one amend-
ment. The legal description in the motion to pass the Resolution vacating a
Permanent Utility Easement be corrected to read: vacating a Permanent Utility
Easement OYer and across the E. 10.0' of the South 132.46' of the north 1'2.46'
of Lot 5, and the West 10.0' of the South 132.4 6' of the North 142.46' of Lot
6, Block 5, Dakota Hills 4th Addition.
Moved by Councilman Shannon, seconded by Councilman
Fischer to pass the First Reading of the Flood Plain Ordinance
and to call for a Public Hearing on Monday, May 16, 1977 at
7:30 P.M. on said Ordinance. Ayes, 8; Nayes, none.
Moved by Councilman Novak, seconded by Councilman
Karnick to refer to the Planning Commission of the City Council
the petition requesting the vacation of Oak Street between 14th
and 15th Stree~s. Ayes, 8; Nayes, none.

Shannon to pass the First Reading of the Ordinance rezoning the
Peavey Company property from an I-I to a 1-2 Zone. Also to
call for a Public Hearing on the rezoning for Monday, June 6th
at 7:30 P.M. in the Council Chambers. Ayes, 8; Nayes, none.

Erickson to authorize the re-advertisement of bids for the
improvements on Old Mill Park. all of the Ravine work is to be
deducted from the plans. Bids to be opened on June 14, 1977 at
10:00 A.M. and considered for award at the Council meeting of
June 20, 1977. Ayes, 8; Nayes, none.
Moved by Councilman Erickson, seconded by Councilman
Novak to pass the First Reading of the Ordinance rezoning the
Smead Mfg. Company property from an I-I to an 1-2 Zone. Also,
to call for a Public Hearing on the rezoning for June 6th at
7:45 P.M. in the Council Chambers. Ayes, 8; Nayes, none.

Fischer to refer the matter of modifying Zoning standards to a
Committee consisting of members of the Council Planning Committee
and the Planning Commission. Ayes, 8; Nayes, none.

Trautmann to pass the Third and Final Reading of the Ordinance
Regulating Licensing of Persons engaged in Tree Removal. The
amendment eliminates the $5,000 required bonding. Ayes, 8;

A report was given by the City Engineer regarding the DUTCH ELM TREE REMOVAL TO
Dutch Elm diseased tree removal. The Council decided to carry 5/16/77
this item over to the meeting of May 16, 1977.
An informal presentation on the Lake Rebecca Project
was given by the Corps of Engineers.
The Council requested the Park Use Ordinance be put
on the June 6, 1977 Agenda.

BE IT RESOLVEDfby the City Council of the City of
Hastings, Minnesota, as follows:
1. It is hereby found, determined and declared that this City
should issue $285,000 General Obligation Water Revenue Bonds of 1977 to defray
the expense of water improvements and $545,000 General Obligation Improvement
Bonds of 1977, Series A to defray the expense of various improvements in the
City.

2. This Council shall meet at the time and place specified in
the forms of notice hereinafter contained for the purpose of opening and
considering sealed bids for, and awarding the sale of $285,000 General Obliga-
tion Water Revenue Bonds of 1977 and $545,000 General Obligation Improvement
Bonds of 1977, Series A of said City.
3. The City Clerk is hereby authorized and directed to cause
notice of the time, place and purpose of said meeting to be published in the
official newspaper of the City and in Commercial West not less than ten days
in advance of date of sale, as provided by law, which notices shall be in
substantially the forms set forth in Exhibit A and Exhibit B attached hereto.

The bonds will be general obligations of the Issuer for which its unlimited

amount of $50,000 in 1978 and $55,000 in each of the years 1979 to 1987, both

If within three working days after the award of the Obligations the Purchaser
in writing requests that CUSIP identification numbers be printed on the
Obligations, and agrees to be responsible for the CUSIP Service Bureau charge for
the assignment of said numbers, the numbers will be printed on the Obligations,
but neither the failure to print each number on any Obligation nor any error with
respect thereto shall constitute cause for failure or refusal by the Purchaser to
accept delivery of the Obligations.
DELIVERY, LEGAL OPINION, COSTS AND PAYMENT
The Obligations will be delivered without cost to the Purchaser at a place
mutually satisfactory to the Issuer and the Purchaser within 40 days following
the date of their award. Delivery will be subject to receipt by the Purchaser
of an approving legal opinion of Briggs and Morgan, Professional Association of
St. Paul, Minnesota which opinion will be printed upon the Obligations, and of
customary closing papers, including a no-litigation certificate. Payment for

$5,450 payable to the order of the Treasurer of the Issuer must be filed with

the Purchaser fails to comply with the accepted bid. No bid may be withdrawn
until the conclusion of the meeting of the Issuer at which bids are to be acted

of 1% and not exceeding 7% per annum. All Obligations of the same maturity r-l,

APPEAL AWARD OF
MOEN PROPERTY
The City Attorney reported that the Court appointed
Commissioners had reported a value on parcel #3 (Moen) in the
Vermillion River Project at $17,000.00. The City Attorney recom-
mended appealing the award, and paying 3/4 of the award, plus
interest from date of award, at this time.
Moved by Councilman Shannon, seconded by Councilman
Trautmann to appeal the award on parcel #3 (Moen) and pay 3/4 of
the award, plus interest on award, to allow transfer of title
and possession at this time. Ayes, 8; Nayes, none.
