The City Council of the City of Hastings, Minnesota met in a regular
meeting on Monday, April 18, 1977 at 7:30 P.M. in the Council Chambers of the
City Hall.
Members present: Councilmen Shannon, Trautmann, Novak, Karnick,
Collins, and Mayor Petersen.
Ii
Members absent:
Councilmen Fischer, Erickson, Latch.
The Mayor asked if there were any corrections or additions to the
Minutes of the meeting of April 4, 1977 and hearing none, declared the Minutes
approved as read.
The Mayor opened the Public Hearing on the construc-
tion of the East Hastings Sanitary Sewer and Watermain Extension
at 7:35 P.M. The Administrator read into the record the official
Notice of Hearing and certificate of the mailing list. An open
discussion was held, the Mayor gave everyone in the audience an
opportunity to be heard. There being no further questions the
Mayor closed the Public Hearing at 7:50 P.M.
Moved by Councilman Karnick, seconded by Councilman
Novak to authorize the advertisemen~ 16rA~~s for the East
Hastings Project, bids to be opened on June 16, 1977 and con-
sidered for award on June 20, 1977. Ayes, 5; Nayes, None.

Moved by Councilman Novak, seconded by Councilman
Karnick to approve the appointment of Dale Johnson, 1901 Manor
Lane, to the Planning Commission. Term to expire Dec. 31, 1978.
Ayes, 5; Nayes, none.
Item #4, Zoning Amendment, was held over to the next
Council meeting of May 2, 1977 due to the lack of a quorum.

Moved by Councilman Novak, seconded by Councilman
Shannon to reject all bids. Further, the Natural Resources
Commission and the City Staff are to review the project and
present a recommendation to the Council and the next meeting
on May 2, 1977. Ayes, 5; Nayes, none.
Moved by Councilman Novak, seconded by Councilman
Shannon that the Purchase Agreement heretofore entered into
with Rosewood Corporation shall be amended by substituting
for the closing date called for by said contract, the closing
date of July 31, 1977 as requested by Rosewood Corporation in
its letter of April 5, 1977. The Mayor and City Clerk are
authorized to execute an addenda to the Purchase Agreement in
accordance with this motion. Ayes, 5; Nayes, none.
Moved by Councilman Novak, seconded by Councilman
Karnick that the City enter into a Contract with Municipal
Ordinance Codifiers, Inc. to update the City Code at a cost
not to exceed $3,000.00. Ayes, 5; Nayes, none.

RE: REFINING SYSTEMS, INC.
That the Mayor and City Clerk are authorized, on behalf
of the City of Hastings, to enter into a Contract for Deed with
Refining Systems, Inc. in accordance with this resolution hereby
adopted: The Contract for Deed shall be in the original prin-
cipal amount of the original Contract for Deed with Refining
Systems, Inc. It shall acknowledge payment of the amount that
has heretofore been paid on the Contract. It shall require a
$5,000.00 principal payment May 1, 1977. The then unpaid balance
shall, with interest at 8% per an num commencing May 1, 1977, be
paid as follows: $l,OOO.qo principal, plus accrued interest shall
be paid August 1, 1977 and on the first day of every third month
thereafter until May 1, 1980 at which time the entire balance
shall be due. Provided, further, that if construction i~ to be
undertaken prior to that time, the balance shall be paid for in
full prior to construction. Further, that the Contract for Deed
shall cover property south of Spiral Drive which the Council
previously agreed to sell to Refining Systems, Inc. instead of
the property to the North of Spiral Drive which is the subject of
the prior eontract for Deed.

Karnick to adopt the above Resolution regarding Refining Systems,
Inc. Ayes, 5; Nayes, none.
WHEREAS, pursuant to an advertisement for bids for fur-
nishing the City of Hastings with one (1) Squad Car for the Police
Department, the following bid was received complying with the
advertisement:

the pu chas of one (1) Police Squad Car, according to the specifi-
cations ther fore approved by the City Council and on file in the

to pass the Resolution Vacating a Permanent Utility Easement over
and across the East 10 ft. of Lot 6 and the West 10 ft. of Lot 7,
Block 5, Dakota Hills Fourth Addition. Ayes, 5; Nayes, none.

Karnick to approve the appointment of Wallace H. Erickson, City
Clerk/Treasurer, as the Acting Admdnistrator, until a new
Administrator is appointed, and shall be paidt}uJ,Administrator
salary. Ayes, 5; Nayes, none.
Moved by Councilman Trautmann, seconded by Councilman
Shannon to pass the Second Reading of the Amendment to Ordinance #55,
Regulating Licensing of Persons engaged in Tree Removal.and concern-
ing the $5,000 required bonding. Ayes, 5; Nayes, none.

The City Council instructed the Staff to review the
feasibility of advertising for bids for Dutch Elm Tree removal
as proposed by Dennis Pellant. Specifications are to be reviewed
and given to the Council for consideration at the May 2, 1977
Council meeting.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City
of Hastings, Minnesota:
The Mayor and City Clerk are hereby authroized and directed to
enter into a contract with Allied Painting & Renovating Company to repair
the City Hall Building according to the specifications therefore approved
by the City Council and on file in the office of the City Engineer.
The City Clerk is hereby directed and authorized to return forth-
with to all bidders the deposits made with their bids, after a contract has
been signed.
Adopted by the City Council of the City of Hastings, Minnesota this
18th day of April, 1977.
