HomeMy WebLinkAbout04-04-77 Hastings, Minnesota April 4, 1977 52 The City Council of the City of Hastings, Minnesota met in a regular meeting on Monday, April 4, 1977 at 7:30 P.M. in the Council Chambers of the City Hall. Members present: Councilmen Erickson, Karnick, Novak, Latch, Trautmann, Collins, S hannon, Fischer, and Mayor Petersen. ,i , I I I Members absent: None. The Mayor asked if there were any additions or corrections to be made to the Minutes of the meeting of March 21, 1977 and hearing none declared the Minutes approved as read. The Mayor asked if there were any additions or corrections to be made to the Minutes of the meeting of March 28, 1977 and hearing none declared the Minutes approved as read. Representative Harry "Tex" Sieben, Jr. addressed the Council in regard to the status of many of the legislative proposals and bills before the State Legislature at this time. APPROVE VARIANCE FOR E. GARY & M. FOX Moved by Councilman Erickson, seconded by Councilman Shannon to approve the request of E. Gary and M. Fox, 120 E. 6th Street for a variance to construct a garage l~ feet from the rear property line on the grounds that this garage would be in line with others along the alley and the five foot setback is not reasonable when applied to lots that are on a public alley. Moved by Councilman Novak, seconded by Councilman Fischer to approve the variance for Gary Endress, 509 W. 19th Street on the grounds that an administrative error was made and Mr. Endress should not be held responsible for the mistake. The Staff is also required to ask Mr. Endress to clarify the 5 foot setback and establish the necessary stakes to clearly delineate the setback of 5 feet as required. Ayes, 8; Nayes, none. Moved by Councilman Shannon, seconded by Councilman Trautmann to approve the Special Use Permit for Al Sieben, 612 W. 6th Street to construct a duplex in an R-2 District. Ayes, 8; Nayes, none. Moved by Councilman Latch, seconded by Councilman Shannon to table Item #5, the consideration of the purchase of the Haas property. Ayes, 8; Nayes, none. Moved by Councilman Novak, seconded by Councilman Trautmann to authorize the City Attorney to hire a local appraiser to give the City an appraisal of the Haas property. After the appraisal has been done the City Attorney is to bring it back for the Council's consideration. Ayes, 8; Nayes, none. Moved by Councilman Fischer, seconded by Councilman Erickson to authorize the use of the Four Diamonds area again this year for the Softball games. The city to pay the expenses involved in putting a Satellite facility at the Four Diamonds location for the players. Ayes, 8; Nayes, none. Dennis Pellant spoke briefly to the Council in regard to the Dutch Elm Program stating that the State Legislature has not finalized the bill which will provide funding to local govern- ments and as such the details of the local program will be delayed until the bill is passed. . APPROVE VARIANCE FOR GARY ENDRESS APPROVE SPECIAL USE PERMIT AL SIEBEN TABLE HAAS PROPERTY ISSUE HIRE APPRAISER FOR HAAS PROPERTY FOUR DIAMONDS USED FOR SOFTBALL GAMES REPORT ON DUTCH ELM PROGRAM CONSENT AGENDA ITEMS APPROVED 53 CONSENT AGENDA ITEMS b) Approve Cigarette License for M & HJ 1400 Vermillion St. c) Approve Certification of Correction of Plat - Dakota Hills 3rd Addition. d) Application for 3.2 Beer License - Pizza Hut, Westview Shopping Center. e) Approve the name change of the Liquor License of "Tobies" to "Ivanhoe's of Hastings, Inc. 314 Vermillion St., Hastings, Mn. f) Pay all bills as audited. AUTHORIZE BIDS FOR SQUAD CAR ESTABLISH EMPLOYEE ASSISTANCE PROGRAM j Moved by Councilman Shannon, seconded by Councilman Novak to authorize the advertisement for bids for a marked Squad Car. Bids to be opened at 11:00 A.M. on April 18th, and considered for award at the Council meeting of April 18, 1977. Ayes, 8; Nayes, none. ~! Moved by Councilman Latch, seconded by Councilman Trautmann to authorize the City to establish an Employee AssiStance Program, for the purpose of rendering assistance to those employees who may have problems with alcoholism, chemical dependency, financial problems, family problems or personal problems of a nature that may require counseling and referral services of a specialized agency. It is felt this type of service isimost appropriate for the City Council of Hastings to enter into for its employees. Furthermore, the City Administrator is to be authuuized to enter into the necessary contracts to assist any employee who may have a problem, with the Human Resources Association of Hastings. Ayes, 8; Nayes, none. RESOLUTION #1.2-77 Moved by Councilman Trautmann, seconded by Councilman REFINING SYSTEMS, INC. Novak to renew the contract the City presently has with Refining Systems, Inc. in the Industrial Park, with the understanding that RSI will pay immediately, andadditiona1 $5,000 toward the purchase of their property and that the interest rate of 8% be established, retroactive to September 1, 1976 on the unpaid balance. Be it further resolved that the remaining principal and interest be paid on a quarterly basis until the property [~J has been fully purchased or until such time RSI receives its full ~unding. If RSI receives its full funding it will payoff any remaining principal and interest immediately. Ayes, 8; Nayes, none. RESOLUTION #9,g-77 AWARD BID ON PUBLIC WORKS BUILDING RESOLUTION #9~-77 AWARD BID FOR CRUSHED GRAVEL TABLED 1977 IMPROVE- MENT PROJECT FROM AGENDA MARCH 21st. DENY UTILITY PERMIT AL SIEBEN Moved by Councilman Erickson, seconded by Councilman Latch to accept the low bid of George Olsen Construction Co. in the amount of $132,340 for the Public Works Building. The Staff is to proceed to negotiate with the office of EDA for possible inclusions in the program in view of the fact the money requested by the City in its initial grant request exceeds what the low bid was and therefore there is a possibility of adding some additional things into the building to improve the facilities. Be it further understood this award is being granted to George Olsen Construction Company with the understanding he will be on the site itself to begin construction no later than April 25, 1977. If he is not able to do so the Council will award the bid to the next lowest bidder. The Grant monies we have received for this building have a requirement that construction begin no later than April 25, 1977. Ayes, 8; Nayes, none. Resolution with bid tabulation on file. Moved by Councilman Fischer, seconded by Councilman Trautmann to award the contract for the producing and soockpi1ing of 12,000 yards of Class 5 modified gravel for the City to Davies Excavating Inc. in the amount of $13,200 Ayes, 8; Nayes, none. Moved by Councilman Latch, seconded by Councilman Shannon to deny the Utility Permit request of A1 Sieben for Lot 38 and South 14 feet of Lot 39, Block 3, Tripps Addition. Ayes, 8; Nayes, none. 54 The City Attorney requested the City Council to remove from the Tree Licensing and Regulating Ordinance, the bonding portion requiring the Applicant to file a $5,000 bond in addition to the Liability insurance required. The City Attorney felt that the Liability insurance coverage was sufficient and that no bonding is required. ORDINANCE #55 SEC. SER.
