Hastings, Minnesota
March 7, 1977
The City Council of the city of Hastings, Minnesota met in a
regular meeting on Monday, March 7, 1977 at 7:30 P.M. in the Council
Chambers of the City Hall.

Members present: Councilmen Erickson, Karnick, Novak, Latch,
Trautmann, Shannon, Fischer, and Mayor
Petersen.

Councilman Collins.
The Mayor asked if there were any additions or corrections to the
minutes of the meeting of February 22, 1977 and hearing none declared the
minutes approved as read.
Moved by Councilman Novak, seconded by Councilman
Karnick to pass the third and final reading of the Ordinance
regarding the Natural Resources Commission. Ayes, 5; Nayes,
Shannon, Fischer. Motion carried.
Moved by Councilman Karnick, seconded by Councilman
Erickson to pass the third and final reading of the Ordinance
regarding the Planning Commission. Ayes, 5; Nayes, Shannon,
Fischer. Motion carried.
Moved by Councilman Latch, seconded by Councilman
Erickson to appoint the following individuals to the Planning
Commission: Gilbert Gergen, 420 E. 6th St.; Milton Terrell,
517 Ramsey St.; Otto Murry, 615 W. 8th St.; Arthur Groth,
2600 Westview Drive,; and Gary Kramer, 1338 W. 15th St.

Fischer to approve the Mayor's appointment of Thomas Simmons,
Westview Drive, to the Hastings Housing & Redevelopment Authority.

Moved by Councilman Novak, seconded by Councilman
Latch to appoint Audrey Kuhn, 418 W. 12th St.; and George Irvin,
1913 Pine St. to the Hastings Charter Commission. Ayes, 7;

Moved by Councilman Novak, seconded by Councilman
Erickson to reappoint Joseph Kugler, Anthony Willeke, and Marjorie
Voelker to the Hastings Library Board.for three year terms.
Ayes, 7; Nayes, none.
Representatives from the State Highway Department of
Minnesota gave a presentation to the City Council regarding the
upgrading of Highway #61 which runs the entire north and south
length of the City. As a result of the discussion the Council
agreed to hold, on March 22nd, an informal meeting with the
business men along Hwy #61 to discuss the proposed upgrading of
that street. This meeting is to be held at 7:30 P.M. in the
Council Chambers. The Mayor requested the Press to run an
appropriate article to assist in getting the word out about the
meeting.
The Mayor presented placques of appreciation for service
to the City to the following individuals: Anthony Kramer, Donald
Hallberg, Erwin Schnirring, Henry Sfark, Marcella Linde, Richard
Walker, Theodore Shannon, Douglas Differt, Warner Wellman.

STATEMENT
Moved by Councilman Fdscher, seconded by Councilman
Shannon to call for a Public Hearing on March 21, 1977 at 7:30
P.M. in the Council Chambers regarding the amendment to the
Zoning Ordinance concerning County property being rezoned from
Agriculture to Public Institution. Be it further moved that
Section 10.01, Subd. I, Official Zoning Map be amended so the
Dakota County Government Center property on T.H. #55 is reBoned
from Agriculture to Public Institution. Ayes, 7; Nayes, none.
Moved by Councilman Latch, seconded by Councilman
Erickson to pass the second reading of the amendment to the
Zoning Ordinance, amending Section 10.17 Community-Regional
Commerce and Section 10.21 PI - Public Institution and to call
for a Public Hearing on Monday, Ma!~h 21, 1977 at 7:35 P.M. to

Novak to approve a Home Occupation permit for Dave Sulla, 1208
E. 3rd Street to repair small appliances. Ayes, 7; Nayes, none.
The City Planner gave an update on the ordinance in
regard to Park uses.
The City Planner gave an update in regard to the Met-
ropolitan Council System Statement and requested that if there
were any questions or inquiries that members of the Council had,
to please contact him.

Karnick to pass the second reading of the ordinance on Dutch
Elm Disease Control. Ayes, 7; Nayes, none.
The Council, after a brief discussion on the resolution
in regard to diseased trees decided not to take any action now
but that the item be forwarded to the agenda of the March 21st
meeting.

Fischer to approve the Resolution in support of cont1nuad use of
the Hastings State Hospital. Ayes, 7; Nayes, none.
Moved by Councilman Erickson, seconded by Councilman
Karnick to approve the following items on the Consent Agenda:

a) authorize payment of $25.00 monthly to Daryl Plath
as Civil Defense Director.
b) authorize advertisement of bids for 12,000 yds of
gravel for the Street Dept. Open bids on 3-31-77
@ 10:00 A.M. and consider for award on 4-4-77 @
7:30 P.M.
c) accept the resignation of Douglas Differt from the
Charter Commission.
d) approve the appointment of Mary Richmond, 415 w.
18th St. as a part-time secretary for the Fire
Dept., at a salary of $3.00 per hour.
e) Dorothy Johns.on, part-time secretary for the Police
Dept. finished the probation period, authorize a
salary increase from $2.95 to $3.25 per hour.
f) authorize payment of all bills as presented.
g) accept resignation of James Peterson from the
Planning Commission.

Councilman Erickson introduced the following resolution RESOLUTION #85-77

BID FOR PICKUP TRUCK
WHEREAS, pursuant to an advertisement for bids for furnishing
the City with one (1) 1~ Ton Pickup Truck for the Street Department, the
following bid was received complying with the advertisement:

WHEREAS, one bid (1) was received from Joe O'Brien Chevrolet-
Cadillac, Inc. and no other Bidders appeared, or submitted bids;
NOW THEREFORE BE IT RESOLVED by the City Council of the City
of Hastings, Minnesota:
The Mayor and City Clerk are hereby authorized and directed to
enter into a contract with Joe O'Brien Chevrolet-Cadillac, Inc. for the
purchase of one (1) 1~ Ton Pickup Truck for the Street Department, according
to th ecifications therefore approved by the City Council and on file in
the of ce f the City Clerk.

Councilman Shannon seconded the motion to adopt said resolution
~ and the same was passed by the following vote: Ayes, 7; Nayes, none.
Moved by Councilman Latch, seconded by Councilman
Trautmann to authorize the City Water and Sewer Departmeatto
bill tb the individual homeowners, who have freezeups in the
winter time, the actual water and sewer used in the freezeup
period. After the City assists in thawing the frozen water
line, water must continue to run through the pipe for an ex-
tended period of time to prevent further freezing. The charge
will be based on the rate of the actual water used after the
freezeup occurs. The higher sewer rate that is caused by the
freezeup will not be used to calculate the sewer rate for the
remainder of the year. Ayes, 7; Nayes, none.
The City Attorney again reviewed his proposal on a
procedure for ordinance review. He gave the Council an update
in regard to the matter.
Moved by Councilman Novak, seconded by Councilman
Trautmann to authorize the City Attorney to enter into the
necessary negotiations to change the descriptions on the
documents to correct the "Dike description" in regard to the
property the City owns along the Vermillion River, a portion
of which abuts to the County property and the Franzmeier
property. Ayes, 7; Nayes, none.
Moved by Councilman Fischer, seconded by Councilman
Shannon to authorize the City Staff to send out a letter to
all individuals in the benefited area of the proposed Vermillion
River Flood Control Project. Be it further moved that the assess-
ment information be sent out in geneaa1 terms which fairly well
reflects the figures which are before the Council tonight on the
general assessment breakout. Ayes, 7; Nayes, none.

BID AWARD TO 3-21-77
Moved by Councilman Latch, seconded by Councilman
Shannon to have the Council accept the receipt of all bids
that were presented to the City in regard to the S.W. Water-
main Interconnection Project. The Council will withhold the
award of bids, retain the bids and bid bonds of the lowest
three bidders and will consider the matter further at the
meeting of March 21, 1977. Ayes, 7; Na"s, none.

OLD MILL PARK PLAN
Moved by Councilman Erickson, seconded by Councilman
Trautmann to authorize the advertisement of bids for the Old
Mill Park Plan which the Council had previously accepted. Bids
to be opened on April 12, 1977 at 2 p.m. and forwarded to the
City Council for consideration at the meeting of April 18, 1977
at 7:30 p.m. Ayes, 7; Nayes, none.

IMPROVEMENTS
Moved by Councilman Fischer, seconded by Councilman
Erickson to adopt the resolution in support of the concept of
Senate File 103, proposed by Senator Robert M. Benedict that
would put a moratorium on the taxing of home improvements.
