The City Council of the City of Hastings, Minnesota met in a
regular meeting on Tuesday, February 22, 1977 at 7:30 P.M. in the Council
Chambers of the City Hall.
Members present: Councilmen Erickson, Karnick, Novak, Latch,
Trautmann, Collins, Fischer, Shannon, and
Mayor Petersen.

None.
The Mayor asked if there were any additions or corrections to the
minutes of the Special meeting of the Council held on January 31, 1977,
hearing none, declared the minutes approved as read.
The ~1ayor asked if there were any additions or corrections to the
minutes of the regular meeging of February 7, 1977. Councilman Shannon
stated that the vote on the telephone resolution should reflect that he voted
in the negative on that motion. The Mayor asked if there were any other
additions or corrections and hearing none, declared the minutes approved as
amended.
Moved by Councilman Trautmann, seconded by Councilman
Shannon to approve the Special Use permit and variance for Lloyd
Gath for the duplex at 414 Spring St. Ayes, 4; Nayes, Erickson,
Latch, Novak, Collins. Motion failed.
Moved by Councilman Latch, seconded by Councilman
Shannon to adopt Resolution ~Vacation of Basement for Ingress-
Egress" for the Tannebaum Estates Addition. Ayes, 8; Nayes, none.

Shannon to approve the final Plat of the Tannebaum Estates
Addition subject to their paying the necessary park fee and
utility fees. Ayes, 8; Nayes, none.
Moved by Councilman Fischer, seconded by Councilman
Shannon to approve the expenditure of $10,500 of Federal Revenue
Sharing Funds to support the Youth Action Council of the City
of Hastings, for the fiscal year 1977. Ayes, 8; Nayes, none.
Moved by Councilman Erickson, seconded by Councilman
Karnick to approve the following consent agenda items:
a) the building plan proposal for the Rosewood Corp.
allowing the brick facing as requested.
b) Home Occupation permit for Robert Thorpe, 1334
w. 18th St.
c) adopt the resolution requesting DNR license for the
Vermillion River S.W. Watermain cross ing.
d) all bills as presented.
Vote: Ayes, 8; Nayes, none.
Mr. Clarence Smith of Amenity I gave a presentation of
the Old Mill Park Plan.
Moved by Councilman Fischer, seoonded by Councilman
Shannon to approve the Plan aadpspsd,fidations as presented by
Amenity I. Ayes, 8; Nayes, none.
Moved by Councilman Erickson, seconded by Councilman
Latch that Tom Novak, acting Mayor, be instructed to meet with
the Hudson Co. management personnel and with the representatives
of the employee union, which currently is on strike, to encourage
both sides to try and resolve their differences. Ayes, 8;
Nayes, none.

Karnick to remove from the table the ordinance . concerning
the organization and make up of the Natural Resources Comm.

Collins to amend the ordinance concerning the Natural Resources
organization and makeup that was originally proposed by the
Mayor. The Council to consider the ordinance amendment which
is before them.

Collins to call for the question and to limit debate on the
issue of the Committee structure. Ayes, 6; Nayes, Trautmann,
Fischer. Motion passed.

In view of the previous motion passing, the Mayor
called for the vote on the amended ordinance concerning the
Natural Resources Commission from that which was originally
proposed by the Mayor. Aye~, 5; Nayes, Trautmann, Shannon,
Fischer. Motion carried.
Moved by Councilman Erickson, seconded by Councilman
Karnick to approve the second reading of the amended Natural
Resource Commission ordinance.
Moved by Councilman Novak, seconded by Councilman
Karnick to limit calling for the question and limit debate
on the Natural Resources ordinance second read6ng. Ayes, 8;
Nayes, none.
The Mayor, in view of the vote for the question,
called for the roll call on the now second reading of the
amended Natural Resources Commission Ordinance. Ayes, 5;
Nayes, Trautmann, Fischer, Shannon. Motion carried.
Moved by Councilman Karnick, seconded by Councilman
Novak to amend the proposed ordinance regarding the make-up
and composition of the Planning Commission f~om what was the
original motion as proposed by the Mayor. Ayes, 5; Nayes,
Trautmann, Shannon, Fischer. Motion carried.

Karnick to approve the second reading of the Planning Commission
Ordinance as amended. Ayes, 5; Nayes, Trautmann, Shannon,
Fischer. Motion carried.
Moved by Councilman Trautmann, seconded by Councilman
Shannon to deny the variance request of Johnson Standard station
on Hwy 61 and 15th Street, in accordance with the Planning
Commission recommendation. Ayes, 7; Abstained, Erickson.
Moved by Councilman Trautmann, seconded by Council-
man Latch to a-prove the first reading of the amendment to the
zoning ordinance which would allow public offices in a Public
Institution District. Ayes, 8; Na yes, none.
Moved by Councilman Latch, seconded by Councilman
Karnick to approve the first reading of the rezoning of the
County Government Center from Agriculture to Public
Institutions District. Ayes, 8; Nayes, none.

A brief discussion was held in regard to appointments
to the Planning Commission. No action was taken by the Council.
Moved by Councilman Trautmann, seconded by Council-
man Fischer to pass the first reading of the Ordinance on Dutch
Elm Disease control and regulation within the City of Hastings.
Subdivision 3A be amended to read as follows: or to obey any
reasonable direction given by the Street Superintendent.

Moved by Councilman Novak, seconded by Councilman
Fischer to accept the City of Hastings' Financial Report for
the fiscal year 1976. Necessary copies be forwarded to State
Agencies in accordance with the law. Ayes, 8; Nayes, none.
Moved by Councilman Latch, seconded by Councilman
Karnick to call for a public hearing regarding the
rezoning of the County Courthouse property for March 7, 1977
at 7:30 P.M. in the Council Chambers of the City Hall. Ayes, 8;
Nayes, none.

A brief discussion was held on the item of the
resolution regarding the State Hospital. No action was taken.
The Council requested it be put on the Agenda of the March 7th
Council meeting for consideration.
The Mayor asked fhe City Engineer & Chief of Police
to review the Minnesota Department of Transportation corres-
pondence in regard to a Transportation Agency for the City and
to report back to the Council on a proposal as soon as possible.
The City Administrator read the letter of resignation
from Mr. Tom Simmons as an employee of the City. Moved by
Councilman Shannon, seconded by Councilman Fischer to accept
the resignation of Mr. Simmons, effective Ma rch 8, 1977.

The next item for consideration was the matter of the REVISE CONTRACT
contract with the United States of America, Army Corps of Engineera:ORPS OF ENGINEERS
for the Vermillion River Project. It was reported that the City VERMILLION RIVER
had some time ago entered into an agreement between the United PROJECT
States of America and the City of Hastings, Minnesota for local
cooperation at Vermillion River, Hastings, Minnesota setting
forth the terms and conditions of the flood control project. It
was further reported that subsequent bo the execution of that
contract, that the federal law had been changed to provide that
the Corps of Engineers would be responsible for the first
$2,000,000.00 cost of the project instead of the first
$1,000,000.00 cost of the project, as originally was the law
when the contract was signed. The terms of the contract were
reviewed. Moved by Councilman Trautmann, seconded by Councilman
Fischer as follows:
That the C~~y\through the Mayor and Clerk be and they
hereby are authorized to enter into the revised contract with the
Corps of Engineers which revised contract bears date February 22,
1977 and sets forth the terms of the agreement between the City
and the United States of America regarding the Vermillion River
project, a copy of which is on file in the City Administrator's
office. Upon being put to a vote, the motion was unanimously
adopted.

Moved by Councilman Shannon, seconded by Councilman
Novak to authorize the city staff, that if upon their review
of the problem, feel that it would be appropriate to put up for
bids the building structure on the Kaiser property, in order to
have them removed. Be it further authorized that any necessary
papers for sale or bid be allowed to be made. Ayes, 8; Nayes, none.
The City Attorney regpeted on a letter from Mrs.
Kitzman concerning her inquiry as to whetheer or not the City is
interested in purchasing her property. After a general dis-
cussion the Council expressed no interest in thee purBhase of
the property at this time.

Moved by Councilman Novak, seconded by Councilman
Erickson to authorize the City Engineer to draw up the final
plans and specifications, including alternate bids, concern-
ing the type of Downtown street lights which were presented
to the Council this evening. Ayes, 8; Nayes, none.
ADVERTISE FOR BIDS FOR
PUBLIC WORKS BUILDING
Moved by Councilman Erickson, seconded by Councilman
Shannon to authorize the City Engineer to put up for bids the
Public Works building addition which is to be done at the City
garage site. The bids to be opened at 2:00 p.m. on March 31,
1977 and considered for award at the April 4, 1977 Council
meeting at 7:30 p.m. Ayes, 8; Nayes, none.

with respect to the improvements described in the Noti ce of Hearing hereinafter
set forth, and
WHEREAS, said Engineer has advised this Council that the aforesaid
improvements are feasible and should be made as proposed in the Notice of
Hearing thereon, and
WHEREAS, the Council considers it expedient to make the following
listed improvements,

The City Council proposes to assess all or part of the cost for such improve-
ments against every lot, piece or parcel of land within the Corporate Limits that
abuts upon or is benefitted by said improveme nts according to the special benefits
received without regard to cash valuation.
The estimated cost of said improvements is $523,000

Persons desiring to be heard in reference to the proposed improvements may
be heard at said time and place.
The City Clerk is hereby authorized and directed to cause said notice to be
given two publications in the official newspaper and to give mailed notice to
every property owner whose property is benefitted by said improvements. Such
publications shall be one week apart and at least three days shall elapse between
the last publication and the date of hearing. Mailed notice shall be given not
less an n days before the hearing, pursuant to provisions of Section 429.031
