The City Council of the City of Hastings, Minnesota met in a
regular meeting on Monday, January 3, 1977 at 8:00 o'clock P.M. in the
Council Chambers of the City Hall.
Members present: Councilmen Novak, Erickson, Fischer, Kramer,
Schnirring, and Mayor Petersen.

Members absent:
Councilmen Trautmann, Latch, and Hallberg.
The Mayor asked if there were any corrections or additions to the
Minutes of December 20, 1976. The Mayor commented that he thought a
correction needed to be made on the motion regarding Tom Simmons salary. An
additional statement to be added to read: these funds are to be taken from
Revenue Sharing monies. The Minutes were approved as amended.
Moved by Councilman Erickson, seconded by Councilman
Novak to approve the cancellation of the On-Sale, Off-Sale, and
Sunday Liquor Licenses for Wm. House, dba, "Bill's House"
117 E. 2nd Street, Hastings, Mn. Ayes,S; Nayes, none.
Councilman Latch arrived in the Council Chambers at
8:06 P.M.
Moved by Councilman Erickson, seconded by Councilman
Novak to approve the application for On-Sale, Off-Sale, and
Sunday Liquor Licenses for Richard A. Hoffman, 353 Rose Lane,
St. Paul, Mn. dba: "Downtowner" at 117 E. 2nd St. Hastings, Mn.
Ayes, 6; Nayes, none.

Moved by Councilman Novak, seconded by Councilman
Kramer to approve the concrete block building as proposed by
the Rosewood Corporation, and recommended by the Planning
Commission. Ayes, 6; Nayes, none.
Moved by Councilman Kramer, seconded by Councilman
Latch to approve the reappointment of James Peterson to the
Planning Commission. Ayes, 4; Nayes, Erickson, Novak. Motion
carried, appointment approved.
Moved by Councilman Kramer, seconded by Councilman
Fischer to move the First Reading of the Mobile Home Ordinance
as proposed by the Planning Commission. Ayes, 3; Nayes, 3;
Being a tie vote the Mayor voted nay. Motion defeated.
Moved by Councilman Erickson, seconded by Councilman
Latch to approve the advertisement for a Dogcatcher for the City
of Hastings, but to include in the ad that the individual have
his own vehicle with which to perform the service of dogcatcher.
Ayes, Erickson and Latch. Nayes, Fischer, Schnirring, Kramer,
and Novak. Motion failed.
Moved by Councilman Schnirring, seconded by Council-
man Erickson to approve the advertisement for a City Dogcatcher
using the ad as it appeared in the report submitted to the City
Council and to state that the City will provide the behic1e.
Ayes, 5; Nayes, Kramer.
Moved by Councilman Fischer, seconded by Councilman
Schnirring to approve the Police department use of the 500
gallon gasoline tank which currently belongs to the Parks Dept.
The tank to be converted to un-leaded gasoline use for the Police
Dept. Ayes,S; Nayes, Erickson.
Moved by Councilman Fischer, seconded by Councilman
Schnirring to pass the secondc;:reading of Ordinance $50, the
Industrial User Strength Charge. Ayes, 6; Nayes, none.

The City Attorney reviewed the Prano property issue
with the City Council. He suggested that additional time would
be needed to examine the law due to a change in the law that
has taken place and asked the Council to hold the item over
to the January 17, 1977 meeting. The Mayor and Council
concurred with the City Attorney's recommendation.

The Council discussed the proposed Southwest Ponding
Basin Fencing issue and decided to. hold the item over to the
next Council meeting and asked that the City Attorney review
current court cases involving similar situations and report
back to the Council.
